the lobbyist’s assistance, VPMA was able to meet with the Gov-ernor’s policy staff to determine the course of this initiative. In discussions with the policy staff and key House members, it be-came obvious that this initiative would become law.

The determination was made for VPMA to support the legislation. We worked to get the amendment that two seats be added to BACS, one for a struc-tural commercial applicator and one for a person engaged in the commercial sale or application of agricultural pesticides.

The Governor’s initia-tive was codified in Senate Joint Resolution 66, and House Joint Resolution 49 both in-troduced on January 10. They both passed their respective houses, and crossed over to the other house. Each house passed an enabling legisla-tion bill (HB1291 and SB678) which contained the addition of the two dedicated seats that we

requested. These bills have also crossed over to the other house.

As expected each house insisted on their own version, so a conference committee has been called to deal with it. As of press time, this is virtually a done deal – we fully expect the merge of the PCB and the BACS to occur. It will most likely have an effective date of July 1, 2012.

PCB Merge...set fees to pay for the imple-mentation.

In the ensuing time, the PCB has adopted and imple-mented a number of regulations that have dramatically upgraded the professionalism of commer-cial applicator businesses. The PCB has operated efficiently and without controversy, over-seeing a sometimes controver-sial issue with open and fair minded sensibility.

The PCB’s work is carried out by the staff of VDACS Of-fice of Pesticide Services which is overseen by Matthew Lohr, Commissioner of VDACS. Opponents of this merge are concerned that the loss of this

independent board could sac-rifice the public’s health when discussions of pesticide and agriculture are in conflict at BACS.

The Commissioner answers this concern by explaining that the PCB fulfills its role by rely-ing on employees of VDACS OPS. This agency has a very knowledgeable staff of about 25 dedicated employees throughout the Commonwealth.

The PCB’s policy respon-sibilities will be seamlessly transferred to BACS; and the VDACS OPS staff will continue the high quality of the pesti-cide management program in Virginia. The agency staff will continue to train and certify pes-ticide applicators, educate the public about safe pesticide prac-

tices, coordinate the disposal of unwanted pesticides and the re-cycling of pesticide containers. They will continue to administer the Pesticide Control Act, the Worker Protection Standard, the Endangered Species Act and the Clean Water Act, in addition to other federal law.

If this legislation pro-gresses as it is expected to, VPMA will have scored what we consider a victory in an unwinnable situation. However, it is important to recognize the changing legislative climate that our industry is experiencing in Virginia.

After a decade of relative quiet on the legislative front, our industry has seen increased legislative change in the last 18 months – with regulations

pertaining to fumigation, apply-ing pesticides over water, mold inspection and remediation, and lead paint issues being enacted in the last year.

The LLRC will remain vig-ilant in our oversight. However, there are things that our mem-bers can do now, to strengthen our position as legislative watchdogs for the industry. You can develop a relationship now with your House Representative and Senator. These relation-ships are the backbone of the work we do. In addition, you can make a generous donation to VPCA PAC. On July 1, 2011, you may recall, new regulations went into effect concerning mold inspectors, supervisors and remediators; requiring state certification of these posi-tions. Individuals who apply chemicals to a wood structure for the sole purpose of control-ling wood-destroying pests were exempted from these regulations. However, some pest management firms have expanded into the mold inspec-tion and remediation business as a tangent service area.

As part of Governor McDonnell’s initiative to streamline government (includ-ing the merge of the PCB into

Mold Inspectors and Remediators to be Deregulatedthe Board of Agriculture and Consumer Services) he has proposed the deregulation of mold inspectors, supervisors and remediators. This deregu-lation will be achieved in the same House and Senate bills that will implement the PCB merge.

The Department of Pro-fessional and Occupation Regulation (DPOR) has con-firmed that if this legislation is passed, state licenses for these professions will be eliminated, as will the new regulations ad-opted last year. This deregula-tion will be effective as of July 1, 2012.

Bed bug eggs are incred-ibly hard to find and to kill, resulting in reinfestations after treatments have been complet-ed. Most insecticide treatments are ineffective in killing bed bug eggs.

There is no research sug-gesting how bed bug eggs com-bat insecticides, although we can assume the egg shell pro-vides the most protection. How much of a role does the egg shell play in the protection of the embryo? There is not much information available about bed bug eggs, which is strange if

you think about how much of a problem they present to the pest management industry. Usinger in the Monograph of Cimicidae (1966) provides some informa-tion about bed bug egg biology and physiology, but there is limited research on this topic. This research issue needs to be addressed.

To better understand how the egg shell protects the embryo, I am going to inject pyrethroid insecticides into bed bug eggs. I will inject eggs from both resistant and non-resistant strains. I am also going

to topically treat eggs with a direct spray of pyrethroid insecticide. I will compare the dose of insecticide that it takes to kill eggs via injec-tion to the dose that it takes to kill eggs that are sprayed. I will also com-pare mortality differences be-tween resistant and non-resistant eggs that are either injected or sprayed with insecticide. These stud-

ies will allow me to quantify the egg shell’s ability to protect both resistant and non-resistant eggs from insecticides.

If the egg shell protects the bed bug embryo from insecticide penetration, it is also possible that the egg shell protects the embryo from water loss. Insects that live indoors are always at risk of dehydra-tion. How does the bed bug egg survive in this dry environment without losing excessive mois-ture due to respiration (breath-ing)? Little is known about how much moisture bed bug eggs lose to the environment. I intend to measure water loss from bed bug eggs of different strains (resistant and non-resistant) using respirometry. A respirom-eter is a machine that measures transpiration (breathing rate) in insects. The respirometer also will measure the amount of water lost in transpiration over time at different temperatures. I intend to compare the amount of water lost between resistant and non-resistant eggs to see if resis-tant eggs are less susceptible to desiccation.

This semester I am learn-ing how to inject eggs (it is not easy) and developing my experimental protocols. I hope my research will aid in the fight against these stubborn bugs, and will be of service to the pest management industry. Thank you VPMA for helping fund this research.

My research objectives are to determine the response of both fed and starved bed bugs to diatoma-ceous earth applications in labora-tory evaluations and to determine survivorship for both fed and starved adult bed bugs at a range of temperatures.

1. To determine sur-vivorship for both fed and starved bed bugs at a range of temperatures. My research shows that an average of 94% of bed bugs die at room tem-perature (23 degrees Celsius) after prolonged starvation (4 to 5 months). At 7 degrees Cel-sius, the mortality rate is much lower for the same amount of time, 6% and 33% for the two

strains of bed bugs that I am us-ing. The practical application of this study will provide the pest management community with specific lengths of time that bed bug infested bags of personal belongings must remain closed in order to prevent a reinfesta-tion. 2. To determine the response of both fed and starved bed bugs to diatoma-ceous earth applications in laboratory evaluations. The four diatomaceous earth prod-ucts used were Safer Brand, Harris brand, Mother Earth D and PermaGuard. 100% mor-tality was reached in about 32

hours for bed bugs exposed to the PermaGuard, and about 48 hours for those exposed to MotherEarth D. 100% Mortality for Safer and Harris brands was reached in 5 and 6 days, respectively. Further assays have been performed using only MotherEarth D diatoma-ceous earth where mortality was recorded until all insects had died and the average times to mortal-ity were calculated for 50% 95% and 99% of the population. The data show that these two bed bug strains died at approximately the same rate, with 50% dead in 12.6 hours, and 99% dead in 23.2 hours. Full mortality was reached by 50 hours.

Insulation - Registered Pesticide vs. Treated Article...

Question of the Day: How can both of the following state-ments be true?

• Company A is install-ing insulation that is treated with a pesticide in the attic of homes. Company A is required to be licensed as a pesticide business and can only use certified applicators to install the insulation.

• Company B is also installing insulation that is treated with a pesticide in the attic of homes. Com-pany B is not required to be licensed as a pesticide business and does not have to use certified applicators to install the insulation.

As certified pesticide ap-plicators and licensed pesticide businesses, you know that ac-cording to the Virginia Pesticide Control Act:

Pesticide …. any substance or mixture of substances intended for preventing, de-stroying, repelling, or miti-gating any insects, rodents, fungi, bacteria, weeds, other forms of plant or animal life, bacterium, or viruses…Every pesticide manufac-tured, distributed, sold, offered for sale, used, or

offered for use shall be reg-istered.

You also know that:

No person shall use …. or supervise the use of any pesticide in exchange for compensation of any kind …without first obtaining certi-fication as either a commer-cial applicator or registered technician. No person may apply or recommend for use any pesticide commercially without a pesticide business license and the employment of a certified commercial applicator responsible for: (i) the safe application of the pesticides; and (ii) provid-ing recommendations for the use of pesticides.

But do you know that the Federal Insecticide Fungicide and Rodenticide Act (FIFRA) contains an exemption for what are called “treated articles”?

The answer to the Question of the Day is based on the insu-lation the company is installing and whether or not the insula-tion is required to be registered as a pesticide or is considered a “treated article” and is exempt from registration as a pesticide.

Sec. 152.25 Exemptions for pesticides of a character not requiring FIFRA Regulation states …

The pesticides or classes of pesticides listed in this section have been determined to be of a character not requiring regu-lation under FIFRA, and are therefore exempt from all provi-sions of FIFRA when intended for use, and used, only in the manner specified.

(a) Treated articles or substances. An article or substance treated with, or containing, a pesticide to protect the article or substance itself (for ex-ample, paint treated with a pesticide to protect the paint coating, or wood products treated to protect the wood against insect or fungus infestation), if the pesticide is registered for such use.

In this example, whether or not the manufacturer of the insulation (that has been treated with or contains a pesticide) is required to register the insula-tion as a pesticide depends on how the manufacturer intends the insulation to be used:

the purpose of installing the insulation is to, for example, reduce energy consump-tion, improve air quality and maintain a comfortable indoor environment, and the pesticide is only to protect the insulation itself.

• On the other hand, if in addition to reducing energy consumption, improving air quality and maintaining a comfortable indoor environ-ment, the insulation (that has been treated with or contains a pesticide) is to be used to control pests in the structure where it has been installed, the insulation is considered a pesticide and must be registered.

How can you tell if the insulation you are considering installing is a treated article or a registered pesticide?

Look for an EPA Registra-tion Number. If the insulation does not have an EPA Regis-tration Number, it is a treated article. If it has one, it is a registered pesticide. Remem-ber, you can only use the insula-tion for its intended purpose. If you install the insulation that is a treated article and make any pesticide claims, you are using an unregistered pesticide which is a violation of both Federal and State law.

So, back to the Question of the Day: How can both of the fol-

lowing statements be true?

Company A is installing insulation that is a registered pesticide (has an EPA Registra-tion Number). The law requires a pesticide business be licensed to apply (in this case, install) a pesticide and only certified ap-plicators apply the pesticide.

Since Company A has a pes-ticide business license and certi-fied applicators, they can legally apply the insulation (registered pesticide). As always, the “label is the law” so all label directions must be followed.

Company A can also install the insulation that is exempt from registration and is con-sidered a treated article. Since

Company B is installing insulation that is considered to be a “treated article” and is exempt from registration. In this case, the use of the pesticide to treat or be contained in the article (insulation) is to protect the article itself.

Since Company B is install-ing insulation that is exempt from registration and is consid-ered a “treated article” and not a pesticide (does not have an EPA Registration Number), they do not need a pesticide busi-ness license and the individuals installing the insulation do not have to be certified.

It is important to note that claims about treated articles are limited to the protection of the article itself.

However, if Company B were to make any pesticidal claims beyond the protection of the insulation itself, for exam-ple, if they claimed it protected the attic or the house from pests, or if Company B were to of-fer any pesticide services, for example, through their adver-tising, Company B would be in violation of Virginia’s laws and regulations and could be subject to enforcement action for application by an uncertified individual, failure to possess a pesticide business license and application of an unregistered pesticide.

Dear Fellow PMP’s of Virginia, I want to thank a number of my fellow PMP’s in Virginia for their financial contributions and encouraging support during my campaign for a Virginia State Senate seat, which unfortunately was not successful this past November. I also want to thank Andrea and Kristin at VPMA for their assistance in communicating my desire to be the first PMP to be a member of the Virginia State Senate and the Virginia General Assembly.

I believed during the campaign, and still do today, that we need more business persons regard-less of party affiliation in our different levels of government. My father, who ran twice for State Senate in the early 1960’s and 1970’s, relayed to me that we need more business persons than law-yers in our General Assembly. That viewpoint, in my opinion, still runs true in our present time.

• This is a voluntary certification and is NOT required by VDACS.• A passing score of at least 75% on a 50 question exam is required to earn certification.• If participant does not pass the exam, he must retake the exam within six months at a regularly scheduled course, or with an authorized proctor. Retest will be $25.• If participant does not pass second exam, the WDI course must be retaken.• Certification is good for two years.

VPMA WDI Recertification Workshop Goes Online

If you have already earned your VPMA Certified WDI Inspector certification, then you know that in order to maintain your status, you must attend a recertification workshop every two years.

In the past, members had to travel to a workshop site for a four hour course. Time and expense of travel and time away from routes made this in-person training quite costly.

Beginning in April 2012, WDI Inspectors will be able to get their recertification online, eliminating the need for travel. The program will also be avail-able 24/7, so technicians can

complete the training during off-hours or when they have down-time at work.

The program will be com-prised of four modules: WDI In-sect Behavior and Biology, WDI Inspection Step by Step, WDI Tools of the Trade, and Com-pleting the NPMA-33 Form.

All Certified Inspectors who were due to expire on June 30, 2011 had their expiration dates extended until June 30, 2012. Once the online workshop is up and running Certified In-spectors will be notified and will have ample time to complete the training before the June dead-line.

VPMA Master Technician DesignationThis program provides technicians with in-depth, hands-on training using state-of-the-art microscopes and is

conducted by Dr. Dini Miller, Tim McCoy, MS and graduate students from the Dodson Urban Pest Management Lab at Virginia Tech. The series of workshops investigate seven major pest groups – Ants, Termites, Occasional In-vaders, Cockroaches, Rodents, Bed bugs and Flies. At the completion of each workshop, participants will receive a certificate designating them as a VPMA Master for each pest group. Once a technician has mastered at least four of the seven pest groups, special recognition will be made at the final workshop designating them as a Master Techni-cian.

In 2011 and 2012, my research was focused on mea-suring the thicknesses of the bed bug cuticles from pyrethroid-resistant Richmond strain and pyrethroid-susceptible Harlan strain bed bugs using scanning electron microscope (SEM). I was also analyzing the cuticular hydrocarbons that were pres-ent as the wax layer of the bed bug exoskeleton using the Gas-Chromatography and Mass-Spectrometry (GC-MS). Cuticular hydrocarbons may protect bed bugs from water-based pyrethroid insecticides.

The results of the SEM cuticular thickness measure-ments showed that some of the individual bed bugs from pyre-throid-resistant Richmond strain

had particularly thicker exocuti-cles than pyrehtorid-susceptible Harlan strain bed bugs. In addi-tion, both Richmond and Harlan strain bed bugs were found to have thicker exocuticles on the dorsal side of the abdominal tergites compared to the ventral side of the abdominal sternites. The results of the GC-MS identified nine cuticular hydro-carbons that were unique to the pyrethroid-resistant Richmond strain bed bugs, and fifteen cu-ticular hydrocarbons that were present in both Richmond and Harlan strain bed bugs. Among the fifteen cuticular hydrocar-bons that were present in both strains of bed bugs, some of the cuticular hydrocarbons were more abundant in Richmond

strain than Harlan strain bed bugs.

For the next several months, I would like to fin-ish the statistical analysis of the SEM cuticular thickness measurements and continue the analysis of bed bug cuticular hydrocarbons. Also I would like to start a new experiment isolating the cuticular proteins directly from bed bug exuviae. I would like to quantify and compare the amount of cuticular proteins directly from pyre-throid-resistant Richmond strain and pyrethroid-susceptible Har-lan strain bed bugs.

VPMA WDI Inspector Certification Workshop - (see page 14 for more infomration) March 20 in Rich-mond and March 21 in Manassas - choose one day. VPMA Member price is $190 for 1 or 2 registrants; $175 for 3 or 4 registrants and $150 for 5 or more registrants. Deadline to register is March 15, 2012.
