AIRCRAFT PARKING CHARGES: General aviation aircraft parked longer than two hours in designated general aviation parking areas and aircraft will incur a charge of $16.15 per day or any part of a day. Fixed base operators may apply for a contract rate for parking where the fixed base operator advises Adelaide Airport Limited of the aircraft type and registration of the aircraft that park for more than two hours on each consecutive day per month. Code ‘B’ or greater—the charges for parking of Aircraft in the category of Code ‘B’ or greater is by arrangement with AAL from time to time. Definitions (a) Government Mandated Services means those services which AAL provides to RPT Operators and other users of the Airport

which are mandated by the Commonwealth Government (in applicable legislation and ministerial or Commonwealth Department directions) or other lawful authority and includes (but are not limited to) the following services:

(i) Terminal passenger checked bag screening; (ii) Terminal passenger screening; (iii) airside inspections; and (iv) other services required by the Commonwealth Government or other lawful authority. (b) Infant means children less than two years old, not occupying a seat. (c) Landing Charge means the amount from time to time charged by AAL to an aircraft operator in respect of the use by an

aircraft of AAL’s runways, taxiways and aprons. The Landing Charge is a single charge made on each arrival (landing) of an aircraft.

(d) MTOW means maximum take-off weight as specified by the manufacturer. (e) Passenger Facility Charge (‘PFC’) mean the amount from time to time charged by AAL to an RPT Operator in respect of its

Passengers using a Terminal for the purpose of recovering costs relating to the Terminals. (f) RPT (Regular Public Transport) Operation means an operation of an Aircraft for the purposes of the carriage of people, or

both people and goods, of an air service that: (i) is provided for a fee payable by persons using the service; (ii) is conducted in accordance with fixed schedules to or from fixed terminals over specific routes; and (iii) is available to the general public on a regular basis.

1168 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE [26 April 2013 Per Passenger Charge Rules (1) Applies to all arriving and departing passengers and excludes transit passengers, infants and positioning crew. (2) Applies to all arriving, departing and transit passengers and excludes infants and positioning crew. (3) Applies to departing passengers only and excludes infants and positioning crew. (4) Applies to departing passengers and departing transit passengers and excludes infants and positioning crew. (5) Applies to all transit passengers excluding infants arriving from a port outside Australia. Notes (i) Charge Base: An Aircraft Operator may elect, by agreement with AAL, and entirely at AAL’s discretion, to incur Aeronautical

Charges on a MTOW or Passenger basis, which basis is then fixed for the ensuring 12 month period. (ii) Minimum charge: A minimum charge applies to all General Aviation customers as follows: (a) Fixed Wing Aircraft $43.32 per landing. (b) Rotary Wing Aircraft $21.65 per landing. (iii) AAL has a growth incentive scheme which provides discount on the landing charges indicated above for airlines which exceed

a target growth rate for the year. Details of this scheme are available to airlines on request. (iv) The PFC will be adjusted annually by the increase in the Consumer Price Index (All Groups Weighted Average of Eight Capital

Cities) on the anniversary date of the commencement of charging for the PFC (17 February 2006). The PFC will be reviewed every five years; the next review date is 17 February 2016.

Preamble It is necessary to amend the Barunga West District Council Development Plan dated 29 November 2012.

NOTICE PURSUANT to Section 29 (2) (b) (ii) of the Development Act 1993, I, being the Minister administering the Act, amend the Barunga West District Council Development Plan dated 29 November 2012 as follows: 1. Within Principle of Development Control 1 of the Primary

Production Zone insert the following words after ‘intensive animal keeping’:

‘waste water treatment plant to service the township of Fisherman Bay’.

2. Within Principle of Development Control 11 (a) (i) of the Primary Production Zone replace the words ‘20 hectares’ with the words ‘10 hectares’.

3. Within the ‘Exceptions’ column of the Primary Production Zone non-complying table for ‘Land Division’ delete the words ‘or (c):’ in the lead-in text and insert the words ‘, (c) or (d):’.

4. Within the ‘Exceptions’ column of the Primary Production Zone non-complying table for ‘Land Division’, replace the words of part (a) (i) ‘20 hectares’ with ‘10 hectares’.

than 14 days from date of closing. (d) The Approval Holder, or a person acting on his or her behalf, must not pay a refund on, or seek reimbursement

for, containers that the Approval Holder or the person acting on his or her behalf, knows were not purchased in South Australia.

(e) The Approval Holder must ensure that prominent signage is displayed, detailing the offence and the penalties under Section 69 of the Act, for presenting interstate containers for refund.

RULES OF COURT

District Court Civil Rules 2006 (Amendment No. 22)

BY virtue and in pursuance of Section 51 of the District Court Act 1991 and all other enabling powers, we, Terence Anthony Worthington, Chief Judge, Dean Ernest Clayton, and Paul Vincent Slattery, Judges of the District Court of South Australia, make the following Rules of Court. 1. These rules may be cited as the District Court Civil Rules 2006 (Amendment No. 22). 2. The District Court Civil Rules 2006 as amended by these Rules may be cited as the District Court Civil Rules 2006. 3. This amendment will commence on the 1st May 2013, or upon its gazettal, whichever is the later. 4. The District Court Civil Rules 2006 are amended as set out below. 5. Rule 136 is amended by adding at the end of the existing subrule (1) (a) and before the semicolon the following words: ‘or affidavits filed in lieu of pleadings’. 6. Rule 220 is amended by: (1) deleting the existing subrule (2); (2) renumbering the existing subrules (3) and (4) as subrules (2) and (3)

respectively. 7. Rule 316B is amended by deleting in sub-rule (6) (b) the words ‘the Manager of the prison or training centre in which the person is detained’ and replacing them with the words ‘the prisoner, care of the Chief Executive of the Department for Correctional Services’. Part 2—Variation of Liquor Licensing (General) Regulations 2012 4—Insertion of regulations 7A and 7B

After regulation 7 insert:

7A—Small venue licence—prohibited entertainment For the purposes of section 40A(3)(b) of the Act, entertainment of the following kind is prescribed:

(a) entertainment of a sexually explicit nature;

(b) a professional or public boxing or martial art event within the meaning of the Boxing and Martial Arts Act 2000.

7B—Additional areas in which small venue licences permitted—bodies to be consulted

For the purposes of paragraph (b) of the definition of prescribed bodies in section 40A(4) of the Act, the following bodies are prescribed:

(a) Australian Hotels' Association (S.A. Branch);

(b) Licensed Clubs' Association of South Australia Incorporated;

(c) The South Australian Restaurant Association Incorporated.

5—Insertion of regulation 14A After regulation 14 insert:

14A—Form of notice of submission For the purposes of section 77A(1) of the Act, a notice of submission in respect of an application for, or in relation to, a small venue licence must be in the form of Form 2A set out in Schedule 2.

6—Variation of Schedule 2—Forms (1) Schedule 2, Form 1—delete the form and substitute:

NOTICE is hereby given that the Council has undertaken a review to determine whether alterations are required in respect to elector representation, including ward boundaries and the composition of Council. CITY OF MOUNT GAMBIER

DEVELOPMENT ACT 1993 Urban Boundary Adjustment Development Plan Amendment

(DPA)—Public Consultation NOTICE is hereby given that the, City of Mount Gambier pursuant to Sections 24 and 25 of the Development Act 1993, has prepared a Development Plan Amendment Report (DPA) to amend its Development Plan(s). The Amendment will change the Development Plan by formalising the transfer of planning policies over land ceded from the District Council of Grant to the City of Mount Gambier, ie by ensuring that the policies applicable to the affected land under the Grant (DC) Development Plan are incorporated into the Mount Gambier (City) Development Plan. The policies of these zones will be incorporated into ‘like’ zones within the City of Mount Gambier such that there are comparable development controls applicable over the affected areas. In addition, the land that was located within the Deferred Urban Zone in the north of Mount Gambier is to be rezoned to the Residential Zone and to a new Public Purpose (Education) Zone. Land located within the Primary Industry Zone is to be rezoned to the Caravan and Tourist Park Zone to reflect the long standing use of the land so zoned. To rezone a portion of the Light Industry Zone, west of White Avenue, adjacent the railway line to the General Industry Zone. The area(s) affected by the proposed DPA is described as follows:

• Land bordered by Jubilee Highway West, O’Leary Road, Wireless Road West and Wandilo Road;

• Land bordered by Wireless Road West, O’Leary Road, Pine Hall Avenue and Suttontown Road;

• Land to the west of Suttontown Road, between Pine Hall Avenue and Wireless Road West and within approximately 450-530 m of Suttontown Road;

• Land bordered by Jubilee Highway East, Dohle (Hawkins) Road, Sycamore Road and Attumurra Road;

• Land to the north of McCormick Road and west of Nelson (Punt) Road and within approximately 730 m of Nelson Road (Punt) Road; and

• Land to the north west of White Avenue and to the south east of Cave Road and Oak Street, contained within Certificate of Title 6089/37.

The affected area is the land transferred from the District Council of Grant to the City of Mount Gambier as part of the Local Boundary Reform which occurred on 1 July 2010. Having duly considered all relevant provisions of the Local Government Act 1999, the information and alternatives contained within the original Council Options Paper and the matters raised in the written submissions received in the initial consultation, Council has proposed that the following changes come into effect at the next Local Government Elections in November 2014. • The retention of a Ward Structure; • The retention of a Mayor as the principal member of

Council, elected ‘at large’ by the community; • Not support the introduction of Area Councillors; and • The retention of the existing four Ward Structure and

eleven Councillors, as detailed in Option 2—Current Structure (Amended) of the Elector Representation Review Options Paper.

Report Council has prepared a report detailing the review process, public consultation undertaken and the proposal Council now considers should be carried into effect.
