EXECUTIVE SUMMARY The problem with money in politics is that large contributions—which only a fraction of the American public can afford to make—unduly influence who can run for office and who wins elections in the United States. Money is a critical factor in determining election outcomes. Without personal wealth or the ability to raise large sums of money from wealthy contributors, many aspiring candidates are locked out of the process. Those voters who wish to support views that are not supported by wealthy donors are left without an outlet. Nowhere is the influence of big money on elections more apparent than in the congressional primary elections throughout the United States. Our analysis of Federal Election Commission (FEC) campaign finance data for the 2002 election cycle indicates that money played a key role in determining election outcomes and that the majority of campaign contributions came from a small number of large donors (many of whom reside out-of-state). ► Money was a key determinant in election outcomes. According to FEC data, major party congressional candidates who raised the most money won 90% of their primary races in 2002. Winning candidates out-raised

their opponents by a margin of more than 4-to-1, with the winners raising an average of $464,000 and losers raising $99,000. ► The vast majority of campaign contributions came from a small number of large donors. FEC data indicate that while only 0.12% of voting age Americans made a contribution to a candidate of $500 or more, these large donations accounted for 91% of itemized individual contributions received by primary candidates. 73% of contributions came at or above the $1,000 level, while only 0.07% of voting age Americans made a $1000 contribution. ► Out-of-state donors exerted significant influence on primary election contests. 31% of itemized individual contributions to primary candidates came from out-of-state donors. Residents of Rhode Island, Montana, Delaware and New Hampshire, for example, were significantly outspent in their home states by a combination of residents from just a few wealthy states, including California, Florida, New Jersey, New York and Texas.

INTRODUCTION

nalyses of money in politics often focus on quid pro quo corruption in which a donor

literally buys access and influence with a decision maker. But looking only at influence-peddling masks a deeper impact of money on our political system. This report examines the influence of money on elections, rather than on politicians. Specifically, we search for lessons to be learned from the most recent federal contests. Some 2002 congressional primaries were hard-fought nail-biters featuring two incumbents pitted against one another by redistricting. Most were mundane and non-competitive affairs with the incumbent or anointed challenger facing little real opposition. However, the races did—with few exceptions—have one thing in common. The candidates who raised the most money won their races almost every time. The importance of money to winning campaigns has forced candidates to compete in a “wealth primary,” in which those who aspire to hold federal office must acquire large sums of money. This might not be noteworthy if candidates were raising their campaign money from average citizens. In this scenario, the amount of money someone can raise would be an approximate proxy for his or her level of support in the community. It would therefore follow that those with more grassroots support would win most elections. However, as our analysis demonstrates, this is far from the case. In fact, congressional candidates are raising a large portion of their funds from a small percentage of the population who are giving at levels that most citizens cannot afford. Because it is this set of large donors—and not the general public—that candidates need to please in the early stages of their campaigns, the interests and concerns of this distinct segment of Americans threaten to drown out those of average, non-wealthy citizens. In fact, a study funded by the Joyce Foundation has shown that the group of people who make large political contributions is not representative of the U.S. population at large. Large political donors are more likely to be white, male and

wealthy. Their interests—while not necessarily less valid—are likely to be different from their fellow citizens. This helps explain why many observers perceive public policy outcomes on issues ranging from environmental preservation to consumer protections to be out-of-step with public opinion. In the end, those who perform well in the “wealth primary” earn the right to compete for citizens’ votes in primary and general elections. Those who are not wealthy and fail to attract support from wealthy donors almost always lose their races—and often pack up and go home before the first vote is cast. This may leave many voters without candidates who represent their views and limit the pool of people who are willing and able to enter public service by running for office. Our study’s focus on the primaries—rather than general elections—is particularly important after the recent round of congressional redistricting. Due to the “gerrymandering” of congressional districts, the vast majority of seats in the House of Representatives are considered “safe” for one party.1 This means that the stiffest competition, especially for sitting members of Congress, is more likely to occur in the primaries. The role of money is often enhanced because voters cannot resort to party labels to sort out candidates. Pure exposure—which can be bought—is even more critical.

he 2002 congressional primaries confirm a strong trend in modern politics. Money is a

key determinant in who wins elections. Analysis of FEC data shows that 90% of primary candidates who raised the most money won their races. This held true across the board throughout the states—big and small, Northern and Southern, “liberal” and “conservative,”

“Democratic” and “Republican” (Table A). In addition, as Table B demonstrates, primary winners often outspent their opponents significantly. Winning candidates out-raised their opponents by a margin of more than 4-to-1, with the winners raising an average of $464,000 and losers raising $99,000.

U.S. PRIMARIES ARE PREDOMINANTLY FUNDED BY LARGE CONTRIBUTORS

he fact that the candidate who raises the most money almost always wins his or her

race might not be noteworthy if candidates were raising money from average citizens. In this scenario, the amount of money someone can raise would be an approximate proxy for his or her level of support in the community. It would therefore follow that those with more grassroots support would win most elections. In fact, this is far from the case. Most candidates for federal office depend upon the support of a relative handful of individuals who can afford to give substantially to their campaigns. According to an analysis of FEC data, fully 91% of itemized contributions from individuals to candidates were greater than or equal to $500. Contributions of $1,000 or more accounted for 73% of total itemized individual contributions.2 The general dependence of primary candidates on large donors holds true for every state (Table C).

Large Contributors Represent a Small Fraction of Voting Age Americans

Very few Americans make large political contributions. According to our analysis of FEC data, not more than 359,000 Americans made an itemized political contribution of $200 or more to a 2002 federal primary candidate.3 This amounts to 0.17% of the voting age population of the United States. This number dwindles 2 The current individual contribution limit is $1000 per election, or $2,000 per election cycle. This means that an individual may contribute $1,000 to a candidate’s primary campaign and then another $1,000 to the same candidate’s general election campaign. As noted in our methodology, we counted all contributions to candidates made up to the primary date for this report, including contributions of more than $1,000 from a single donor. By law, the candidate would only be allowed to spend $1,000 of each of these contributions on his or her primary race. Due to the recently passed Bipartisan Campaign Reform Act (BCRA), this limit will double to $2,000 per election, or $4,000 per election cycle, on November 6, 2002. 3 This number represents the number of contributions of $200 or more. Since many individuals contribute to more than one candidate, this overestimates the actual number of people making donations at this level—and therefore is a highly conservative estimate for our purposes.

considerably as we head up the scale. Not more than 253,000 people, or 0.12%, contributed $500 or more; just 0.07% of voting age Americans, or not more than 158,500 people, made a contribution of at least $1000 to a 2002 congressional primary candidate (Table D). If money is a key factor in determining election outcomes, a small number of Americans making the bulk of contributions enjoy disproportionate influence over who runs for office and who wins elections in the United States. These large donors are not representative of the larger population as a whole. According to a nationwide survey funded by the Joyce Foundation during the 1996 congressional elections, 95% of those who gave contributions of at least $200 were white; 80% were male; 50% were more than 60 years of age; and 81% had annual incomes greater than $100,000. This stood in stark contrast to the general population at the time, where 17% were non-white, 51% were women, 12.8% were over 60, and only 4.6% declared an income of more than $100,000 on their tax returns. The study also found that 65% of these donors were affiliated with a business organization. 4 Because this segment of society does not reflect the United States population as a whole, its interests may be distinct from those of society at large.

andidates in the 2002 congressional primaries raised a significant portion of their campaign

funds from contributors who do not reside in their home states. In effect, individuals who are not eligible to vote for local candidates are still able to wield influence over which ones raise the most money and win their primary or general elections. In the case of $1,000 donors, this influence may be quite significant. Analysis of FEC data indicates that 31% of itemized individual contributions to federal primary candidates came from outside of candidates’ home states (Table E).

Furthermore, residents from certain states tend to provide a disproportionate amount of support to candidates across state lines. As shown in Table F, residents of Rhode Island, Montana, Delaware and New Hampshire, for example, were significantly outspent in their home states by a combination of residents from just a few wealthy states, including California, Florida, New Jersey, New York and Texas.

CONCLUSION

ur analysis has shown that the candidate who spent the most money won his or her

2002 congressional primary an overwhelming majority of the time. Furthermore, a large portion of the money raised by primary candidates comes from a tiny fraction of the American public. This segment of society does not reflect the United States population as a whole, and its interests may be distinct from those of society at large. In the end, the disproportionate financial influence exerted by a small percentage of the American population has a profound impact on the democratic process in several ways. Because money is a key factor in determining election outcomes, candidates who are not wealthy themselves are forced to appeal to wealthy donors in order to compete effectively in election contests. Many qualified candidates who are unable or unwilling to raise funds from this segment of society struggle to mount viable campaigns for federal office. Many of these candidates drop out of races, lose in the primary, or make the rational decision not to run in the first place. In effect, this “wealth primary” system may serve to limit the diversity of public

service talent available for solving society’s most pressing problems. In addition, members of Congress may not be representative of—and often may not be representing—average, non-wealthy voters in their districts. Because of the important role large contributors play in financing campaigns, it is reasonable to conclude that legislators are accountable—at least in part—to the wealthy donors that determine their chances of re-election. As a result, public policy, on issues ranging from the environment to consumer protection, may disproportionately reflect the interests of the large contributors at the expense of the average citizen. Our research has shown that wealth plays an important role in American democracy, specifically by influencing who is elected to federal office. This, however, is not a given. It is the result of our particular campaign finance system. On the following page, we make several recommendations that will help engender a system that employs election contests that are won or lost based upon ideas, not money.

RECOMMENDATIONS

e must employ wholesale reform measures that will uphold the ideal of a

working representative democracy in America and provide ordinary citizens with an equal opportunity for political participation. A comprehensive campaign finance reform plan should include the following provisions: ► Lower contribution limits. Contribution limits for all candidates and all races should be set at a level that average Americans can afford. Given that only 0.07% of voting age Americans made a $1,000 contribution for the 2002 primary elections, Congress should dramatically lower contribution limits, not increase them as they did in the recently enacted Bipartisan Campaign Reform Act (BCRA).

► Limit campaign spending. Elections should be contests of ideas, not battles of dollars. The use of personal wealth in campaigns should be limited through spending caps so that no candidate has an unfair financial advantage. ► Provide free media for candidates. Free TV, radio, and mail should be provided to candidates. This would dramatically decrease the cost of campaigns and would provide an

opportunity for those who are not favored by wealthy donors to get their messages out. The American public owns our airwaves, which are supposed to be operated “in the public interest,” so this requirement would not impinge upon the rights of commercial broadcasters. ► Provide tax credits for small political contributions. Tax credits for small political contributions (up to $100) would encourage more small contributors to participate in the political process. This would increase the voice of average Americans, enable candidates to run campaigns geared towards non-wealthy citizens, and provide a counterweight to the big money flooding into the process from large donors. ► Require in-district fundraising. Candidates should be required to raise all or most of their funds from the constituents they seek to represent. This will make representatives more accountable to their constituents and reduce the influence of outside interests.

METHODOLOGY 1. Data Source. All data were downloaded from the Federal Election Commission (FEC) website (http://www.fec.gov/finance/ftpdet.htm) on October 2, 2002.

2. Data Parameters. The data analyzed cover the 1998, 2000 and 2002 election cycles, spanning January 1, 1997 through August 2002. For 2002 House candidates—those coded as being from a specific district in the FEC database—we included contribution data for the time period spanning 1/1/01 through the date of each candidate’s primary. Contribution data for Senate candidates—those coded as not from a specific district—is for the time period spanning 1/1/97 through the date of each candidate’s primary. Our analysis focuses on Democratic and Republican primaries, as fundraising may not play as large of a role in “third” party primaries. 3. Transaction Type. This analysis focuses on hard money, which includes individual and Political Action Committee (PAC) contributions. We excluded all soft money contributions from this analysis because soft money is not given directly to candidates, rarely plays a role in primary elections, and represents less than 20% of the money raised for federal elections.

4. Contributions Earmarked for the Primary or General Elections. The FEC database distinguishes between contributions made for primary and general elections. We did not make use of these distinctions because we often found them to be inaccurate. For example, contributions greater than $1,000 were often allocated to either primary or general elections. Given that the law only allows contributions of up to $1,000 per election, this is not possible. Instead, we decided to count all of the money raised by a candidate up to the date of the primary because we felt this would provide a more accurate reflection of actual candidate fundraising. There were therefore some instances in which more than $1,000 has been credited to a candidate as raised for his/her primary race. We decided to allow this because this report specifically focuses on money raised, not money spent. Even if a candidate is not allowed to spend all of his/her funds in a

particular race, the fact that this candidate has raised the money does impact the contest. It may scare off other candidates and affect the media’s perception of candidate viability. Furthermore, in order to ensure that analyzing money spent (versus money raised) would not significantly alter our results, we ran the numbers for primary victories based on money spent in a representative sample of states. We found that in 92% of the primary races, the candidate who spent the most money won his or her primary. The full results are displayed in Appendix C. 5. FEC Data Holes and Inconsistencies. In the course of our research, we identified several flaws in the FEC data that present challenges to accurate data analysis. ► Duplicate Names. The FEC individual contribution data files contain numerous duplicate names (one person who spells his/her name slightly differently contributing two $500 contributions to the same candidate or one person contributing $1,000 to numerous candidates). Therefore, our calculations actually reveal the number of contributions of a certain amount, not the number of people contributing this amount. We believe that this makes our figures conservative with respect to calculations of the percentage of voting age populations making large contributions (i.e. percentages of people giving large amounts will be higher than reality). ► Districts. The FEC candidate data file often listed the candidates as running in the wrong district. This error was due in many instances to redistricting. We made every effort to correct these errors. ► Missing Candidates. Several candidates who won their primaries are not listed as having a campaign committee in the FEC candidate data file. Refer to the end of Appendix A for a complete list of the missing candidates. ► Missing Campaign Committee Numbers. In some instances, FEC’s candidate database does not contain Principal Campaign Committee

identification numbers for certain candidates, including candidates who won their primaries. Because of the way FEC’s data is structured, we cannot analyze fundraising data without a Principal Campaign Committee identification number. As a result, candidates without these identifiers are listed as having raised $0. 6. 2002 Voting Age Population. 2002 Voting Age Population (VAP) statistics were downloaded from http://elections.gmu.edu. The numbers represent projections conducted by George Mason University Assistant Professor Michael McDonald using U.S. Census Bureau methodology. 7. Out-of-state Contributors. We defined “out-of-state contributors” as donors listing a home state that differs from the candidate receiving the contribution. 8. Louisiana. Louisiana’s primary is scheduled for November 5, 2002; therefore, we were unable to include the state in any analysis pertaining to primary winners. However, we did include Louisiana in analysis of overall fundraising as of the end of August 2002. 9. Determining Primary Winners. In order to determine the number of major party primaries in a given state, we took the number of districts, added one Senate seat, doubled this figure (for Democratic and Republican primaries) and then subtracted the number of times a primary was not applicable. This occurred when no Senator was up for re-election or when one of the major parties did not nominate a general election candidate for a House or Senate seat. There were some instances in which none of the candidates in a given primary were listed by the FEC as having raised any money; a few instances in which the winner was listed as having raised no money, but other candidates were listed as having raised money; and some in which the winner was simply not in the FEC database at all. Given that these situations are not credible, we subtracted these cases out of our sample to come up with the number of primaries in a state for which we had reliable data. We then counted the number of times we could be sure that the biggest fundraisers won their primaries. We determined primary winners by

consulting www.politics1.com. To calculate the percentage for each state, we divided this number by the number of primaries in the state for which we had reliable data. One further note is that J.C. Watts, Republican member of the House of Representatives from Oklahoma, raised the most money in his district, but is retiring and therefore did not compete in the primary. The next biggest fundraiser won that primary, so we counted that as the biggest fundraiser having won for our calculations. We did not adjust for this when calculating the average fundraising of winners and losers, so the "losers" number for Oklahoma will be slightly inflated.

In order to answer the question of whether money spent is a larger factor in determining election outcomes than money raised, we analyzed the campaign spending and primary election results from a sampling of states. As demonstrated below, the candidates who spent the most money won their primaries the vast majority of the time (92%), which is consistent with our findings for money raised.
