Vary the Approval of Category B Containers I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Vary the Approval of Category B Containers Approve as Category B Containers, subject to the Conditions 1-4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; (d) the name of the holders of these approvals. (1) That containers of the class to which the approval relates must bear the refund marking specified

by the Authority for containers of that class. The Authority specifies the following refund markings for Category B containers:

(a) ‘10c refund at collection depots when sold in SA’; or (b) ‘10c refund at SA/NT collection depots in State/Territory of Purchase’. (2) The holder of the approval must have in place an effective and appropriate waste management

arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

the Environment Protection Authority, provide the Environment Protection Authority with a written report on diagnostic radiography authorised by her/him during a period specified by the Environment Protection Authority. The report must contain statistics of diagnostic radiography authorised and details of any radiation safety issues associated with the examinations during the specified period.

(4) The exemption shall take effect commencing on the date of publication of this Notice in the Government Gazette.

1—Short title This proclamation may be cited as the National Energy Retail Law (South Australia) (Implementation) Amendment Act (Commencement) Proclamation 2013.

2—Commencement of Part 2 and suspension of certain provisions (1) Subject to subclause (2), Part 2 of the National Energy Retail Law (South Australia)

(Implementation) Amendment Act 2012 (No 16 of 2012) (the Amendment Act) will come into operation on 1 February 2013.

(2) The operation of the following provisions of the National Energy Retail Law (South Australia) Act 2011, inserted into that Act by section 4 of the Amendment Act, is suspended until a day or time or days or times to be fixed by subsequent proclamation or proclamations:

(a) section 18;

(b) section 21;

(c) section 28(2)(a);

Electricity (Standing Contracts) (Revocation) Proclamation 2013 under section 36AA of the Electricity Act 1996

Preamble 1 On 12 September 2002 section 36AA of the Electricity Act 1996 was declared by proclamation to

Preamble 1 By proclamation made pursuant to the Mining Act 1971 on 3 March 1988 (Gazette 3.3.1988 p512)

certain land in the Mintabie area (Road Reserve) was reserved from the operation of Parts 4, 5, 6, 6A, 7 and 8 of the Act.

1—Short title These regulations may be cited as the National Energy Retail Law (Local Provisions) Regulations 2013.

2—Commencement These regulations will come into operation on 1 February 2013.

3—Interpretation In these regulations—

the Act means the National Energy Retail Law (South Australia) Act 2011.

4—Application of law—electricity (section 16(b) of Act) For the purposes of paragraph (b) of section 16 of the Act, the National Energy Retail Law (South Australia) will not apply in relation to the area of the State constituted by the township of Cockburn.

5—Consumption thresholds (section 17 of Act) (1) Pursuant to section 17(1)(a) of the Act, this regulation determines the upper consumption

threshold for determining whether business customers are small or large customers in relation to the consumption of electricity.

(2) The upper consumption threshold for electricity is 160 MWh per annum.

31 January 2013] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 172 6—Local area retailers (1) Pursuant to section 11 of the National Energy Retail Law (South Australia), the following

retailers are nominated as local area retailers for this jurisdiction for the purposes of that Law:

(a) in relation to the provision of electricity—AGL South Australia Pty Limited (ACN 091 105 092);

(b) in relation to the provision of gas—Origin Energy Retail Ltd (ACN 078 868 425).

(2) A retailer nominated under subregulation (1)—

(a) will be the local area retailer for all small customers within the whole of the geographical area of this jurisdiction (subject to the operation of regulation 4); and

(b) will be responsible for both existing and new connections (in the manner and to the extent contemplated by section 22 of the National Energy Retail Law (South Australia)).

7—Minimum standards of service for customers—written and telephone enquiries (1) Pursuant to section 23 of the Act, this regulation imposes minimum standards of service for

small customers in relation to written and telephone enquiries.

(2) A retailer must—

(a) use the retailer's best endeavours to achieve any service standard referred to below during each financial year, as assessed at 30 June; and

(b) keep sufficient records to monitor and report on the retailer's performance levels and provide any information referred to below.

(3) The applicable service standard under this regulation for written enquiries is as follows:

COMMITMENT STANDARD

Responding to written enquiries 95% of enquiries within 5 business days

(4) For the purposes of subregulation (3)— (a) a written enquiry will be taken to be an enquiry by email, fax or letter from a small

customer to the retailer requesting information from the retailer or making a complaint about an act or omission of the retailer; and

(b) a response to such an enquiry will include any direct or telephone contact, or a written response, in which the retailer answers the enquiry or acknowledges receipt of the enquiry and indicates the process that will be followed in dealing with the enquiry, including the time within which the retailer will deal with the enquiry.

(5) The applicable service standard under this regulation for telephone enquiries is as follows:

COMMITMENT STANDARD

Responding to telephone enquiries 85% of telephone calls within 30 seconds of receipt of the call between 8 a.m. and 6 p.m. on a business day

(6) For the purposes of subregulation (5), a response to a telephone enquiry must be—

(a) by a person answering the telephone call; or

(b) by the provision of a computer or telephony based interactive service which is able to process calls by providing information or directing a call to a person,

wait for a response under paragraph (a) or (b).

(7) A retailer must report to the AER by 31 August in each year in relation to the service standards achieved by the retailer during the immediately preceding financial year (or part of a financial year).

(8) A report under subregulation (7) must include—

(a) the percentage of compliance with the service standards set out above;

(b) an explanation of the reason or reasons for any non-compliance with a service standard; and

(c) a report on how the retailer intends to improve the retailer's performance so as to meet the service standard set out above.

8—Extreme weather events For the purposes of Part 6 of the National Energy Retail Rules, any day where the forecast for the Adelaide Metropolitan area issued by the Bureau of Meteorology at 4 p.m. CST indicates that the following day is the third day in a sequence of 3 days (which may occur on a rolling basis) where the average of the minimum and maximum temperature for each day equals or exceeds 28° Celsius is declared to be an extreme weather event.

9—Re-energisation after de-energisation for non-payment (1) This regulation applies in relation to the re-energisation of premises of a small customer after

there has been a de-energisation for—

(a) failing to pay a bill by the pay-by date; or

(b) failing to make a payment in accordance with a payment plan; or

(c) failing to pay an instalment due under an instalment arrangement; or

(d) failing to pay a security deposit.

(2) The following standards apply in relation to the provision of electricity:

(a) where a retailer is required to arrange for the re-energisation of a small customer's premises in accordance with the National Energy Retail Rules and the customer makes a request for re-energisation before 4 p.m. on a business day, the retailer must—

(i) in the case of premises in the Adelaide central or metropolitan areas—arrange for the re-energisation of the premises on the day of the request; and

(ii) in the case of any other premises—use the retailer's best endeavours to arrange for the re-energisation of the premises on the day of the request and in any event ensure that arrangements are in place by the end of the next business day for the re-energisation of the premises;

(b) where a retailer is required to arrange for the re-energisation of a small customer's premises in accordance with the National Energy Retail Rules and the customer makes a request for re-energisation at or after 4 p.m. and before 9 p.m. on a business day—

31 January 2013] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 174 (i) if the premises are in the Adelaide central or metropolitan areas and the

customer pays any reasonable charge determined by the retailer or the distributor for after-hours re-energisation—arrange for the re-energisation of the premises on the day requested by the customer; and

(ii) if the premises are not in the Adelaide central or metropolitan areas, it is reasonably practicable for the retailer to arrange for re-energisation of the premises on the day requested by the customer, and the customer pays any reasonable charge determined by the retailer or the distributor for after-hours re-energisation—arrange for the re-energisation of the premises on the day requested by the customer; and

(iii) if the premises are not in the Adelaide central or metropolitan areas and subparagraph (ii) does not apply—arrange for the re-energisation of the premises by the end of the next business day (and any after-hours connection fee will not apply);

(c) where a retailer is required to arrange for the re-energisation of a small customer's premises under the National Energy Retail Rules and the customer makes a request for re-energisation at or after 9 p.m. on a business day, the retailer must arrange for the re-energisation of the premises by the end of the next business day.

(3) The following standards apply in relation to the provision of gas:

(a) where a retailer is required to arrange for the re-energisation of a small customer's premises in accordance with the National Energy Retail Rules and the customer makes a request for re-energisation before 3 p.m. on a business day, the retailer must arrange for the re-energisation on the day of the request;

(b) where a retailer is required to arrange for the re-energisation of a small customer's premises in accordance with the National Energy Retail Rules and the customer makes a request for re-energisation at or after 3 p.m. and before 9 p.m. on a business day—

(i) if the customer pays any reasonable charge determined by the retailer or the distributor for after-hours re-energisation—the retailer must arrange for the re-energisation of the premises on the day requested by the customer; or

(ii) in any other case—the retailer must arrange for the re-energisation of the premises by the end of the next business day;

(c) where a retailer is required to arrange for the re-energisation of a small customer's premises under the National Energy Retail Rules and the customer makes a request for re-energisation at or after 9 p.m. on a business day, the retailer must arrange for the re-energisation of the premises by the end of the next business day.

(4) For the purposes of this regulation, but subject to subregulation (5), the Adelaide central or metropolitan areas will be constituted by areas determined by the Minister from time to time by notice published in the Gazette.

(5) Any area where a small customer is supplied with electricity through a 19 kV SWER line will be taken to be outside the Adelaide central and metropolitan areas.

31 January 2013] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 175 10—Immunity in relation to failure to supply electricity (section 25(2)(a) of Act) (1) For the purposes of section 25(2)(a) of the Act, an agreement under section 25(1) of the Act

that limits the liability of a distributor of electricity for an act or omission associated with a failure to supply electricity done or made in bad faith or through negligence must comply with the following requirements: (a) in the case of a small customer who purchases less than 30 MWh of electricity per

annum—the agreement— (i) must provide for liability for any loss suffered, including physical loss,

consequential loss and loss of profits, due to— (A) problems in the quality of the supply of electricity to the premises

at which electricity is to be supplied (such as power surges and power drops); or

(B) interruptions to or failures of the supply of electricity to the premises at which electricity is to be supplied; and

(ii) must not set the amount for limitation of liability to less than $500 000 (indexed) in relation to an event;

(b) In the case of a small customer who purchases at least 30 MWh of electricity per annum—the agreement— (i) must provide for liability for any physical loss or damage, and for personal

injury (but no other loss), due to— (A) problems in the quality of the supply of electricity to the premises

at which electricity is to be supplied (such as power surges and power drops); or

(B) interruptions to or failures of the supply of electricity to the premises at which electricity is to be supplied; and

(ii) must not set the amount for limitation of liability to less than $1 000 000 (indexed) in relation to an event.

(2) An amount under subregulation (1) that is expressed to be indexed will be adjusted on 1 July of each financial year commencing after this regulation comes into operation by multiplying the stated amount by a proportion obtained by dividing the Consumer Price Index (All Groups Index for Adelaide) for the March quarter of the calendar year in which the relevant financial year commences by the Consumer Price Index (All Groups Index for Adelaide) for the March quarter 2003.

(3) A distributor must not enter into any other agreement with a small customer—

(a) that seeks to vary or exclude a distributor's liability for an act or omission associated with a failure to supply energy done or made in bad faith or through negligence; or

(b) that seeks to set a lower monetary amount in connection with such a liability that is less than an amount that applies under subregulation (1).

(4) Rule 83 of the National Energy Retail Rules (insofar as those Rules apply as part of the law of South Australia) is modified to the extent of any inconsistency with section 25 of the Act or a provision of this regulation.

(5) The National Energy Retail Rules (insofar as they apply as part of the law of South Australia) are also modified as if they provided that an agreement that complies with this regulation may constitute a permitted alteration under section 69(4)(c) of the National Energy Retail Law (South Australia).

Electricity Law (South Australia).

11—Use of prepayment meter systems For the purposes of section 56(2) of the National Energy Retail Law (South Australia), the sale of energy to small customers using a prepayment meter system is permitted within this jurisdiction.

12—Price comparator It is declared that section 62 of the National Energy Retail Law (South Australia) applies in relation to this jurisdiction on and after 1 February 2013.

13—Gas RoLR procedures If a gas RoLR event occurs before 1 January 2014, the distributor, AEMO and the designated RoLR must use reasonable endeavours to deliver information or data within the periods required by the Retail Market Procedures (South Australia).

14—Variation of National Energy Retail Rules The National Energy Retail Rules, insofar as they have effect as part of the law of South Australia, apply as though the following amendments were made to those Rules:

(a) Rule 16(2)(b)—strike out ", unless the customer is a small market offer customer";

(b) Rule 90—after subrule (3) insert:

(4) A distributor of electricity is not required to comply with this rule if the duration of the interruption is less than 15 minutes.

(5) Subrule (4) will expire on 30 June 2015.

(c) Schedule 2, clause 8—after paragraph (c) insert:

(d) We are also entitled to limit our liability for an act or omission done or made in bad faith or through negligence to $500 000 (indexed) in respect of claims by customers who purchase less than 30 MWh of electricity per annum or to $1 000 000 (indexed) in respect of customers who purchase at least 30 MWh of electricity per annum.

(d) Schedule 2, clause 10.2—after paragraph (b) insert:

(c) We are not required to give you notice if the planned interruption is less than 15 minutes.

15—Variation of National Gas Rules (transitional arrangements) The National Gas Rules, insofar as they have effect as part of the law of South Australia, are modified so that Part 21 of those Rules does not apply in relation to any distributor or retailer in South Australia until 1 July 2013.

16—Standing offers (transitional arrangements) (1) A request made to AGL South Australia Pty Limited (ACN 091 105 092) ("AGL") under

section 36AA of the Electricity Act 1996 before 1 February 2013 that, immediately before that day, is yet to be subject to a contract between AGL and the relevant customer under that Act will be taken to be a request for an offer under section 22 of the National Energy Retail Law (South Australia).

These regulations may be cited as the Electricity (General) Variation Regulations 2013.

Part 2—Variation of Electricity (General) Regulations 2012 4—Variation of regulation 12—Functions and powers of Commission (1) Regulation 12—after paragraph (b) insert:

(c) on or before 31 August in each year, to submit to the Minister and publish on its website a report prepared for the purposes of monitoring prices for the sale of electricity available to a small customer under the National Energy Retail Law (South Australia) during the immediately preceding financial year containing the information required by the Minister under subregulation (2).

(2) Regulation 12—after it present contents as varied by this regulation (now to be designated as subregulation (1)) insert:

(2) The Minister may require the following information for the year to which the report relates to be included in a report prepared under subregulation (1)(c):

(a) comparisons of standing offer prices of NERL retailers generally available to classes of small customers in South Australia;

(b) estimates relating to the annual cost to a small customer of electricity supplied to the customer (based on a reasonable estimate of the average annual level of consumption of electricity by a small customer in South Australia) under each standard retail contract of NERL retailers generally available to classes of small customers in South Australia;

(c) details relating to the difference in annual cost to a small customer of electricity supplied to the customer (based on a reasonable estimate of the average annual level of consumption of electricity by a small customer in South Australia) under market offer prices of NERL retailers generally available to classes of small customers in South Australia compared to the cost to that customer under standing offer prices of NERL retailers generally available to classes of small customers in South Australia;

(d) such other information as the Minister requires in writing to be included.

5—Variation of regulation 13—Functions of Technical Regulator—major interruptions to electricity supply

Part 6A—Contestable services 39A—Contestable services (1) For the purposes of section 36AF(3)(a) of the Act, a connection service—

(a) which is provided to a standard—

(i) that is of a higher or lower quality or reliability than the standard of quality or reliability required by the National Electricity Rules, any code made by the Commission under the Essential Services Commission Act 2002 relating to electricity distribution or any other relevant instrument; or

(ii) that exceeds the levels of service or plant ratings required by the connection assets of the operator of the distribution network to which the connection relates; and

(b) to which a customer is required to contribute to the cost of providing the service,

is prescribed.

(2) For the purposes of section 36AF(3)(b) of the Act, the following requirements are specified and must be applied in relation to the provision of a contestable service prescribed under subregulation (1):

(a) a customer may request the operator of a distribution network to prepare technical specifications for the construction of connection assets or an extension to the network (assets or an extension);

(b) if a request is made under paragraph (a), the operator must only prepare technical specifications if the customer—

(i) supplies the operator with the information that is reasonably required to allow the preparation of the specifications; and

(ii) pays a reasonable fee (which must not exceed an amount approved by the Commission) to the operator for the preparation of the specifications;

the general design parameters and operating requirements for the assets or an extension to enable connection to the network and must—

(i) contain sufficient details to allow the customer to call for tenders from third parties for the design and construction of the assets or an extension; and

(ii) contain details of the voltage of the connection, required current rating, minimum transformer sizes, and other equipment requirements; and

(iii) contain details of the operator's technical and maintenance requirements, to ensure the works, when designed and completed—

(A) are compatible with the network; and

(B) are capable of being operated and maintained by the operator in accordance with its operations and maintenance procedures; and

(C) do not adversely affect the network or other persons connected to the network; and

(iv) inform the customer that tenderers must submit separate amounts for designing and constructing the connection assets or designing and undertaking an extension; and

(v) inform the customer of a reasonable period for conducting the tender, given the nature of the works and the technical specifications;

(d) the operator must prepare the technical specifications as requested by the customer—

(i) if the preparation of the specifications involves complex work—within a reasonable period agreed with the customer after receipt of the request (and that period must not exceed 20 business days); or

(ii) in any other case—within the period of 10 business days after receipt of the request;

(e) a customer may call for tenders for the design and construction of the assets or an extension, based on the technical specifications prepared by the operator;

(f) if, within the period specified under paragraph (c)(v), the customer notifies the operator that it has selected a successful tenderer, the operator must liaise, in a reasonable manner having regard to paragraph (g), with the customer and the successful tenderer about the following matters:

(i) the design and construction of the assets or an extension;

(ii) payments from the customer and payments to the successful tenderer;

equipment installed;

(iv) the program for undertaking the works;

(v) handing over the assets or an extension to the operator on completion of the works;

(g) the operator is not obliged to accept the design and construction of the assets or an extension by a successful tenderer if the operator considers on reasonable grounds that—

(i) the successful tenderer does not have the requisite skill and competence to undertake the design and construction of the works in accordance with the technical specifications; or

(ii) the proposed design and construction does not meet the technical specifications, in particular, the matters referred to in paragraph (c)(iii);

(h) if a dispute between a customer and an operator arises under paragraph (g), the customer or operator may refer the dispute to the Technical Regulator for resolution.


connection means a physical link between a distribution network and a customer’s premises to allow the flow of electricity;

connection alteration means an alteration to an existing connection including an addition, upgrade, extension, expansion, augmentation or any other kind of alteration;

connection assets means those components of a distribution system which are used to provide a connection service;

connection service means the design and construction of connection assets that may be built separate to, or in isolation from, the existing distribution network relating to either or both of the following:

(a) a service relating to a new connection for premises;

(b) a service relating to a connection alteration;

extension means works (outside the boundaries of the operator's distribution network (as it existed before the construction of any connection assets or an extension on behalf of a customer in accordance with this regulation)) required for the connection requested by the customer;

new connection means a connection established or to be established in accordance with Chapter 5A of the National Electricity Rules and relevant energy laws, where there is no existing connection.

After Part 9 insert:

Part 9A—Regulation of NERL retailers 44A—NERL retailers to comply with code provisions and other

requirements For the purposes of section 63AB(1) of the Act, a NERL retailer must comply with—

(a) a code made by the Commission under the Essential Services Commission Act 2002 relating to electricity metering; and

(b) if the scheme under Part 4 of these regulations applies to the retailer, a code made by the Commission under the Essential Services Commission Act 2002 relating to residential energy efficiency; and

(c) the technical and safety requirements or standards prescribed under Parts 10, 11 and 12 of these regulations;

(d) clause 8.2 (as amended from time to time) of the electricity pricing order under section 35B of the Act.

Note—

Regulation 22 provides for the application of a scheme relating to energy efficiency to NERL retailers.

44B—Inset networks (1) For the purposes of section 63AB(1)(c) of the Act, an exempt seller within

the meaning of the National Energy Retail Law (South Australia) may only carry on operations as an inset network operator or inset network retailer if the exempt seller ensures that an inset customer has an effective right of access to a NERL retailer of the customer's choice.

(2) For the purposes of this regulation, an inset customer has an effective right of access to a NERL retailer of the customer's choice only if the customer may—

(a) have access to and use the inset network for the purpose of consuming electricity purchased by the customer from a NERL retailer of the customer's choice; and

(b) install, maintain and use meters and other equipment necessary for that purpose,

without any charge being payable by the customer (other than to the NERL retailer) or by the NERL retailer.


inset customer, inset network, inset network operator and inset network retailer have the same respective meanings as in regulation 15.

early termination fee to be offered (1) For the purposes of section 63AB(1)(e) of the Act, a NERL retailer must be

willing to offer a market retail contract to small customers under which the NERL retailer agrees not to directly or indirectly charge a small customer who is a party to the contract a fee for early termination of the contract no matter what the reason for termination may be.

(2) In connection with the operation of subregulation (1)—

(a) a NERL retailer must clearly identify in naming the contract that it offers for the purposes of subregulation (1) that no fee applies for early termination of the contract; and

(b) a NERL retailer must provide information about the contract that it offers for the purposes of subregulation (1) to its existing small customers, and to small customers more generally (and, in so doing, must comply with any requirements specified by the Commission).

(3) In this section—

market retail contract has the same meaning as in the National Energy Retail Law.

44D—Participation in ombudsman scheme For the purposes of section 63AC(1) of the Act, the prescribed level is 750 MW.h.

44E—Annual administration fee (1) For the purposes of section 63AE(2) of the Act, the annual administration

fee is to be calculated in accordance with the following formula:

X is the annual administration fee for a NERL retailer;

EA is the costs determined by the Minister of the administration of the Act;

ESC is the costs determined by the Minister of the administration by the Commission of the Essential Services Commission Act 2002 attributable to the retailing of electricity to small customers;

AEMC is the costs referred to in subregulation (2);

Q is the amount determined by the Minister to adjust the annual administration fee based on events that occurred during the period to which the previous annual administration fee related (such as a new entrant to the market for the retailing of electricity) or such other matter relating to that previous period that the Minister thinks fit;

Y is the number of NERL retailers that retail electricity to small customers at the commencement of the period to which the annual administration fee relates.

31 January 2013] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 187 (2) For the purposes of section 63AE(7)(c) of the Act, the costs determined by

the Minister of the administration in relation to retailing of electricity in South Australia of Part 9 of the National Energy Retail Law (South Australia) by the Australian Energy Market Commission established by the Australian Energy Market Commission Establishment Act 2004 are prescribed.

(3) If a NERL retailer commences retailing electricity to small customers as a NERL retailer during a period to which an annual administration fee relates, the annual administration fee for the NERL retailer is to be adjusted by multiplying—

(a) the annual administration fee that would have been payable by the NERL retailer had it been retailing electricity as a NERL retailer during the whole of the relevant period; and

(b) the proportion that the number of whole months between the commencement of retailing and the end of the relevant period bears to 12 months.

(4) If a relevant entity within the meaning of section 33 of the National Energy Retail Law (South Australia) Act 2011 had, before 1 February 2013, paid (as an electricity entity under the Electricity Act 1996) to the Commission a licence fee under section 20 of the Act in respect of the whole or any part of the period commencing on 1 February 2013 and ending on 1 February 2014, the Commission must determine an amount in relation to the licence fee that is to be offset against the annual administration fee that applies to the entity, or credited or refunded to the entity (as determined by the Commission).

(c) details relating to the difference in annual cost to a small customer of gas supplied to the customer (based on a reasonable estimate of the average annual level of consumption of gas by a small customer in South Australia) under market offer prices of NERL retailers generally available to classes of small customers in South Australia compared to the cost to that customer under standing offer prices of NERL retailers generally available to classes of small customers in South Australia;

(d) such other information as the Minister requires in writing to be included.

Part 8A—Regulation of NERL retailers 36A—NERL retailers to comply with code provisions and other

requirements (1) For the purposes of section 61AD(1) of the Act, a NERL retailer must

comply with—

(a) a code made by the Commission under the Essential Services Commission Act 2002 relating to gas metering; and

(b) if the scheme under Part 4 of these regulations applies to the retailer, a code made by the Commission under the Essential Services Commission Act 2002 relating to residential energy efficiency.

Note—

Regulation 16 provides for the application of a scheme relating to energy efficiency to NERL retailers.

comply with the following requirements:

(a) a NERL retailer must prepare, maintain, publish on its website and periodically revise a safety awareness plan in accordance with the following requirements:

(i) the plan must deal with matters prescribed by subregulation (3);

(ii) the retailer must obtain the approval of the Technical Regulator to the plan and any revision;

(iii) the retailer must comply with the plan as approved from time to time;

(iv) the retailer must audit from time to time its compliance with the plan and report the results of those audits to the Technical Regulator;

(v) the retailer must, on or before 31 August in each year, lodge with the Technical Regulator a report relating to the previous financial year containing the following information:

(A) the results of any audit of the retailer's compliance with its safety awareness plan;

(B) details of the measures taken to implement the plan, such as information about the publication and distribution of brochures, and the number of times the plan and related material has been viewed by customers on any website operated by the retailer;

(C) whether the retailer has been able to comply with all aspects of the safety awareness plan and whether the retailer considers the plan to have been operating effectively;

(b) a NERL retailer must, subject to the limitation set out in paragraph (c), use its best endeavours to supply gas in accordance with the standards of quality under regulation 38 and any relevant Act or other instrument that relates to the quality of gas supply;

(c) the obligation in paragraph (b) is limited to the extent that the distribution system or the quality of gas supply is adversely affected by the actions or equipment of a small customer;

(d) a NERL retailer must use its best endeavours to supply gas in a manner that does not interfere with the safe operation of a distribution system;

(e) a NERL retailer must use its best endeavours to provide a reliable supply of gas to a small customer in accordance with any relevant Act or other instrument that relates to the reliability of gas supply;

maintenance, operation, reading or replacement of a meter—

(i) supply to an entity holding a licence authorising the operation of a distribution system information obtained from those meters as is reasonably required by the entity for the purposes of its operations in such format as is reasonably required by the entity and in a manner consistent with recognised practices in the gas industry; and

(ii) allow the entity, at the expense of the entity, to inspect and test the meter as is reasonably required by the entity for the purpose of its operations.

(3) The following are matters that must be dealt with by a safety awareness plan:

(a) the establishment and maintenance of systems for—

(i) communicating information to customers regarding the safety of gas infrastructure, installations and appliances; and

(ii) measuring the use of such information systems by customers;

(b) the provision of material with information and adequate warnings about the properties of gas relevant to safety;

(c) the establishment and maintenance of systems for—

(i) warning the public about the need for due care with respect to gas infrastructure, installations and appliances; and

(ii) informing customers about the correct action to be taken with respect to defects or malfunctions of gas infrastructure, installations and appliances (including but not limited to gas leaks or suspected gas leaks), and the means by which customers can report those defects or malfunctions; and

(iii) informing customers of approval schemes for gas appliances and the manner in which a customer can determine whether a gas appliance has been approved; and

(iv) informing customers of the fact that persons who undertake gas fitting work are required to be licensed or registered under the Plumbers, Gas Fitters and Electricians Act 1995 and of the manner in which customers can determine whether a person is appropriately licensed or registered; and

(v) ensuring that a point of contact for customers regarding gas supply difficulties and gas shortages is provided.

relevant Act or other instrument means—

(a) an Act (including any instrument made under an Act); or

(b) a standard, code, guideline or other instrument issued by the AER, the Commission or the Technical Regulator,

that applies to a person engaged in the retailing of gas.

36B—Sale of gas to small customers—market contract without early termination fee to be offered

(1) For the purposes of section 61AD(1)(g) of the Act, a NERL retailer must be willing to offer a market retail contract to small customers under which the NERL retailer agrees not to directly or indirectly charge a small customer who is a party to the contract a fee for early termination of the contract no matter what the reason for termination may be.

(2) In connection with the operation of subregulation (1)—

(a) a NERL retailer must clearly identify in naming the contract that it offers for the purposes of subregulation (1) that no fee applies for early termination of the contract; and

(b) a NERL retailer must provide information about the contract that it offers for the purposes of subregulation (1) to its existing small customers, and to small customers more generally (and, in so doing, must comply with any requirements specified by the Commission).

(3) In this section—

market retail contract has the same meaning as in the National Energy Retail Law.

36C—Participation in ombudsman scheme For the purposes of section 61AE(1) of the Act, the prescribed level is 10 Tj.

36D—Annual administration fee (1) For the purposes of section 61AH(2) of the Act, the annual administration

fee is to be calculated in accordance with the following formula:

X is the annual administration fee for a NERL retailer;

GA is the costs determined by the Minister of the administration of the Act;

ESC is the costs determined by the Minister of the administration by the Commission of the Essential Services Commission Act 2002 attributable to the retailing of gas to small customers;

AEMC is the costs referred to in subregulation (2);

administration fee based on events that occurred during the period to which the previous annual administration fee related (such as a new entrant to the market for the retailing of gas) or such other matter relating to that previous period that the Minister thinks fit;

Y is the number of NERL retailers that retail gas to small customers at the commencement of the period to which the annual administration fee relates.

(2) For the purposes of section 61AH(7)(c) of the Act, the costs determined by the Minister of the administration in relation to the retailing of gas in South Australia of Part 9 of the National Energy Retail Law (South Australia) by the Australian Energy Market Commission established by the Australian Energy Market Commission Establishment Act 2004 are prescribed.

(3) If a NERL retailer commences retailing gas to small customers as a NERL retailer during a period to which an annual administration fee relates, the annual administration fee for the NERL retailer is to be adjusted by multiplying—

(a) the annual administration fee that would have been payable by the NERL retailer had it been retailing gas as a NERL retailer during the whole of the relevant period; and

(b) the proportion that the number of whole months between the commencement of retailing and the end of the relevant period bears to 12 months.

(4) If a relevant entity within the meaning of section 33 of the National Energy Retail Law (South Australia) Act 2011 had, before 1 February 2013, paid (as a gas entity under the Gas Act 1997) to the Commission a licence fee under section 20 of the Act in respect of the whole or any part of the period commencing on 1 February 2013 and ending on 1 February 2014, the Commission must determine an amount in relation to the licence fee that is to be offset against the annual administration fee that applies to the entity, or credited or refunded to the entity (as determined by the Commission).

DEVELOPMENT ACT 1993 Local Heritage Places Development Plan Amendment—

Public Consultation THE City of Unley has prepared a Development Plan Amendment (DPA) to amend the Unley (City) Development Plan to address a review of existing heritage places and proposed inclusions of additional heritage places. The Development Plan Amendment affects the whole Council area by virtue of places being dispersed across the Council area. The DPA is subject to interim authorisation, to avoid speculative development contrary to new policy, making it immediately operational while consultation and review for permanent authorisation is conducted.
