Purpose

Yuan Ming Supermarket Ltd. has filed an application with the Region of Peel for:

• A retail business exemption to the Retail Business Holidays Act for the existing Yuan Ming Supermarket located at 1000 Burnhamthorpe Road West

Effect

If approved by Regional Council:

• The existing supermarket can be open (voluntarily) from 9 am to 9 pm on New Year’s Day, Good Friday, Easter Sunday, Victoria Day, Canada Day, Labour Day, and Thanksgiving Day.

Retail Business Holidays Act

Applicants must demonstrate that:

• The exemption criteria outlined in the Act and accompanying regulation (O.Reg 711/91) have been addressed; and

• The exemption would assist in the maintenance or development of tourism.

Retail Business Holidays Act

In making its decision, a municipal Council is to take into account:

• The principle that holidays should be maintained as common pause days; and

• A by-law may only be passed if there is compliance with the Provincial tourism criteria found in Ontario Regulation 711/91.

Provincial Tourism Criteria

• A retail business establishment may be exempt if

– It is located within 2 km of a tourist attraction; and,

– It is directly associated with the tourist attraction or relies on tourists visiting the attraction for business on a holiday

6: Retail Business Holidays Act: 1990

An applicant may apply for a by-law to permit one or more Retail Business Establishments to open on a holiday for the maintenance and development of tourism.

The Act stipulates that a retail establishment may be exempted if:

It is located within 2 kilometers of a tourist attraction; and

It is directly associated with the tourist attraction OR relies on tourists visiting the attraction for business on a holiday.

A “tourist attraction” is limited to:

Natural attractions or outdoor recreation attractions;

Historical attractions; and

Cultural, multi-cultural, or education attractions.

Any retail establishments that uses a total area of 2,400 or more must in addition, provide goods or services on holidays primarily to tourists.

7: Reasons for Application

Yuan Ming Supermarket meets the tourism criteria under the Retail Business Holidays Act: Regulation 711/91.

Section 2(1): A retail business establishment may be exempted if,

a) it is located within two kilometers of a tourist attraction (Square One); and

b) It is directly associated with the tourist attraction OR relies on tourists visiting the attraction for business on a holiday.

Yuan Ming Supermarket will continue to promote holidays through various promotions and ethnic food choices. Sales of food products and prepared food will be available for statutory holidays and can be seen in the flyer samples provided by Yuan Ming.

Reasons for Application Internal Tourism: Yuan Ming Supermarket

provides a superior selection of Asian groceries in the Region of Peel. Opening on holidays will provide a venue for these customers within Peel region. Currently similar grocery stores are open on holidays within Peel and York Regions.

External Tourism: Yuan Ming Supermarket is the westernmost full service Asian Grocer in the GTA. Nearly 55% of customers travel more than 10km to shop at Yuan Ming Mississauga. This customer distribution illustrates that Yuan Ming has a wide consumer draw which provides an opportunity to attract consumers to the Mississauga area from beyond the GTA on holidays. This will not only provide a potential increase in tourist numbers but will increase potential customer spending in the community.

10: Tourism Activities Yuan Ming Supermarket is located within close proximity to some of Mississauga's leading tourist

attractions, such as Celebration Square, Art Gallery of Mississauga, The Living Arts Centre and Square One Shopping Centre. Additionally, the location of Yuan Ming Supermarket is in the middle of a number of green spaces allowing it to become a destination for tourists visiting these sites .

These parks not only provide beautiful natural spaces to be experienced, but also are home to a number of recreational areas providing opportunities for swimming, skating, baseball, and a number of other recreational programs for families and individuals alike. These facilities attract visitors from beyond the local communities and, as a result, opening Yuan Ming Supermarket for holidays will provide an additional amenity to meet the needs of these visitors.

Tourism Activities (contd.) Riverwood Conservancy

One of the many natural attractions within 2km of Yuan Ming Supermarket is the RiverwoodConservancy. The Riverwood Conservancy is a volunteer and member based charity that helps to provide a number of programs to the local community in education, stewardship and gardening and horticulture. Their emphasis is providing an education to children and youth regarding the natural environment while continuing to provide a public garden, park and nature preserve. In addition the Riverwood Conservancy is also rich in historical attractions including agricultural artifacts and a number of heritage buildings. Square One Shopping Centre Located in the heart of Mississauga, Square One Shopping Centre offers a shopping experience for the local communities and tourists alike with 1.7 million square feet of retail space. Square One attracts approximately 24 million visitors a year with more than 350 retail stores and services. Since receiving exemption under the RBHA in 2009 Square One continues to expand with numerous renovations and the opening of new retailers. Source: http://www.shopsquareone.com/

Targeted holiday activities will aid in creating a “family time” environment on Statutory Holidays; this will increase customer/resident spending in Mississauga, Ontario.

Yuan Ming Supermarket caters to tourists from within and outside of Peel by offering various products from foodstuffs to prepared meals. This offering of diverse range of products is what allows Yuan Ming to serve tourists travelling to Mississauga, Ontario and the surrounding area.

Promote customer draw to the area to ensure that the dollars spent are being spent within the community

Exemption would maintain common pause day principle and fully meet obligations under the Employment Standards Act.

Its proximity and accessibility to community attractions and other tourist destinations in the Mississauga area make Yuan Ming the primary caterer to customers with basic day to day needs, as well as last minute shopping ideas for those visiting the local tourist attractions.
