SOLELY NEW FUNDS HOmE QUARTER PROTEcTION cLASS EXcLUSION ORDERWhereas subsection 44(12) of The Saskatchewan Farm Security Act, R.S.S. 1988, provides in part as follows:
“(12) Subject to subsection (13), the board may make orders excluding any mortgage or class of mortgages from the operation of this section where, in the opinion of the board, it is in the best interests of the farmer.”
And whereas the Farm Land Security Board is of the opinion that it is in the best interests of farmers to exclude a class of mortgages made solely for new funds.
THE FARm LAND SEcURITY BOARD THEREFORE ORDERS this 14th day of October, A.D. 2010, pursuant to subsection 44(12) of The Saskatchewan Farm Security Act (the Act), that the class of mortgages known as “solely new funds mortgages” be excluded from the operation of section 44 of the Act.
A “solely new funds mortgage” is any mortgage executed on or after the date of this Order, given solely to secure new advances, readvances or other obligations secured pursuant to the terms of the mortgage, including advances to refinance debt with any other creditor not affiliated with the mortgagee, and which meets the conditions in (1) and (2) below:
(1)(a) the mortgage secures only new advances and does not, in whole or in part, secure debt previously incurred by that farmer with the mortgagee or its affiliates;
(b) none of the new advances are to pay out or refinance debt incurred by that farmer with the mortgagee or its affiliates;

(c) the mortgagee is a recognized financial institution as defined in Part I of the Act;(d) the mortgage is not secured by a homestead not deeded to the borrower.
(2) At the time the mortgage is given, the farmer executes a statutory declaration stating:(a) the purpose of establishing the noted mortgage is solely to secure new advances pursuant to this
Order, and;(b) no advances will be used to pay debt with the subject mortgagee or its affiliates, and;(c) the declaration is made for the purpose of establishing that the noted mortgage is a solely new
funds mortgage pursuant to this class Exclusion Order, and to thereby exclude the noted mortgage from Home Quarter Protection.
This shall be a continuing Order and applies only with respect to mortgages executed on or after the 14th day of October, A.D. 2010, and shall not be considered in interpreting any mortgage executed prior to that date.

SASKATcHEWAN WORKERS’ cOmPENSATION BOARD — 2011 PROVISIONAL ASSESSmENT RATESBackground To Saskatchewan’s Compensation System
Saskatchewan’s system of workers’ compensation was founded in 1930 by a coalition of business and labour. Workers gave up the right to sue their employers for workplace injuries, and losses resulting from those injuries. Employers agreed to pay the cost of the compensation system. This working partnership provides for fairness, protection, and economic stability when workplace injury or illness occurs.
The WcB and its Board members act as trustees of this agreement between employers and workers. The agreement is based on five principles: no-fault compensation, security of benefits, collective employer liability, independence of the Board, and exclusive jurisdiction. These principles are the basis of a compensation system regarded as one of the most successful in North America.
The WcB’s obligations are set out in The Workers’ Compensation Act, 1979.

Covering the Cost of the System
The WcB has two sources of revenue: employer assessments based on payroll, and return on its investments.
Employer assessments, or rates, are set annually for each of 50 employer industry classifications. Rates vary depending upon the number of injuries and costs incurred by the employers within each classification.
The rate setting process is based on the premise that today’s employers are responsible for the cost of today’s injuries. The WcB holds discussions with employer associations before rates are set each year. This year, 18 meetings were held with employer/trade associations representing the majority of employers.
Notification of Rates
The WcB notifies each Saskatchewan employer by letter of the 2011 rates.

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the monday of the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m. of the previous Friday. Please allow yourself at least one full week to ensure mail delivery of Gazette submissions. Publication of any material received late will be delayed until the following week’s issue.
All material for publication in The Saskatchewan Gazette must be submitted electronically (WordPerfect or Word) accompanied by a signed hard copy to the Office of the Queen’s Printer, Saskatchewan Justice, B19-3085 Albert St., Regina SK S4S 0B1, tel. (306)787-2367, or by E-mail: [email protected].
Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.
Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. cheques or money orders must be made payable to the Queen’s Printer Revolving Fund. Please include the GST in addition to regular charges at the rate of 5% each for those items listed below under “GST Payable”.
The minimum charge for publication of notices not specified below is $16.00 for each notice, which sum shall accompany the material when forwarded for publication.
