DEVELOPMENT ACT 1993: SECTION 48

DECISION BY THE PRESIDING MEMBER OF DEVELOPMENT ASSESSMENT COMMISSION AS DELEGATE OF THE GOVERNOR

Preamble 1. The decision by the Governor under Section 48 of the Development Act 1993, to approve the development of an Organics Waste Treatment and Recycling Research Facility at Buckland Park was published in the Government Gazette on 5 December 2003. 2. The development was the subject of a Public Environmental Report and an Assessment Report under Sections 46 and 46C of the Development Act 1993. 3. Seven amendments to the development approval were subsequently considered and approved by the Development Assessment Commission as delegate of the Governor, and published in the Government Gazette on 29 April 2004, 6 May 2004, 27 May 2004, 13 January 2005, 9 June 2005, 23 June 2005 12 October 2006, 16 August 2011. 4. A further amendment to the development approval has been under consideration by the Presiding Member of the Development Assessment Commission as delegate of the Governor under Division 2 or Part 4 of the Development Act. 5. The amendment to the development is contained in a letter dated 30 May 2013 from Lachlan Jeffries of the Jeffries Group and relates to the permanent increase in tonnage received of green waste at Buckland Park from 150 000 tonnes to 185 000 tonnes. 6. The Presiding Member of the Development Assessment Commission is satisfied that the minor variation does not require the preparation of a further or amended Public Environmental Report. 7. The Presiding Member of the Development Assessment Commission has, in considering the matter, had regard to all relevant matters under Section 48 (5) of the Development Act 1993. Decision PURSUANT to Section 48 of the Development Act 1993, the Development Assessment Commission, as delegate of the Governor granted provisional development authorisation to the amended Organics Waste Treatment and Recycling Research Facility at Buckland Park, subject to the conditions and Notes to the applicant below: (a) reserve a decision on the following pursuant to Section

48 (6): (i) Construction of the bulkfill (subgrade) for future

windrow areas using Calsilt. CONDITIONS OF APPROVAL

1. The Organics Waste Treatment and Recycling Research Facility, Buckland Park shall be undertaken in accordance with: (a) the following documents and drawings as they relate to

the Organics Waste Treatment and Recycling Research Facility, Buckland Park:

Documents (i) the Public Environmental Report prepared by

Jeffries Garden Soils dated January 2003; (ii) the Response Document prepared by Jeffries

Garden Soils dated May 2003; (iii) Environmental Management Plan for a Resource

Organics Resource Centre at Buckland Park, prepared by Rodenburg Davey & Associates Pty Ltd, dated 6 August 2003, Revision 1 (enclosing final drawings);

(iv) the letter from Finlaysons Lawyers, titled Jeffries Organics Recycling Facility Proposal-Final Development Application dated 26 September 2003;

(v) the assessment report prepared by the Minister for Urban Development and Planning dated November 2003;

(vi) the letter from Jeffries Garden Soils dated 21 March 2004;

(vii) the letter from Jeffries Garden Soils dated 5 April 2004;

(viii) the letter from Rodenburg Davey & Associates Pty Ltd dated 14 April 2004;

(ix) the letter from Rodenburg Davey & Associates Pty Ltd dated 15 April 2004;

(x) the letter from Rodenburg Davey & Associates dated 28 April 2004;

(xi) the letter from Lachlan Jeffries of Jeffries Group dated 4 March 2004;

(xii) the letter from Lachlan Jeffries dated 24 May 2004;

2. The quantity of feedstock to be received or processed at the site shall not exceed 185 000 tonnes per annum. 3. The raw materials for composting shall comprise green organics (foliage, grass cuttings, prunings and branches), saw dust, timber (pallets, boxes), and wet organics (processed grease trap residue, street sweepings) unless otherwise prescribed under the provisions of an Environmental Management Plan prepared and amended (as approved by the EPA pursuant to this development approval. 4. All incoming feedstock material shall be unloaded, stored and processed (screened and shredded) at Jeffries Wingfield site before being transferred to Buckland Park by covered truck in stage 1.

All incoming feedstock (unprocessed) shall be unloaded, stored and processed in the receival shed at Buckland Park in stage 2 within 24 hours of being received. 6. The construction of the processing areas (windrowing and final product), wheel wash bay area and surface water storage area shall be to the specifications listed in the ‘Environmental Management Plan for a Recycled Organics Resource Centre at Buckland Park, dated 21 August 2003, Revision 2. 7. The construction of all stages for the windrowing areas and wastewater areas shall be to Level 1 Supervision as set out in Australian Standard 3798-1996. Daily logs and final supervision report shall be forwarded to the Environment Protection Authority. 8. A minimum of 1 m separation distance shall be maintained between the groundwater level and the underside of all liners on the site. 9. The location and decommission status of old wells located on the site shall be confirmed and the operational wells decommissioned in accordance with the requirements of the Water Resources Act 1997. 10. Work constituting building work under the Development Act 1993 shall be certified by a private certifier as complying with the Building Rules, prior to any building work commencing. 11. Design specifications of the receival shed shall be forwarded to the Environment Protection Authority prior to construction and approved by the Development Assessment Commission prior to its construction. The receival shed shall be fully enclosed and have a concrete floor. 12. The design and construction of the road access junction to the site from Port Wakefield Road shall be to the reasonable satisfaction of Department for Transport, Energy and Infrastructure and at the cost of the proponent. 13. Prior to commencing operation at the site McEvoy Road must be sealed to the standard agreed between the proponent and the City of Playford, and at the cost of the proponent. 14. The proponent must install a meteorological monitoring station in accordance with ‘Meteorological Monitoring Guidance for Regulatory Modelling Applications, US EPA, February 2000’. And be operational before operations at the site commence. It shall be to such a standard that it produces data suitable for air pollution modelling and complaint resolution. Note: the parameters that should be recorded are wind speed and direction at 10m height, standard deviation of wind direction, temperature at 2m and 10m heights, solar radiation and rainfall. Unless varied by the following conditions: 15. The mounds constructed up to 15 March 2004 with compost material contaminated with plastics shall be covered with a minimum of 300 mm of topsoil and maintained to ensure no plastic material is exposed. 16. Compost material used for the construction of the mounds or used on site may only contain an incidental amount of plastic fragments or other contaminants after processing, with the exception of mounds constructed up to 15 March 2004. 17. The compost material containing plastics, currently located at the Jeffries Wingfield facility shall be allowed to be stockpiled adjacent to the proposed Primary Processing Building at the Jeffries Buckland Park site to enable future processing to remove the plastic and other contaminants prior to use on the site in future mound construction. 18. A topsoil cover of a minimum of 300 mm shall be maintained over the stockpile to ensure there is no litter. 19. The ‘Calgrit 50’ and ‘Grit’ shall be maintained at a moisture content that will minimise the potential for generation of dust at stockpile areas, during stockpiling, construction and operation of the windrows. 20. The water quality in the surface water storage ponds shall be monitored in accordance with the relevant provisions of the Environmental Management Plan. 21. The surface and side slopes of the ‘Calgrit 50’ and ‘Grit’ capping layer and the surface water drainage system will be inspected on a monthly basis and after prolonged rain to ensure their integrity, and shall be maintained to ensure effective operation.

22. Unprocessed organic material shall not be received at the Jeffries Organic Waste Treatment and Recycling Research Facility until the primary processing facility proposed at the site is established. 23. All vehicles transporting primary processed material to Buckland Park shall have the following features: • Vehicles will be fully enclosed, ie solid floor sides and a

canvas or synthetic top cover that is attached to the sides in a manner that does not allow the escape of material;

• Vehicles will consist of either semi-trailers or truck and trailer combination.

24. A combined wheel wash and wash bay shall be installed within the Buckland Park facility for vehicles transporting materials and products to and from the facility and for the wash down of mobile plant within the facility. 25. All vehicles used solely for the transportation of primary processed organics to the Buckland Park site shall be required to be washed down externally before leaving the site empty, provided the vehicle body remains fully enclosed. The vehicles shall be washed externally and internally if used to transport compost or other materials from the Buckland Park site. 26. All mobile plant moving from one activity area to another shall be washed down at the wash bay before entering the new activity area. 27. Construction for the variations shall occur as per the specifications supplied in the Jeffries letter dated 24 May 2004 and email from Robert Rodenburg dated 1 July 2004. 28. Raw material and feedstock for composting shall not be placed on the hard stand areas at any time. 29. Maintenance of at least a 200 mm layer over the Calsilt perimeter mounds shall be required to be composed of a minimum layer of 100 mm of sandy loam then followed by a minimum layer of 100 mm of coarse compost. 30. The Equipment Washdown Facility shall be contructed as per the details listed in the letter dated 25 February 2005 from the Jeffries Group.

NOTES 1. The proponent has an obligation under the Aboriginal Heritage Act 1988, whereby any ‘clearance’ work, which may require permission to disturb, damage or destroy Aboriginal Sites must be undertaken with the full authorisation of the Minister for Aboriginal Affairs. 2. An environmental authorisation granted by the Environment Protection Authority will include conditions requiring compliance with the standards of site preparation, management and maintenance detailed in the Environmental Management Plan, dated 21 August 2003, Revision 2 and the following requirements; • The monitoring of the separation distance between

groundwater and underside of the clay liner. Measures will be required to put in place to ensure corrective actions being activated prior to the separation distance being at, or less than 1 m. It is proposed to set a trigger level at 1.10 m separation distance for more frequent level monitoring (minimum daily) and a second one at 1.05 m separation distance to activate corrective actions. The Environment Protection Authority licence condition will require water levels to be measured weekly and assessed and reported monthly to the Environment Protection Authority for the first year of operation.

• Maintenance of all drains and ponds. 3. The Minister has a specific power to require testing, monitoring and auditing under Section 48 (c) of the Development Act 1993. Dated 5 November 2013. T. BYRT, Presiding Member, Development

COMPLYING DEVELOPMENT—REGULATION 8A AND SCHEDULE 4 Areas Revoked and New Areas Determined by the Minister for the Purposes of Schedule 4—

Complying Development, Clause 2B—New Dwellings Preamble For the purposes of Section 35 of the Development Act 1993, the development of new dwellings that are located within areas determined by the Minister and that meet the requirements of Clause 2B of Schedule 4 of the Development Regulations 2008, will be complying development. The Minister has decided to extend the existing determined area within the Town of Gawler under which Clause 2B of Schedule 4 applies. To give effect to this adjustment, the Minister has decided to revoke the existing determined areas for the Town of Gawler and apply a new determined area.

NOTICE PURSUANT to Schedule 4, Part 2B (1) of the Development Regulations 2008, I, John Rau, being the Minister administering the Development Act 1993, have revoked all existing determined areas applying to the Town of Gawler as previously published in the Government Gazette. Further, I have determined that Clause 2B of Schedule 4 will, in the Town of Gawler, apply in relation to the shaded areas shown on the Residential Code Maps attached to this Notice marked ‘Attachment A’ and fix the day on which this Notice is published in the Government Gazette as the day on which the determined area will apply.

Approval of Category B Containers I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Approval of Category B Containers Approve as Category B Containers, subject to the conditions in subclauses 1, 2, 3 and 4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; and (d) the name of the holders of these approvals. (1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for

containers of that class. The Authority specifies the following refund markings for Category B Containers: (i) ‘10c refund at collection depots when sold in S.A.’; or (ii) ‘10c refund at S.A./N.T. collection depots in State/Territory of purchase’. (2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to

containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B Containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Revocation of Approval of Category B Containers I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby revoke the approvals of the classes of Category B Containers sold in South Australia as identified by reference to the following matters, which are described in the first 4 columns of Schedule 1 of this Notice: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; and (d) the name of the holders of these approvals. Variation to Existing Approval of Collection Depot I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 69 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Variation to Existing Approval of Collection Depot Vary the approval of the collection depot, listed at Schedule 1 of this Notice, that was granted under the Act prior to the date of this Notice and impose the conditions of this approval to be as follows: Approval of Collection Depot The collection depot identified by reference to the following matters is approved: (a) the name of the collection depot described in Column 1 of Schedule 1 of this Notice; (b) the name of the proprietor of the depot identified in Column 3 of Schedule 1 of this Notice; and (c) the location of the depot described in Columns 4-6 of Schedule 1 of this Notice. The collection depot listed at Schedule 1 of this Notice is approved in relation to all classes of containers which were

approved under the Act, at or subsequent to the date of this Notice, as Category B Containers. Conditions of Approval Impose the following conditions on the approval: (a) If the approval holder’s name or postal address (or both) changes, then the approval holder must inform the

Authority in writing, within 28 days of the change occurring. (b) If the collection depot is sold to another party, the Approval Holder must inform the Authority in writing, within

28 days of settlement. (c) The approval holder who wishes to cease operation of the depot shall notify the Authority in writing no less than

14 days from the date of closing. (d) The approval holder, or a person acting on his or her behalf, must not pay a refund on, or seek reimbursement for,

containers that the Approval Holder, or the person acting on his or her behalf, knows were not purchased in South Australia.

(e) The approval holder must ensure that prominent signage is displayed, detailing the offence and the penalties under Section 69 of the Act, for presenting interstate containers for refund.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, the holder of a Northern Zone Rock Lobster Fishery licence issued pursuant to the Fisheries Management (Rock Lobster Fisheries) Regulations 2006 (the ‘exemption holders’) are exempted from the provisions of Regulation 4 of the Fisheries Management (Vessel Monitoring Scheme) Regulations 2007, but only insofar as the exemption holder shall not be guilty of an offence when using a registered boat that is endorsed on the licence without a fitted and approved vessel monitoring unit (the ‘exempted activity’), subject to the conditions specified in Schedule 1, from 1 November 2013 until 31 May 2014, unless this notice is varied or revoked earlier.

SCHEDULE 1 1. The registered boat used pursuant to this exemption must be 7.5 m or less in length. 2. The exemption holder may only conduct the exempted activity when fishing for species other than southern rock lobster (Jasus edwardsii) and giant crabs (Pseudocarinus gigas). 3. TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007 (‘the Act’), a registered master fishing pursuant to a Northern Zone Rock Lobster Fishery Licence (the ‘exemption holder’) is exempt from Regulation 7 and Clause 18 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder, or a person acting as their agent, may take Southern Rock Lobster (Jasus edwardsii) using rock lobster pots that do not have escape gaps (‘the exempted activity’), subject to the conditions in Schedule 1, during the period 1 November 2013 until 31 May 2014, unless varied or revoked earlier.

SCHEDULE 1 1. A person fishing pursuant to a Northern Zone Rock Lobster Fishery Licence may only undertake the exempted activity when an employed independent observer is on board the boat and that observer is undertaking catch sampling for research purposes, in accordance with the agreement between the South Australian Northern Zone Rock Lobster Fishermen’s Association and SARDI Aquatic Sciences. 2. Data generated from the exempted activity must be forwarded directly to SARDI Aquatic Sciences. Data may not be copied or provided to additional parties. 3. The observers for the purpose of this exemption are limited to Asher Dezsery, 158 Dawkins Road, Lewiston, S.A. 5501 and Timothy Schoept, 24A Cardiff Road, Port Lincoln, S.A. 5606. 4. Only when an observer is on board a boat can the escape gaps on all rock lobster pots be closed. 5. All escape gaps must be opened as soon as the observer(s) leave the boat. 6. Background: 1. Pursuant to Section 6 of the Public Corporations Act 1993, and Sections 6 and 7 (2) (f) of the South Australian Water Corporation Act 1994, the South Australian Water Corporation (SA Water) is subject to control and direction by its Minister, and has the functions conferred on it by its Minister. 2. The South Australian Water Corporation Act 1994 is committed to the Minister for Water and the River Murray (the Minister) by way of Gazettal notice dated 21 October 2011 (p. 4289). 3. The Water Industry Act 2012 provides for the regulation of prices for water and sewerage retail services by declaring the water industry to constitute a regulated industry for the purposes of the Essential Services Commission Act 2002 and providing for the Essential Services Commission of South Australia (the Commission) to make a determination under the Essential Services Commission Act 2002 regulating prices, conditions relating to prices, and price-fixing factors for such retail services. 4. In making such a determination, the Commission must comply with the requirements of any pricing order issued by the Treasurer under Section 35 of the Water Industry Act 2012.

The Treasurer has, on 24 September 2012, issued such a pricing order (the Initial Pricing Order) which applies to, amongst other things, a determination in respect of drinking water and sewerage retail services provided by SA Water for the three year period commencing 1 July 2013 (the initial regulatory period). 6. As part of the Initial Pricing Order, the Treasurer has required that any determination of the Commission in respect of such services allow SA Water to recover: (a) the efficient cost of assets to be acquired over the course

of the initial regulatory period which are required to support activities that SA Water is required to provide in accordance with a direction under Section 6 of the Public Corporations Act 1993;

(b) the costs of externalities (including water planning and management) as are attributable to and payable by SA Water in accordance with the law, including a direction under Section 6 of the Public Corporations Act 1993; and

(c) such costs (less any relevant contributions to such costs that it receives) that are attributable to activities that SA Water is required to provide in accordance with a direction under Section 6 of the Public Corporations Act 1993, and are either:

(i) specified in the relevant direction, or if not so specified,

(ii) determined by the Commission to be efficient. 7. The Minister considers it appropriate, in the interests of transparency, to direct SA Water to: (a) provide certain services, in addition to the services it is

required to provide pursuant to Section 7 of the South Australian Water Corporation Act 1994 and the Charter for SA Water;

(b) purchase renewable energy certificates or carbon offsets for the purpose of operating the Adelaide Desalination Plant;

(c) maintain State-wide pricing in respect of the drinking water and sewerage retail services it provides to customers;

(d) continue to contribute to water planning and management charges; and

(e) continue to annually reimburse the Minister in respect of fees paid to the Valuer-General for copies of the valuation roll,

the costs of which may be recovered by SA Water in accordance with the terms of the Initial Pricing Order.

8. The Minister intends that this Direction revoke and replace the previous Direction made to SA Water pursuant to Section 6 of the Public Corporations Act 1993 on 25 February 2013 and published in the Gazette on 7 May 2013. Direction: I, Ian Hunter, Minister for Water and the River Murray, direct SA Water to purchase or provide the following services, facilities and contributions until further notice, subject to and in accordance with the following provisions: A. SA Water must purchase applicable renewable energy certificates (RECs) for the purposes of the operation and maintenance of the Adelaide Desalination Plant and associated infrastructure, or otherwise fully offset the carbon impact of that operation and maintenance, sufficient to maintain South Australia’s commitment at Clause 17 of the Implementation Plan for Augmentation of the Desalination Plant (100 gigalitres per annum), National Partnership Agreement on Water for the Future.

F. State-wide Pricing Facility SA Water must set tariffs for the provision of the drinking

water and sewerage retail services it provides on the basis of State-wide pricing i.e. the tariffs or tariff components for such services must be the same, or result in a similar outcome, for all customers in an equivalent class irrespective of the customer’s location.

The South Australian Government will make the following contributions to SA Water in each financial year of the initial regulatory period in order to support the lowest levels of State-wide tariffs possible:

(i) in relation to SA Water’s drinking water retail services.

Road Closure—Cleve NOTICE is hereby given, pursuant to Section 10 of the Roads (Opening and Closing) Act 1991, that The District Council of Cleve proposes to make a Road Process Order to close the whole of the un-made Public Road situate between Sections 68 and 69, Hundred of Mann and merge with the said Section 69 more particularly delineated and lettered ‘A’ on Preliminary Plan No. 13/0039. DISTRICT COUNCIL OF KIMBA Temporary Road Closure

NOTICE is hereby given that at a Council meeting held on 9 October, 2013, Council resolved the following: That: (1) The District Council of Kimba exercise the power subject

to Section 33 of the Road Traffic Act 1961 and Clause F of the instrument of general approval of the Minister dated 27 April 2010, to make an order that High Street from Martin Terrace to the southern side of North Terrace be closed between 5 p.m. and 8.30 p.m. and that High Street between Cross Street and the southern side of North Terrace remain closed between 8.30 p.m. and 10.30 p.m. on Saturday, 21 December 2013 for the purpose of holding Kimba’s Christmas pageant and festivities.

(2) Pursuant to Section 33 (1) (b) of the Road Traffic Act 1961, make an order directing that persons taking part in the event be exempted, in relation to roads, from the duty to observe the Australian Road Rules specified and attached to the exemption:
