So what is the common denominator? Well, CASH, of course! These guys, who have witnessed the erosion of their income due to drastic changes in reimbursements, have accepted the paradigm shift and realized they had to offer services their patients might desire beyond the insurance model. Chiropractic Persecution?

We seem to be bombarded by relentless attacks on our beloved

profession. There’s insurance per-diems, cuts in reimbursements, unjustified visit limits, etc. On the regulatory side, here comes Medicare “Quality Payment Programs” like the Merit-based Incentive Payment System or “MIPS” and Advanced Alternative Payment Models or “APMs”. It’s not surprising that we feel overwhelmed and defeated. But, don’t be. This is not about Chiropractic…it’s a sign of the general shift in the economics of health care delivery. It’s happened before and it’s going to happen again, and we will survive! I have recently become aware of practice enhancements that three of my medical friends have incorporated. I have known these very successful Docs for many years and they all have enjoyed quite robust practices. The filing of a lawsuit is disturbing to any doctor. They are distracted by the allegations and worried about the outcome. pro-inflammatory background state has complex origins and is highly interrelated to diet, body composition, physical activity levels and other modifiable variables. Perhaps one of the most important and overlooked factors in a chronic pro-inflammatory state is chronic stress activation. The stress response is a series of changes in systemic activation to alter homeostasis to meet the demands of the current perceived situation. This shift in physiologic set points is termed “allostasis”. While the evolutionary origins of these set point shifts such as heart rate and blood glucose relate to the preparation for the management of danger, this system is equally responsive to psychosocial stress. While this ability to change physiologic set points is protective in situations of threat or danger, they become damaging when activated repeatedly or over long intervals in response to psychosocial stress. While the allostasis induced by brief and non-repetitive stress quickly shifts back to homeostasis, chronic stress exploits neuroplasticity, driving the alterations in physiologic response such as elevated blood pressure and activation of the sympathetic nervous system to become habitual, a situation termed “allostatic loading”. One of the often under-appreciated allostatic responses to stress is inflammatory activation. This is mediated by activation of the sympathetic nervous system which triggers release of epinephrine and norepinephrine from the adrenal medulla. One of the targets of these catacholamines is the spleen where they activate class switching in circulating lymphocytes to a pro-inflammatory cytokine producing state. A chronic state of high sympathetic activation (sympathetic dominance) associated with stress causes chronic activation of the pro-inflammatory cytokine profile even in the absence of other

stimulating factors such as infection or acute injury. In the past, suppression of inflam-matory pathways has been the mainstay of treatment for inflammation. More recently it has been appreciated that there should be a coordinated signaling of pro-inflammatory activity with activation of pro-resolving/anti-inflammatory pathways. Activation of these pro-resolving mechanisms may be more productive in symptomatic control as their activation causes co-inhibition of the sympathetic inflammatory pathway as well as activation of pro-resolving mechanisms. Both activation of the pro-resolving/anti-inflammatory pathway and the

inhibition of the sympathetic inflammatory pathway are dependent upon lymphocyte class switching in the spleen. The stimulus activating this pathway comes from the splenic plexus of the vagal nerve. Activation of the splenic plexus releases acetylcholine, which targets α7n acetylcholine receptors on circulating macrophages, causing them to produce and release a broad family of specialized pro-resoling mediators (SPMs) which are strongly anti-inflammatory and induce tissue healing. The tissue healing or trophic component of the SPM response is in contrast to direct inflammatory suppressing therapies such as corticosteroids and NSAIDs which are dystrophic and associated with tissue degeneration rather than healing. Much attention has been paid to the availability of fatty acids in white blood cell membranes regarding the potential to switch from a pro-inflammatory activation pattern to a pro-resolving/anti-inflammatory activation pattern. While this is important and cannot be overlooked, good omega-6:3 balance often fails to produce adequate clinical effect because of poor activation of WBC class switching in the spleen due to sympathetic dominance. As this knowledge has evolved, several innovative therapies

for activating the vagus

nerve have been explored to balance the autonomic dysfunction that chronic psychosocial stress induces driving the pro-inflammatory state. Interestingly, these therapies have also shown potential as non-drug methods of treating the secondary affect disorders such as anxiety and depression that often result from alterations in brain activation and neurotransmitter levels associated with chronic stress and autonomic activation. As 80% of vagal signaling is afferent these vagal therapies help to re-order the central neuroplastic change responsible for the sympathetic dominance. It has been known for some time that anxiety and depression are associated with chronic inflammatory activation and that the commonly used drugs to treat them such as SSRIs do so, at least in part, by suppressing inflammatory cytokine levels. It is likely that these effects are mediated indirectly through balancing of the autonomic activation and its relationship to pro-resolving/anti-inflammatory activation. Given these observations it is not surprising that vagal nerve activation therapy has been used successfully to treat refractory depression. There are many parts to the whole story of chronic inflammation. Failure to address each component of the complex processes sequentially involved in pro-resolving/anti-inflammatory response can result in a poor outcome. Chronic stress is a dominant component and one that is perhaps the most unappreciated by clinicians. Fortunately, effective non-drug therapies now exist. We will be discussing vagal balancing therapies in depth as well as several other components of autonomic and inflammatory/

pro-resolving systems at the fall UVCA convention.

The May 2016 insurance tip covered the importance of getting patients involved with their

insurance provider to help resolve issues pertaining to claims and/or benefit coverage. It included a “Patient Insurance Information” document designed to inform patients of your policy and procedures and to use as a guide in educating them on their involvement in the process. The terms “Summary Plan Description” and “plan fiduciaries” were referenced in the “Patient Insurance Information” document and are a very important part of the patient education process. The purpose of this Insurance Tip is to provide more detail around these two terms so patients are fully prepared before presenting their case to their insurance provider.

Summary Plan Description (SPD):The SPD is one of the most important documents employees are entitled to receive when participating in an employer self-insured ERISA plan. It tells participants what the plan provides and how it operates. The Plan Administrator is legally obligated to provide a copy of of the SPD free of charge to participants in the following circumstances: • When a new plan takes effect• When an employee becomes eligible to participate in a plan• Upon written request of a plan participant or beneficiary The SPD must clearly identify in easily understood language the following items:• A description or summary of the benefits• The plan name, sponsor and administrator• Funding mechanisms• Participation and qualification guidelines• Calculation methods for service and benefits• Benefit vesting schedules• Benefit payment procedures and timing• Claims submission process• Claims appeal process• Address for service of legal process• Circumstances that may result in ineligibility or denial of

benefits• A statement of participants’ ERISA rights and other technical

notices Large employers typically have self-insured plans that are administered by their Human Resources Department. Therefore, if the coverage is through a self-insured plan, the first step for the patient to take when there is a problem is to contact the company’s Human Resources Department. The procedures for an internal appeal are generally outlined in the patient’s employee handbook or can be obtained from the Human Resources Department. Normally this is a process that will result in a fair determination after the patient’s specific issue(s) are reviewed and compared to the policies, requirements and procedures outlined in the SPD. There may not be a formal Human Resources Department in smaller companies with self-insured plans, but generally there is an individual or internal committee who is charged with handlingthe responsibilities associated with the plan. Usually there are procedures for submitting an appeal or complaint, but if not, the patient should first discuss the issue with his/her supervisor. If the patient feels the dispute was not settled satisfactorily through the internal process, the next option is to contact the Department of Labor for assistance since self-insured plans are regulated by ERISA and the federal government has

exclusive jurisdiction over them. Unfortunately, this can be a slow process and sometimes takes a year or more to get a final determination. Since self-insured plans are regulated by ERISA, state regulatory agencies like the Bureau of Insurance WILL NOT be able to formally assist. The patient can contact

patient how to proceed with a complaint based on the terms of the contract between the employer and the insurance company who is administering the plan. The patient should find out who has fiduciary responsibility for the fully-insured plan – the employer or the insurance company.

Plan Fiduciaries:Most employers sponsoring self-insured group health plans exercise some discretionary authority and therefore are fiduciaries. In a fully insured plan, fiduciary status depends on whether the employer exercises discretion over the plan. A plan must have at least one fiduciary (a person or entity) named in the written plan, or through a process described in the plan, as having control over the plan’s operation. The employer, being a fiduciary, can also hire a service provider or providers to handle fiduciary functions, setting up the agreement so that the person or entity hired then assumes liability for those functions selected. However, the employer is required to monitor the service provider periodically to assure that it is handling the plan’s administration prudently. The employer is responsible for the selection of the service provider, generally an insurance company, but is NOT liable for the individual decisions made by the insurance company, such as hiring a third-party to administer the plan. An example is where XYZ company (employer) contracts with Anthem (insurance company) to manage their plan and Anthem hires ASHN (third-party administrator) to administer the plan. In this case, Anthem (insurance company) would have fiduciary responsibility for the plan and ASHN”s (third-party administrator) operating policies and procedures.

Monitoring a Service Provider:An employer should establish and follow a formal review process at reasonable intervals to decide if it wants to continue using the current service provider or look for a replacement. When monitoring service providers, actions to ensure they are performing the agreed-upon services include:• Reviewing the service providers’ performance• Reading any reports they provide• Checking actual fees charged• Asking about policies and practices (such as a TPA’s claims

processing systems)• Ensuring that plan records are properly maintained • Following up on participant complaints.

The Significance of being a Fiduciary:Fiduciaries have important responsibilities and are subject to standards of conduct because they act on behalf of participants in a group health plan and their beneficiaries. These responsibilities include: • Acting solely in the interest of plan participants and their

beneficiaries and with the exclusive purpose of providing benefits to them.

• Carrying out their duties prudently. • Following the plan documents (unless inconsistent with

ERISA). • Holding plan assets in trust. • Paying only reasonable plan expenses. The plan document serves as the foundation for plan operations. Employers should be familiar with their plan document,

especially when it is drawn up by a third-party service provider, and should periodically review the document to make sure it remains current.

Summary:The better prepared the patient is before filing a complaint with his/her employer or insurance provider, the greater the chance for a positive outcome. If the SPD is used in the preparation process, the patient will be fully informed about all aspects of the plan, including benefit coverage, the claims process and who has fiduciary responsibility. During preparation, the patient could discover that his/her interpretation of the benefit coverage is incorrect and decide not to pursue the complaint any further. On the other hand, he/she may discover a discrepancy between what is stated in the SPD and what he/she is being told by the employer’s Human Resources Department or the insurance company. If this turns out to be the case, then he/she will have already done the research and will be fully prepared to present his/her case to the administrator of the employer’s plan. If the patient has an individual plan, he/she should review the insurance policy (contract) thoroughly, just as reviewing the SPD for an employer plan. If the issue can’t be worked out with the claim representative, the patient should contact his/her insurance agent for another opinion. Since the patient is the plan beneficiary, he/she has the most influence when trying to resolve an issue, whether it’s with his/her employer or through the agent or claims representative forthe insurance company. For employer plans, the employer either has fiduciary responsibility for the plan or has a duty to monitor service providers for their performance, claim policies and practices, and participant complaints. If the patient feels this is not being done properly, his/her next option is to file a complaint with the Department of Labor. For individual plans, patients have the option of filing a complaint with the Virginia Bureau of Insurance if they feel their issue was not resolved satisfactorily. In the end, the matter will be resolved one way or the other and the patient will understand the outcome because of his/her involvement throughout the process, potentially minimizing any bad feelings toward you or your practice should he/she end up being responsible for the bill.

Dr. Jason Brown says, “I highly recommend it. The second edition was great but this 3rd edition is even better. It should be required reading for every chiropractor.”

2. The Six Pillars of Sports Recovery: A comprehensive guide on how to recover faster and outperform at the highest levels, 1st Edition by Ricky Rosa, DC. Dr. Louis Crivelli states, ““This is a great book that deals with a crucial part of athletic and physical performance, recovery. Many texts and resources deal with the training leading up to an athletic event, but seem to neglect the necessary steps one must take AFTER the event or workout in order to maintain peak performance. Dr. Rosa’s 6 pillars encompass the entire recovery process; he leaves nothing out. I especially liked his section on psychology. His references are excellent. I look forward to utilizing his concise method to help my patients, competitive athletes and “weekend warriors” alike, stay healthy and at their best. I would recommend this book to any physician or clinician interested in helping athletes as well as the athlete themselves.”

conversations with even larger companies at the national level. The newest addition to the SecureCare family is Blue Cross Blue Shield of Minnesota. On October 1, SecureCare will become the exclusive provider of chiropractic services for this Blues plan, with a positive impact on the lives of 1,600 chiropractors in Minnesota. On the East Coast, SecureCare is staying very busy working with a large group of payors. We began introducing SecureCare to our East Coast payors in August 2015. There are 31 companies that we were asked to approach regarding chiropractic network management. In less than a year we have met with 18 of them and we have meetings scheduled with 4 more. Several of them are working through the opportunity analysis process right now. The payors are quickly learning that our network management model is very unique and beneficial to all parties involved. I’m working on how to improve their form to reduce lower cervical disc irritations and overall cervical spine subluxations. Does anyone have any experience with this sport and any specific exercises I can add to my regime for them? I’ve been studying the game and watching videos of form clinics. Just wondered if anyone else has any insight.”

Responses Included:• “They are complicated biomechanics for sure. Use systematic assessments like SFMA to find

the cause. I know with the PGA golfers, we find trends of injuries but many causes. Common faults tend to involve some degree of limitation of TSP rotation and core stability; however, lead hip IR and trail arm ER (90/90) limitations can also easily influence compensation. A systematic assessment helps you identify what is the cause as well as whether to address immobility (JMD/TED) or motor control(SMCD).“

• “I use Athletic Body in Balance by Gray Cook as a patient tool for those who can work well with a book. I also tailor correctives for specific problems. The most recent was having the patient hold a theraband under tension against his right external shoulder rotators while performing swing form to correct humeral head impingement with fatigue during long play. You want to be certain that all required segments have the necessary range of motion and control throughout with resistance to fatigue. Always work with balance in transitioning position as they will tighten wierd muscles to compensate. Chronically tight calves and hamstrings seem to be most common.”
