Preamble1. The Development Plan amendment entitled ‘The Barossa

Council—Rural B Zone (Concordia)—Waste Disposal AnomalyPlan Amendment (the Plan Amendment) has been finalised inaccordance with the provisions of the Development Act 1993.

2. The Minister for Urban Development and Planning hasdecided to approve the Plan Amendment.

NOTICE

PURSUANT to section 26 of the Development Act 1993, I—

(a) approve the Plan Amendment; and

(b) fix the day on which this notice is published in theGazette as the day on which the Plan Amendment willcome into operation.

THE MAGISTRATES COURT OF SOUTH AUSTRALIAAmendment No. 21 to the Magistrates Court

(Civil) Rules 1992PURSUANT to section 49 of the Magistrates Court Act 1991 and all other enablingpowers, we the undersigned do make the following amendments to the Magistrates Court(Civil) Rules 1992:

Rule 106 is deleted and replaced with the following:

106. (1) Subject to these Rules or to an order of the Court, a successful partyin an action (other than a minor civil action) is entitled on judgmentto costs against an unsuccessful party, or any other party that theCourt may order, in accordance with the following principles:

(a) where judgment is in respect of an action for a sum of money:

(i) a successful plaintiff is entitled to costs on the relevantscale in the Third Schedule applicable to the sum actuallyrecovered;

(ii) a successful defendant is entitled to costs on the relevantscale in the Third Schedule applicable to the sum claimed;

(b) where judgment is in respect of any other action—a successfulparty is entitled to costs on the scale in the Third Schedulespecified by the Court;

or

(c) where the action involved unusual difficulty or intricacy, orother proper cause exists—a successful party is entitled to costson such percentage of the Supreme Court scale as the Courtspecifies.

(2) In a minor civil action, a successful party is entitled on judgment tocosts against an unsuccessful party, or any other party that the Courtmay order, in accordance with the relevant scale in the ThirdSchedule.

(3) If, on the hearing of an action (other than a minor civil action), asuccessful party recovers a sum of money being $3 000 or less, thatparty is, unless for special reasons the Court orders otherwise,entitled to costs only as if it were a minor civil action.

(4) Where proper cause exists, the Court may order that a successfulparty is entitled to costs on a solicitor and client basis.

(5) Unless the Court orders otherwise, a party is not entitled to costs onboth a claim and counterclaim in the same action.

(6) Where there is no scale of costs applicable to an action orproceeding, the Court may fix the appropriate scale of costs onapplication of the successful party or at the request of the Registrar.

(7) (a) A party may, by notice in writing served on all other parties,certify that the nature of an action entitles the parties to costs onthe relevant scale in the Third Schedule as a complex actionand, unless any other party by notice in writing objects(including detailed reasons for the objection) within 21 days ofthe service of the notice, a party entitled to costs in the action isentitled to costs on the relevant scale as a complex action.

(b) If a party so objects, the relevant scale may be determined bythe judicial officer hearing the trial of the action.

(c) In any other case, unless the Court orders otherwise, the relevantscale for a complex action will not apply.

(8) A plaintiff who serves a claim by post (except by the agency of theRegistrar) is not entitled to the costs thrown away up to the time ajudgment relying upon that service is set aside unless the Court issatisfied that the claim form came to the attention of the defendant.

(9) Where a Non-Payment Order is in force Rule 127A deals with acreditor’s right to costs.

(10) A magistrate may intimate her or his view of the likely result of acase at any time in pre-trial processes and if s/he does so thatintimation must not be available to the trial magistrate until afterjudgment when the trial magistrate may take it into account inrelation to costs.

Note that a plaintiff may not be entitled to the costs for the filing of a claimunless notice of the claim is given, or if the defendant has given notice ofwillingness to consent to judgment, in accordance with Rule 20A.

PURSUANT to section 44 of the Radiation Protection and ControlAct 1982, I, Graeme Robert Palmer, Acting Director of theRadiation Protection Division of the Environment ProtectionAuthority, being a person to whom the powers of the Ministerunder that section have been delegated under the Act, exemptdiagnostic radiographers from the requirements of regulation 40 ofthe Radiation Protection and Control (Ionising Radiation)Regulations 2000, subject to the following conditions:

1. This exemption only applies to the exposure of a person toionising radiation for the purposes of plain radiography where:

(1) the exposure has been directed by Luke AndrewChristofis while engaged in the capacity of NursePractitioner at an Emergency Department; and

(2) Luke Andrew Christofis has classified the person astriage category 3, 4 or 5 presenting with isolatedextremity or pelvic injuries.

2. The direction referred to in condition 1 must comply with thefollowing requirements:

(1) it must be in writing;

(2) it must contain details of the examination or treatmentbeing undertaken;

(3) it must contain the clinical indications for theexamination or treatment;

(4) it must contain a statement by Luke Andrew Christofismaking the direction that the person is classified as triagecategory 3, 4 or 5 presenting with isolated extremity orpelvic injuries;

(5) it must contain a statement by Luke Andrew Christofisthat he has due authority to give the direction;

(6) it must be signed by Luke Andrew Christofis; and

(7) it must be signed by the radiographer who is performingthe examination or treatment.

3. Luke Andrew Christofis must, when directed to do so by theRadiation Protection Division, provide the Radiation ProtectionDivision with a written report on diagnostic radiographyauthorised by him during a period specified by the RadiationProtection Division. The report must contain statistics ofdiagnostic radiography authorised and details of any radiationsafety issues associated with the examinations during the specifiedperiod.

4. The exemption shall take effect commencing on the date ofpublication of this notice in the Government Gazette.
