The event was held inmild, sunny conditions atthe front of the LincolnCounty Courthouse, Fridaymorning, April 27, 2012.The prayer for the eventwas offered by Jason Cook,associate pastor at CenterPoint Church in WestHamlin. Lincoln CountyHigh School PantherBattalion students present-ed the colors. The nationalflag and the Children’sMemorial Flag were raisedby Lincoln County SheriffDavid Vickers.

Speakers for the eventincluded Lincoln CountyChief Circuit Court JudgeJay Hoke and LincolnCounty Prosecutor JackieStevens. Stevens, who willstep down as prosecutor atthe end of this year, com-mented on his work in thearea of prosecuting thosewho abuse or harm chil-dren. He spoke of theimportance of reportingcrimes to the authorities,and reflected on his recentinvolvement in a success-fully prosecuted abusecase.

On or about May 18,2012, the Lincoln CountyCommission will submit arequest to the West VirginiaDevelopment Office for theRelease of U.S. Departmentof Housing & UrbanDevelopment Small CitiesBlock Grant funds under Title Iof the Housing andCommunity Development Actof 1974 (PL 93-383), asamended, to undertake a proj-ect known as the Big HartsWater System ImprovementsProject, Project #11SCBG0006, which willextend water service to resi-dents in the Lincoln andLogan County communities ofBig Harts Creek, SmokehouseFork, Thompson Branch,Rockhouse Fork, Big TraceFork, Buck Fork and sur-rounding areas. This projectwill include the construction of97,400 linear feet of 8-inchand smaller diameter watermain, one (1) 200 gallon perminute booster station, one(1) 200,000 gallon water stor-age tank, 50 fire hydrants,valves, individual customerservices and related appurte-nances.

Finding of noSignificant Impact

The Lincoln CountyCommission has determinedthat the project will have nosignificant impact on thehuman environment.Therefore, an EnvironmentalImpact Statement under theNational Environmental PolicyAct of 1969 (NEPA) is notrequired. Additional projectinformation is contained in theEnvironmental ReviewRecord (ERR) on file atRegion II Planning andDevelopment Council, 214Fourth Street, Huntington,West Virginia 25712. Counciloffice hours are: 8:30 A.M. to4:30 P.M. Monday throughFriday.

Public CommentsAny individual, group,

or agency disagreeing withthis determination or wishingto comment on the projectmay submit written commentsto the Lincoln CountyCommission. All commentsreceived by May 17, 2012 willbe considered by the LincolnCounty Commission prior toauthorizing submission of aRequest for Release ofFunds. Commentators shouldspecify which part of thisNotice they are addressing.

Release of FundsThe Lincoln County

Commission certifies to theWest Virginia DevelopmentOffice that Charles S.McCann, in the capacity asPresident of the LincolnCounty Commission, con-sents to accept the jurisdictionof the Federal Courts, if anaction is brought to enforceresponsibilities in relation tothe environmental reviewprocess and that theseresponsibilities have been sat-isfied. The West VirginiaDevelopment Office approvalof the certification satisfies itsresponsibilities under NEPAand related laws and authori-ties, and allows the LincolnCounty Commission to useProgram funds.

Objection to Release ofFunds

The West VirginiaDevelopment Office will con-sider objections concerningrelease of funds or the LincolnCounty Commission certifica-tion received by June 6, 2012or for a period of fifteen daysfollowing its actual receipt ofthe request (whichever islater), only if they are on oneof the following bases:

(a) the certification wasnot executed by the CertifyingOfficer of the Lincoln CountyCommission;

(b) the Lincoln CountyCommission has omitted astep or failed to make a deci-sion or finding required by EMregulations incurred costs notauthorized by 24 CPR Part58;

(c) the grant recipienthas committed funds orincurred costs not authorizedby 24 CPR Part 58 beforeapproval of a release of fundsby the West VirginiaDevelopment Office; or

(d) another Federalagency acting pursuant of 40CPR Part 1504 has submitteda written finding that the proj-ect is unsatisfactory from thestandpoint of environmentalquality. Objections must beprepared and submitted inaccordance with the requiredprocedures (24 CRF Part 68)and shall be addressed to theWest Virginia DevelopmentOffice at Building 6, Room B-553, Capitol Complex,Charleston, West Virginia,25305. Potential objectorsshould contact the WestVirginia Development Officeto verify the actual last day ofthe objection period.

On November 4, 2011, Mountaineer Gas Company filed revised tariff sheets reflecting increased rates and charges of about 4.9%annually to become effective December 4, 2011. Mountaineer proposed a 3.63% increase for resale customers.

On November 29, 2011, the Commission ordered that Mountaineer’s revised tariff sheets be suspended and the use of theincreased rates and charges be deferred until 12:01 a.m. August 31, 2012, unless otherwise ordered by the Commission.
