PURSUANT to Section 29 (2) of the Development Act 1993, I, Jay Weatherill, being the Minister administering the Act, amend theCampbelltown (City) Development Plan consolidated on 27 November 2003 as follows:

‘Delete Map Cam/3 in the Campbelltown (City) Development Plan consolidated on 27 November 2003 and insert the contentsof Attachment A’.

TAKE notice that pursuant to section 59 of the Fisheries Act1982, Helen Tassie, Education Officer of the MalacologicalSociety of South Australia Inc. (the ‘exemption holder’),c/o Marine Invertebrates Section, South Australian Museum,North Terrace, Adelaide, S.A. 5000, or her agents are exemptfrom the provisions of Clause 65 of Schedule 1 of the Fisheries(General) Regulations 2000 insofar as she may engage in theactivities specified in schedule 1 (the ‘exempted activity’), subjectto the conditions set out in Schedule 2, from 4 February 2004 to14 February 2004 inclusive, unless varied or revoked earlier.

SCHEDULE 1

The collection of aquatic organisms from South Australiancoastal waters (including intertidal rocky reefs) adjacent toStreaky Bay.

SCHEDULE 2

1. Aquatic organisms collected by the exemption holderpursuant to this notice must not be sold.

2. Before collecting any aquatic organisms pursuant to thisnotice, the exemption holder must notify the PIRSA FisheriesCompliance Unit on 1800 065 522 with details of the proposedlocations and the dates on which the collections are to be made.

3. While engaging in the exempted activity, the exemptionholder must carry identification proving membership of theMalacological Society of South Australia.

4. Within 14 days of the collection of aquatic organismspursuant to this notice, the exemption holder must provide a reportin writing to the Director of Fisheries, (Attention: Kristy Power,P.O. Box 282, Port Adelaide, S.A. 5015), giving the followingdetails:

• the date and time of collection;

• the description of all species collected; and

• the number of each species collected.

5. While engaging in the exempted activity, the exemptionholder must be in possession of a copy of this notice. Such noticemust be produced to a PIRSA Fisheries Compliance Officer ifsuch an officer requests that it be produced.

6. The exemption holder must not contravene or fail to complywith the Fisheries Act 1982, or any regulations made under thatAct, except where specifically exempted by this notice.

3. A maximum of 5 fish of any species per location may betaken for the purpose of species identification.

4. Before conducting the exempted activity, the exemptionholders must advise the PIRSA Fisheries Compliance Unit on1800 065 522 with the name of the person who will be conductingthe exempted activity, details of the proposed locations and thedates on which the collections are to be made.

5. The exemption holders must provide a report in writingdetailing the outcomes of the research and the collection oforganisms pursuant to this notice to the Director of Fisheries,(Attention: Kristy Power, P.O. Box 282, Port Adelaide, S.A.5015) within 3 months of the expiry of this notice, giving thefollowing details:

• the date, time and location of collection;• the description of all species collected; and• the number of each species collected.

6. While engaging in the exempted activity, the exemptionholders must be in possession of a copy of this notice. Such noticemust be produced to a PIRSA Fisheries Compliance Officer ifsuch an officer requests that it be produced.

Notice of Restriction of Water Use in the Saunders CreekCatchment Area

PURSUANT to section 16 (1) of the Water Resources Act 1997(‘the Act’), I, John David Hill, Minister for Environment andConservation, being of the opinion that:

1. The rate at which water is being taken from thewatercourses, and from the wells accessing the upperunconfined aquifer in the Murray Group Formation and thelower confined aquifer in the Renmark Beds (‘the Wells’), inthe area described in Schedule 1 (‘the designated area’) is likelyto affect the quality of the water in those watercourses andaquifers;

2. The rate at which water is being taken from watercoursesand the Wells in the designated area is such that there is a riskthat the available water in the designated area will not besufficient to meet future demand; and

3. The rate at which surface water is taken from thedesignated area is such that the surface water available in thedesignated area can no longer meet the demand,

hereby restrict the taking of, surface water, water fromwatercourses and water from the Wells, in the designated areasubject to the exceptions specified in Schedule 2.

SCHEDULE 2

1. Subject to clause 3 of this Schedule, a person authorised inwriting by the Minister responsible for administering the Act (‘theMinister’) or delegate pursuant to a notice under section 16 of theAct published in the Government Gazette on 24 January 2002 atpage 383, may take water for the same purpose and subject to thesame conditions as specified in the authorisation.

2. The Minister or delegate may grant an authorisation pursuantto this notice in accordance with Guidelines dated 24 January2002 signed by the Minister (‘the Guidelines’).

3. Any authorisation referred to in clauses 1 or 2 of Schedule 2may be varied by the Minister or delegate by the issue of a furtherwritten authorisation granted in accordance with the Guidelines. orcancelled where a person authorised to take water has transferredhis or her land and the transferee of that land has been authorisedto take water in accordance with clause 5 hereof.

4. It is a condition of the right to take water under this noticethat:

(a) The water is only taken through a meter which accuratelymeasures the quantity of water taken and is at all times ingood working condition; and

(b) That the person or persons with the right to take waterunder this notice will permit any person appointed as anauthorised officer under section 87 of the Act to read themeter and inspect the meter, for the purpose of assessingwhether the meter is in good condition and is accuratelymeasuring the rate the water is taken, at any reasonabletime.

5. Where land has been transferred from a person authorisedunder any of the notices referred to in clauses 1 or 2 of Schedule 2the Minister may authorise the transferee to take water on thesame terms as the transferor pursuant to the Guidelines or suchvaried terms as the Minister or delegate may specify in writing tothe transferee.

6. This restriction does not apply to the taking of water pursuantto section 7 (5) of the Act for domestic purposes or watering stock(other than stock subject to intensive farming) or to taking waterfor fire fighting or public road making in the area as indicated inSchedule 1.

7. This restriction does not apply to the taking of undergroundwater for the purpose of applying chemicals to non-irrigated cropsand non-irrigated pasture in the area as indicated in Schedule 1.

This notice will remain in effect for 2 years from the date of thisnotice unless earlier varied or revoked.
