Revocation of Approval of Category A Containers

I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby revoke the approvals of the classes of Category A containers sold in South Australia as identified by reference to the following matters, which are described in the first 4 columns of Schedule 1 of this Notice:

(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers;

(d) the name of the holders of these approvals.

These approvals are revoked as the Authority is satisfied that the condition of approval relating to the waste management arrangement for the class of containers has been contravened:

Vary the Approval of Category B Containers

I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:

Vary the Approval of Category B Containers:

Approve as Category B Containers, subject to the conditions 1-4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:



(c) the type of containers; and


(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class.

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Fires During the Fire Danger Season—Variation of Restrictions on Lighting of Fires—Carols by Candlelight

I, EUAN ARTHUR FERGUSON, AFSM, the Chief Officer of the South Australian Country Fire Service, in accordance with Regulation 32A (3), hereby vary the restriction on lighting and maintaining of fires to allow the lighting of candles on 20 December 2009 within the part of the State bounded by the roads from the corner of Morphett Street and War Memorial Drive, to the corner of War Memorial Drive and King William Street, to the corner of King William Street and North Terrace, to the corner of North Terrace and Morphett Street, to the corner of Morphett Street and War Memorial Drive.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that, pursuant to section 115 of the Fisheries Management Act 2007, Australian Bight Abalone Ltd (Admini-strators Appointed), Australian Bight Abalone Management Pty Ltd (Administrators Appointed) and Australian Bight Infrastructure Pty Ltd (Administrators Appointed), c/o Sam Davies of McGrath Nicol, G.P.O. Box 9986, Adelaide, S.A. 5001 (the ‘exemption holder’) or a person acting as an agent, are exempt from section 52 of the Fisheries Management Act 2007, but only insofar as they may collect beachcast algae and seagrass, for the purpose of trade or business (the ‘exempted activity’) in the areas specified in Schedule 1, subject to the conditions in Schedule 2, from 1 December 2009 until 15 January 2010, unless varied or revoked earlier.

SCHEDULE 1

Intertidal area between Mean Low Water Springs and Mean High Water Springs and bounded by 486181mE, 6285680mN (MGA zone 53) to the north and 485411mE, 6279859mN (MGA zone 53) to the south.

SCHEDULE 2

1. The exemption holder may take beachcast (unconnected and deposited on shore) algae and seagrass for the purpose of trade or business from the area listed in Schedule 1.

2. A maximum of 500 tonnes may be collected pursuant to this exemption.

3. The operation should be designed to prevent removal of sand.

4. Written permission from the Department for Transport, Energy and Infrastructure must be obtained before material may be collected from the area.

5. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 on any day of operation, at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and other related questions. Exemption No. 9902311.

6. A report on the area of beach cleared (square metres), volume of seagrass cleared (cubic metres) and the method and location of disposal must be supplied to the Director of Fisheries, G.P.O. Box 1625, Adelaide, S.A. 5001 no later than 15 working days after the expiry of this exemption.

7. While engaged in the exempted activity the exemption holder or their agent must carry or have about or near their person a copy of this notice. Such notice must be produced to a PIRSA Fisheries Officer upon request.

8. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007 (‘the Act’), a registered master fishing pursuant to a Northern Zone Rock Lobster Fishery Licence (the ‘exemption holder’) is exempt from sections 52 and 53 of the Fisheries Management Act 2007 and Clause 18 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder, or a person acting as his agent, may take southern rock lobster (Jasus edwardsii) using rock lobster pots that do not have escape gaps (‘the exempted activity’), subject to the conditions in Schedule 1, during the period 26 November 2009 until 31 May 2010, unless varied or revoked earlier.

SCHEDULE 1

1. A person fishing pursuant to a Northern Zone Rock Lobster Fishery Licence may only undertake the exempted activity when an employed independent observer is on board the boat and that observer is undertaking catch sampling for research purposes, in accordance with the agreement between the Northern Zone Rock Lobster Fishermen’s Association and SARDI Aquatic Sciences.

2. Before conducting the exempted activity, the exemption holder must contact the PIRSA Fisheries on 1800 065 522 and answer a series of questions about the exempted activity. You will need to have a copy of your exemption with you at the time of making the call and be able to provide the following details:

• name of the person making the call;

• licence number;

• name of the boat and its registration number;

• the name of the Registered Master on board the boat;

• port of departure;

• number of days at sea; and

• Exemption No. 9902310.

3. While engaged in the exempted activity, the exemption holder must have in his possession a copy of this notice and produce a copy of this notice if requested by a PIRSA Fisheries Compliance Officer.

4. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulation made under that Act, except where specifically exempted by this notice.

MOTOR VEHICLES ACT 1959

Notice of Incidents that will Extend Period during which a Licence is Subject to Mandatory Alcohol Interlock Scheme

Conditions

I, MICHAEL O’BRIEN, Minister for Road Safety, hereby specify the following incidents for the purposes of section 81E (5) (b) of the Motor Vehicles Act 1959 (the Act):

The Registrar of Motor Vehicles must be satisfied that the following incidents have not been recorded by the alcohol interlock fitted to the nominated vehicle during the three months immediately preceding the expiry of the prescribed minimum period as defined in section 81E of the Motor Vehicles Act 1959:

(1) A second incident where the alcohol interlock records a failed attempt to start or re-start the vehicle due to the alcohol interlock detecting a level of blood alcohol concentration.

(2) A first incident where the alcohol interlock records an interference with the device.

(3) This Notice of Incidents will come into operation on the day it is published.

Notice of Instructions for the Operation of a Nominated Vehicle fitted with an Alcohol Interlock

PURSUANT to section 81F (1) (c) of the Motor Vehicles Act 1959, I, Michael O’Brien, Minister for Road Safety, hereby give notice that a nominated vehicle fitted with an alcohol interlock for the purposes of the Mandatory Alcohol Interlock Scheme set out in Part 3 of the Act, must only be operated in accordance with the following instructions:

(1) The driver of the nominated vehicle must direct a sample of the driver’s breath into the alcohol interlock fitted to the vehicle before operating the vehicle and whenever the interlock signals that a re-test is required.

(2) If the nominated vehicle is being driven on a road when the alcohol interlock fitted to the vehicle signals that a re-test is required, the driver of the vehicle must bring the vehicle to a stationary position on the side of, or off, the road, safely and in accordance with the Road Traffic Act 1961, and perform the re-test as referred to in Clause 1.

(3) The driver of the nominated vehicle must not, without reasonable excuse, drive the vehicle on a road more than three minutes after the alcohol interlock fitted to the vehicle has signalled that a re-test is required unless the driver has performed the re-test as referred to in Clause 1.

(4) This Notice of Instructions will come into operation on the day it is published.

RADIATION PROTECTION AND CONTROL ACT 1982

SECTION 44

Notice by Delegate of the Minister for Environment and Conservation

PURSUANT to section 44 of the Radiation Protection and Control Act 1982, I, Keith Baldry, Director of the Radiation Protection Division of the Environment Protection Authority, being a person to whom the powers of the Minister under that section have been delegated under the Act, exempt employers of persons who are involved in the use or operation of any radiation gauge containing a source of ionising radiation, from the requirements of Regulations 18 of the Radiation Protection and Control (Ionising Radiation) Regulations 2000, subject to the following conditions:

(1) this exemption does not apply to persons who install, maintain or service radiation gauges, or to persons who are likely to receive an annual effective dose in excess of 1 millisievert as a result of any involvement in the use or operation of radiation gauges, and

(2) the employer must issue a personal monitoring device to a radiation worker, and keep a personal radiation exposure record in respect of that worker, if directed in writing by the Director of the Radiation Protection Division of the Environment Protection Authority to do so.

NOTICE OF CONFIRMATION OF ROAD PROCESS ORDER

Road Closure—Loxton

BY Road Process Order made on 17 June 2009, the District Council of Loxton Waikerie ordered that:

1. The whole of the unnamed public road situate east of Starcevich Road and between pieces 91 and 92 in Filed Plan 199378, more particularly delineated and lettered ‘A’ in Preliminary Plan No. 08/0111 be closed.

2. The whole of the land subject to closure be transferred to East Terrace Pty Ltd in accordance with agreement for transfer dated 30 May 2009 entered into between the District Council of Loxton Waikerie and East Terrace Pty Ltd.

3. The following easement is granted over portion of the land subject to that closure.

Grant a free and unrestricted right of way appurtenant to Certificate of Title Volume 5942, Folio 817.

On 13 November 2009 that order was confirmed by the Minister for Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 82008 being the authority for the new boundaries.

Pursuant to section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.

ROAD TRAFFIC ACT 1961

SUPPLEMENTARY NOTICE OF APPROVAL AND EXEMPTION Pursuant to Sections 161A and 163AA of the Road Traffic Act 1961

OPERATION OF ROAD TRAIN VEHICLES IN SOUTH AUSTRALIA

1. APPROVAL

1.1 In accordance with the powers delegated to me by the Minister for Transport under section 163AA of the Road Traffic Act 1961 and Regulation 155 of the Road Traffic (Vehicle Standards) Rules 1999, I hereby vary the conditions of the Notice of Approval and Exemption titled ‘Operation of Road Train Vehicles in South Australia’ (the ‘Primary Notice’) dated 2 June 2008 and published in the South Australian Government Gazette, as detailed below.

2. APPLICATION OF SUPPLEMENTARY NOTICE

2.1 This Supplementary Notice must be read in conjunction with the Primary Notice and applies to Approved Vehicles operating under the Primary Notice and engaged in the transport of product for Iluka Resources Limited.

3. ROUTES AVAILABLE TO APPROVED VEHICLES

3.1 An Approved Vehicle may operate under the conditions of the Primary Notice on:

3.1.1 the Ooldea-Colona Station Road, from the Iluka Mine Access Road to the Ooldea-Colona Station Road/ Eyre Highway junction.

3.2 Notwithstanding the requirements of Clause 39.1 of the Code of Practice for Road Trains, an approved vehicle travelling under this Notice may operate at Higher Mass Limits on the route identified in 3.1 of this Notice.

4. CONDITIONS AND LIMITATIONS APPLYING TO THIS SUPPLEMENTARY NOTICE

4.1 The driver of an approved vehicle must:

4.1.1 continue to comply with all conditions and requirements of the Primary Notice; and

4.1.2 carry at all times a legible, current and complete copy of:

(i) this Supplementary Notice;

(ii) the Primary Notice;

(iii) the ‘Code of Practice for Road Trains’ dated April 2008;

(iv) all current approved Road Train and Converter Dolly route network map(s) (as appropriate) specific to the entire route being travelled/operated on during the particular journey undertaken with the exception of the route identified in 3.1 of this Notice, including more specific detailed maps of routes and townships where available; and

(v) a current driver medical certificate where you are required to undergo and pass a medical examination;

4.1.3 produce any or all of the documents indicated in 4.1.2 above when requested by a DTEI Authorised Officer appointed under the Road Traffic Act 1961 or a Police Officer.

5. DEFINITIONS

In this Notice:

5.1 ‘Primary Notice’ means the Notice of Approval and Exemption titled ‘Operation of Road Train Vehicles in South Australia’, dated 2 June 2008;

5.2 ‘Supplementary Notice’ means this Supplementary Notice;

5.3 ‘Code of Practice’ means the Code of Practice for Road Trains, dated April 2008, as issued by the Department for Transport, Energy and Infrastructure; and

5.4 ‘Approved vehicle’ means a vehicle combination consisting of a prime mover towing two trailers, where a converter dolly supporting a semi trailer is counted as a single trailer (double road train).

6. COMMENCEMENT OF THIS NOTICE

6.1 This Supplementary Notice is valid from 12.01 a.m. on 4 December 2009 until 12.01 a.m. on 28 February 2010. 7. AUTHORISATION

I hereby vary the conditions of the Notice of Approval and Exemption titled ‘Operation of Road Train Vehicles in South Australia’ (the ‘Primary Notice’) dated 2 June 2008 and published in the South Australian Government Gazette as detailed below.

1. DEFINITIONS

In this Notice:

1.1 ‘Primary Notice’ means the Notice of Approval and Exemption titled ‘Operation of Road Train Vehicles in South Australia’, dated 2 June 2008;

1.2 ‘Supplementary Notice’ means this Supplementary Notice for the operation of Road Train vehicles in South Australia greater than 25 m and up to 30 m in length; and

1.3 ‘Code of Practice’ means the Code of Practice for Road Trains, dated April 2008 as issued by the Department for Transport, Energy and Infrastructure.

2. VARIATION OF CONDITIONS FOR APPROVED VEHICLES

2.1 The minimum length for a Road Train as prescribed in Clause 16.2 of the Code of Practice is hereby varied such that the overall length must be greater than 25 m and up to 30 m.

3. CONTINUED COMPLIANCE WITH THE PRIMARY NOTICE

3.1 A driver of an Approved Vehicle must continue to comply with all conditions and requirements of the Primary Notice, except as varied by this notice.

4. COMMENCEMENT OF THIS NOTICE

4.1 This Supplementary Notice is valid from 12.01 a.m. on 1 January 2010 until midnight on 31 December 2010.

1—Short title

These regulations may be cited as the Harbors and Navigation Variation Regulations 2009.

215—Facilities levy

A facilities levy of the amount fixed by Schedule 14 is payable on the registration, inspection or survey of a vessel and, in accordance with section 90A(4) of the Act, a certificate of registration, inspection or survey will not be issued for the vessel until the levy is paid.

216—Boating facility advisory committee

(1) There is to be a committee to advise the Minister on any variation of the amounts of the facilities levies, and the application of the Facilities Fund, under section 90A of the Act.

(2) The committee is to consist of a maximum of 8 members appointed by the Minister of whom—

(a) 1 must be a person nominated by the Boating Industry Association of South Australia Incorporated; and

(b) 1 must be a person nominated by the South Australian Recreational Boating Council Incorporated; and

(c) 1 must be a person nominated by the South Australian Recreational Fishing Advisory Council Incorporated; and

(d) 1 must be a person nominated by the Local Government Association of South Australia; and

(e) 2 must be persons who, in the opinion of the Minister, have experience in the operation of commercial vessels (with at least 1 having experience in the commercial fishing industry).

(3) At least 1 member of the committee must be a woman and 1 a man.

(4) The Minister may appoint a person to be a deputy of a member of the committee and the deputy may act as a member of the committee in the absence or during a temporary vacancy in the office of that member.

(5) If a person is appointed as a member of the committee on the nomination of a body, a person appointed as his or her deputy must also be appointed on the nomination of that body.

(6) If a body fails to nominate a person within 6 weeks of a written request to do so from the Minister, the Minister may appoint such person as the Minister thinks fit and that person will be taken to have been duly appointed as a member or deputy member (as the case may require) of the committee.

(7) A member of the committee will be appointed for a term not exceeding 2 years and, at the expiration of a term of appointment, will be eligible for reappointment.


(8) A member of the committee is entitled to such fees and allowances as may

be determined by the Minister.

(9) The Minister may remove a member of the committee from office on any ground that the Minister considers sufficient.

(10) The office of a member of the committee becomes vacant if the member—

(a) dies; or

(b) completes a term of office and is not reappointed; or

(c) resigns by written notice to the Minister; or

(d) is removed from office by the Minister under subregulation (9).

(11) An act of the committee is not invalid by reason only of a vacancy in its membership or a defect in the appointment of a member.

(12) The Minister will appoint 1 member of the committee to be the presiding member of the committee and may appoint 1 member to be the deputy presiding member.

(13) The presiding member of the committee or, in his or her absence, the deputy presiding member (if a deputy presiding member has been appointed), will preside at any meetings of the committee.

(14) Subject to these regulations and any directions of the Minister, the committee may conduct its business in such manner as it thinks fit.

5—Variation of Schedule 14—Fees and levies

(1) Schedule 14, clause 1(a)—after "fee" insert:

2A—Calculation of facilities levy

(1) The amount of a facilities levy set out in clause 3 is the amount payable if registration, inspection or survey of the vessel is for a 12 month period.

(2) If a vessel is registered, inspected or surveyed for a period other than 12 months, a pro rata adjustment is to be made to the amount of the facilities levy set out in clause 3 by applying the proportion that the number of months in the period of registration, inspection or survey bears to 12 months.

(3) If—

(a) a facilities levy for a vessel has been paid in respect of a period (the initial period); and

(b) a further facilities levy becomes payable for the vessel because a certificate of registration, inspection or survey is proposed to be issued for a period (the subsequent period) that commences before the expiry of the initial period,


the amount of the facilities levy payable on the registration, inspection or survey of the vessel for the subsequent period is to be reduced by the amount of the facilities levy already paid in respect of the whole months for which the initial period and subsequent period overlap.

(4) If the amount of the facilities levy already paid in respect of the whole months for which the initial period and subsequent period overlap is greater than the amount payable for the subsequent period, no facilities levy is payable.

Example—

A vessel is registered as a fishing vessel on 1 January 2010 for a period of 2 years and a facilities levy of $100 is paid. A decision is made to use the vessel as a trading vessel and so it is surveyed for a period of 1 year commencing on 1 July 2010. No facilities levy is payable on survey if the amount that would be payable apart from this subregulation is less than $50 (being the amount of the facilities levy already paid in respect of the period 1 July 2010 to 30 June 2011). If the vessel is further surveyed for a period of 1 year commencing on 1 July 2011, the levy then payable will be that payable for the year less $25 (being the amount of the facilities levy already paid in respect of the period 1 July 2011 to 31 December 2011).

(3) Schedule 14, clause 3, item 43 and heading before item 43—delete the item and heading and substitute:

(2) Each member of the committee is to be taken to have been appointed by the Minister for the balance of his or her term of appointment as a member of the Boating Facility Advisory Committee and, if the member was appointed as a member of the Boating Facility Advisory Committee on the nomination of a particular body, the person's appointment as a member of the committee will be taken to have been on the nomination of that body.

2—Deputy of member of Boating Facility Advisory Committee continues as deputy of member of advisory committee

(1) On the commencement of these regulations, a person who was, immediately before that commencement, a deputy of a member of the Boating Facility Advisory Committee (continued under regulation 217 as then in force) will be taken to have been appointed by the Minister as a deputy of the relevant member of the committee for the balance of the term of his or her appointment as a deputy of a member of the Boating Facility Advisory Committee.

(2) Each deputy of a member of the committee is to be taken to have been appointed by the Minister for the balance of his or her term of appointment as a deputy of a member of the Boating Facility Advisory Committee and, if the deputy was appointed as a deputy of a member of the Boating Facility Advisory Committee on the nomination of a particular body, the person's appointment as a deputy of a member of the committee will be taken to have been on the nomination of that body.

The Jamestown ward then contains the area generally east of a line formed by the Georgetown-Caltowie Road until the intersection of Manatoo Road which then follows southerly along Hillam Road to Neindorf Road and southerly along the line of the existing Ward boundary until the intersection with Boultons Hill Road and then easterly along Boultons Hill Road to the intersection with the Jamestown-Spalding Road then north along the Jamestown-Spalding Road to Diagonal Road. The Ward then contains an area generally north of a line formed by Diagonal Road as it travels easterly to Ward Hill Road then north along Belalie East Road until Cooanna Creek Road and easterly along Cooanna Creek Road until the intersection with Motherowie Road then south along Motherowie Road to Yellowie Road and south-easterly along Yellowie Road to the Council boundary adjoining the Regional Council of Goyder.


2.—Spalding Ward

The western boundary of the Spalding Ward commences at a point on the Council’s boundary where the Yacka-Koolunga Road crosses the boundary with the Wakefield Regional Council. The Ward includes that area generally south of the Yacka-Koolunga Road as it travels easterly to the junction of Main North Road then southerly to North Terrace (Yacka) then easterly along North Terrace to East Terrace then southerly along East Terrace to the Yacka-Andrews Road and then along the Yacka-Andrews Road to the point of the existing Ward boundary. The Ward’s western boundary then travels northerly along the line of the existing Ward boundary until the intersection with Bundaleer Road. The Ward then contains all the area generally south of a line formed by Bundaleer Road as it travels to the intersection with Boultons Hill Road and then easterly along Boultons Hill Road to the intersection with the Jamestown-Spalding Road. Then north along the Jamestown-Spalding Road to Diagonal Road and easterly along Diagonal Road to Ward Hill Road then north along Belalie East Road until Cooanna Creek Road and easterly along Cooanna Creek Road until the intersection with Worubia Road then south along Worubia Road to Yellowie Road and south-easterly along Yellowie Road to the Council boundary adjoining the Regional Council of Goyder.


3.—Rocky River Ward

The north-eastern boundary of the Rocky River Ward commences at a point on the Council’s northern boundary where the Appila-Laura Road crosses the boundary with the District Council of Mt Remarkable. The Ward includes that area west of the Appila-Laura Road as it travels south to the intersection with the Stone Hut-Caltowie Road. It then contains the area generally south of the Stone Hut-Caltowie Road which continues to the intersection with the Gladstone-Caltowie Road. The boundary then follows the Gladstone-Caltowie Road until the intersection with the Georgetown-Caltowie Road. The Rocky River Ward then contains the area generally west of the Georgetown-Caltowie Road until the intersection of Manatoo Road which then travels southerly along Hillam Road to Teetuppenie Road. The ward then contains the area generally north of Teetuppenie Road to the intersection with the Georgetown-Caltowie Road and the boundary then travels southerly until the intersection with Bondowie Road and westerly along Bondowie Road until the intersection with Kitto Road then southerly along Kitto Road to the intersection with the Main North Road and northerly along the Main North Road until the intersection with the Gladstone-Huddleston Road. The Rocky River ward then contains the area generally north of the Gladstone-Huddleston Road until the intersection of the boundary of the Regional Council of Port Pirie.


4.—Yackamoorundie Ward

The western boundary of the Yackamoorundie Ward commences at a point on the Council’s boundary where the Yacka-Koolunga Road crosses the boundary with the Wakefield Regional Council.
