A Around the HBANAHB Names Top 200 Builders: Builder Magazine, published by the National Association of Home Builders, recently published its annual list of the top 200 builders in the country. Several companies with operations in the Cincinnati area were included on the list. Those listed and their ranking include Ryan Homes (Reston, VA) - #4; M/I Homes (Columbus, OH) - #14; The Drees Co. (Ft. Mitchell, KY) - #28; Fischer Homes (Erlanger, KY) - #40; Arthur Rutenberg Homes (Clearwater, FL) - #121; and Hills Communities/ Inverness Homes (Cincinnati) - #166. D.R. Horton Homes (Ft. Worth, TX) which does not operate in the Cincinnati area was ranked #1.

Congratulations to T.J. Ackermann and Ralph Meierjohan, The Meijerjohn Group, and their CiTiRAMA® community, Witherby Meadows, for being recognized as the Cincinnati Community Development Corporation’s 2014 Developer of the Year. The community was singled-out during the May awards luncheon for introducing “visitability” into last year’s CiTiRAMA®. The HBA was also recognized by the Center for Independent Living Options at the 25th anniversary celebration of the Americans with Disabilities Act in July for promoting passage of the 2-year tax abatement in the City of Cincinnati for new homes that include visitability.

Barry Keidel RetiresBarry Keidel, who spent 44 years with Keidel Supply, Cincinnati’s largest local plumbing supplier and wholesale distributor, retired on July 2. He joined the company shortly after graduating from the University of Cincinnati and took over as president following his father in the early

1990s. Under Barry’s leadership, the company grew from a neighborhood supply shop to a large showroom and distribution center. Keidel Supply currently has three Ohio locations. In 2009, Keidel hired Mike Barton as CEO.

Proposed Amendments to HBA BylawsThe Board of Directors approved several revisions to the HBA bylaws at their monthly meeting in May. There are basically eight series of revisions. Builder members will be requested to approve these amendments at the fall membership meeting scheduled Thursday, Oct. 22, 6 pm, at Four Bridges Country Club. Copies of the document, with the highlighted amendments can be obtained at CincyBuilders.com/builder-documents. Questions: Dan Dressman, [email protected].

1. Merges the Constitution into the By-Laws. There will no longer be separate documents. All provisions in the current Constitution are included in the text of the revised By-Laws. Pages: 2-5, 6-7

2. Changes the classification of builders from “Active” to “Builder.” Makes consistent with the NAHB classifications. Page 5

3. Changes the definition of Builder (Active), Associate and Affiliate members to make consistent with NAHB definitions. Pages 5-6

4. Clarifies that the member is an individual and not a business entity. Makes compliant with Section 501(c)(6) of the Internal Revenue Code (the HBA’s tax exempt status). Page 5

5. Moves the provisions concerning disciplinary action from the Election of Member section to the Code of Ethics. From Page 8 to Page 7

6. Makes meeting notice provisions uniform throughout document. Pages 8, 9, 11,12

7. Moves quorum provisions from Code of Ethics to Voting section. From Page 3 to Page 9

8. Allows for electronic and regular mail balloting for votes on director elections and member-wide issues. Page 9

The Sales and Marketing Council once again raised nearly $5,000 through the HBA Charitable Foundation for People Working Cooperatively to modify a disabled veteran’s home to make it more accessible for him at this year’s Dancing with the HBA. 10 Code Proposals with Big Price TagsThere are dozens of proposals to change the next edition of the International Code Council’s model codes that have a particularly big impact on home building practices and on builders’ bottom lines.

Here are 10 examples — and 10 reasons to talk to your code officials who will vote on these proposals at the ICC Public Comment Hearings or online during the Governmental Consensus Voting Period this fall.

G226-15 – Fire Prevention Superintendent: This proposal would require a fire prevention superintendent from an approved agency to be present 24/7 during construction of all Type V buildings.

If this is approved, add another independent third-party inspector to your budget. Requested Final Action: Disapprove

G230-15 – Sprinklers during Construction: This proposal would require the fire sprinkler system be completed, tested and approved before construction can continue above 40 feet in height for all buildings of Type III, IV and V construction.

This is an impractical and onerous requirement that will add significant cost and drastically change the order in which utilities are brought to the site. Requested Final Action: Disapprove

G162-15 – Horizontal Separation: This proposal would require a 50-foot separation distance from Type V buildings (with light-frame wood construction) above a horizontal separation to lot lines or adjoining buildings on the same lot.

The result: Low-rise multifamily and mixed-use buildings consisting of several floors of wood framing over top of a concrete or steel “podium” and constructed using the International Building Code would have to be built at least 100 feet apart from each other, not very plausible for infill developments in urban and close suburban neighborhoods. Requested Final Action: Disapprove

G128-15 – High-Risk Areas: This proposal limits the height, area and number of stories of in buildings with automatic fire sprinklers located in high-seismic, flood hazard or hurricane-prone regions, to the same limits as unsprinklered buildings.

The proposal (and several similar proposals) claims to promote resilient construction, but is not based on sound science, nor does it reflect a broad consensus of stakeholders. Where adopted, followed and enforced, the International Building Code does an excellent job of providing strong, resilient buildings.

FS176-15 – Foam Plastic Insulation: Exterior Walls: This proposal adds a new section that requires a thermal barrier to be installed on exterior side of foam plastics 1/2-inch thick or greater used in exterior walls.

Another layer of gypsum or other material not only adds more costs, but it means a lot of significant design changes from the width of a window sill to the size of the doorjamb. Requested Final Action: Disapprove

S10-15 – Special Inspections – This proposal would require special inspections for firestops, fire-resistant joint systems and perimeter fire barrier systems on all buildings over two stories.

Building inspectors already do these inspections as part of their regular duties. Paying for an additional inspection just costs more money without ensuring additional safety. Requested Final Action: Disapprove

EB13-15 & EB34-15 – Accessibility: These proposals would allow changes to existing buildings to comply with the 2009 edition of ICC A117.1 instead of the upcoming edition, which includes such changes as increasing the turning diameter from 60 inches to 67 inches and the clear floor space from 30 x 48 inches to 30 x 52 inches.

This is the first time that the A117.1 standard has deviated from the original federal accessibility regulations, and therefore the issue needs to be addressed in the case of existing buildings. The concept of allowing existing buildings to conform to past accessibility requirements is not new: It has already been established in the Fair Housing Act, and it is logical that the building code follows suit. Requested Final Action: Approve as Submitted

M85-15 – Flexible Duct Length: This code change proposal limits flexible duct lengths to a 5-foot maximum.

The proposed limit will impact the ability to install flexible ducts in attics and in locations poorly suited for rigid ductwork. The change will also increase the cost of

typical installations. Requested Final Action: Disapprove

P101-15 Part I and II – Size of water service pipe: This proposal will increase the minimum size of water service piping from ¾ inch to 1 inch in diameter for both the International Plumbing Code and the International Residential Code.

This is a solution looking for a problem that doesn’t exist. Modern fixtures have decreased water consumption, lowering peak demand in older homes. If sprinklers are required, they frequently have a separate tap and need to be properly sized based on the application, not an arbitrary diameter. The additional fee for the larger connection varies by jurisdiction, in some cases the cost increase can be in excess of $2,000. Requested Final Action: Disapprove

RM32-15 –Return air plenums: This proposal would remove the ability to use a stud wall or floor joists cavity for return air plenums.

This would prevent a traditional and effective construction practice without any data to support the change. Currently there is no requirement to have any return ducting. The existing code allows for panned return air plenum that provide a more effective path back to the air handler than no return. No reason to change the code. Requested Final Action: Disapprove

New Closing Rules Take Effect October 1The Consumer Financial Protection Bureau (CFPB) announced that new mortgage lending rules scheduled to take effect on Aug. 1 will be delayed until Oct. 1.

On Oct. 1, the CFPB will institute new rules regarding disclosures under the Truth in Lending Act and Real Estate Settlement Procedures Act that will affect all home builders, particularly those with a real estate lending arm.

Under the new procedures as a result of the Dodd Frank Act, four documents will be merged into two. The Good Faith Estimate and Truth in Lending disclosures will be eliminated and combined into a new single Loan Estimate form, or “LE.”

In addition, the final Truth in Lending Disclosure and HUD-1 Settlement Statement are being replaced by the Closing Disclosure, or “CD.”

What Do These Changes Mean?

Under the new rule, the biggest change is that the Closing Disclosure must be provided to the consumer a full three days prior to the closing, and if there are changes during that 72-hour period, the closing could be delayed.

Currently, the HUD-1 Settlement Statement can be presented to the buyer on the day of closing and any changes to the statement can take

place during the loan closing.

In addition, the Loan Estimate must be delivered to the prospective buyer no later than three business days after receiving the application.

Changes Aimed at Helping Consumers

These new rules are intended to streamline the loan application process and make it easier for consumers to understand by clearly spelling out the most relevant details all on one page – the interest rate of the mortgage loan, the amount of the monthly payments and a listing of all the closing costs.

For consumers applying for adjustable rate mortgages, the documents will explain how their interest rate and future monthly payments could change based on certain factors.

During the rulemaking process, NAHB was actively involved by submitting comment letters, both individually and with coalition partners, urging the CFPB to ensure that any changes that would make it easier for consumers to understand and comply with the settlement process would not place any undue burdens on builders, lenders and other housing professionals.

EPA Issues Final Waters of the U.S. Rule The Waters of the U.S. Rule was published on June 29, 2015 and will be effective on August 28th.

The rule, which will go into effect by mid-August, establishes a broad definition of tributaries which, for the first time, includes ditches. It will also allow federal agencies to regulate adjacent non-wetlands located more than a quarter-mile from a traditional navigable water and isolated ponds located within the 100-year floodplain.

The U.S. Supreme Court has twice affirmed that the Clean Water Act places limits on federal authority and that the rule permits the federal government to supplant the role of the states in regulating intrastate waters.

The House recently passed legislation that would force the EPA and the Corps to withdraw this rule and develop a new plan after the agencies go back and consult with state and

Build-PACThe 2015 Build-PAC fundraising campaign is in full gear. The goal is to raise $20,000 in 2015 to contribute to local and state candidates who are pro-housing and pro-small business.

The government at the local, state and federal government is involved in

every aspect of your business. Too often, the government acts as a business prevention department, keeping you from doing what is best for your clients, customers, employees and other stakeholders. This impact involves every type of business—builders, developers, planners, engineers, distributors, suppliers, vendors, contractors, manufacturers, etc. Every regulation adds costs to a business and ultimately to the homebuyer, the end consumer.

local governments, conduct discussions with small business stakeholders as mandated under the Regulatory Flexibility Act, and produce an accurate cost-benefit analysis. Companion legislation, S. 1140, the Federal Water Quality Protection Act, is pending in the Senate. The NAHB testified in favor of the legislation.

OSHA Seeks to Protect Construction Workers in Confined SpacesConfined spaces are work areas that are not designed for continuous occupancy and may be difficult to exit in the event of an emergency. In home building, some of these may include manholes, sewer systems, crawlspaces and attics.

On May 4, OSHA issued a final rule covering workers who enter confined spaces in construction.

In general, the new rule requires employers to:

• Evaluate the jobsite to identify confined spaces

• Develop a written program and permitting system for permit-required confined spaces

• Control physical hazards and conduct monitoring for atmospheric hazards in confined spaces that are permit required

• Provide training for confined space entrants, attendants, supervisors and emergency duties.

In addition, home builders who hire trade contractors (i.e., subcontractors) to do work in a confined space may also have responsibilities under the new standard.

Builders, or controlling contractors as OSHA labels them, must discuss permit required confined spaces on the site and their hazards with employers who must enter permit required spaces, as well as each other before and after entering the space.

cacy NAHB Summer Meeting – Capitol Hill Visits

Prior to the NAHB Summer Meeting in Washington, D.C., Ray & Jill Neverovich, Dan Dressman and Steve Feldmann met Speaker John Boehner and Senator Sherrod Brown. They were joined by Stuart Cowan for meetings with Congressmen Steve Chabot and Brad Wenstrup. (see photos). The group discussed several federal issues, including environmental regulations, GSE reform (Fannie Mae and Freddie Mac), labor shortages, and tax reform.

Partners for Progress Candidates ForumThe 2015 Southwest Ohio Candidates’ Forum has been rescheduled for September 10th at Cooper Creek from 6:00-7:30pm. The focus is on local candidates running in 2015 (township trustees and clerks, city council members and mayors, school board members, judges). The forum is a good opportunity for our members to meet and hear from candidates for local offices. The Partners for Progress coalition is composed of the HBA of Greater Cincinnati, the Cincinnati Area Board of Realtors, the Greater Cincinnati/Northern Kentucky Apartment Association, the Associated Builders & Contractors of the Miami Valley, and the Mortgage Bankers Association of Greater Cincinnati.

Statehouse UpdateHB77 (Contractor Registration)The House Commerce & Labor Committee is expected to take up a revised version of the contractor registration legislation. HBAGC continues to work with the local delegation in opposition to the legislation. There isn’t a timetable on when the new version will be introduced.

Type II Annexation The HBA is part of a group working to see if there is legislation that all interested parties can agree on so that a bill can move forward. There isn’t a timetable on when legislation will be introduced.

BudgetThe State approves a budget every two years. The Ohio legislature recently approved the budget for the cycle covering July 1, 2015 through June 30, 2017.

There are a few highlights. • 6.3% across-the-board income tax cut.• 3% tax rate for business income over $250,000.• Phase-in over two years of a 100% deduction for the first $250,000 of business income. It will go from current 50% deduction to 75% deduction in 2016 and then 100% deduction in 2017.• The proposal to raise the commercial activity tax and sales tax were not part of the final bill.

OVDC UpdateSoil & Water Conservation District Committee met with Clermont County Soil & Water Conservation District Board and staff.

OVDC seeking input from members operating in the City of Cincinnati regarding the use of Interim Development Overlay Districts. These districts are being discussed by the City in relation to tear-down/ sub-divide projects in Hyde Park and Mt. Lookout.

Craig Abercrombie will serve as the OVDC representative on the Hamilton County Thoroughfare Plan Update Committee, which will soon begin work.

OVDC reviewed proposed amendments to the Hamilton County Rules & Regulations for Plats and Subdivisions of Land. Amendments are primarily process oriented.

OVDC’s Summer Membership Meeting was held on July 7th. Darin Hall from the Hamilton County Land Reutilization Corporation and Mike McNamara from the Butler County Land Reutilization Corporation discussed the land banks in their respective counties and how these tools can be used to encourage residential development.

OVDC’s Butler & Hamilton County Engineering Standards Committee met with the Butler County Engineer’s Office and Planning Commission staff concerning a new proposed fee on developers who cannot obtain a subordination agreement with gas companies who have a gas transmission line easement in a new subdivision. The fee would provide funds for the County if they would have to repair a public improvement because of pipeline repairs undertaken by

the gas companies. The subordination agreement was historically used and required the gas company to make the public improvement repairs. Gas companies are starting to refuse to enter into these agreements. The committee is attempting to work out an alternative.

Other Local UpdatesStuart Cowan will participate in a focus group being conducted by the Warren County Regional Planning Commission to answer the question – “what are the things in our community that contribute to the health and well-being of the people who live and work here.” This focus group is part of the effort by the Warren County Combined Health District and Warren County Community Partners to develop an updated comprehensive health assessment.

A group of builders are working with Liberty Township on a new regulation for cold weather driveway installation. Currently, Liberty Township wants a driveway installed irrespective of whether the weather is conducive to a quality installation. The builders are working on a compromise to ensure that the driveway is timely installed and that the builder can install a quality driveway.

Billing To Begin This SummerEmployers in Ohio should have received by now a Notice of Estimated Premium from the Ohio Bureau

of Workers’ Compensation (BWC). This notice is part of BWC’s move toward a new, prospective billing system for workers’ compensation premium. Beginning in August, Ohio employers will begin to pay workers’ compensation premium for a coverage period in the future rather than in arrears. The BWC Notice of Estimated Premium mailed last month advises employers what their annual premium will be for the 2015 policy year period (July 2015 through June 2016) and the payroll used to calculate that premium.

As BWC transitions to this new payment model, employers will follow a bi-monthly payment schedule. Under this payment plan, the first prospective premium payment will be due by August 31, 2015 and will apply to coverage in September and October. Subsequent premium payment deadlines are:

• November 2, 2015 (November/December coverage)• December 31, 2015 (January/February coverage)• March 2, 2016 (March/April coverage)• May 2, 2016 (May/June coverage)

If employers prefer a different payment plan (monthly, quarterly or semi-annually), they will need to notify BWC by July 15, 2015. In addition, if there have been significant changes to employers’ operations that have impacted payroll, employers may want to communicate those changes to BWC to determine a more accurate premium.

One final important reminder is that BWC will also mail a payroll report for the January 2015 through June 2015 coverage period by early July. Employers will need to report payroll for this period, but do NOT need to pay premium. BWC will provide a credit for this premium to prevent a double payment as they transition to the new model. In addition, BWC will provide a credit for the first two months of premium in the 2015 policy year (July and August).

it DataNew Home Permits Quicken Pace for Summer SalesCINCINNATI – The pace of new home permits has increased in anticipation of a hot summer market. Permits were up 9.3% overall for the first five months of the year, compared to the same period in 2014, reports the Home Builders Association of Greater Cincinnati (HBA).

A total of 867 single-family permits were issued in Butler, Clermont, Hamilton and Warren counties from January through May, compared to 802 during the same timeframe last year. Attached permits (condos and apartments) increased too, jumping from 60 to 75 units (a 25% increase).

Warren County led in the single-family permit category with 349 permits (a 18.3% increase), followed by Butler County with 230 permits (a 7.8% decrease); Hamilton County with 187 permits (a 26.4% increase); and Clermont County with 119 permits (a 7.8% decrease). Single-family permits were up 8.1% overall from January through May.

Liberty Township continues to lead all areas in the region with a total of 95 new single-family permits issued through May; Hamilton Township ranked #2 with 88 permits; #3 was Clearcreek Township with 57 permits; #4 was the City of Mason with 56 permits; #5 was the City of Cincinnati with 51 permits; #6 was City of Springboro with 40 permits; #7 was Batavia Township with 39 permits; #8 was Turtle Creek Township with 31 permits; #9 was West Chester Township

with 30 permits; and #10 was Fairfield Township with 24 permits.

“This is a very good indication that the new home market during the summer months will be robust.” said Dan Dressman, HBA Executive Director. “Employment has picked up, mortgage rates are still low, existing housing inventory is down, and optimism is returning in many areas of the region,” he added.
