THE OBLIGATIONS OF OWNING A LISTED BUILDINGBeing listed means the building is included on a national register as a property of architectural or historical importance. It means that its style and character must be maintained and owners have a responsibility and duty to ensure its upkeep.
Contrary to popular belief the listing protects both inside and out, the area immediately surrounding and includes any extensions previously added. It may also include garden walls, courtyards etc.
The owner must maintain the house, at their own expense, to the standard and style dictated by the local council’s conservation officer.

VAT – THE BACKGROUND
VAT ZERO RATING WAS NO ACCIDENT.
IT REFLECTED THE FACT THAT APPROVED LISTED BUILDING WORKS COULD ONLY TAKE PLACE ON COMPLETION OF AN APPROVAL PROCESS INTENDED TO SAFEGUARD THE HERITAGE VALUE OF THE PROPERTY CONCERNED.

VAT – THE 2012 BUDGET
THE DECISION TO IMPOSE 20% TAX ON ALL WORKS TO A LISTED BUILDING, THE GOVERNMENT ARGUED, WAS TO:
“ CLOSE A LOOPHOLE THAT ALLOWED MILLIONAIRES TO BUILD TAX FREE SWIMMING POOLS”. (Financial Secretary to the Treasury, Mark Hoban 14th April 2012).
THIS DECISION WAS BASED ON A STUDY OF 105 APPLICATIONS FOR LBC (FOI request).
LPOC STUDIED 12,049 SUCH APPLICATIONS PRIOR TO THE 2012 BUDGET AND FOUND ONLY 34 REFERENCES TO SWIMMING POOLS OF WHICH LESS THAN HALF MAY HAVE QUALIFIED FOR VAT RELIEF.

VAT PLACING HERITAGE AT RISKSince the introduction of VAT to approved alterations to listed buildings there has been a noticeable decline in the number and “type” of applications for permission to undertake work on their homes. This suggests that owners are ignoring the consent process and undertaking unauthorised work, thereby placing these buildings at risk.

VAT –THE WAY FORWARDThe current VAT regime, where new building is incentivised over repair, maintenance and alteration of older properties creates a perverse tax on conservation and maintenance that subsidises demolition and rebuilding. We call on all political parties to permanently reduce VAT to 5% on the repairs, maintenance and improvement of listings in private ownership as permitted under EU rules.

FRUSTRATING PROCESSESOwners are consistently frustrated by inconsistent standards, lack of national guidance and local authorities who can no longer provide a professional conservation service due to fewer conservation officers.
Nigel and Fiona Gibbons bought Oakhurst Farm on the Surrey / Sussex border in 2006. It was a rundown 200 acre farm with dilapidated buildings everywhere. Double glazed windows would not be allowed in the main house, the Conservation Officer determined, as that is not what was originally there; even in this day and age of energy
conservation. More arguments followed – “perhaps at a stretch the old retained part but surely not the newly built section?” He wouldn’t budge.
Ten thousand pounds later, seven brand new bespoke single glazed Georgian sash windows were delivered ... and then the Conservation Officer changed his mind.
Nigel commented: “They are things of beauty and are completely useless to us. We really had no choice but to start again so we now have double glazed windows throughout.”

FRUSTRATING PROCESSES. THE SOLUTIONNationally set exemptions on minor works to listed buildings stipulating works that do not require listed building consent. Changes such as new bathroom and kitchen fittings and routine repairs such as repointing need to be clearly removed from the consent regime.
A more routine method of securing consent for minor works. It is no longer acceptable for owners to have to wait several months to get consent to make minor alterations to a window frame or to change their gutters.
Better, more detailed and clearer guidance on issues such as double glazing to remove what can often be a postcode lottery with decisions varying from area to area. The amount of helpful Government guidance has been slashed in recent years leaving owners in the dark or at the whim of the local planning committee.
