Whereas, on the basis of an indent placed by Executive Engineer,LAWDA vide No. LDII/2030-33 dated 31-10-2017, followed by Vice-Chairman, LAWDA, Srinagar's No. C-LDA/39 dated 22-09-2018, anotification under section 4(1) was issued by Collector, Land Acquisition(LAWDA), Srinagar vide No. C-LDA/1014-30 dated 12-12-2017 for landmeasuring 01 Kanal, 10 Marlas and 125 Sfts. situated in Village Saderbal,Tehsil North (Hazratbal), District Srinagar ;

Whereas, the Collector, Land Acquisition (LAWDA), Srinagarvide No. C-LDA/462-79 dated 20-08-2018 has reported that thenotification issued under section 4(1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, tothe proposed acquisition and some interested persons/land owners filedobjections within the prescribed period as required under sections 5 & 5Aof the Land Acquisition Act but they failed to produced the documentaryevidence relating to their occupancy rights in respect of the said land, asthe land in question is shown belonging to Raja Opender Krishan Koul S/oRaja Diva Krishan Koul R/o Nursing Garh, Srinagar, as intimated by theDeputy Commissioner, Srinagar ;

Whereas, the report furnished by Collector, Land Acquisition(LAWDA), Srinagar vide letter number referred to above, duly endorsed bythe Deputy Commissioner, Srinagar vide No. DCS/LAS/1233/LAWDA/413-17 dated 28-09-2018, Divisional Commissioner, Kashmir videNo. Div.Com/LAS-Acq/3459/6334 dated 05-02-2019 and by the FinancialCommissioner, Revenue vide No. FC-LS/LA-4841/2019 dated 19-03-2019has been examined and it has been found that some interested person/land owners file objections and after examination these have been disposedoff as not based on facts/merits ;

Whereas, the Government is satisfied that the land particulars whereofare given above, is required for public purpose viz. for construction of MainSewar Line for Sub-Zone Co3 and Co4 of Zone 1© from RD 638 to 1011Meters along Western Fringe of Negeen Lake including development ofapproach road to 5.4 MLD STP at Nallah Amir Khan, situated in VillageSaderbal, Tehsil North (Hazratbal), District Srinagar by LAWDA .

Whereas, the Collector has also expressed urgency of taking overpossession of the land immediately ;

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring 01 Kanals,10 Marlas and 125 Sfts. situated in Village Saderbal, Tehsil North (Hazratbal),District Srinagar, particulars whereof are given above is required forpublic purpose viz. for construction of Main Sewar Line for Sub-ZoneCo3 and Co4 of Zone 1© from RD 638 to 1011 Meters along WesternFringe of Negeen Lake including development of approach road to 5.4MLD STP at Nallah Amir Khan, situated in Village Saderbal, Tehsil North(Hazratbal), District Srinagar by LAWDA. Further, the Collector, LandAcquisition, LAWDA, Srinagar is directed under section 7 of the said Actto take order for acquisition of the said land after giving prescribed noticeto the interested person(s) as required under the Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,Samvat 1990, it is also ordered that on expiry of fifteen days from thepublication of the notification under section 9 (2) of the said Act, the Collectorwill take the possession of the aforementioned land in Village Saderbal,Tehsil North (Hazratbal), District Srinagar, required for public purpose,subject to fulfillment of the conditions prescribed under section 9 (2) andsection 17-A of the Land Acquisition Act and Rule 63 of the Land AcquisitionRules.

However, the Collector concerned shall be personally responsible foridentification and proper title verification of all types of land involved in the

Whereas, the Collector, Land Acquisition (ACR), Udhampur videNo. ACRU/SQ/3224-25 dated 20-10-2018 has reported that the notificationissued under section 4(1) of the J&K State Land Acquisition Act was servedupon the interested persons for filing objections, if any, to the proposedacquisition and some interested persons/land owners have filed objectionsstated therein that the status quo order has been passed for the land underacquisition measuring 10 Kanals 06 Marlas under Khasra No. 01 by TehsildarSettlement, Udhampur vide No. 991-92/STUR dated 02-11-2012 in a casetitled Viney Kumar etc. V/s Bodh Raj and a major part of their land hasalready been acquired by Railway and Air Force Station and the land leftwith theme is near the Air Force Station where the construction is prohibitedby competent authority. The land under discussion is suitable for them as itis beyond the limit of prohibited area of Air Force Station and connectedwith the road and requested for withdraw the acquisition proceedings.

Further, Collector, Land Acquisition (ACR), Udhampur vide his letterdated 20-10-2018 has submitted that the objections filed by the interestedpersons does not hold any merit as compare to acquisition purpose as thesewerage main pit has to be build on a specific location and therefore, thelocation of this pit cannot be shifted to any other place. Moreover, thisproject is a great importance and monitored by the PMO Office on regularbasis ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),Udhampur vide number referred to above, duly endorsed by the DeputyCommissioner, Udhampur vide No. DCU/SQ/3936-37 dated 27-12-2018,Divisional Commissioner, Jammu vide No. 502/3437/Acq/Baryal/Udh/18/4720-22 dated 02-02-2019 and by the Financial Commissioner, Revenuevide No. FC-LS/LA-4822/2019 dated 25-01-2019 has been examined andit has been found that some land owners/interested persons have filedobjections and after examination these have been disposed off under relevantnorms ;

The Militants by their illegal acquiredweapons fired indiscriminately upon the patrolling party of Police/securityforces with the intension to kill them with the result one Army personnelof 10 Sikh got seriously injured. The Militant continued the firing andmanaged their entrance into a nearby house of Ab. Rashid LoneS/o Gh. Hassan Lone R/o Baderagund and the area was immediatelycordoned by Police Kulgam, 9RR, 19RR, 10 Sikh army and 163 Bn.CRPF. The fire was retaliated in self defense ; and

2. Whereas, a case FIR No. 333/2017 under sections 302, 307,120-B RPC and 7/27 of Arms Act was registered in Police Station,Qazigund and investigation initiated ; and

3. Whereas, during the course of investigation the site plan ofscene of occurrence was prepared and the arms ammunition recoveredfrom the scene of occurrence were seized on spot and seizure memowas prepared. The seized arms/ammunition was sent to FSL, Jammufor ballisitc examination, the opinion thereof is still awaited. That thesamples, comprising of two Molars and hair with piece of scalp of eachforeign Militant taken, by the team of doctors while conducting autopsywere sent to CFSL, Delhi for DNA test report thereof, is alsoawaited ; and

4. Whereas, during investigation four accused persons (OGWs)namely 1. Rayees Ahmad Dar S/o Gh. Mohammad Dar R/o ChanporaFrisal. 2. Rashid Ahmad Allayi S/o Farooq Ahmad Allayi R/o Hamzapora,Bijbehara 3. Sartaj Ahmad Alliyai S/o Ab. Gani Allayi R/o HawooraMishipora Qaimoh 4. Umar Yousuf Rather S/o Mohd Yousuf RatherR/o Naibasti, Chinigam, Kulgam had been found involved and arrestedin the case ; and

5. Whereas, the statements of witnesses were recorded undersections 161 and 164-A Cr. PC, wherein they have corroborated thecontents of FIR. During further course of investigating two vehiclesTaveera bearing registration No. JK03E/1715 of Rayees Ahmad Darand Sumo bearing registration No. JK03B/6352 of Sartaj Ahmad Allayimentioned above have been found used in the commission of offences.Accordingly, both the vehicles had seized and seizure memos wereprepared ; and

6. Whereas, on the basis of evidences collected and statementsof witnesses recorded under sections 161, Cr. PC and 164 Cr. PC,the offences under sections 302, 307, 120-B RPC, 7/27-A Act, 13, 16,18, 20, 38 and 39 ULAP Act, 1967 are made out against the accusedkilled militants 1. Abu Maviya 2. Abu Furqan R/o Pakistan 3. YawarBashir Wani S/o Bashir Ahmad Wani R/o Hablish, Kulgam and primafacia case under sections 13, 18, 38, 39 ULA (P) Act is made outagainst accused OGWs Rayees Ahmad Dar S/o Gh. Mohd DarR/o Chanpora Frisal, Rashid Ahmad Allayi S/o Farooq Ahmad AllayiR/o Hamzapora, Bijbehara, Sartaj Ahmad Allayi S/o Ab. Gani AllayiR/o Hawoora, Mishipora, Qaimoh and Umer Yousuf Rather S/o MohdYousuf Rather R/o Naibasti, Chinigam, Kulgam ; and

7. Whereas, the militants Abu Maviya, Abu Furqan R/os Pakistanand Yawar Bashir Wani S/o Bashir Ahmad Wani R/o Hablish, Kulgamhave been killed in different encounters and no sanction is requiredagainst them, while as two OGWs namely Rayees Ahmad DarS/o Gh. Mohd Dar R/o Chanpora, Frisal, Rashid Ahmad Allayi S/oFarooq Ahmad Allayi R/o Hamzapora, Bijbehara (Juveniles) have beenbailed out by the Hon’ble Court of Chief Judicial Magistrate,Anantnag ; and

8. Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and hascome to a definite conclusion that this is a fit case for accord of sanctionfor launching prosecution against the accused persons ; and

9. Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that thereis sufficient material and evidence available against the accused personsfor their prosecution under the aforesaid provisions of law.

10. Now, therefore, in exercise of powers conferred bysub-section (2) of section 45 of the Unlawful Activities (Prevention)Act, 1967, the State Government hereby accords sanction for launchingprosecution against the following accused persons for the commission

2. Whereas, a case FIR No. 41/2017 was registered in PoliceStation, Kunzer under section 13 of Unlawful Activities (Prevention)Act, 1967 and investigation taken up ; and

3. Whereas, during the course of investigation the site plan wasprepared and statement of witnesses were recorded under relevantprovisions of law and placed on record. Investigation conducted revealedthat, in order to cause hatred in the minds of people of the area andfor furtherance of subversive activities, accused raised anti-nationalslogans against the State and Country, by celebrating the death of onekilled militant Sabzar Ahmad of South Kashmir ; and

4. Whereas, cogent evidence, oral and documentary, collectedduring the course of investigation, prima facie, establishes a case undersection 13 Unlawful Activities (Prevention) Act, 1967 against theaccused Adil Ahmad S/o Ab. Gani Rather R/o Gunipora, KunzerMohalla, Chanpora, Ward No. 2 and investigation of case concludedas proved. However section 153-B was dropped from the case, as itcouldn’t be substantiated against him ; and

5. Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and hascome to definite conclusion that this is a fit case for accord ofprosecution sanction against the said accused person for commissionof offences punishable under section 13 of the Unlawful Activities(Prevention) Act, 1967 ; and

6. Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that thereis sufficient material and evidence available against the accused personsfor his prosecution under the aforesaid provisions of law.

2. Whereas, a case FIR No. 82/2018 was registered at PoliceStation, Panthachowk and investigation taken up ; and

3. Whereas, during the course of investigation pasted incriminatingposters were seized as piece of evidence and accordingly site plan ofplace of occurrence was prepared. Statements of witnesses wererecorded under relevant sections of law. During investigation, materialwitnesses namely constable Nisar Ahmad deposed that, while comingback towards Police Station after performing his duties, he identifiedaccused Zeeshan Afaaq Shah S/o Mohammad Afaaq R/o Aripora,Panthachowk while pasting these posters on the walls and poles in thearea of Zewan who on seeing police party managed to flee from thespot before being apprehended. The accused was later arrested in thecase, who disclosed that, he has attended various seminars of HurriyatConference and some unknown person handed over these poster tohim for pasting in the area of Zewan ; and

4. Whereas, during the investigation one cell phone was recoveredfrom his possession and on preliminary examination, incriminatingmaterial was recovered from it. The cell phone was seized as pieceof evidence and forwarded to FSL, Chandigarh for examination andopenion thereof is awaited. Evidence collected has, prima facie,established a case punishable under section 13 UAP Act, 506 RPCagainst accused Zeeshan Afaaq Shah S/o Mohammad Afaaq R/oAripora, Panthachowk and investigation of case was concluded asproved against him. While as section 132-B of Jammu and KashmirRepresentation of people Act, 1957 was dropped from the case in viewof deficient evidence ; and

5. Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and hascome to definite conclusion that this is a fit case for accord ofprosecution sanction against the said accused person ; and

Whereas, after perusing the Case Diary, the relevant documentsand also taking into consideration the observations/views of the authorityappointed under sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, the State Government is of the view that thereis sufficient material and evidence available against the accused personsfor his prosecution under the aforesaid provisions of law.

7. Now, therefore, in exercise of powers conferred bysub-section (2) of section 45 of the Unlawful Activities (Prevention)Act, 1967, the State Government hereby accords sanction for launchingprosecution against the accused person namely Zeeshan Afaaq ShahS/o Mohammad Afaaq R/o Aripora Panthachowk for commission ofoffences punishable under section 13 of Unlawful Activities (Prevention)Act, 1967 arising out of FIR No. 82/2018 of Police Station, Panthachowk.

Mir, Mohd Shafi Mir S/o Mukhta Mir residents of Binner andothers raised anti-national slogans in a religious conference held atBinner. The accused No. 1 has stated that “Indian Army is using bulletand killing the youth since 1971. This will not discourage the youth,but will encourage them.” The said act of the accused has affectedthe sovereignty and integrity of the country ; and

2. Whereas, a case FIR No. 110/2018 in Police Station, Baramullaunder section 13 ULA (P) Act was registered and investigation takenup ; and

3. Whereas, during the course of investigation site plan of placeof occurrence was prepared. Statements of witnesses were recordedunder section 161 Cr. PC. Besides statement of material witnesses wererecorded under section 164-A Cr. PC. Statement of witnesses sorecorded would inter alia reveal that accused Ab. Rashid Sheikh @Dawoodi S/o Ab. Rehman Sheikh R/o Badroo Yaripora, Kulgam raisedAnti National slogans and instigated youth at an Islamic Conferenceat Binner for which the accused was acting as Chief Guest. Investigationconducted has prima facie established commission of offences punishableunder section 13 UAP Act against Ab. Rashid Sheikh @ DawoodiS/o Ab. Rehman Sheikh R/o Badroo, Yaripora, Kulgam and investigationof case concluded as proved against him while as benefits under section169 Cr. PC, was given to Bashir Ahmad Mir S/o Mukhta Mir, FayazAhmad Bhat S/o Gh. Rasool Bhat, Gh. Hassan Mir S/o Mohd AkbarMir, Mushtaq Ahmad Mir S/o Gh. Mohd Mir, Mohd Shafi Mir S/oMukhta Mir as nothing could be established against them ; and

4. Whereas, the authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and hascome to a definite conclusion that this is a fit case for accord ofprosecution sanction against the said accused person ; and

Subsequentlya joint Naka/MVCP at Janbazpora, Baramulla was laid and duringchecking of vehicles, one militant fired some shots of fire with a Pistolupon the Naka Party and, in order to manage his escape from thespot also tried to job a Grenade upon the said party, however, wasoverpowered by police party and apprehended on spot. The apprehendedmilitant disclosed his name as Irshad Ahmad Shah S/o LateGhulam Nabi Shah R/o Seloo affiliated with HM outfit and fromwhose possession, arms ammunition viz. Chinese Pistol=01 No. MagPistol=01 No., Live Cartridges=04 Nos. and Chinese HandGrenade=01 No. were recovered ; and

2. Whereas, a case FIR No. 18/2017 under sections 307 RPC,7/27 Arms Act was registered in Police Station, Baramulla andinvestigation taken up ; and

3. Whereas, during the course of investigation site plan of placeof occurrence was prepared. During inspection of place of occurrence,two empty cartridges were also recovered/seized and to this effectseizure memo was prepared. Statements of witnesses acquainted withthe facts and circumstances of the case under sections 161, 164-ACr. PC, were recorded and placed on file. The seized pistol along withthe seized cartridges was sent to FSL for Ballistic examination andexpert opinion thereof received reveals that the cartridges seized fromthe place of occurrence have been fired from the same pistol whichwas recovered from the possession of accused Irshad Ahmad ShahS/o Late Ghulam Nabi Shah R/o Seloo, Sopore. During investigation,it also transpired that the accused is figuring in the categorization listof terrorists and is an active terrorist of banned HM outfit, accordinglysec. 20 UAP Act, 1967 was added in the case ; and

4. Whereas, cogent evidence, circumstantial as well as documentaryhas prima facie substantiated the commission of offences punishableunder sections 307 RPC 7/27-A Act, sec. 20 UA (P) Act andinvestigation of the case concluded as proved against him ; and

5. Whereas, the Authority appointed by the State Governmentunder sub-section (2) of section 45 of the Unlawful Activities(Prevention) Act, 1967, has independently scrutinized the Case Diaryfile and all the other relevant documents relating to the case and has
