B. Market Flow Threshold Field Test and NAESB Transmission Loading Relief Business Practices
As indicated in the Joint Filing, the North American Electric Reliability
Corporation (“NERC”) initiated a Market Flow Threshold Field Test (“Field Test”) on June 1, 2007 with the RTOs to determine a market flow threshold that will allow the RTOs to meet their relief obligations during Transmission Loading Relief (“TLR”) consistently without jeopardizing reliability. In August 2009, based on the results of the Field Test from January 1, 2008 through July 20, 2009, the NERC Operating Reliability Subcommittee (“ORS”) Market Flow Threshold Task Force developed a recommendation to use a 5% market flow threshold for the three RTOs. The recommendation was presented to and approved by the NERC TLR Standard Drafting Team on August 25, 2009, and was submitted to and approved by the ORS on September 1, 2009.
In Order No. 676-D, the Commission indicated that NERC Standard IRO-006-4, Section E (which corresponds to Appendix D of the NAESB’s TLR Standards) explicitly provides that the regional differences waivers given to PJM, Midwest ISO, and SPP are to be retired upon completion of the field test. Thus, once NERC completes its TLR field testing, responsibility for Appendix D of the WEQ-008 TLR standards immediately transfers to NAESB. This transfer of responsibilities occurs automatically and does not require NERC to take any further steps to accomplish it. Thus, there will be no lag between the completion by NERC of its field testing and the assumption by NAESB of its responsibility for administering the Regional Differences Section under Appendix D.1
Accordingly, Order No. 676-D requires the RTOs to revert back to a 0% threshold required by Regional Differences Section of WEQ-008 Appendix D upon completion of the Field Test on October 31, 2009, regardless of the NERC recommendation to implement a 5% threshold.
Based on the findings of the Field Test, the NAESB WEQ Business Practices Subcommittee determined that it no longer needed to maintain the Regional Differences in Appendix D of WEQ-008 if the three RTOs plan to use the same 5% threshold as the rest of the Eastern Interconnection, and therefore recommended removal of the Regional Differences. The NAESB WEQ Executive Committee unanimously approved removing 1 Standards for Business Practices and Communication Protocols for Public

C. Joint Filing Waiver Request In the Joint Filing, the RTOs request a waiver of NAESB Standard WEQ-008-1.4
and WEQ-008 Appendix D. As indicated in the Joint Filing, a waiver is necessary for the RTOs to utilize a 5% market flow threshold upon the conclusion of the Field Test on October 31, 2009, pending Commission approval of the revisions to the WEQ-008 Business Practices recommended by NAESB and NERC. II. DESCRIPTION OF TARIFF REVISIONS
In this filing, SPP submits Tariff revisions to reflect the waiver requested in the Joint Filing. Specifically, SPP proposes to revise Attachment R-1 of the SPP Tariff, which incorporates by reference several NAESB Business Practices including the NAESB TLR Standards in WEQ-008. SPP has revised Attachment R-1 to remove the incorporation by reference of WEQ-008-1.4 and WEQ-008 Appendix D. Clean and redlined versions of the revisions to Attachment R-1 are attached to this filing as Exhibit Nos. 1 and 2, respectively.
III. EFFECTIVE DATE AND WAIVER OF NOTICE REQUIREMENTS
SPP requests a November 1, 2009 effective date for the revisions proposed in this filing. Pursuant to section 35.11 of the Commission’s rules and regulations, 18 C.F.R. § 35.11, SPP requests a waiver of the Commission’s 60-day notice requirement set forth in 18 C.F.R. § 35.3 so that SPP may implement the proposed Tariff revisions on November 1, 2009 after completion of the Field Test. Good cause exists to grant a waiver so that SPP may utilize the market flow threshold approved by NAESB and NERC rather than reverting to a 0% threshold at the conclusion of the Field Test pursuant to Order No. 676-D and the Regional Differences in WEQ-008. Additionally, a waiver of the 60-day notice requirement is appropriate given that the revisions proposed in this filing do not affect rates or charges for any jurisdictional service.2
