On or about April 20, 2007, Defen-dant executed a home equity line of credit agreement in the maximum principal sum of $70,000.00 evi-dencing his promise to repay a loan from Waccamaw Bank secured by a second lien upon his then primary residence (the “Note”). A true and correct copy of the Note is attached hereto as Exhibit A and incorporated herein by reference.7. Waccamaw Bank was closed on June 8, 2012, by the Commissioner of Banks for the State of North Car-olina. The Federal Deposit Insur-ance Corporation (the “FDIC”) was appointed as the Receiver of Wac-camaw Bank. FCB acquired the Note from the FDIC by Purchase and Assumption Agreement dated June 8, 2012. FCB, successor to Wacca-maw Bank, is the current owner and holder of the Note.8. As evidenced by the attached let-ter giving notice of default, demand, and right to cure to avoid accelera-tion dated April 4, 2016, FCB provid-ed Defendant with the opportunity to reinstate the loan by paying the past due amount; and, failing that, the let-ter gave notice that the loan would be accelerated.
