    RESOLUTION 2013.3TRANS PORTATION I M PROVEM ENT PROG RAM FFY 201 4.201 8

    WHEREAS, the Greater Buffalo-Niagara Regional Transportation Council (GBNRTC) has been designatedby the Governor as the Metropolitan Planning Organization (MPO) for the Greater Buffalo-Niagara region;and

    WHEREAS, Title 23, United States Code, Section 134; and Title 49, United States Code, Section 5303,require each MPO to develop and approve a Transportation lmprovement Program (TlP); andWHEREAS, GBNRTC in cooperation with the New York State Department of Transportation, has reviewedand documented compliance of the GBNRTC planning process with all existing federal rules andregulations, including Moving Ahead for Progress in the 21't Century (MAP-21) requirements; andWHEREAS, GBNRTC, in accordance with all federal requirements for a TIP has developed a staged five-year integrated program of federally funded highway, transit and other transportation projects for theGreater Buffalo-Niagara region, that:

    * includes a priority listing of projects and project segments to be carried out within the time frame of theTIP,

    * is financially constrained with realistic estimates of total project cost and revenues expected for theprogram periods,

    * includes projects which are consistent with the 2035 Long Range Transportation Plan Update,* includes projects identified based on the priority merit and certainty of financing developed through a

    program development process,

    * includes consideration of elderly and disabled transportation services and the mandates of theAmericans with Disabilities Act of 1990,

    WHEREAS, extended consultation efforts have been made with appropriate State and local agencies toincrease involvement in the planning process and development of the TIP; and

    WHEREAS, the United States Environmental Protection Agency (USEPA) promulgated the 2008 B-HourOzone National Ambient Air Quality Standards (NAAOS) on May 21, 2012 to be effective on July 20, 2012classifying the Buffalo-Niagara Falls metropolitan statistical area as in attainment for the 2008 ozonestandard;

    WHEREAS, the USEPA promulgated a new rule on July 20,2012 revoking the Transportation Conformityrequirements for 1997 8-Hour Ozone NAAQS effective on July 20,2013; and

    WHEREAS, as a result, the GBNRTC will not be required to make a transportation conformity determinationunder the new 2008 8-Hour Ozone NAAQS.

    THEREFORE BE lT RESOLVED, the GBNRTC endorses the five-year Transportation lmprovementProgram for the Federal Flscal Years 2014-2018 and recommends the initiation of those projects and plansso specified; and

    BE lT FURTHER RESOLVED, the GBNRTC certifies compliance of the planning process with all applicablefederal rules and regulations, including MAP-21 requirements; and

    BE lT FURTHER RESOLVED, that GBNRTC endorses the 2014-2018 TIP as consistent with all currentplans and programs the GBNRTC program development process, and the GBNRTC congestionmanagement process; and

    BE lT FURTHER RESOLVED, the TIP development process, including public involvement activities andtimeline established for public comment, were explicitly used to satisfy the program-of-projects requirementsof the Federal Transit Administration Urbanized Area Formula Program Section 5307(c); andBE lT FURTHER RESOLVED, Council members agree as a condition of all TIP amendment approvals, theTIP continue to be fiscally constrained in accordance with federal regulations; and

    BE lT FURTHER RESOLVED, that should any additional financial resources provide for expanding the2014-2018 TIP beyond currently approved funding targets, all programming proposals shall berecommended by the GBNRTC-PCC for Policy Committee action; and

    BE lT FURTHER RESOLVED, that projects approved in the previous TIP (FFY 2011-2015) are automatic-ally incorporated into lhe2014-2018 Annual Element if they are not obligated by September 30,2013, aslong as fiscal constraint is demonstrated; and

    BE lT FURTHER RESOLVED, that the Committee authorizes the Secretary of the Council to fonrvard theapproved program to the New York State Department of Transportation, requesting that it take all necessaryaction to include the program in the Statewide Transportation lmprovement Program and obtain federalapproval.

    This resolution shall take effect on the 21st day of July 2013.

    OVERVIEW GBNRTC ORGANIZATION

    TheGreaterBuffaloNiagaraRegionalTransportationCouncil(GBNRTC)isthetransportationpolicyandplanningorganizationfortheErieandNiagaraCountiesregionofWesternNewYork.Designatedasa Metropolitan Planning Organization (MPO) by the Governor of New York, the GBNRTC sharesresponsibility with the New York State Department of Transportation (NYSDOT) for cooperativelydeveloping transportation plans and programs that ensure an integrated multimodal transportationsystemservesandsupportsmetropolitancommunitydevelopmentandthesocialgoalsoftheGreaterBuffaloNiagararegion.TheGBNRTCcurrentlyconsistsofthefollowingsevenmembers:CityofBuffalo,CityofNiagaraFalls,CountyofErie,CountyofNiagara,NYSThruwayAuthority, theNiagaraFrontierTransportationAuthorityandNYSDOT.TheSenecaNationofIndians,theTransportationCounciloftheBuffaloNiagaraPartnershipandtheEmpireStateDevelopmentCorporationformallyserveasRegionalStrategicStakeholders.

    TRANSPORTATION IMPROVEMENT PROGRAM (TIP)

    AsanMPO,theGBNRTCisresponsibleforthedevelopmentandmaintenanceofbothaLongRangeMetropolitanTransportationPlan(LRP)andashorttermTransportationImprovementProgram(TIP).The LRP looks 20 plus years into the future to predict the transportation needs of the region usingforecast trends and anticipated conditions. The TIP is the complementary capitalprogramming

    component of the LongRangeMetropolitan Transportation Plan consisting of all federally fundedroadways,transitandmajortransportationprojectsbeingconsideredwithintheregionoverthenextfive(5)years.TheTIPalsoincludesthoseregionallysignificanttransportationprojectsbeingadvancedby state and localentitieswithnonfederal funding. Inclusion in theTIP is aprerequisite to federalfunding approval for projects programmed from funding sources directly under the GBNRTCresponsibility.

    The20142018TIP representsa regional consensusonwhichpriority transportationprojectsareessentialtotheBuffaloNiagararegionduringthistimeperiod.Projectsincludedintheprogrammovetheregiontowards implementingtheLongRangeMetropolitanTransportationPlan,meetshortrangeneeds,andprovideforthemaintenanceoftheexistingtransportationsystem.Thisdocument includesinformation on the TIP development and project selection processes including how projectsmake itontotheTIP,opportunitiesmadeavailableforpublicreviewandcomment,highlightsofmajorprojectsandacompletefirstyearlistingofprojectsknownastheannualelement.Thestatusofprojectsfromtheprevious20112015TIP,acompletelistingofallprojectsincludedinthe20142018TIPandallotherfederallyrequiredelementsareincludedinthisdocument. GBNRTC TRANSPORTATION PROJECTS SUBCOMMITTEE (TPS)

    TheGBNRTCTransportationProjectsSubcommitteeisspecificallychargedwithaddressinganyandall issuespertaining to thedevelopment,maintenanceandmonitoringof the regionsTransportationImprovementProgram(TIP).SubcommitteemembersincludeplanningandtransportationofficialsfromeachoftheGBNRTCsmemberagencies.

    Thesubcommitteehasamongitstasks:

    Reviewdescriptivedatareportsontheregionstransportationinfrastructure Designandimplementprojectselectionprocedures Prioritizeandscheduleregionalprojects PrepareandrecommendafiscallyconstrainedmultiyearTIP Assessandincorporatepublicfeedback Regularlyreviewprojectstatusandassesscostchanges Recommend amendments to the TIP as necessary tomaintain project viability and fiscal

    constraintsThe Transportation Projects Subcommitteewas primarily responsible for the development of this

    20142018TIP.PUBLIC INVOLVEMENT OPPORTUNITIES

    The GBNRTC officially adopted an updated PublicParticipationPlanonDecember12,2011specifyingactionstobe followed for certain GBNRTC activities. The policyspecifically outlines the opportunities and process to befollowed for development of the TIP. The communityparticipation program seeks to provide continuing

    opportunities for individuals and community groups to participate in the planning process.Opportunitiesareprovidedforpublic inputatallstagesofplanningandprojectdevelopmentprocess.Theeffortsundertaken in thedevelopmentof theTIPare consistentwith theGBNRTCofficialPublicParticipationPlan.

    Forthisyears20142018TIPdevelopmentcycle,thepublicinvolvementandreviewperiodofficiallybeganApril3,2013andextended inexcessofthestandardtwenty(20)calendardaysrequiredbytheGBNRTCPublicParticipationPlan, throughApril30,2013.Anofficialpublicnoticewasplaced in theBuffaloNewsfollowedbyanemailblasttohundredsofpeopleontheGBNRTCemaillist.ThedraftTIPwasmadeavailableviatheinternet,atourpublicmeetingsandintheGBNRTCoffices.Besidesthetwo(2) formalpublicmeetings, thisyearsoutreachalsoemployedavarietyof socialmedia forums inanattempttoinitiateadialogwiththecommunity.OutreacheffortsarefullydocumentedintheAppendixaswellasthepubliccommentsreceivedandanswered.

    2035 LONG-RANGE METROPOLITAN TRANSPORTATION PLAN UPDATE: Establishing the TIP Framework

    The 2035 LongRange [Metropolitan] Transportation Plan Update (LRP) is a 20year multimodalblueprint for transportation systems and services aimed at meeting existing and anticipatedtransportationdemandsinthetwocounties.Itservestoguidetransportationinvestmentandfundingdecisions,projectselectioncriteria,andcorridorlevelplanningintheregion.Ithasbeendevelopedinpartnershipwithbothpublicandprivateagencies,communitygroups, interestedresidents,andotherstakeholders.

    TheLRP includesasetofgoalsandobjectives thatestablish the framework forTIPdevelopment,alongwithasetofperformancemeasurestogaugeregionalprogress.Thesetooresultedfromextensivepublic outreach process including a series ofworkshops, a public opinion survey, and input from acitizens advisory group and GBNRTC member agencies. The goals and objectives of the LRP andcorrespondingperformancemeasuresarelistedbelow.Preservation of Existing Transportation Infrastructure Maintain the transportation system for allmodesinreliablecondition;consistentwithfunctionalhierarchyandminimizinglifecyclecosts.

    PROGRAM DEVELOPMENT / PROJECT SELECTION PROCESS

    The Greater BuffaloNiagara Regional Transportation Council shares responsibility with the New York StateDepartment of Transportation for cooperatively developing transportation plans and programs that ensure anintegratedmultimodaltransportationsystemservesandsupportsmetropolitancommunitydevelopmentandthesocialgoalsoftheGreaterBuffaloNiagararegion. The intentofaTransportation ImprovementProgram(TIP) in itssimplestterms is tocarryout the regions transportationvisionasexplained in theprevioussection,within theconstraintsofavailablefunding.

    GBNRTChashadas itsgoaltheselectionofprojectsthataddresstheneedsoftheregionasdefined intheLRPaswellastakeadvantageoftheresultsofstudiesthathavebeencompletedthroughtheUnifiedPlanningWorkProgram.In order to do thisGBNRTC typically undergoes a defined Strategy Scripting process. The elements of this strategyscriptinginclude:

    Considerationofshorttermplanswithaviewas towhatmayyieldapotentialprojectwhilestill focusingonassetmanagement;

    Needsidentificationinvolvingareviewofdatasources,visualizationtechniques,andpriorityrankings; Needs assessment focusing on public review, program scenarios and prioritization, as well as air quality

    conformityandperformanceanalysis; RecommendingprojectsfortheTIP;and PolicyCommitteeapproval.A variety of issues coalesced to make development of this 20142018 TIP anything but typical. The standard

    Strategy Scripting process was overwhelmed by drastic funding reductions and new program directives whichnecessitatedafreshlookatboththecurrent20112015programandtheabilitytoevenconsidernewprojectadditions.

    MAP21andNYSDOTGuidingPrinciplesMovingAheadforProgressinthe21stCenturyAct(MAP21)wassignedintolawonJuly6,2012andisthefederal

    authorization for federal highway and transit programs.     BothMAP21 andNYSDOTsComprehensiveProgramUpdate (CPU) focusedon systempreservation and safety.TheCPU preservation first strategy focusedonpreventive,correctiveanddemandworkutilizingassetmanagementprinciplesanddatadrivendecisionmaking;andhighestprioritywasgiventopreservethefunctionalityoftheexistinghighway system. Inherent in this approach is a short term decline in conditions as resources are concentrated onstabilizingthebacklogofpreservationcandidates.Oncetheseassetsareinthelowercostpreservationcycle,thefutureyearsavingsareappliedtoothercandidatestobringthemintoastateofgoodrepair.

    Projects consistingof reconstruction,major rehabilitation,orminor rehabilitationswerehenceforth classified asBeyondPreservation (BP). As funding for thiscategoryofBPprojectswasgreatly reduced,memberagencieswereaskedtoreviewandconfirmthecompiled listofdesignatedPreservationandBeyondPreservationprojects. NewBPformswerethencreatedforallBPprojectsonthis listingandtransmittedto localagenciesforcompletion. BPformsrequiredaBPNarrativeSheetandaBPStructures(bridge)orBPPavement(roadway)form.FinalizedformsweresubmittedforanindependentreviewbyNYSDOTMainOfficestaffinearlyJanuary2013.BPprojectsthatdidnotgothisprocessand/orarenotapprovedbyNYSDOTwerenoteligibleforstateMarchisellimatchingfunds.

    Thisprocess constitutedabottomsupevaluationofcurrentlyprogrammedprojectsand lead to some rescopingthatmovedthemfromtheBPtopreservationlist.Inadditionsomeprojectdeletionsoccurredinordertostretchscarcedollars,improvereturnoninvestmentsandconformtonewprograminitiatives.

    AfewcandidateprojectsweresubmittedusingthestandardInitialProjectProposal(IPP)formsandallunderwenttheintenseBP/Preservationscrutinygiventoexistingprojects.GBNRTCroadscoredatawasalsoanalyzedtoscreenfornewpreservationprojects. Roadsegmentsthathadrecordedascoreof 6formorethan10consecutiveyearswereidentifiedasprobablepreservationprojects. Itwasacknowledgedthatonceafacilityscored 5or less itfell intothebeyond preservation category. Some of the preservation segments identified but unfundablewere added to localcapitalprogramstodowithnonfederalresources.

    ProgramRealignmenttoNewFundingTargetsTheinabilityoftheHighwayTrustFundtosustainthefederalhighwayandtransitprogramswasrecognizedinthe

    previous federal legislation (i.e. SAFETEALU) and at least two commissions have tackled the issue. In response toreducedfundingappropriationsinFFY2012,the20112015TransportationImprovementProgramwasrealignedwithaseriesofchangestoprojectdeliveryschedules,workscopesandcostsonFebruary24,2012(Resolution201118).Thecombination ofmodifications brought the TIP at that time into fiscal constraintwith those reduced funding levels.ProjectsthathadconstructionletdatesslipbeyondFFY2014wereconsideredcandidatesforthe20142018TIPprojectselection process. See the section titled Financial Planning & Demonstration of Fiscal Constraint for a thoroughdiscussionofthiskeycomponentofprogramdevelopment.

    TransportationAlternatives(TA)Transportation Alternatives is a new fund source under MAP21 which combines the former Transportation

    EnhancementsProgram,SafeRoutestoSchoolandRecreationalTrailsprograms. Therearestillmanyuncertaintiesatthestateandfederal levelregardinghowthisprogramwouldandshouldbeadministeredbut legislationstatesMPOswillgetadefinedallocation.AccordingtoinformationpublishedintheFederalRegister71812theGBNRTCisexpectedtoreceiveapproximately$624kforFFY2013buttodatenoprojectsinthisTIPhavebeenfundedusingTAfunds.TheTIPwillbeamendedastheprogramparametersareclarified.

    TransportationConformityDetermination/CongestionMitigationAirQuality(CMAQ)TheUnitedStatesEnvironmentalProtectionAgency(USEPA)promulgatedthe2008BHourOzoneNationalAmbient

    AirQualityStandards (NAAOS)onMay21,2012 tobeeffectiveon July20,2012 classifying theBuffaloNiagaraFallsmetropolitanstatisticalareaasinattainmentforthe2008ozonestandard.TheUSEPAalsopromulgatedanewruleonJuly20,2012revokingthetransportationconformityrequirementsfor19978HourOzoneNAAQSeffectiveonJuly20,2013.Asaresult,theGBNRTCwillnotberequiredtomakeatransportationconformitydeterminationunderthenew20088HourOzoneNAAQS.

    WiththeGBNRTCbeinginattainmentforozoneafterJuly20,2013,theMPOwillnolongerbeeligibleforadirectallocationofCongestionMitigationAirQuality (CMAQ) fundsafterFederalFiscalYear (FFY)2014. ForRegion5,onlyChautauquaCountywillbeadirectrecipientofCMAQfunds.NYSDOThasthediscretiontoallocateCMAQfundstoanyregion in New York State that promotes emission reductions and supports the State Implementation Plan (SIP) toachieveNationalAmbientAirQuality Standards. Proposals areevaluatedon aprojectbyprojectbasis. The lossofCMAQfundshasrenewedeffortstoexpediteallCMAQfundedprojectsintheregionsoallmoniesareobligatedbeforetheendofFFY2014.

    SPECIAL CONSIDERATIONS CongestionManagementProcess

    Federal transportation legislation requires that each metropolitan planning area in the United States have aCongestionManagementProcess (CMP). TheCongestionManagementProcess isaplanning toolusedbyGBNRTCtoanalyze the transportation system and plan and implement travel demand reduction and operationalmanagementstrategiestoreduceorminimizecongestion.ThepurposeoftheCMPisto:

    Manageorreducetheexistingcongestion Efficientlyutilizeexistingtransportationfacilities Maximizethemobilityofpersonsandgoods KeepfuturecongestionproblemsfromoccurringA CMP is a systematic process for managing congestion that provides information on transportation system

    performanceandonalternativestrategiesforalleviatingcongestionandenhancingthemobilityofpersonsandgoodstolevels that meet State and local needs. The CMP represents one component of the larger regional transportationplanningprocess;itdoesnotoperateindependentlynordoesitaccountforallaspectsofplanning.Congestionisnottheonly variable tobe consideredwhendetermining transportationpriorities. The roleof theCMP is toprovidepublicagencies and decisionmakers with a tool to examine congestion in greater detail. Additional federal requirementsregardingtheCMParenecessary inErieandNiagaraCounties,astheregion isclassifiedasanonattainmentTMAforozone.Therequirementsarethat:

    Allreasonable,multimodalTransportationDemandManagement(TDM)/OperationsandSupplyManagement(OSM)strategiesmustbeanalyzedincorridorswherecapacityincreaseisproposed.

    IftheanalysisdemonstratesthattheTDM/OSMstrategiescannotsatisfytheneedforadditionalcapacity,theCMSshouldidentifyallreasonablestrategiesformanagingthesingleoccupancyvehicle(SOV)facilityeffectively.

    AllidentifiedstrategiesshouldbeincorporatedintoSOVorcommittedtobytheStateandtheMPO. FederalfundsmaynotbeprogrammedinanonattainmentTMAforanyhighwayorSOVprojectunlessbased

    onapprovedCMP.The process of congestion management is reasonably mature in the GBNRTC region, as the MPO specifically

    allocates resources in the transportation improvementprogram forcongestionmanagementprojects.This integratedapproachprovidesconsistentandfocusedcongestionmanagementopportunitiesandoperationalanalyses.Further,acomprehensiveregionaloperationsagency,theNiagaraInternationalTransportationTechnologyCoalition(NITTEC),hasbeeninplaceandactivelyfunctioningtocoordinatesystemsoperation.ThisgroupincludesallGBNRTCmembersaswellasCanadianpartnersinaregionalapproachtosystemsoperationsefficiency.NITTECiscurrentlycompletingaRegionalConcept of Transportation Operations document, which is fully embodied in the CMP, and an Integrated CorridorManagement demonstration to cooperatively put operations management practices in place in a major BiNationalcorridor.

    This 20142018 TIP includes funding formany projectswhich advance the specific strategies introduced in theBuffaloNiagarametropolitanareathatwillcontributetoamoreeffectiveuseandimprovedsafetyofexistingandfuturetransportationsystems.Theseprojectsinclude:

    PublictransportationimprovementsarefundedwhicharekeycomponentsofaregionalstrategyprovidingandfinancingeffectiveandefficientNFTAMetrotransitservicetomeetthevariedandevolvingmobilityneedsoftheregion.ExpectationsareformoreintensivetransitserviceprovisioninkeycorridorsandfurtherintegrationwithlanduseinTransitSupportiveDevelopmentarrays.

    ITStechnologiesasrelatedtotheregionalITSarchitecturearealsoextremelyimportantincongestionmanagement.GBNRTChasendorsedtheITSRegionalArchitectureanditisusedtoguideprojectdevelopmentinvestments.TheBuffaloNiagaraBiNationalRegionalITSArchitectureisaroadmapfortransportationsystemsintegrationforthemetropolitanareaofBuffalo,NiagaraFalls,andthesurroundingmunicipalitiesinNewYorkaswellasRegionNiagarainOntario,Canadaoverthenext15years.TheBuffaloNiagaraBiNationalRegionalITSArchitecturehasbeendevelopedthroughacooperativeeffortbytheregion'stransportationagencies,coveringallsurfacetransportationmodesandallroadsintheregion.TheBuffaloNiagaraBiNationalRegionalITSArchitecturerepresentsasharedvisionofhoweachagenciessystemswillworktogetherinthefuture,sharinginformationandresourcestoprovideasafer,moreefficient,andmoreeffectivetransportationsystemfortravelersintheregion.

    SafetyTheultimategoalsrelativetosafetyremainthesameasinpreviousTransportationImprovementPlans: ReducefatalitiesandsevereinjuriesonpublicroadwaysintheBuffaloNiagararegion. Positivelyaffecttransportationsystemperformancethroughanoverallreductioninthenumberofmotor

    vehiclecrashesintheBuffaloNiagararegion.To accomplish these goals, the GBNRTC explicitly considers safety as an integral part of capital investment,

    operationsanddailymanagementprograms,earlyinthetransportationplanningprocess.Candidateprojectsproposedfor the TIP reference emphasis areas outlined by the AASHTO Strategic Highway Safety Plan and internal accidentanalyses.Improvementprojectsandprogramsfollowthestrategiesrecommendedformeetingthegoalsforimprovingsafetyrelativetotheseemphasisareas.Effectivelyincorporatingsafetyintoplans,operationsstrategiesandpoliciesisanongoing longtermprocess. Itrequires leadershipcommitmentsbyestablishingnew institutionalpartnershipsandstrengtheningexistingones.

    terrorist attacks on the WorldTrade Center and the Pentagon,MPOs have been directed toconsidersecuritywithinthecontextof transportation planning andprogramming activities. The 2035LongRange [Metropolitan] Transportation Plan Update revisitedstatewide, regional, and localemergency and security plans toensure the most relevantinformation was incorporated intothe Plan. Defining the role of theMPOintermsofsecuritycontinuestobeanongoingeffort.

    An issue paper entitled TheRole of the Metropolitan PlanningOrganization (MPO) in Preparingfor Security Incidents and Transportation System Response,prepared by the Georgia InstituteofTechnology,tackledthequestionofwhat the role of theMPO is insecurity/disaster situations.     GBNRTC policy concerning accommodation for older adults and individuals with disabilities is consistent withfederal regulations.     STATUS OF THE 2011-2015 TRANSPORTATION IMPROVEMENT PROGRAM

    The TIP is a dynamic document that provides for the modification of existing projects, and the advancement of new ones throughout the program period. In preparation for the new 2014-2018 TIP, changes to the previously approved 2011-2015 Transportation Improvement Program were documented. The first TIP closeout item involves the disposition of current TIP projects both in terms of those no longer on the program and those phasing changes that affected a projects schedule. The second closeout item summarizes those formal actions taken to manage the 2011-2015 TIP, including the addition of new projects. The GBNRTC has a rigorous set of change control thresholds and approval processes (discussed elsewhere in this document) which are used when dealing with the regions Transportation Improvement Program. The level of action required is dependent upon the type of change being made. All actions are documented and posted on the GBNRTC website. These changes collectively constitute a progress report on the accomplishments made toward implementation of the program and towards advancing the goals and objectives set forth in the long-range metropolitan plan.
