HR CHALLENGES – MANAGING LEAVES OF ABSENCE

FMLA Overview

Employers Subject to FMLA Requirements

• Private-sector employers with 50 or more employees for at least 20 workweeks in current or preceding calendar year

• All public and local educational agencies regardless of # of employees

Employee Eligibility

• Worked for the employer at least 12 months (not consecutively)

• Worked at least 1,250 hours during 12 months prior to start of leave

• Work at a location with at least 50 employees within 75 miles

Length of Leave

• Total of up to 12 weeks in a 12-month period (26 weeks for care of service member)

• Employer can determine 12-month period used

• Medical leaves may be taken intermittently

FMLA Overview

Leave Entitlement

• For the birth of a son or daughter, and to care for the newborn child;

• For the placement with the employee of a child for adoption or foster care, and to care for the newly placed child;

• To care for an immediate family member (spouse, child, or parent – but not a parent “in-law”) with a serious health condition;

• When the employee is unable to work because of a serious health condition

• Qualifying Exigency Leave: when spouse, son, daughter, or parent of employee is called to active duty and deployed to a foreign country

• Military Caregiver Leave: care for a covered family member recovering from a qualified injury or illness incurred in the line of duty

EE out of work on FT basis for specific period of time (e.g. maternity leave)

EE out of work on unpredictable or periodic basis (e.g. migraines)

EE requires work schedule change or reduction of hours over a period of time

LOA SOLUTION – OUTSOURCING

Many employers turning to outside vendors to help manage leaves of absence

Outsourcing relieves HR staff of the burden of properly managing leave, providing all required notifications, and the ability to enforce leave declinations and employment termination

Outsourcing considerations:

• Employees will need to adjust to speaking with someone from outside your organization

• Thorough employee communication and education

• Leave decisions may be different than those made in the past –previously approved leaves may be denied

• Employers still need to provide accurate eligibility information
