Ex-MLA may face 3 yrs injail for sheltering terrorist

New Delhi: Indian Mujahideenterrorist Shahzad Alam’s star-tling disclosure that he wassheltered by a former DelhiMLA after fleeing from the Bat-la House encounter scene inSeptember 2008, could makethe ex-legislator face a mini-mum sentence of three yearsunder the Unlawful Activities Preven-tion Act (UAPA).
The IM terrorist had allegedly toldthe Delhi police that he was providedshelter and financial help by a formerDelhi MLA after he escaped from theBatla House shootout on September 19,2008, an incident which still evokessharp reaction from political parties.
After the repeal of POTA to keep itselection promise, UPA-I was in 2004forced to make amendments to UAPA,1967, and bring in specific provisionsto deal with the growing shadow of ter-rorism on the country.
Section 19 of the amended UAPA pro-
vides for a minimum punishment ofthree years, which could in serious cas-es be extended to life term, for thosewho harbour or help conceal a terror-ist, even after knowing that the personharboured is a subversive element.
The only loophole in the section,which the ex-MLA can exploit, is thatthe person giving shelter to the terror-ist must have the knowledge about theactivity of the guest.
Section 19 says: “Whoever volun-tarily harbours or conceals, or attemptsto harbour or conceal any person know-ing that such person is a terrorist shallbe punishable with imprisonment for
a term which shall notbe less than three yearsbut which may extendto imprisonment forlife, and shall also be li-able to fine.”
US, UK LAWS HARDER ONTERRORISM The stricter anti-terrorlaws enacted by the US
and UK shortly after the 9/11 attacksthat snuffed out the existence of twintowers also have similar provisions todeter persons from extending help toterrorists.
Section 803 of Uniting and Strength-ening America by Providing Appro-priate Tools Required to Intercept andObstruct Terrorism (USA PATRIOTACT) Act enacted a few weeks after 9/11refers to a host of provisions in otherlaws against terrorism and says any-one who harbours a terrorist “shall befined under this title or imprisoned fornot more than 10 years, or both.”

New Delhi: Top Delhi University andJawaharlal Nehru University professorsare among those in the CBI net for ‘al-legedly’ conspiring to facili-tate recognition to colleges inJaipur by the All India Coun-cil for Technical Education(AICTE).
The agency has registeredtwo separate cases of cheat-ing against them for allowingthe recognition on the basisof false documents. The ac-cused include G V Singh, professor,School of Computer and System Sci-ences, JNU, and R S Gupta, a professorin DU. While Singh has been accused ofviolating AICTE norms for a regular col-lege in Jaipur, Gupta is ‘alleged’ to havefacilitated recognition to an engineer-ing college.
The other accused in the first caseare T K Garg, professor of electronicsand communication engineering de-partment, National Institute of Tech-nology, Kurukshetra, M K Jha, HoD ofchemical engineering department in
NIT, Jalandhar, Narendra Singh,AICTE’s deputy director, and Ram KaranBhakar, president of the Rajdhani Edu-cational Welfare Society, Jaipur.
Another case has been registeredagainst R S Gupta, DU pro-fessor, D V S Verma, pro-fessor, BPS Mahila Ma-havidhyalaya, Sonepat, TK Garg, professor in NIT,Kurukshetra, S P Singh,then regional officer,AICTE, Chandigarh, andAshish Gupta, secretary ofthe Jaipur-based Pooja Ed-
ucational Society. The accused are saidto have violated AICTE norms in grant-ing recognition to an engineering college.
“The allegation is that the accusedpersons, while working as public ser-vants during the year 2008, abused theirofficial positions and entered into crim-inal conspiracy with the president ofJaipur-based Educational Welfare Soci-ety to cheat AICTE in the matter ofgranting recognition to a college at Pha-gi in Jaipur by AICTE on the basis offalse documents,’’ said CBI press infor-mation officer R K Gaur.

The Kandhamal district ad-ministration told the visitors,who had on Thursday gone toriot-affected villages and in-teracted with the Christianvictims of violence, that it
would not be proper for themto visit the two fast trackcourts to witness the justicedispensation system at workbecause of security and other
issues, official sources said.“The EU team comprised
diplomats who come under thedistinguished foreigner’s scaleof security. It would not have
been convenient to makearrangements for such a largeteam inside the court withoutdisturbing the legal work,” anofficer disclosed.
Sources said the EU team,which had representativesfrom such countries as Swe-den, Italy, Britain, Spain, Hun-gary, Poland, Ireland and Fin-land, was very keen to make atrip to the court and deliber-ated over the matter at a meet-ing with district collector Kr-ishan Kumar and superinten-dent of police Praveen Kumar.But the district officials puttheir foot down and deniedpermission. Prior to that, thedistrict lawyers’ associationhad objected to the EU team’sinterest to visit the court onground that it would be “un-constitutional”.

“We are taking serious objectionto his interview in the media,” ob-served a division Bench comprisingJustice Elipe Dharma Rao and Jus-tice N Paul Vasanthakumar when thewrit appeals regarding her prematurerelease from the 19-year-long deten-tion in connection with the RajivGandhi assassination case.

on the issue, said, “They arediscussing this in the media.It will amount to contempt ofcourt, as the matter is sub ju-dice. He is a learned person,not a common man. We haveto be serious on this. The mat-ter is sensational and subju-
dice. Why this publicity? Put an endto this kind of behaviour.” Reactingto this, G Rajagopal, senior counselfor Swamy, said: “I apologise onSwamy’s behalf. It will not happenagain.”
The Bench, however, did not passany orders on Nalini’s request to thecourt, seeking permission to appearin person and argue her own case.
