An Act further to amend the Indian. Penal Code and the Code of Criminal Procedure, 1898; in their application to the 3[State of Tamil ad^].

WHEREAS it is expedient further to amend the Indian Penal Code (Central Act XLV of 1860), and the Code of Criminal Procedure, 1898 (Central Act V of 1898), in their application to the 3IState of Tamil Nadu] for the purposes hereinafter appearing ;

BE it enacted in the Eleventh Year of the Republic of India as follows :-

1. (1) This Act may be called the Indian Penal Code and short title the Code of Criminal Procedure (l[Tamil Nadu] Amend- extant. ment) Act, 1960.

Amendment of 2. In section 202 of the Indian Penal Code (Central Act section 292, XLV of 1860) (hereinafter referred to as the said Code), for

(a) prints or causes to be printed in any newspaper, periodical or circular, or exhibits or causes to be exhibiteo, to public view or distributes or causes to be distributed or in any mabner puts into circukition any picture or any printed or written document which ia grossly indecent, or is scurrilous or intcnded for blackmail, or

(b) sells or lets for hire, or. for purposes of sale or hire makes, produces or has in hi*; possession, any pfcture or any printed or written document which is grossly indecent or is scurrilous or intended for blackmail, or

( c ) conveys any picture or any printed or written documerLt which is grossly indecent or is scurrilous or intended for blackmail knowing or having reason to believe that such picture or document will be printed, sold, let for hire, dist-ibuted or publicly exhibited or in any manner put into circulation, or

(e) advertises or makes known by any means what- soever that any person is engaged or is ready to engage in any act which is an offence under this seqtion, or that any such newspaper, periodical, qircular, picture or other printed or written documei~t which is grossly indecent or is scurrilous or intended for blackmail can be procured from or through any person, or

(,) offers or attempts to do any act which is an offence under this section,

shall be punished with imprisonment of , either description for a term which may extend to two years', or with fine, or with both :

Provided that for a second or any subsequent offence under this section, he shall be punished with imprisonment of either description for a term which shall not ke less than six 111onths and not more than two years and with fine.

Explmalior~ I.--For the purposes of this section, the word ' scurrilous ' shall be deemed to include any mstier which is likely to be injurio~ls to morality or is calculated to injure any person :

Provided that it is not scurrilous to express in go& kith anything whatever respecting the conduct of-

Explanation II.-In deciding whether any person has cornmitt ed an offence under this section, the Court shall have l6egard. inter alia, to the following considerations:-

(a) the general character of the person charged , and where relevant, the nature of his business;

'(b) the genera1 character and dominant effect of the matter alleged to be grossly indecent or scurrilous or intended for black mai 1; i

i (e) any evidence offered or called by or on behalf of

the accused person as to his intention in committing any of the acts specified in this section."

BE it enacted by the Legislature of the State of Tamil Nadu In the Thirty-first Year of the Republic of India as follows :-

1. (1) This Act .yay be called the Code of Criminal Pro- cedure (Tamil Nadu Amendment) Act, 1980. and extent*

(2) It extends to the whole of the State of Tamil Nadu.

Amendment 2. In section 24 of the Code of Criminal Procedure, or section 24, 1973 (GntraI Act 2 of 1974),- Central Act 2 of 1974. (a) in sub-section (6), after the expression "sub-

section (5)", the following shall be inserted, namely :-

"but subject to the provisions of sub-section (6-A)";

(b) afbr sub-section (6), thc following sub-section shall be inserted, namely - - _ :-

(2) The- letter of request shall be transmitted in such manner as the Central Government may specify in this behalf.

(3) Every statement recorded or document or thing received under sub-section (I) shall be deemed to be the evidence collected during the course of investigation under this Chapter.

166B. (I) Upon receipt of a letter of request from a Court or an authoritg in a country or place outside India competent to issue such letter in that country or place for the examination of any person or production of any document or thing in relation to an offence under investigation in that country or plac.2, the Central Government may, if it thinks fit-

(i) forward the same to the Chief Metropolitan Magistrate or Chief Judicial Magistrate or such Metropoljtan Magistrate or Judicial Magistrate as he may appoint in this behalf, who shall therelipon summon the p'erson before him and record his state- ment or cause the document or thing to be produced; or

( i i ) send the letter to any police oflicer for investigation, ' who shall thereupon investigate into the offence in the same

manner, .

(2) All the evidence taken or collected under sub-section ( I ) , or authenticated copies thereof or the thing so collected, shall be for- warded by the Magistrate or police officer, as the case may be, to the Central Government for transmission t q the Court or the authority issuing the letter of request in such manner as the Central Gwern-

3. (1) The Code of Criminal Procedure (Amendment) Qdiqance, 1990 is hereby repealed.

(2) Notwithstanding such repeaI, anything done or any actiop taken under the Code of CriminaI Procedure, as amended by the said Ordi- nance, shall be deemed to have been done or taken under the Code of Criminal Procedure, as amended by this Act. i

h BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-fourth Year of the Republic of India as follows:-- ,< h

1. (1j This Act may be called the Code of Criminal Procedure (Tamil Nadu Short title,

Amendment) Act, 2003. extent and commence-

(2) It extends to the whole of the State of Tamil Nadu. men t.

F' (3) It shall come into force at once.

2 In section 167 of the Code of Criminal Procedure, 1973,- Amendment o f

( 1 ) in the lo sub-section (2). for clause (b), the following clause shall be section 167.

substituted, namely:--

"(b) no Magistrate shall authorise the detention of an accused person under this section, -

(i) if the accused is in the custody of police, urlless the acc~~sed is physically produced before him; and

(ii) ifthe accused is detained otherwise than in the custody ofpolice, unless the accused is produced before him either In person or through the media ol'electronic video linkage".

r (2) in the Explanation-Il under sub-section (2). after the expression "an accused

person was produced", the expression " in person or, as the case may be. through the media of electronic video linkage" shall be inserted.
