Calculating buying costs

“What are the buying costs?” is naturally one of the most often asked questions by prospective purchasers. You would think this should be a straightforward question for any property professional to answer and the information available would be clear and concise, but in reality the constant tinkling of legislation by successive Government’s has created a rather confusing state of affairs which is not just limited to would-be buyers.As I read over the legislation and amendments I couldn’t help but wish that those who were responsible for devising the methods by which the current stamp duty is calculated had spent their efforts more fruitfully on creating a simpler and fairer system which doesn’t discriminate against buyers or sellers because of their agreed purchase/sales price being marginally above the £250,000 or £350,000 mark.If you buy property in Gibraltar for up to £200,000 then no stamp duty is payable, but for properties with a value between £200,000 to £350,000, stamp duty is payable at a rate of 2% on the first £250,000 and the balance attracts a rate of 5.5%, whilst a buyer of a property with a value in excess of £350,001, will pay 3% on the first £350,000 and 3.5% on the balance of the purchase price.However, following the Chief Minister’s budget announcement in Parliament on 30th June 2014, a new threshold was created for purchasers that qualify as first-time buyers or second-time buyers as defined by Section 19A of the Stamp Duties Act 2005 (“Qualifying Purchasers”). The reasoning given for the change was that it would assist working families with the purchase of their homes as well as those families who may need to move to alternative accommodation as their family composition changes.The new threshold that came into effect from 1st July 2014 means that no stamp duty is payable by first-time and second –time buyers on the first £250,000 of the cost of their property, irrespective of the total cost of their new home. This in effect represents a potential saving of £5000 in stamp duty for those prospective purchasers that fit into the criteria of “Qualifying Purchasers”.Under Section 19A.(1), a “First-time buyer” means a person, being an individual, who has not previously been a purchaser of Property subject to duty where the Real Property in Gibraltar consisted of residential property, and similarly, Section 19A.(2) defines a “second-time” buyer as a person, being an individual, who has on only one occasion previously been a purchaser of Property subject to duty where the Real Property in Gibraltar consisted of residential property.As you can see, there are now a number of factors that need to be considered when deciding the applicable stamp duty on a property transaction – namely the agreed price and whether the purchaser falls under the statutory definition of a first-time or second-time buyer, but the upshot of all this is that many purchasers can now benefit from a £5000 saving in stamp duty.
