MARCH 24, 2015

Mayor Febre called the meeting to order at 7:30 P.M. The Clerk made the following announcement:

“On January 2, 2015, adequate notice of this meeting pursuant to the Open Public Meetings Act has

been furnished by inclusion thereof in the Annual Schedule of Meetings for 2015 which has been

posted on the bulletin board at Borough Hall, filed with the Borough Clerk, faxed to the Our Town,

The Record, The Community News and The County Seat newspapers and distributed to all persons, if

any, requesting copies of same pursuant to said Act.”

In case of an emergency or fire alarm you must evacuate the building by using any of the exit doors in

the room. They are immediately to my right and the double doors at the rear of the room. Occupants

must exit the building by using the staircase and not the elevator.

This meeting is being recorded by both video and audio and may be rebroadcast.

There being no items on or off the agenda, Mayor Febre closed this portion of the meeting.

PROCLAMATIONS, PRESENTATIONS, ETC.

Mayor Febre gave a brief summary of the circumstances that took place on February 25, 2015 relating

to the commendations that he is presenting this evening.

Mayor Febre presented Certificates of Commendation to Police Officer Glenn Tutschek and Police

Sergeant Timothy Moran.

Mayor Febre welcomed the Youth Month participants in attendance to the meeting.

Mayor Febre read a proclamation proclaiming April Autism Awareness Month.

Whereas, autism is a general term used to describe a group of complex developmental

brain disorders – autism spectrum disorders – caused by a combination of genes and

environmental influences. These disorders are characterized, in varying degrees, by social and

behavioral challenges, as well as repetitive behaviors; and

Whereas, an estimated 1 in 88 children in the U.S. is on the autism spectrum – a 600

percent increase in the past two decades that is only partly explained by improved diagnosis;

and

Whereas, the Centers for Disease Control and Prevention have called autism a national

public health crisis whose cause and cure remain unknown; and

Whereas, on December 18, 2007 the United Nations General Assembly adopted

resolution 62/139 World Autism Awareness Day by unanimous consent, encouraging UN

Member States to take measures to raise awareness about autism throughout society and to

promote early diagnosis and early behavioral intervention;

Whereas the aims for World Autism Awareness Day are to inform the general public

about the global health crisis of autism, stress the importance of early diagnosis and early

intervention, and to celebrate the unique talents and qualities of individuals with autism;

Whereas autism is a lifelong condition in which the bulk of cost falls in adulthood,

creating an enormous economic impact.

Now therefore, I, Adrian J. Febre, Mayor of the Borough of Maywood, County of Bergen in the State

of New Jersey, do hereby proclaim Thursday, April 2, 2015, as World Autism Awareness Day and

the Month of April 2015, as Autism Awareness Month.

MEETING OPEN TO THE PUBLIC (FIVE MINUTE TIME FRAME)

Mayor Febre opened the meeting to the public for any comments on or off the agenda.

Gianna Gervino – 469 Hill Street – asked if her Girl Scout Troop 825 could plant fruits and vegetables

in the Community Garden to work towards their Gold Award.

Mayor Febre responded yes and invited the members of Girl Scout Troop 825 to attend the next Green

Team meeting.

Borough Clerk Pelligra advised the 2015 Community Garden application will be available soon for

organizations to complete and submit to the Borough Clerk’s office.

There being no further comments on or off the agenda, Mayor Febre closed this portion of the meeting.

Council member DeHeer moved for approval of the February 3, 2015 Special Meeting minutes, the

February 10, 2015 Work Session and Closed Session minutes, and the February 24, 2015 Council

Meeting and Closed Session minutes; seconded by Council member Messar; and so carried with the

exception of Council member Gervino abstaining to the February 3, 2015 Special Meeting minutes and

the February 10, 2015 Work Session and Closed Session minutes.

PRESENTATION OF BILLS AND CLAIMS AND REQUEST FOR PUBLIC COMMENT

The Clerk presented the bill resolution and supplemental bill resolution.

Council member Lindenau moved for approval, seconded by Council member Gervino; and so carried

by unanimous roll call vote.

CORRESPONDENCE AND REPORT OF THE BOROUGH CLERK

Borough Clerk Pelligra reported on the following:

1. She stated a resolution was added to tonight’s agenda authorizing Neglia Engineering to move

forward with the update of the drug-free zone map.

REPORT OF ADMINISTRATOR

Administrator Stern was absent.

REPORT OF THE ATTORNEY

Attorney Dario reported on the following:

1. He stated he received emails regarding the new home construction on Maywood Avenue and

stated the Borough Engineer and property developers will meet on Tuesday.

COMMITTEE REPORTS

Council member Gervino reported on the following:

1. He stated we met with CFO Cuccia for a preliminary budget meeting and are in the process of

scheduling additional meetings; adding he will report further after those meetings.

Council member DeHeer reported on the following:

1. He reported he met with Jaeger Avenue residents regarding the situation with the new

construction on Maywood Avenue; adding the hay bales at the rear of the properties and

thawing of the ground has helped. He stated the Borough Engineer is following up with the

developer regarding topography changes and test pits and he has assured the residents this

matter will not be forgotten.

Council member Eisenberg reported on the following:

1. He stated he had the pleasure of attending the Maywood Avenue PTO Comedy Night

fundraiser on Saturday night.

2. He stated he was asked by residents to review dog ordinances as they relate to where residents

may walk their dogs, adding I welcome Borough Clerk Pelligra’s input when he and Council

member Messar meet to review the ordinances.

Council member Messar reported on the following:

1. He congratulated Sergeant Moran and Officer Tutschek for their fine work; adding as a resident

I thank Chief Pegg, Captain Natale and the entire police force for keeping Maywood safe.

2. He reported the following from the Police Department:

The drug disposal box has been delivered courtesy of CVS and will be installed in the

lobby after authorization by the Prosecutor’s office.

The fifth grade Youth Leadership Program graduation will be held on April 16, 2015.

3. He reported the following from the Recreation Department:

The movie “Big Hero Six” will be shown at the library on Wednesday, April 8, 2015 at

5:30 pm.

A town-wide garage sale is scheduled for May 16 and 17, 2015, adding the fee is $5.00

and the event will be advertised in the local newspapers.

4. He attended the First Aid Squad meeting and stated these volunteer members have one of the

toughest roles in the borough; adding they are a spirited, passionate group and encouraged

anyone looking to volunteer, to consider joining the first aid squad.

Council member Lindenau reported on the following:

1. He stated the DPW is hoping this year’s snow season has come to an end and is looking

forward to removing the salt equipment from the trucks, adding they are working on the fields

in preparation of Opening Day for baseball.

REPORT OF THE MAYOR

Mayor Febre reported on the following:

1. He stated he is glad there is no snow on the ground and as spring and Easter are approaching,

he would like to thank Billy Jerlinski for decorating West Pleasant Avenue for Easter.

2. He stated the Fire Police are sponsoring a bus trip to the Sands Casino in Pennsylvania on

Saturday, March 28, 2015.

RESOLUTION AUTHORIZING THE REDEMPTION OF A

TAX SALE CERTIFICATE FOR BLOCK 76 LOT 22

BE IT RESOLVED, by the Mayor and Council of the Borough of Maywood that the Tax

Collector is hereby authorized to issue a check in the amount of $ 87,305, payable to “TOWER FUND

SVCS-CUST EBURY FUND 1NJLLC” for the Redemption of Tax Sale Certificate #14-002, dated

12/09/14 on property known as Block 76, Lot 22, 575 Elm Street. This amount includes a premium of

$ 60,000.00.

BE IT FURTHER RESOLVED that the taxpayer has paid to the Borough Tax Collector the full

amount of said redemption, less the premium, to the Borough of Maywood.

BE IT FURTHER RESOLVED that the Lien Holder bid and paid, $ 60,000.00 as a Premium to

the Borough of Maywood, on the date of sale for Tax Sale Certificate # 14-002.

BE IT FURTHER RESOLVED, that this check is to reimburse the Buyer of the lien; and

BE IT FURTHER RESOLVED, that the Borough Clerk is hereby authorized and directed to

furnish copies of this resolution to the Chief Financial Officer and the Tax Collector.

APPOINTING SALLY J. MILLER AS REGISTRAR FOR

THE BOROUGH OF MAYWOOD

WHEREAS, Donna De Gregorio will hold the position of Registrar for the Borough of

Maywood, County of Bergen, New Jersey through March 30, 2015; and

NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of

Maywood that Sally J. Miller be appointed as Registrar of the Borough of Maywood effective April 1,

2015; and

BE IT FURTHER RESOLVED that this appointment be for a three year term effective

April 1, 2015 through March 30, 2018; and

BE IT FURTHER RESOLVED, that the Borough Clerk is hereby authorized and directed to

forward a copy of the within resolution to Vincent T. Arrisi, State Registrar, Department of Health and

RESOLUTION # 60-15

RESOLUTION AUTHORIZING NEGLIA ENGINEERING TO PREPARE AN AMENDED

DRUNK-DRIVING-FREE SCHOOL ZONES AND DRUG-FREE ZONE MAP FOR THE

BOROUGH OF MAYWOOD, BERGEN COUNTY, NEW JERSEY

WHEREAS, with the advice of the Chief of Police of the Borough of Maywood, the Mayor

and Council of the Borough of Maywood deem it necessary to review and revise its Drunk-Driving-

Free School Zones and Drug-Free Zone map; and

WHEREAS, to facilitate same the Borough needs to retain the services of an Engineer to

Survey the Borough and prepare an official Drunk-Driving-Free School Zones and Drug-Free Zone

map; and

WHEREAS, the Borough Engineer, Neglia Engineering having submitted a proposal for such

services dated March 12, 2015 in the amount of $970.00; and

WHEREAS, the Borough Engineer, Neglia Engineering has the expertise for such duties and

having significant familiarity with the Borough is the best candidate for the appointment; and

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of

Maywood, County of Bergen, State of New Jersey that the Mayor be and he is hereby authorized and

directed to execute, and the Borough Clerk to attest, to any and all documents necessary to execute the

agreement between the Borough of Maywood and Neglia Engineering for the surveying and

preparation of the official Borough of Maywood Drunk-Driving-Free School Zones and Drug-Free

Zone map.

Council member DeHeer moved for the adoptions, seconded by Council member Messar.

Council member Eisenberg stated he would like CFO Cuccia be present to give a report to the council

regarding the appropriations.

Council member Messar asked the Youth Month participants what they have taken away from this

Reese stated he found it interesting to learn about what is happening in town.

Gianna stated she found it interesting how the council discusses a very broad range of topics.
