REGULATIONS REGARDINGTRANSGENDER IDENTITY AND

EXPRESSION

The Fair Employment and Housing Council (Coun-cil) of the Department of Fair Employment and Hous-ing (DFEH) proposes to amend sections 11030, 11031,and 11034 of Title 2 of the California Code of Regula-tions after considering all comments, objections, andrecommendations regarding the proposed action.

PUBLIC HEARING

The Council will hold a public hearing starting at10:00 a.m. on June 27, 2016, at the following location:

At the hearing, any person may present statements orarguments orally or in writing relevant to the proposedaction described in the Informative Digest. AUTHORITY AND REFERENCE

Government Code section 12935(a) authorizes theCouncil to adopt these proposed regulations. The pro-posed regulations implement, interpret, and make spe-cific section 12900 et seq. of the Government Code.

INFORMATIVE DIGEST/ POLICY STATEMENTOVERVIEW

This rulemaking action clarifies, makes specific, andsupplements existing state regulations interpreting theFair Employment and Housing Act (“FEHA”) set forthin Government Code section 12900 et seq. As it relatesto employment, the FEHA prohibits harassment anddiscrimination because of the race, religious creed, col-or, national origin, ancestry, physical disability, mentaldisability, medical condition, genetic information, mar-ital status, sex, gender, gender identity, gender expres-sion, age, sexual orientation, and military and/or veter-an status of any person.

In compliance with the Administrative ProcedureAct, the Council proposes to adopt these rules as dulynoticed, vetted, and authorized regulations. The overallobjective of the proposed amendments is to describehow the Fair Employment and Housing Act applies totransgender individuals in the employment context, pri-marily by centralizing and codifying existing law, clari-fying terms, and making technical corrections. This ac-tion has the specific benefit of clarifying an often mis-understood area of the law, in turn reducing litigationcosts and court overcrowding. Ultimately, the proposedaction furthers the mission of the DFEH by protectingtransgender Californians from employment discrimi-nation.

In addition to technical amendments and generallyprohibiting discrimination, the proposed amendments

clarify and/or articulate the following: (1) the definitionof “transitioning”; (2) that employers shall provideequal access to facilities and appropriate alternatives,based in part on employees’ gender identity or genderexpression; (3) that transitioning employees are not re-quired to provide proof of medical treatment to use thefacility of their choice; (4) the appropriate facilitysignage for single–occupancy facilities; (5) that em-ployers may not require employees to dress or groom ina manner inconsistent with their gender identity or ex-pression; (6) the rules regarding transgender employeesand the recording of gender or name; and (7) when re-quiring documentation of sex, gender, gender identity,or gender expression is lawful.

The Council has determined that the proposedamendments are not inconsistent or incompatible withexisting regulations. After conducting a review for anyregulations that would relate to or affect this area, theCouncil has concluded that these are the only regula-tions that concern the employment provisions of theFair Employment and Housing Act.

DISCLOSURES REGARDING THEPROPOSED ACTION

The Council has made the following initialdeterminations:

Mandate on local agencies and school districts:None.

Cost or savings to any state agency: No additionalcosts or savings beyond those imposed by the Fair Em-ployment and Housing Act.

Cost to any local agency or school district, whichmust be reimbursed in accordance with Govern-ment Code sections 17500 through 17630: None.

Other nondiscretionary cost or savings imposedon local agencies: No additional costs or savings be-yond those imposed by the Fair Employment and Hous-ing Act.

Cost or savings in federal funding to the state:None.

Cost impacts on a representative private personor businesses: No additional costs or savings beyondthose imposed by the Fair Employment and HousingAct. Therefore, the agency is not aware of any cost im-pacts that a representative private person or businesswould necessarily incur in reasonable compliance withthe proposed action.

Results of the economic impact assessment/analy-sis: The Council anticipates that the adoption of the reg-ulations will not impact the creation or elimination of

jobs within the state, the creation of new businesses orthe elimination of existing businesses within the state,or the expansion of businesses currently doing businesswithin the state. To the contrary, adoption of the pro-posed amendments is anticipated to benefit Californiabusinesses, workers, and the state’s judiciary by clarify-ing and streamlining the operation of the law, making iteasier for employees and employers to understand theirrights and obligations, and reducing litigation costs forbusinesses.

Statewide adverse economic impact directly af-fecting businesses and individuals: The Council hasmade an initial determination that the proposed actionwill not have a significant statewide adverse economicimpact directly affecting businesses, including the abil-ity of California businesses to compete with businessesin other states.

Significant effect on housing costs: None.Small Business Determination: The Council antici-

pates that the regulations will not create additional costsor savings beyond those imposed by existing regula-tions. Similarly, the Council has determined that there isno impact on small businesses as a result of this pro-posed action because these regulations primarily serveto clarify existing law.

Business Report: The Council has determined thatthe proposed regulations do not require a report to bemade.

CONSIDERATION OF ALTERNATIVES

In accordance with Government Code section11346.5, subdivision (a)(13), the Council must deter-mine that no reasonable alternative it considered or thathas otherwise been identified and brought to the Coun-cil’s attention would be more effective in carrying outthe purpose for which this action is proposed, or wouldbe as effective and less burdensome to affected privatepersons than the proposed action, or would be morecost–effective to affected private persons and equallyeffective in implementing the statutory policy or otherprovision of law.

The Council has thus far not become aware of a betteralternative and invites interested persons to presentstatements or arguments with respect to alternatives tothe proposed regulations at the scheduled hearing orduring the written comment period.

The Executive Director of the Commission will re-view the above–referenced conflict–of–interestcode(s), proposed pursuant to Government Code Sec-tion 87300, which designate, pursuant to GovernmentCode Section 87302, employees who must disclose cer-tain investments, interests in real property and income.

The Executive Director of the Commission, upon heror its own motion or at the request of any interested per-son, will approve, or revise and approve, or return theproposed code(s) to the agency for revision and re–submission within 60 days without further notice.

COST TO LOCAL AGENCIES

There shall be no reimbursement for any new or in-creased costs to local government which may resultfrom compliance with these codes because these are notnew programs mandated on local agencies by the codessince the requirements described herein were mandatedby the Political Reform Act of 1974. Therefore, they arenot “costs mandated by the state” as defined in Govern-ment Code Section 17514.

EFFECT ON HOUSING COSTSAND BUSINESSES

Compliance with the codes has no potential effect onhousing costs or on private persons, businesses or smallbusinesses.

AUTHORITY

Government Code Sections 82011, 87303 and 87304provide that the Fair Political Practices Commission asthe code–reviewing body for the above conflict–of–interest codes shall approve codes as submitted, revisethe proposed code and approve it as revised, or returnthe proposed code for revision and re–submission.

REFERENCE

Government Code Sections 87300 and 87306 pro-vide that agencies shall adopt and promulgate conflict–of–interest codes pursuant to the Political Reform Actand amend their codes when change is necessitated bychanged circumstances.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

The California Department of Food and Agricul-ture’s (CDFA’s) Fertilizing Materials Inspection Pro-gram (FMIP) is statutorily tasked with licensing and la-bel registration, tonnage reports, field inspections, andadministration of the Fertilizer Research and EducationProgram (FREP). The FMIP is responsible for review-ing and registering product labels, promoting agronom-ically sound and environmentally safe use of fertilizingmaterials through FREP, and ensuring fertilizing mate-rials are safe, effective, and meet the nutrients guaran-teed by the manufacturer. Producers of specialty fertil-izer, packaged agricultural mineral, auxiliary soil andplant substance, organic input material (OIM), andpackaged soil amendment are statutorily mandated toregister with the FMIP.

The objective of the proposed regulations is to clarifythe statutes in the Food and Agricultural Code (FAC) re-lated to labeling, sampling, registration, inspection pro-tocols, and reporting of fertilizing materials. The pro-posed changes provide improved clarity and uniformi-ty, and correct outdated, ambiguous, or vague languageusing more applicable and precise terminology. Fur-thermore, many of the proposed changes provide im-proved transparency with fertilizer labeling and offerfuller disclosures for the end user. These changes wouldhelp the fertilizer industry and consumers to better un-derstand the law, as well as the ingredients, directionsfor use, and safety of the products.

partment anticipates regulations will provide improvedclarity and uniformity to the fertilizer industry. Thesechanges will be beneficial to consumers to assist themto better understand the context of the original regula-tions. Similarly, many of these regulations provide bet-ter transparency with fertilizer labeling and offer im-proved disclosures for the end user.

The proposed adoption to the regulations will clarifyreferences in statute and provide guidance for labelevaluation. The fertilizer industry will receive addition-al guidance through tangible labeling examples that canbe applied when creating its own labeling, thereby as-sisting to expedite the registration process and permit-ting lawful sales of fertilizing products in California.

There is no existing, comparable federal regulation orstatute regulating fertilizing materials. The Departmentis the only agency which can implement regulationspertaining to fertilizing materials. As required by Gov-ernment Code Section 11346.5(a)(3)(D), the Depart-ment has conducted an evaluation of this regulation andhas determined that it is not inconsistent or incompat-ible with existing state regulations.

DISCLOSURES REGARDING THEPROPOSED ACTION

The Department has made the following initialdeterminations:

These regulations will not:(1) Create or eliminate jobs within California;

(2) Create new businesses or eliminate existingbusinesses within the State of California; or

(3) Affect the expansion of businesses currently doingbusiness within the State of California.

(4) The benefits of the regulation to the health andwelfare of California residents, worker safety, andthe state’s environment: As stated under theInformative Digest/Policy Statement Overviewabove, the proposed regulations will provideimproved clarity and uniformity to the fertilizerindustry. SMALL BUSINESS DETERMINATION

The proposed regulations will not affect small busi-nesses. For required label changes, licensees will nothave to revise their labels until the next registration re-newal cycle. This will allow the changes to be inte-grated into the normal business practices of reprintinglabels with no additional costs. Firms may utilize theircurrent labels until updated versions are created duringtheir two–year renewal cycle, as a regular course ofbusiness.

CONSIDERATIONS OF ALTERNATIVES

In accordance with Government Code section11346.5, subdivision (a)(13), the Department must de-termine that no reasonable alternative is considered orthat has otherwise been identified and brought to theattention of the agency would be more effective in car-rying out the purpose for which the action is proposed,would be as effective, and less burdensome to affectedprivate persons than the proposed action or would bemore cost–effective to affected private persons andequally effective in implementing the statutory policyor other provision of law.

Section 87

These proposed amendments establish, for new li-censees who, as their highest level of service, providepreparation engagements, a prorated CE requirement inpreparation engagements or A&A following initial li-censure for the first renewal period at two hours for each20 hours of CE required. RESULTS OF ECONOMIC IMPACTASSESSMENT/ANALYSIS

Impact on Jobs/Businesses:

This action will not create or eliminate jobs within theState of California because the proposed changes arenot of sufficient magnitude to create or eliminate jobs orbusinesses, or affect the expansion of existing busi-nesses in California. The CBA presently requires indi-vidual licensees to complete 80 hours of CE each two–year renewal cycle. For those providing preparation en-gagements as their highest level of service, this propos-al specifies particular CE subjects for a portion of thosehours and does not add to the total hours required. Costsassociated with changes to the continuing education re-quirements should be minor and absorbable since thelicensee still must complete 80 total hours of CE duringeach renewal period.

Benefits of Regulation:

The CBA has determined that this regulatory propos-al will have the following benefits to the health and wel-fare of California residents, worker safety, and thestate’s environment.

This regulatory proposal does not affect worker safe-ty because it has nothing to do with worker safety.

This regulatory proposal benefits the health and wel-fare of California residents because requiring licenseeswho perform preparation engagements as their highestlevel of service to take CE specific to preparation en-gagements or A&A and CE specifically related to theprevention, detection, and/or reporting of fraud affect-ing financial statements will assist the CBA in its mis-sion of consumer protection by ensuring these licenseesmaintain their professional competency.

INFORMATIVE DIGEST/POLICY STATEMENTOVERVIEW

These proposed regulations amend the CalWORKshome visit regulations. Current regulations only man-date that home visits be used at the time of application orredetermination when living arrangements or other fac-tors affecting eligibility cannot be satisfactorily deter-mined without such a visit. These proposed amend-ments clarify that home visits may also be used as a rea-sonable accommodation to complete the face–to–faceinterview requirement for CalWORKs applicants whohave a mental or physical impairment, or other extremecircumstance, that makes it difficult or impossible tocome into the county office.

This regulatory action will help to accommodatepeople who have a mental or physical impairment, forwhom it is difficult or impossible to come in to thecounty office to complete the face–to–face interview

that is required of all CalWORKs applicants. By speci-fying that a home visit may be used to accommodatethis population, this regulatory action will help ensurethat all people can get access to the benefits that they areentitled to. Additionally, these amendments are not ap-plying a mandate that counties complete home visits,they are simply giving counties more administrativeflexibility. This additional flexibility will benefit clientswithout putting a mandate on county workers. Lastly,counties have stated that they are already utilizing thisflexibility; this regulatory action will just specify thisoption in the regulations.

These regulations are neither inconsistent nor incom-patible with existing state regulations. After conductinga review for any regulations that would relate to or af-fect home visits in the CalWORKs program, CDSS hasconcluded that these are the only regulations that con-cern this area. Also, this determination was made basedon the fact that the purpose of this regulatory change isto clarify what is currently lacking in the regulations.Furthermore, this change will only apply to a very spe-cific segment of the CalWORKs population.

LOCAL MANDATE STATEMENT

These regulations do not impose a mandate upon lo-cal agencies or on school districts. There are no “state–mandated local costs” in these regulations which re-quire state reimbursement under Section 17500 et seq.of the Government Code because any costs associatedwith the implementation of these regulations are costsmandated by the federal government within the mean-ing of Section 17513 of the Government Code.

STATEMENT OF SIGNIFICANT ADVERSEECONOMIC IMPACT ON BUSINESS

The CDSS has made an initial determination that theproposed action will not have a significant, statewideadverse economic impact directly affecting businesses,including the ability of California businesses to com-pete with businesses in other states. This determination

was made based on the fact that this regulatory changeis only clarifying that counties have the option to usehome visits to complete the intake interview require-ment of a face–to–face interview. This additional flexi-bility will benefit clients without putting a mandate oncounty workers. Additionally, counties have stated thatthey are already utilizing this flexibility; CDSS is justspecifying this option in the regulations. This regulato-ry change will only have an effect on certain Cal-WORKs clients and counties.

STATEMENT OF POTENTIAL COST IMPACT ONPRIVATE PERSONS OR BUSINESSES

The CDSS is not aware of any cost impacts that a rep-resentative private person or business would necessari-ly incur in reasonable compliance with the proposedaction.

SMALL BUSINESS IMPACT STATEMENT

The CDSS has made an initial determination thatthere is no impact on small businesses as a result of fil-ing these regulations because these regulations are onlyapplicable to state and county agencies.

STATEMENT OF RESULTS OF ECONOMICIMPACT ASSESSMENT

The adoption of the proposed amendments will nei-ther create nor eliminate jobs in the State of Californianor result in the elimination of existing businesses orcreate or expand businesses in the State of California.

The benefits of the regulatory action to the health andwelfare of California residents, worker safety, and thestate’s environment are as follows: this regulatory ac-tion will clarify in regulation that home visits may beused as a reasonable accommodation to complete theface–to–face interview requirement for CalWORKsapplicants that have a mental or physical impairmentthat makes it difficult or impossible to come into thecounty office. This will ease the burden of the applica-tion process on people with a mental or physical impair-ment and help ensure that all people can get access to thebenefits that they are entitled to. Further, by givingcounties more administrative flexibility regarding theuse of home visits and helping to ensure the consistentreasonable accommodation of CalWORKs applicantsfrom county to county, this regulatory action benefitsboth county workers and CalWORKs applicants.

REQUEST FORMill Creek–Talmage Fish Passage Barrier Removal

and Riparian Restoration Project(Tracking Number: 1653–2016–001–001–R1)

Mendocino County

California Department of Fish and Wildlife (CDFW)received a Request to Approve on April 4, 2016, that theMendocino County Resource Conservation District(District) proposes to carry out a habitat restoration orenhancement project pursuant to Fish and Game Codesection 1653. The proposed project involves replacingan existing culvert with a single–span bridge, removingexisting concrete structures, removing existing riprap,and restoring habitat. The proposed project will be car-ried out on Mill Creek, tributary to the Russian River,located at 900 Talmage Road (Highway 222), Ukiah,Mendocino County, California.

On February 19, 2016, the North Coast Regional Wa-ter Quality Control Board (Regional Water Board) re-ceived a Notice of Intent (NOI) to comply with theterms of, and obtain coverage under, the General 401Water Quality Certification Order for Small HabitatRestoration Projects (General 401 Order) for the MillCreek–Talmage Fish Passage Barrier Removal &

Riparian Restoration Project (Project). The RegionalWater Board determined that the Project, as describedin the NOI, was categorically exempt from CaliforniaEnvironmental Quality Act (CEQA) review (section15333 — Small Habitat Restoration Projects) and metthe eligibility requirements for coverage under the Gen-eral 401 Order. The Regional Water Board issued a No-tice of Applicability (WDID No. 1B16180WNME;ECM PIN No. CW–822298) for coverage under theGeneral 401 Order on March 18, 2016.

The District is requesting a determination that theproject and associated documents are complete pur-suant to Fish and Game Code section 1653 subdivision(d). If CDFW determines the project is complete, theDistrict will not be required to obtain an incidental takepermit under Fish and Game Code section 2081 subdi-vision (b) or a Lake or Streambed Alteration Agreementunder Fish and Game Code section 1605 for the pro-posed project.

In accordance with Fish and Game Code section 1653subdivision (e), if CDFW determines during the review,based on substantial evidence, that the request is notcomplete, the District will have the opportunity to sub-mit under Fish and Game Code section 1652.

California Department of Fish and Wildlife (CDFW)received a notice April 28, 2016 that the California De-partment of Transportation (Caltrans) proposes to relyon a consultation between federal agencies to carry outa project that may adversely affect a species protectedby the California Endangered Species Act (CESA). Theproposed project involves upgrading three bridges lo-cated on State Route 96. The proposed project will oc-cur at Thompson Creek, Beaver Creek, and Seiad Creekin Siskiyou County California.

The National Marine Fisheries Service (Service) is-sued a federal biological opinion Service File No.WCR–2015–2682 (BO) and incidental take statement(ITS) to Caltrans on June 26, 2015 which considered theeffects of the proposed project on the state threatenedand federally threatened Coho salmon (Oncorhynchuskisutch).

Pursuant to California Fish and Game Code section2080.1, Caltrans is requesting a determination that the

BO and associated ITS are consistent with CESA forpurposes of the proposed project. If CDFW determinesthe BO and associated ITS are consistent with CESA forthe proposed project, Caltrans will not be required toobtain an incidental take permit under Fish and GameCode section 2081 subdivision (b) for the proposedproject.

DHCS is seeking federal approval for a State PlanAmendment to develop a process to end a hospital’s en-hanced Neonatal Intensive Care Unit (NICU)–policyadjustors to the hospital’s APR–DRG payments whenboth occur: (1) the hospital has its status as a RegionalNICU or Community NICU with neonatal surgery re-voked by California Children’s Services (CCS) and (2)DHCS does not yet have a SPA approved to remove thehospital from the list of hospitals eligible for the NICU–policy adjustor. The effective date of adopting this pro-cess will be July 1, 2016.
