KAHL GETS THE MESSAGE: Somebody had to go standards in the Bay Area after KFRC's surprise decision to abandon the format. Given KFRC's overhead, it wasn't surprising that the station that finally decided to make a move went with Unistar's AM Only. The surprise was that the new standards outlet wasn't KKHI --whose owner, Buckley, does AM Only in Syracuse and Hartford --but simulcast AC outlet KABL which won't pick up the "Magic" name or any of the airstaff from the former KFRC. Standards represents a full -circle of sorts for KABL which began life in the late '50s as a "good music" outlet under Gordon McLendon before that format mutated into beautiful music. After months of speculation, the National Assn. of Broadcasters has announced that it will share exhibits at its fall '94 radio convention with the Radio -TV News Directors Association, Society of Broadcast Engineers, and, in keeping with the radio show theme, the Society of Motion Picture and Television Engineers. The NAB will be held in L.A. next year, followed by New Orleans in 1985. And if it's time for NAB '94, it must also be time for Art Vuolo's announcement that his video airchecks will be broadcast on channel 7 at the Lowes Anatole hotel in Dallas. Critical Mass Media is sponsoring Vuolo's presentation this year.
The FCC has thrown out petitions to deny against 10 Philadelphia stations filed by a local gay /lesbian coalition which felt that there wasn't enough coverage of gay issues. The FCC did however decide to look at EEO issues including WJJZ, WMMR, WXTU, and WYSP.
The proceeding involving a new FM on 105.9 MHz in Englewood FL has been sent to an ALJ for review after the review board disagreed with a Commission finding that one of two applicants, Sarasota -Charlotte Broadcasting Corp., submitted an integration proposal that was "at variance" from the EEO statement in its application which proposed a different general manager. Originally, the Commission rejected the integration proposal and granted Sandpiper Broadcasting's application, then denied out SCBC's application for review.
The Commission has denied WHSL Corp.'s petition for reconsideration reaffirming the decision to grant SaltAire Communications' application for a new FM on 107.7 MHz in Pawcatuck CT. WHSL complained the Review Board wrongly found that the "participating notes" held by three investors barred WHSL's voting stockholder from issuing more stock to raise capital for the firm without the noteholder's consent. The Commission disagreed, finding that the integrated owner cannot obtain equity financing without the noteholder's cooperation.
Quinnipiac College's WQAQ won't be upgrading to class A status after the Commission affirmed the denial of their request for a short -spacing waiver. The Commission said the college had failed to justify a waiver, failed to demonstrate that there were any public interest factors involved, and failed to meet the threshold test to show that its site was no longer suitable for its current operation.
It's official. If your station is getting read to start the renewal process, you must tell the Commission whether or not you're on the air. FCC Form 303 -S has been modified to incorporated the information and is now available.
The Commission has dismissed RDH Communications' petition for reconsideration of the dismissal of its application for a new FM on 107.3 MHz in Baker LA. The application was dismissed because it didn't have the financial certification page.
ELSEWHERE
The Radio Advertising Bureau has announced a 9% increase in both local and national revenue for the month of July. In the Southeast, local was up 12% over July '92. In the southwest, local was up 14% and national was up 20 %. For the first seven months of this year vs. the comparable period last year, national was up 7% and local was up 9 %.

The Chicago Sun -Times reports that Howard Stern's agent, Don Buchwald, is threatening to mount a "very aggressive legal challenge" to WLUP, the first of Stern's morning affiliates to drop his show. WLUP pulled out last week claiming it had been scared off by the recent barrage of FCC fines against Howard, but perhaps actually motivated by Howard's so -so ratings and the fact that it was getting ready to realign WLUP -AM -FM's format anyway. "Before we're through, it could turn out that Howard owns an AM station in Chicago," says Buchwald. M Street wonders if Buchwald has thought through the implications of this statement: now Howard's affiliates don't just have to worry about him losing the license for them, they also have to worry about Howard taking the license from them, especially if they try to protect it. Got it?
With the growth of the southern gospel format and the related "Christian Country" format, CDX president Paul Lovelace has announced that he will start distributing a monthly "Positive Country" disc for stations that want to do their own Christian country shows or formats. Programmer Rick Bowles has joined CDX for this project. CDX is also sending the stations that receive its monthly discs of regular country releases two CDs of library material, sample playlists (including some country crossover titles), and bio info. Sounds great, less filling. . .Jones Satellite hits the air this month with its new "FM Lite" format, an easy listening /soft AC hybrid blended with some jazz and MOR cuts. The format will add announcers and marketing behind JSN's current easy listening format that was originally designed for the Jones cable systems.

CBN RADIO, COAST TO COAST For those staffers who just arrived on the scene at the CBN Radio Network in Virginia Beach VA, don't unpack yet. Not only has Salem Communications picked up jazz outlet KHIH Denver for $5 million, they also announced plans this week to take over Pat Robertson's web, and move it to L.A. by October 1. CBN claims 200 affiliates. Price was not disclosed.
FLASHBACK TO THE 70 'S... News /talk WWWE Cleveland will have a new morning show done by someone who certainly knows the market. Unistar announced this week that Don Imus will return to Cleveland, his eighth market in syndication, and this time it's on his own volition. Imus was at WGAR in the early 70's, and returned to spin country at WHK in 1978. Chicago will also wake up to a familiar voice as John "Records" Landecker, known for his days at WLS (AM), starts next week at oldies WJMK
WHO ARE Q Louisville's got a new LMA, and it's going to be a headache for the diary editors in Laurel. WQMF, the classic rock outlet at 95.7, has taken over crosstown WVSL Valley Station KY, at 105.9. What makes this LMA a little more unique than others is the fact to BOTH stations will be billing themselves as "QMF." QMF 95.7 will remain classic rock. QMF 105.9 will be album rock. WASHINGTON THIS WEEK
This week's issue is a little lighter than usual due to the fact that we're going to press early to head to the NAB convention in Dallas. However, rest assured you won't miss a single FCC action, as next week's issue will include everything we have to date.
The Commission has denied R &L Broadcasters reconsideration of its action which affirmed the dismissal of their application for a construction permit on 106.7 MHz in Lompoc CA. The decision also affirmed the action of the Mass Media Bureau granting the competing application of Stuart McRae. R &L's application was dismissed because it proposed a short -spacing but had not justified the waiver. In denying R &L's application for review, the Commission held that, while the short -spacing issue was minor, R &L had not provided sufficient justification in its original waiver request to warrant deviation from the spacing rules. The Commission had previously considered and rejected other arguments from R &L, as well.
Harte -Hanks Television has been granted a waiver of the one -to -a- market rule with its purchase of troubled KVAR (AM) in San Antonio from Hispanic Radio Broadcasters. Harte -Hanks also owns KENS -TV there.
The Commission has denied William L. Carroll's petition for reconsideration of an application for a new FM on 97.3 MHz in Lebanon OH. The application of McMurray Communications was previously granted under the standard comparative issue. The Commission said Carroll did not present any new facts or circumstances which would warrant reconsideration.
It doesn't happen very often, but the Media Access Project has been granted an extension of time for the comment period regarding a proposal that successful applicants for new stations be required to operate them for three years before being eligible to sell them. MAP argued that the "brief filing period specified in this proceeding coincides with strict statutory deadlines mandated by the 1992 Cable Act for other rulemakings. MAP contends that this conflict places an undue burden on interested groups such as MAP at a time of year when personnel shortages tend to occur." The comment date has been extended from October 13, 1993 to October 28, 1993.
ELSEWHERE
Salem Communications announced it will pick up another top 25 market this week with the addition of CLG Media's KHIH Denver for $5 million. KHIH's jazz format will probably make way for religion in October. The LMA began this week.
Not to be outdone, Bonneville announced it will pick up Gannett's news /talk KCMO AM and its sister oldies outlet KCMO -FM, giving them a duopoly in Kansas City with news /talk KMBZ & soft AC KLTH. Terms were not disclosed.
Just when you thought everything has been tried, there's a new radio station on the air in South Florida, but you'll have trouble getting it in the car. WSAP signed on last month --on the Separate Audio Program channel of tv translator channel 27 in Ft. Lauderdale. SAP channels are usually used for a second language audio track to go with the video. Channel 27 rebroadcasts CBS channel 6 on its regular video and audio portion, but SAP listeners will be able to hear a number of talk programs, including fare from IBN and For the People nets.
For those of you who haven't had your fill of new urban networks or syndicated morning shows in the past few months, you'll be pleased to know there's another one coming soon as Black Entertainment Television and Stratford Research have teamed up to introduce the BET Radio Network, which will barter both short- and long -form programming. More details will be announced at this week's NAB show in Dallas.

TURNOUT DOWN, SPIRITS UP. This year's NAB Radio Show in Dallas may have had fewer attendees than last year, but exhibitors said those that did make it were more serious about buying than in the past couple of years. It seems that although duopolies may have decreased or eliminated a station's capital budget, the consolidation has allowed many duopoly /LMA managers to pool their stations' equipment or promotion money.
Also, in his keynote address, Ross Perot kicked off the show advising broadcasters to maintain a hands -on management style and pay attention to what your employees are telling you. He also hinted at a daily short -form radio feature, which may be coming soon to a satellite near you. More NAB news on page 6.
IN THE HANDS OF A HIGHER POWER.Just a little bit more than a year after they hit the bird, the Nashville -based Super Gospel Country Network shut down today about 4:00 p.m. ET, just an hour after the memo to affiliates crossed their fax machines. The Commission has denied Highlands Broadcasting Company, Inc. and Lone Cypress Radio Associates, Inc. petitions of reconsideration, reaffirming the grant of J & M Broadcasting's application for a new FM on 95.5 MHz in Carmel CA. The Commission found that Lone Cypress should not be granted credit for female ownership because its argument that J & M's ownership structure is "too nebulous."

Although this year's NAB Radio Show in Dallas was decidedly lackluster, there was a bright spot. NAB President Eddie Fritts and RAB President Gary Fries announced their joint effort targeting unwieldy disclaimers has paid off. Fritts said Senators Richard Bryan (D -NV) and Alfonse D'Amato (R -NY) have introduced legislation to change the law requiring those annoying disclaimers generally heard at the tail -end of any spots referring to leasing or loan information. The bill aims to shorten the amount of required information on any commercials, and would direct the consumer to call an 800 number for additional details. The bill could mean millions of dollars for radio that have historically gone to TV and print. Fritts expects similar legislation to be introduced in the House later this month.

Pat Robertson's Broadcast Equities has reached an agreement with Tribune Company to purchase the fax -delivered news service Zapnews for an undisclosed sum. It will be paired with its Washington D.C. -based StandardNews radio networks.
CBS Radio has won the rights to Major League Baseball for another six years, and did it for half what it paid last time. The pact, which gives the net broadcast rights to all MLB games, including the all -star game and post- season play, cost CBS $25 million, half of the $50 million paid in 1987.
Garry Meier, half of the morning team that's been waking -up Chicagoans for fifteen years, walked off the job this week after bitter on -air verbal abuse by his partner Steve Dahl. The remarks were typical of the type of humor that the morning show has used in the past, but this time was directed at Meier and his new wife, who were in Europe on their honeymoon. Several Chicago broadcasters see the whole issue as a stunt.
After an initial deal with Jones Satellite Network fell apart, Jerry Kutner's Las Vegas -based Sports Entertainment Network has been sold to a company that does on- site broadcasting to spectators at major sporting events. One -on -One Sports announced its intent to acquire a majority share of SEN, which currently programs 24 -hour sports to about 110 stations nationwide. Kutner will stay on as a
consultant.
Following in the footsteps of locally -programmed stations making a go at syndication, Radio Bilingue, a network of four California stations, hits the satellite tomorrow. The net will feature news, arts programming, and mariachi music for non -commercial stations. The Corporation for Public Broadcasting and the NTIA have underwritten the venture, which is based at KSJV Fresno.

WASHINGTON THIS MEEK The NAB reports radio station trading is up dramatically over both 1992 and 1991. In their newest edition of "Trends in Radio Station Sales," compiled by David Schutz of Hoffman -Schutz Media Capital, Inc., the total volume of radio sales in the first two quarters of 1993 was 62% higher than 1992 and 73% higher than the same period in 1991. The Commission has upheld the grant of Troy Broadcasting Corp.'s application for a construction permit for a new FM on 94.7 MHz in Brundidge AL, and denied Ralph W. Black Jr.'s reconsideration of its decision. Black's application had been previously disqualified on a financial qualifications issue. In the Commission's denial, it said that it previously considered Black's arguments.
ELSEWHERE Rep Temps, the Chicago -based company that provides temps for media sales organizations, has opened a New York office. Lynne Wallace, former Sr. VP of Campbell /Mithun /Esty Chicago, will be the account manager there.
Joe Bohannon, morning jock on B -96 Chicago, got slapped with an $8 million lawsuit alleging he defamed one of WMAQ -TV's news anchors by spreading a rumor that she was pregnant with the child of one of the Chicago Bulls players. According to Inside Radio, Joan Esposito filed the suit, which claims the rumor "substantially reduced her salary."
In other syndication news, the Morton Downey, Jr. show has landed on the American Forum Network (800 -800- 8852).
Just when you thought you didn't have enough choices for syndicated sports, Dallas -based Prime Sports Radio has hit the bird. This net is unique in that it

HONESTY IS THE ONLY POLICY... because, in this case, the lack of it cost Westerville Broadcasting Company, L.P. $25,000. Westerville was one of the applicants in a proceeding for a new FM on in Westerville OH who has since been dismissed. But the issue of giving the Commission financial qualification documents that didn't jive with other statements during a pleading were "evidently deceitful."
STERN LOOPED OVER CHICAGO LOSS. Just when you thought Evergreen Media's legal department had a full plate battling the FCC over WLUP -AM's Steve & Garry $3,000 indecency fine, Howard Stern will be serving the next course --at $48 million a
plate. According to Inside Radio and the Chicago Sun -Times, Stern is suing WLUP for breach of contract and seeking punitive damages after they dropped him eight months into a three -year contract. Evergreen contends they were worried about the potential for another indecency fine.

The Commission wants to hear from you regarding the rules and policies regarding the definition of modulation limits. According to the NAB's Radio TechCheck, the FCC is particularly interested in defining and measuring FM modulation, specifically addressing "improved modulation limits on peak amplitude, peak duration, peak recurrence rates, and the time interval over which peaks are to be counted."
The decision to release the notice of inquiry is sparked from the deletion of 73.332 from the rules, which eliminated the requirement that stations monitor their modulation using "type approved" monitors. This has lead to a wide disparity between the types of modulation monitors used by broadcasters, which consequently leads to broad differences in signal processing. Comments to the NOI are due by November 5, 1993. Replies are due by December 15, 1993.
ELSEWHERE
Topping the transaction charts this week was Chancellor Communications' purchase of Group W's KFBK /KGBY -FM Sacramento for $45 million. Inside Radio reports the move is part of Group W President Dan Mason's strategy to get into the top ten markets with multiple stations.

Although details were sketchy at press time, Salem Broadcasting will finally close on Jerry Lee's WBEB Philadelphia for $4 million. It's taken almost three years for this one, which tops the old Salem record of one year to close on their purchase of WYDD Pittsburg from Inspiration Media.
Former Group W radio president Jim Thompson's Liberty Broadcasting has put together a deal to merge with Four Seasons Communications, creating a Washington DC combo. Liberty is in the process of buying WHFS Annapolis MD, while Four Seasons owns WXTR -FM Waldorf MD. Liberty also owns WBAB Babylon (Long Island) NY. Four Seasons owns WMXB Richmond VA.
Nationwide Communications has picked up WCOL -AM & FM Columbus from Great Trails Broadcasting for $15 million, which will now combine forces with their WNCI there. This is Nationwide's first duopoly.
Radio battles in Milwaukee have taken to the streets as Inside Radio reports criminal charges have been filed by WLUM -FM GSM Bob Johnston after an altercation with WKKV -FM's Tony Fields and David Smith. The two rivals have been at each other for several months. The latest incident was spawned when Fields and Smith spotted Johnston in the WiÇKV -FM parking lot trying to plait a Hot 102 bumper sticker on the V -100 van.
If you're looking to pick up a syndicated morning show, but don't want to pay cash, ABC /SMN's Tom Joyner and Moby are both available on a strictly barter basis. In a story in Inside Radio this week, ABC will barter a primary affiliation on one of the news nets in exchange for the morning show, provided all of the spots are cleared. The story sites ABC Executive VP David Kantor's strategy to acquire more affiliates that clear the net programming, while reducing the network's cash outlay for station compensation.
Bob Hall, ABC /SMN's VP /Programming, has been promoted to Senior VP /Programming. He'll now oversee syndicated programming as well as the SMN nets. Former KNIX personality Bill Kramer has joined Morningstar Radio Network as Director of Program Operations.
In the wake of the loss of the Southern Gospel Country Network a couple of weeks ago, the Reach Satellite Network has picked up a few affiliates, which is now up to over 60 affiliates. Reach offers full -time Southern Gospel /Christian Country on a cash /barter basis. Call 800- 334 -2630 for details.
A small station in Bella Vista AR, which has relatively good ratings in Fayetteville /Springdale, is trying its hand at national format syndication. Hendren -McChristian Broadcasting's KBVA is now syndicating its home -grown adult standards format, and hopes to add stations to its own list of owned stations carrying the format. After the failed launch of an -all gay network last year, someone else is giving it a try. Florida -based QBC network plane a 24 -hour offering to be launch in January, 1994. The network is targeting affiliates in the top 18 markets. For more info, call Peter Hamlett at 407- 334 -5000.
Inside Radio reports that the "Hot Hits" phrase coined in the early 80's by consultant Mike Joseph has been licensed to Jeff McClusky and Associates to be pitched to country stations. The first to be offered the positioning statement will be McClusky's own clients, then the rest of the world.
By the way, WLUP -FM has announced its new line -up, which moves Kevin Matthews from middays on the AM to mornings on the FM, and Garry Meier to middays on the FM after the shakeup with morning partner Steve Dahl.
The BRN family of networks has announced a couple of program additions. Debuting October 25, American Forum Network adds "Floyd Brown's Talk Back to Washington," discussing policy decisions and their impact on the public.
