PART 15. VC – VILLAGE COMMERCIAL DISTRICT
1.1.1. Purpose of Intent
The VC Village Commercial District is established as a district in which the principal use of land is for traditional village scale commercial and service uses to serve the surrounding districts and in which traffi c and parking congestion can be reduced to a minimum in order to preserve residential values and promote the general welfare of the surrounding residential districts. In promoting the general purposes of this Ordinance, the specifi c intent of this District is:
(a) To maintain the current level site used for Village commercial and service purposes;
(b) To prohibit intense commercial and industrial use of the land and to prohibit any other use which would substantially interfere with the development or continuation of the commercial activities in the district;
(c) To prohibit any use which, because of its character or size, would interfere with the use of land in the district as a village shopping and service center for resort visitors and the surrounding residential districts;
(d) To preserve the traditional scale, design, ambiance and character of the Village center;
(e) To preserve and enhance the character of the Village as a resort and residential community as more particularly described in Section 1.1.2;
(f) To prohibit any use which will create unmanageable congestion of adjacent streets, residential and public areas and recreational facilities;
(g) To encourage development which is compatible with and supports the Land Use Policy and Plan of the Village of Pinehurst by permitting only low intensity and aesthetically pleasing commercial developments in keeping with the intent of this Ordinance. (See Section 1.1.2.).
1.1.1. Permitted Uses
The following uses may be established as permitted uses in the VC District, in accordance with the procedures established in Chapter 5, Part 2 of this Ordinance:
(a) Art Galleries;
(b) Banks (Savings and Loan Associations);
(c) Dwelling units when all of the following conditions are met:
(1) the units are located in the principal building;
(2) the units are not located on the ground fl oor of the principal building:
(i) the entrance to the dwelling units shall be from the street or lobby;
(ii) the dwelling units are constructed and located so that tenants are not exposed to undue noise, odors, or other detrimental effects of non-residential activities;

(iii) all signs on the property are arranged so as not to cause glare into the residential units; and
(iv) parking requirements are met by off-site spaces or shared spaces.
(d) Financial Institutions;
(c) Florist Shops;
(d) Libraries/Museums;
(e) Offi ces provided that all of the following conditions are met:
(1) the offi ce(s) are located in the principal building;
(2) offi ces not located on ground fl oor, unless ground fl oor is at least 50 percent retail;
(3) offi ces other than medical and dental.
(f) Personal Service Establishments;
(g) Retail Stores;
(h) Offi ces provided that all of the following conditions are met:
(1) the offi ce(s) are located in the principal building;
(2) offi ces not located on ground fl oor, unless ground fl oor is at least 50 percent retail;
(3) offi ces other than medical and dental.
(i) Personal Service Establishments;
(j) Retail Stores;
(k) Accessory Uses meeting the requirements of this Ordinance.
1.1.1. Major Special Uses
The following uses may be established as major special uses in the VC District, subject to approval by the Village Council in accordance with the procedures established in Chapter 5, Part 4.
(a) Bed and Breakfasts, provided that all of the following conditions are met:
(1) the use is located in a structure which was constructed as a single-family dwelling, and contains a minimum of three (3) and a maximum of nine (9) adult guest nine (9) rooms;
(2) a fl oor plan of each dwelling unit must be provided, showing ingress and egress from each room. Each room must have access to a hall or exterior door;

(3) a fi re protection plan approved by the Fire Chief of the Village of Pinehurst must be submitted with the application for the Major Special Use Permit;
(4) no more than two (2) adult guests per room will be permitted at any one time. No more than 18 total guests may be registered at any one time;
(5) the owner must be a permanently domiciled resident of the Bed and Breakfast;
(6) meals served on the premises to paying guests shall be limited to breakfast;
(7) no alcoholic beverages shall be served on the premises to paying guests;
(8) only one (1) unlighted sign will be permitted, which shall have maximum dimensions of two (2) feet high by three (3) feet wide, and not more than three and one half (3½) feet tall at its highest point above ground level;
(9) any interior modifi cations shall be described in the application for the Major Special Use Permit;
(10) off street parking shall be provided in conformance with Chapter 12;
(11) special events for guests such as wedding receptions, parties, etc., are not permitted;
(12) there shall be no less than one (1) bathroom consisting of a bath or shower, water closet, and lavatory for each two (2) guest rooms;
(13) all applicable federal and state regulations for Bed and Breakfasts shall be adhered to;
(14) all procedures outlined in Chapter 5, Part 4, Special Uses must be followed and written fi ndings shall be made with respect to the requirements of this Section.
(b) Restaurants provided that:
(1) no drive-through windows are permitted;
(2) no exterior playground and/or equipment.
