MEMORANDUM OF UNDERSTANDING

BETWEEN

THE VOICE OF VIETNAM

OF

THE SOCIALIST REPUBLIC OF VIETNAM

AND

PUBLIC SERVICE BROADCASTING OF RADIO REPUBLIK INDONESIA (LPP RRI)

OF

THE REPUBLIC OF INDOINESIA

The Voice of Vietnam of the Socialist Republic of Vietnam and Public Service Broadcasting ofRadio Republik Indonesia (LPP RRI), hereinafter referred to as 'The Parties' and singularlyreferred to as 'The Parry';

Desiring to establish and develop cooperation in the sphere of radio broadcasting on the basis ofequally, reciprocity and mutual benefits.

Convinced that the cooperation will foster mutual understanding, friendship and knowledgebetween their peoples;

Pursuant to the prevailing laws and regulations in the respective countries;

Have agreed as follows :

ARTICLE IOBJECTIVE

The purpose of this cooperation is to promote understanding between people of the t*c c*unriesthrough exchange of radio news and programs on arts, culture, tourism, trade and social issaes-

ARTICLE IISCOPE AND COVERAGE

The cooperation under this Memorandum of Understanding shall include the following activities:

1. The Parties shall exchange locally produced radio news and programs, either live or recorded

materials about social, tourism / site of interest, trade, arts & cultural, educational issues, free

ofcharge and on a reciprocal basis.

2. The Parties shall have the right to broadcast and transmit the selected exchanged news and

programs.3. The Parties shall exchange of radio program highlighting the Parties' / respective National

Day celebrations on a reciprocal basis.4. The Parties shall exchange of folk, classic and popular musical programs and or musical

recordings of respective parties.5. The Parties shall exchange ef visits of senior officials, producers, broadcasters, journalists

and technical staffon a reciprocal basis.6. The Parties shall exchange news and information via internet and also banner on their

websites.7. The Parties shall endeavor to co - produce radio programs of mutual interest. Details of

theme, time, venue, expense for specific co - production shall be discussed at least one (01)

month beforehand.8. The Parties shall jointly orgatize a short capacity building workshop, with English as the

medium of communication / instruction.9. Any other areas which may be agreed upon by both Parties, and which relate to the

cooperation in the sphere of radio broadcasting.10. The radio programs for exchange will be in CD format or via ftp (original sound) with script

in English. The length of the programs and the number of broadcasting times shall be

discussed in details by the Implementing Agencies of the two Parties.

ARTICLE IIIIMPLEMENTATION

1. For the implementation of this Memorandum of Understanding, the Parties shall designatepoint of contact for coordinating and facilitating cooperative activities under thisMemorandum of Understanding.

2. The Parties may conclude cooperative arrangement for the implementation of cooperativeactivities under this Memorandum of Understanding. Such arrangement shall be

inconformity with this Memorandum of Understanding and shall consist of. inter alia :

program, activities, financial arrangement, responsibility of the Parties, and other matteds

undertaken by the Parties involved.

ARTICLE IVWORKING GROUP

To set up the plan of cooperation and its activities as well as to review and discuss the activities

and progress of cooperation under this Memorandum of Understanding, the Parties shall

establish Working Group which may meet alternately in Indonesia and Vietnam. If the meeting

cannot be held in certain circumstances, the Parties shall exchange documents in lieu of such

meeting.

ARTICLE VEXPENSES

Expenses in the implementation of Article 2 of this Memorandum of Understanding shall be

borne by each party based on the availability of funds and resources. Specifically for Clause 6,

Article II and for visit of Working Group, the host Party shall cover the expenses of meals,

accommodation and local transport.

ARTICLE \rIINTBLLECTUAL PROPERTY RIGHTS AND PUBLICATION

Any intellectual property brought by each Party in the activities under this Memorandum ofUnderstanding shall be protected by the Parties in accordance with laws and regulation of therespective countries and international agreement related to intellectual property right thattheir countries are Party.The exchanged material in the implementation of this Memorandum of Understanding shallnot be disclosed to any third party for any reason or purpose, without prior writtenpermission of the originating country.

ARTICE VIIAMENDMENT

This Memorandum of Understanding may be amended at any time by mutual written consent ofthe Parties. Such amendment form integralpart of this Memorandum of Understanding and shallenter into force on the date as determined by the Parties.

ARTICLE VIIISETTLEMENT OF DISPUTE

Any dispute arising out of the implementation and / or interpretation of this Memorandum ofUnderstanding shall be settled amicably through consultations and / or negotiations between the

Parties.

ARTICLE IXENTRY INTO FORCE, DURATIOI\ AND TERMINATION

1. This Memorandum of Understanding shall enter into force on the date of its signing.

2. This Memorandum shall remain in force for a period of two years and shall be automaticallyrenewed for every following year.

3. Either Party may terminate this Memorandum of Understanding with giving writtennotification to the other Party on its intention of termination, 5 (five) months in advance.

Such termination shall not affect the validitv and duration of any ongoing programs, projects,

and / or cooperative arrangement made under this Memorandum of Understanding until theircompletion unless decided otherwise b.v the Parties.

IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed thisMemorandum of Understanding.

DONE in Hanoi, Vietnam at this day of ..... in the year two thousand ..... in six original texts,

three each in Vietnamese, lndonesian and English languages; all texts being equally authentic. Inthe event of divergence, the English language text shall prevail.
