The following will be a voluntary sworn statement reference to a homicide/ murder that occurred on or about July 27, 1981, occurring at 300 Hollywood Mall, in the afternoon hours, sometime between 12:00 and 1:00 P.M. This statement is being obtained from a witness MAYER, ARLENE ANN, W/F, DOB: 5/30/35, who resides at 5719 Garfield Street, Hollywood, Florida, telephone number - 961-1836. This statement is being taken by Detective J. Hoffman 10038 and Detective R. Hickman #0434. This statement is commencing on Monday, October 24, 1983, at approximately 1755 hours.

crime under the Florida State Statute to knowingly furnish false information
while under oath?

Q: Okay. mas. MAYER, at this time I'd like to recall, refresh your memory
back to July, 1981, okay and can you please relate to me of an incident
that occurred to you and your daughter at the K-Mart Store located on South
State Road 7 in the City of Hollywood.
A: Uum yes. Uum. I don't know . . . Alright. My husband dropped us off
at the store, my daughter and I got out of the car in the Hollywood Fashion
Center Parking lot.
Q: What time of day would that have been?
A: I'd say anywhere between six thirty, seven.
Q: Okay. Can you relate to what day it was possibly?
A: It was on a Friday or Saturday night, mostly likely I'd say a Saturday
night.
Q: And why do you say that, how do you know that?
A: Because that's the only time I go to K-Mart.
Q: Okay.
A: I won't go by myself.
Q: Okay so your husband drops you off, you and your daughter, and it's -
tell me what happened then, from then on.
A: Alright we got out of the car and we were walkin and this man came from
behind us and walked ahead of us and kept on looking back at us.

A: Uh yea he was, I'd say slightly tall around five foot ten, a thin build,
not a real thin, a thin build, sandy brown hair and it wasn't really, his
hair wasn't thick.

A: Yea it was thin.

A: Especially thorugh the side there.

A: A white.
Q: Approximately how old?
A: I'd say he has to be up in say up in his forties.

A: I can't really place.

got a basket and we started on down, walkin down the middle of the store
and then we went down the middle of the isles and I went over on to a next
isle and this man followed us and he talked to my daughter and she said,
she started screaming for me.
Q: Okay when he talked to your daughter, where were you?
A: I was over on another isle.
Q: You were away from your daughter, she was by herself.
A: Right, right.
Q: Okay. How old was your daughter at the time?
A: She was twelve at the time.
0: Okay.
A: And so then I ran when she started screamin I ran and I went to her and
she was comm n runnin to me pushin the basket and she said this man wanted
to take her for a ride in the basket.
Q: Okay. What - can you describe this subject's clothing? Do you recall
what he was wearing?
A: No I can't really.
Q: Alright. So she came crying or you came back to her when she was upset.
A: Yea well we both met yea and then we walked to the back of the store and
this man still followed us and watched us and then we went over by the lady
apparel where they have the lay away desk and we stood there and then finally
he left.
Q: Did you notice anything unusual about the man, any scars, tatoos, the way

confessing to the abduction of ADAM WALSH? Did you see it in the news-
paper or on TV?
A: No.
Q: Just recently, this past . . .
A: Oh yea.
Q: Okay what day was that did you read something about . . .
A: This Saturday.
Q: This past Saturday.
A: Right.
Q: And where did you see this article?
A: In the Sun Tattler and I called the police department.
Q: Okay and you saw a photograph of an individual in the newspaper.
A: Right and that's when I called the police department.
Q: When you saw this photograph, okay, what did this photograph of this
individual mean to you?
A: Well the only thing that I said was that this man looks familiar but it
didn't dawn on me until I went into the, later in the house when my daughter
was lookin at the paper and she said there's that man.

A: And then I called the Hollywood Police.
Q: Okay now after she indicated that that was the man referring to the
incident in K-Mart, okay and you looked at the photograph, okay, in the
newspaper, are you positive beyond a reasonable doubt that that's the same
man.
A: Yes I am.
Q: That attempted to give your daughter a ride in the K-Mart Store.
A: Right.
Q: Now just prior to taking your statement, I had you view six photographs
of white males with similar characteristics. Okay after you viewed this
photograph, photographic line up, were you able to identify one of the
photographs in this line up?
A: Yes.
Q: Okay and after identifying that photograph, did you sign your name on
the back of the photograph?
A: Yes I did.
Q: Okay for the record, let it reflect th.TMRS. MAYER did identify the
photograph of OTIS TOOLE, that being the same individual that was in K-Mart
a couple days prior to ADAM WALSH'S abduction is that correct.
A: Yea.
Q: And you are positive of that.
A: Oh yea.
