No. F.11/35/74-IC.—The decisions of the Government of India on the recom-mendations of the Third Central Pay Commission relating to civilian employees ofthe Central Government in Classes II. III and IV were notified in the Ministryof Finance Resolution No. 70(34)/73-Imp. Cell dated 1st November, 1973. Govern-ment have now given careful consideration to the recommendations of the Com-mission relating to the pay scales, allowances, retirement benefits etc. in respectof the Central Class I Services/posts, as also those in the All India Services, andhave decided that the recommendations of the Commission on matters afore-mentioned in respect of these officers shall be accepted broadly, subject to themodifications mentioned below. I. Recommendations on pay scales of Central Class I Services/posts(1) The minimum of the senior scale of all Central Class I Services/posts

wherever it has been recommended by the Commission at Rs. 1,050,shall be raised to Rs. 1,100.

(2) The period of restriction on the length of service for drawal of incre-ments in the Junior Administrative Grade wherever recommendedby the Commission shall be removed.

(3) While the specific recommendations of the Commission for provisionof a selection grade in certain Class I Central Services shall be

implemented, the principle of providing such a grade in various Clas*I Central Services has been accepted, the strength of this grade ineach Service/cadre being determined after detailed examination/review of the ea'dre structure, promotion prospects, etc. in thatService/cadre,

(4) The number of posts in the scale of Rs. 2500—2750 wherever theCommission has recommended two scales of Rs. 2250—2500 andRs. 3500—2750 for the posts in the existing senior administrativegrade/Head of Department or equivalent grade in any particularservice shall be 50 per cent of the number of those posts.

(5) The Cadre Review Committee shall review on a priority basis the cadrestrength of the various Central Class I Services in order to improve,wherever necessary, the promotion prospects in these services.

(6) While the recommendations of the Commission for grant of special payto Central Class I Officers shall be implemented, the principle ofgrant of special pay to officers of technical services for work of anarduous nature or requiring specialist qualifications and expertiseother than essential qualifications has also been accepted.

(7) Officers belonging to various Central Class I Services shall be eligiblefor appointment in the Central Secretariat.

II. Recommendations on pay scales of AJ1 India Services

(1) In regard to the Indian Administrative Service there shall be no changein the existing rules for determining the strength of selection gradein that service. Necessary action shall also be taken so that thenumber of posts eligible for the grimt of special pay in a State cadredoes not exceed 50 per cent oi the senior posts under the StateGovernment (excluding posts in the super-time scale).

(2) In regard to the Indian Police Service, the senior scale shall beRs. 1,200—1,700 and the selection grade Rs. 1̂ 800 fixed. Necessaryaction shall also be taken so that the number of posts eligible forgrant of special pay in a State Cadre does not exceed 50 per cent ofthe senior posts under the State Government (excluding posts in thesuper time scale).

(3) Decisions In regard- to the pay scale of the Conservator of Forests anda Selection Grade in the Indian Forest Service above the level ofDeputy Conservator or Conservator of Forests shall toe announcedlater.

m . Recommendations relating to other matters

The recommendations of the Commission relating to fixation of pay, grantof allowance, retirement benefits, date of effect etc. shall be acceptedbroadly, after extending, wherever applicable to Central Class IServices/posts and the All India Services the improvements whichhad been accepted In regard to empolyeea in Classes II to IV.

2. In view of the present financial position Government hope that Class I andAll India Services Officers will make a special deposit of the net amount of thearrears which they receive on account of these decisions for the period from 1stJanuary 1973 to 31st December, 1973 in their Provident Fund. The deposits somade in the Contributory Provident Fund Will, however, not be eligible forcorrespondnig contributions from Government.

maximum for a period of 2 years. Thenumber of selection grade posts shouldbe periodically determined after de-tailed review of cadre structure ofthose services.

not exceed the pay plus special pay-admissible in the same post to IndianAdministrative Service officers withcorresponding seniority and length ofservice should be discontinued.

11. The Class II Cadro in the CentralHealth Service should be graduallyabolished and all future recruitmentshould be to Class I Junior scale. Theexisting posts of General Duty OfficersGrade II and General Duty OfficersGrade I under the Central Health Ser-vice should be appropriately placed inClass I Junior and Senior time scales.The existing GDOs Grade II shouldbe fixed in Junior Class I scale afterproper screening. Those who are notso selected should continue in Class ITand be allotted the standard Class IIscale.

12. Structural recognlsation of Cen-tral Health Service is necessary toensure reasonable promotional oppor-tunities to GDOs Grade I, hospitalspecialists and teaching Specialists intheir respective fields.

13. The Class II cadre in the RailwayMedical Service should be abolishedand a combined Junior and Seniorscale introduced to he called as Assis-tant Divisional Medical Officers.

17. In the case of promotion fromone Class I post to another class Ipost the pay in the higher scale shouldbe fixed at the stage next above thepay drawn in the lower scale irrespec-tive of whether the lower oost washeld in a substanlnve, offlelatins ortemporary capacity.

18. The benefit of Day flxaloin inaccordance with concordance table onpromotion frqm Junior Claas I scaleto Senior Class I scale may be extend-ed to all organised Class I services andalso to promotion in those servicescarrying junior and senior scales eventhough lateral induction takes placein senior scale level also. The benefitmay 'continue in the Scientific iandTechnical Services where it exists atpresent.

19. Class I officers drawing pay up-t0 and including Rs. 1800 per monthin the existing scales should havetheir pav fixed in the proposed scalesafter adding to their existing emolu-ments the amount representing 5 percent of the existing pay (whethersubstantive, officiating or acting) sub-ject to a minimum of Rs, 10 and amaximum of Rs. 50 and subject tovarious other conditions stipulated inSection II of Chapter 67 for the fixa-tion of pav in the proposed scales.

20, As regards officers drawing payabove Rs, 1800 p.m. in the existingscales, their pay in the proposed scalesshould be fixed under the Funda-mental Rules 22. 23 and the relevantaudit instructions.

Some weightage should be ac-corded for the service rendered inClass II, at least in those Class IServices, where promotion from ClassII is, for all practical purposes to theSenior Scale of Class I. The extentof weightage and the conditions underwhich It is to be Riven Is to be decidedby individual Departments.(Chapter 13, paargraph 10)

Dearness Allowance22. Dearness Allowance should be

paid to Central Government employeesdrawing pay of Rs. 700 and above andupto Rs. 2250 p.m. at the rate of 2.5per cent of pay subject to a maximumof Rs. 20 p.m. when the 12-monthlyaverage of the All India WorkingClass Consumer Price Index Numberfor Industrial Workers (General)(1960=1001 goes up by 8 points in thefollowing manner:—•

Rise in prices over thebase period (12-monthly average of200 points of the in-dex with i960 base1)adopted for devisingthe pay structure.

(1) For the price riseof first 8 points inthe iz-m^nthlyaverage of the i960base index.

(2) On the indexaverage rising by16 points

(3) On the indexaverage rising by24 points.

Employees to be?covered

28. The concept of "urban agglo-meration" recommended for the grantof Compensatory (City) Allowanceshould not be applied for the grant "fHouse Rent Allowance

29. (a) Production and verificationof rent receipts should be made com-pulsory in all cases.

(b) However, the employees who areat present drawing house rent allow-ance without production of rantreceipts should be allowed this facilityso long as they claim the same amountof house rent allowance as they arereceiving at present. This concessionshould apply to fresh entrants also.[Chapter 56, paragraph 29(iv)]Rent for Government accommodation

30. The percentage of pay chargedon account of house rent for Govern-ment accommodation will remain un-changed.(Chapter 56, paragraph 44)

Leave Travel Concession

36(a) The existing provision as te-Karda journeys to home-town once in ablock of two years should continuewith the modification that once In ablock of four years, every Govern-ment employee should bp allowed toavail of the leave Travel Concessionfor jorney to any place in India sub-ject to other "prescribed conditionslaid down in the existing scheme. Inallowing the concession of iournev toa place other than home-town, thebenefit should be extended to thoseemployees also whose home towns aresituated within 400 kilometres.

(b) The definition of 'family' forpurposes of the grant of leave travelconcession should be the same as re-commended by the Commission forpurposes of travelling allowance forjourneys on transfer.

(c) The employees should be per-mitted to avail of the leave travelconcession for journeys performedduring casual leave also without speci-fying any minimum period of ab-sence.

Educational Facilities and Allowances

37 (a) The Commission has recom-mended certain rates and/or condi-tions in respect of Children's Educa-tional Allowance and educationalfacilities in the mater of education ofchildren of Central Government em-ployees.

38 (u) No change is considerednecessary in the existing formula forcomputing pension and death-cuin-ret'irement gratuity. However, themaximum qualifying service for earn-ing pension and death-cum-retirementgratuity should be increased from 30years to 33 years. The upper paylimit for the grant of pension and forearning death-cum-retirement gra-tuity should be raised from Rs. 1800to Rs. 2500 per mensem, The existingceilings on maximum pension shouldbe raised from Rs. 675/- p.m. toRs. 1000/- p.m. and on maximumdeath-cum-retirement gratuity fromRs. 24,000/- to Rs. 3D,000/-.

(b) The existing arrangementsunder which the Government emplo-yees are required to contribute partlytowards the financing of the familypension scheme should continue.While the contribution of the emplo-yees should continue to be equal totwo months emoulmcnts, the maxi-mum amount should be raised fromRs. 3600 to Rs. 5000.(Chapter 60 paragraph 54)

amount of family pension at the en-hanced rates should not exceed thenormal superannuation pension (un-commuted value) to which the Gov-ernment employee would be entitledto on superannuation. Family pensionin cases of death after retirementshould be given only to those whowere members of the family of theGovernment employee as declared atthe time of retirement.(Chapter 60, paragraphs 55 to 58)

(d) While there should be no changein the existing conditions for grant ofinvalid, pension, the amount of Invalidpension should not be less than theamount of family pension at the ordi-nary rates.

(e) The Commission has recom-mended certain rates and conditionsfor the grant of terminal benefits fortemporary and quasi-permanent em-ployees in paragraphs 63 to 65 ofChapter 60.

Extraordinary Pension

39. The Commission has recom-mended, that the existing provisions ofthe Central Civil Services (Extra-ordinary Pension) Rules should besimplified and rationalised on thebasis of recommendations made inparagraphs 71 to 76 of Chapter 60.

Date of Superannuation,

40. Retirement of Government ser-vants should take effect from theafternoon of the last day of the monthIn which they attain the age of super-annuation instead of the afternoon ofthe actual date of their superannua-tion.(Chapter 60, paragraph 15)

41. The exemption limit on gra-tuity for purposes of tax liabilityshould also be correspondingly raisedfrom Rs. 2400O to Rs. 30000.

Relief to Pensioners In future

44. Central Government employeeswho retired on or after 1st March,1973, should irrespective of the amountof pension drawn by them be given arelief at the rate of 5 per cent oftheir pension subject to a minimumof Rs. 6 and a maximum of RK. 25 p.m.on the 12-montnly average of the AHIndia Working Class Consumer PriceIndex (1960=100) rising by 16 points.The relief for the first time at theserates should be paid when the 12-monthly average of this index reaches216,(Chapter 60, paragraph 92)

Hours of work45, (a) In general the gross work-

ing hours prescribed in the industrialestablishments under the Governmentshould be 48 hours in a week and 8hours in a day but within this periodof 8 hours the workers should beallowed a break for half an hour totake their meols thus yielding a netof 45 hours per week. As regards theindustrial establishments where thenet weekly hours of work are lessthan 45, the position should be re-viewed.

Casual Leave47, The existing quantum of casual

leave is quite adequate. All operat-ing and maintenance staff who areentitled to less number of publicholidays in a year than the numberallowed to the office staff in admini-strative offices should be allowed 15days casual leave : No class ofemployees should be allowed morethan 15 days casual leave in a calen-dar year. In case higher amountof casual leave has been allowed Incertain cases due to remoteness ofthe region, one or two days' journeytime should be allowed whenever aperson proceeds on casual leave ratherthan allowing an enhanced quantumof leave every year as a regularprovision.

limit on the period of leave that canbe availed at any one time. Theexisting differentiation between, per-manent and temporary employees in•regard to earning leave in the firstyear of service should be abolished.

(b) The present limit of Hs 750/-on leave salary during half pay leaveshould be dispensed with.

(c) The present limit of 240 dayson commuted leave during the entireservice should be removed. Half payleayte upto a maximum of 180 daysof such leave should be allowed to becommuted during entire service wheresuch leave ia utiUaed for an approvedcourse of study.

(d) The special provisions madein the Study Leave Rules for officersin the Indian Economic Service, theIndian Statistical Service and medicalofficers should be extended to manymore categories of specialists andtechnical personnel on merits o£ eachcase.

(e) For courses of study pursued inIndia, the emoluments during StudyI^ave ghould be regulated in thesame way as during earned leavesubject to the emoluments not exceed-ing the pay that the officer wouldhave otherwise drawn had he re-mained on duty. No study allowanceshould be paid during this period.

(f) The existing provisions relatingto study leave availed outside Indiashould continue. The rates of studyallowance admissible in foreign coun-tries should be reviewed by the Gov-ernment from time to time.

(g) In case of death in harness,the cash equivalent of the leave salarythat the deceased employee wouldhave got had he gone on earned leaveon the date of death should be givento his family subject to a maximumof leave salary for 120 days.{Chapter 62, paragraphs 14. 15, 18, 19,20 to 26 and 37)

Miscellaneous49. (a) Messing allowance at pre-

sent admissible for the nursing staffshould be merged in their pay scalesand should not be granted separately.Dearness allowance iand compensa-tory (city) allowance (whereveradmissible) should be allowed to suchtetafr in full at the same rates asapplicable to other employees.(Chapter 16, paragraph 90),
