NOTIFICATION

New Delhi, the 9th April, 1999

S. O. 244 (E).-- In exercise of the powers conferred by clause (3)of article 77 of the Constitution, the President hereby makes thefollowing rules further to amend the Government of India (Allocationof Business) Rules, 1961, namely:-

1. (1) These rules may be called the Government of India(Allocation of Business) (Two hundred and Forty second Amendment)Rules, 1999.

(2) They shall come into force at once.

2. In the Government of India (Allocation of Business) Rules,1961,-

(1) in the First Schedule,-

(a) under the heading "25.Ministry of Planningand Programme Implementation (Yojana aurkaryakram Karyanvayan Mantralaya)", for thesub-headings "(ii) Department of Statistics(Sankhyiki Vibhag)" and "(iii) Departmentof Programme Implementation (KaryakramKaryanvayan Vibhag)", the following shallbe substituted, namely:-

"(ii)Department of Statistics andProgramme Implementation (Sankhyikiaur Karyakram Karyanvayan Vibhag).";

(b) for the heading "28.Ministry of Rural Areasand Employment (Gramin Shetra aur RozgarMantralaya)" and the sub-headingsthereunder, the following heading and sub-headings shall be substituted, namely:-

"28. Ministry of Rural Development (GraminVikas Mantralaya)(i) Department of Rural Development

(Gramin Vikas Vibhag)(ii)Department of Land Resources

(Bhumi Sansadhan Vibhag). ";

(c) for the heading "33. Ministry of UrbanAffairs and Employment (Shahari Karya aurRozgar Mantralaya)" and the sub-headingsthereunder, the following shall besubstituted, namely:-

"33. Ministry of Urban Development (ShahariVikas Mantralaya)";

(2) in the Second Schedule,-

(a) under the heading "MINISTRY OF AGRICULTURE(KRISHI MANTRALAYA)", under the sub-heading"A. DEPARTMENT OF AGRICULTURE ANDCOOPERATION (KRISHI AUR SAHKARITA VIBHAG)",after entry 47, the following entry shallbe inserted, namely:-

"47A.Warehousing in rural areas includingrural godowns.";

(b) under the heading "MINISTRY OF PLANNING ANDPROGRAMME IMPLEMENTATION (YOJANA AURKARYAKRAM KARYANVAYAN MANTRALAYA)", for thesub-headings "B. DEPARTMENT OF STATISTICS(SANKHYIKI VIBHAG)" and "C. DEPARTMENT OFPROGRAMME IMPLEMENTATION" and the entriesthereunder, the following sub-heading andentries shall be substituted, namely:-

"B. DEPARTMENT OF STATISTICS AND PROGRAMMEIMPLEMENTATION (SANKHYIKI AURKARYAKRAM KARYANVAYAN MANTRALAYA)

1. Act as the nodal agency for planningintegrated development of thestatistical system in the country.

2. Coordination of statistical work witha view to identifying gaps in dataavailability or duplicationof statistical work in respect ofDepartments of the Government of Indiaand State Statistical Bureaux (SSBs)and to suggest necessary remedialmeasures.

3. Laying down and maintenance of normsand standards, in the field" ofstatistics, involving concepts anddefinitions, methodology of datacollection, processing of data anddissemination of results.

4. Advise the Departments of theGovernment of India on statisticalmethodology and on statisticalanalysis of data.

5. Preparation of national and regionalaccounts as well as publication ofannual estimates of national product,Government and private finalconsumption expenditure, capitalformation, saving, estimates ofcapital stock a,nd consumption of fixedcapital, as also state level grosscapital formation of supra-regionalsectors and to prepare comparableestimates of State Domestic Product(SDP) at current prices.

6. Compilation and release of the indexof industrial production (TIP) everymonth in the form of 'quickestimates'; conducting of AnnualSurvey of Industries (ASI); andproviding of statistical informationto assess and evaluate the changes inthe growth, composition and structureof the organised manufacturing(factories) sector.

7. Organisation and conduct of periodicall India economic census andfollow-up sample surveys.

8. Conducting of large scale all-Indiasample surveys for creating data baseneeded for studying the impact ofspecific problems for the benefit ofdifferent population groups in diversesocio-economic areas such as employ-ment, consumer expenditure, housingconditions and environment, literacylevels, health, nutrition, familywelfare, etc .

9. Examination of the survey reports fromtechnical angle and evaluation ofappropriate sampling design includingsurvey feasibility studies/techno-analytical studies in respectof surveys conducted by the NationalSample Survey Organisation (NSSO) andother Central Ministries andDepartments.

10. Providing of an in-house facility toprocess data collected through varioussocio-economic surveys and follow-upsurveys of Economic Census conductedby the National Sample SurveyOrganisation and the CentralStatistical Organisation.

11. Dissemination of statisticalinformation on various aspects througha number of regular or ad-hoc publica-tions to Government, semi-Government,or private data user/agencies; anddissemination of data, on request, toUnited Nations Agencies like UnitedNations School Organisation, Economicand Social Commission for Asia and thePacific and International LabourOrganisation; and other relevantinternational agencies.

12. Giving grants-in-aid to registerednon-governmental organisations andresearch institutions of repute forundertaking special studies orsurveys, printing of statisticalreports, and finance seminar,workshop, or conference relating todifferent subject areas of officialstatistics.

13. Functioning as the Cadre ControllingAuthority and deal with thecentralised . aspects of managing theIndian Statistical Service includingall matters pertaining to training,career planning and manpower planning.

14. The Indian Statistical Institute andensuring its functioning in accordancewith the provisions of the IndianStatistical Institute Act, 1959 (57 of1959).

15. Monitoring of 20 point programme.

16. Monitoring of the performance ofInfrastructure Sectors; and

17. Monitoring of projects of Rs.20 croresand above.".

(c) for the heading "MINISTRY OF RURAL AREASAND EMPLOYMENT (GRAMIN SHETRA AUR ROZGARMANTRALAYA) and the sub-headings aridentries relating thereto, the followingheading, sub-headings and entries shall besubstituted, namely :-

"MINISTRY OF RURAL DEVELOPMENT (GRAMINVIKAS MANTRALAYA)

A. DEPARTMENT OF RURAL DEVELOPMENT (GRAMINVIKAS VIBHAG)

1. All matters relating to panchayati rajand panchayati raj institutions.

2. Nodal responsibility for all mattersrelating to the Minimum NeedsProgramme in rural areas, in the fieldof elementary education, adulteducation, rural health, ruralelectrification and the nutrition programmes.

3. Water supply (subject to overallnational perspective of water planningand coordination assigned to theMinistry of Water Resources), sewage,drainage and sanitation relating torural areas. International coopera-tion and technical assistance in thisfield.

4. Public cooperation, including allmatters relating to voluntary agenciesfor rural development and NationalFund for Rural Development.

5. Cooperatives relatable to the items inthis list.

6. All attached or subordinate officesor other organisations concerned withany of the subjects specified in thislist.

7. All matters relating to rural roadsincluding those under the MinimumNeeds Programme in the rural areas.

8. Road works financed in whole or inpart by the Central Government intribal areas of Assam specified inPart I and Part II of the Tableappended to paragraph 20 of the SixthSchedule to the Constitution.

9. All matters relating to cooperationwith the Centre for Integrated RuralDevelopment for Asia and Pacific(CIRDAP) and the Afro-Asian RuralReconstruction Organisation (AARRO),

10. (a) All matters pertaining torural employment or unemployment suchas working out of strategies andprogrammes for rural employmentincluding special works, wage orincome generation and training relatedthereto;

(b) Implementation of thespecific programmes of ruralemployment evolved from time to time.

(c) Micro level planning related torural employment or unemployment andadministrative infrastructuretherefor.

11. Integrated rural developmentincluding small farmers developmentagency, marginal farmers andagricultural labourers, etc.

12. Rural housing including Rural HousingPolicy and all matters germane andincidental thereto under country orrural planning, in so far as itrelates to rural areas.

B. DEPARTMENT OF LAND RESOURCES

1. Land reforms, land tenures, landrecords, consolidation of holding andother related matters.

2. Administration of the Land AcquisitionAct, 1894 (1 of 1894) and mattersrelating to acquisition of land forpurposes of the Union.

3. Recovery of claims in a State inrespect of taxes and other publicdemands, including arrears of landrevenue and sums recoverable as sucharrears, arising outside that State.

4. Land, that is to say, collection ofrents, transfer and alienation ofland, land improvement andagricultural loans excludingacquisition of non-agricultural landor buildings, town planningimprovements.

5. Land revenue, including the assessmentand collection of revenue, survey ofrevenue purposes, alienation ofrevenues.

6. Duties in respect of succession toagricultural land.

7. National Wastelands Development Board.

8. National Land Use and WastelandDevelopment Council.

9. Promotion of rural employment throughWastelands Development,

10. Promotion of production of fuelwood,fodder and timber on non-forest lands,including private wastelands.

11. Research and development ofappropriate low cost technologies forincreasing productivity of wastelandsin sustainable ways.

12. Inter-departmental and inter-disciplinary coordination in programmeplanning and implementation of theWastelands Development Programmeincluding training.

13. Promotion of people's participationand public cooperation and coordina-tion of efforts of Panchayats andvoluntary and non-Government agenciesfor Wastelands Development.

14. Drought prone area programmes.

15. Desert Development Programmes.";

(d) for the heading "MINISTRY OF URBAN AFFAIRSAND EMPLOYMENT (SHAHARI KARYA AUR ROZGARMANTRALAYA)" and the sub-headings andentries relating thereto, the followingheading and entries shall be substituted,namely:-

"MINISTRY OF URBAN DEVELOPMENT (SHAHARIVIKAS MANTRALAYA)

1. Properties of the Union, whether landsor buildings, with the followingexceptions :-

(i) Those belonging to the Ministryof Defence (Raksha Mantralaya)the Ministry of Railways (RailMantralaya) and the Department ofAtomic Energy (Parmanu OorjaVibhag) and the Department ofSpace (Antariksh Vibhag).

(ii) Buildings or lands, the construc-tion or acquisition of which hasbeen financed otherwise than fromthe Civil Works Budget; and

(iii)Buildings or lands, the controlof which has at the time ofconstruction or- acquisition orsubsequently been permanently-made over to other Ministries andDepartments.

2. All Government Civil works andBuildings including those of Unionterritories excluding Roads andexcluding works executed by orbuildings belonging to the Ministry ofRailways (Rail Mantralaya), Departmentof Posts (Dak Vibhag), Department ofTelecommunications (DoorsancharVibhag), Department of Atomic Energy(Parmanu Oorja Vibhag) and theDepartment of Space (AntarikshVibhag).

3. Horticulture operations.

4. Central Public works Organisation.

5. Administration of Government estatesincluding Government Hostels under thecontrol of the Ministry. Location ordispersal of offices in or from themetropolitan cities.

6. Allotment of accommodation in VigyanBhawan.

7. Administration of the Requisitioningand Acquisition of Immovable PropertyAct, 1952 (30 of 1952).

8. Administration of Delhi Hotels(Control of Accommodation Act, 1949(24 of 1949).

9. The Public Premises. (Eviction ofUnauthorised Occupants) Act, 1971 (40of 1971) .

10. Administration of four RehabilitationMarkets viz. Sarojini Nagar Market,Shankar Market, Pleasure Garden Marketand Kamla Market.

11. Issue of lease or conveyance deeds inrespect of Government built propertiesin Delhi and New Delhi under theDisplaced Persons (Compensation andRehabilitation) Act, 1954 (44 of 1954)and conversion of lease deeds, allot-ment of additional strips of landand correctional areas adjoining suchproperties.

12. Stationery and Printing for theGovernment of India including officialpublications.

13. Planning and Coordination of urbantransport systems, with technicalplanning and road based systems beingsubject to items 22 and 23 under theMinistry of Surface Transport (Jal-Bhootal Pariwahan Mantralaya) andtechnical planning of rail basedsystems being subjects to items 1 and2 under the Ministry of Railways (RailMantralaya), Railway Board (RailBoard).

14. Town and Country Planning; mattersrelating to the Planning and Develop-ment of Metropolitan Areas, Interna-tional Cooperation and technicalassistance in this field.

15. Schemes of large scale acquisition,development and disposal of land inDelhi.

16. Delhi Development Authority.

17. Master Plan of Delhi, Coordination ofwork in respect of the Master Planand Slum Clearance in the NationalCapital Territory of Delhi.

18. Erection of memorials in honour offreedom fighters.

19. Administration of the DelhiDevelopment Act, 1957 (61 of 1957).

20. The Delhi Rent Control Act, 1958 (59of 1958).

21. Development of Government Colonies.

22. Local Government, that is to say, theconstitution and powers of theMunicipal Corporations (excluding theMunicipal Corporation of Delhi),Municipalities (excluding the NewDelhi Municipal Committee), otherLocal Self-Government Administrationsexcluding Panchayati Raj Institutions.

23. The Delhi Water Supply and SewageDisposal Undertaking of the MunicipalCorporation of Delhi.

24. Water supply (subject to overallnational perspective of water planningand coordination assigned to theMinistry of Water Resources), sewage,drainage and sanitation relating tourban areas and linkages fromallocated water resources. Interna-tional cooperation and technicalassistance in this field.

25. The Central Council of LocalSelf-Government.

26. Allotment of Government land in Delhi.

27. All attached or Subordinate Offices orother organisations concerned with anyof the subjects specified in thislist.

28. Public Sector Projects falling underthe subjects included in this list,except such projects as arespecifically allotted to any otherDepartment.

29. The Urban Land (Celling andRegulation) Act, 1976 (33 of 1976).

30. Delhi Urban Art Commission, the DelhiUrban Art Commission Act, 1973 (1 of1973).

31. Administration of Rajghat SamadhiCommittee.

32. All matters relating to Planning andDevelopment of the National CapitalRegion and administration of theNational Capital Region Planning BoardAct, 1985 (2 of 1985) .

33. Matters relating to the IndianNational Trust for Art and CulturalHeritage (INTACH).

34. Formulation of housing policy andprogramme (except rural housing whichis assigned to the Department of RuralDevelopment, Poverty Alleviation andRural Employment (Gramin Vikas, GaribiUpshaman aur Gramin Rozgar Vibhag),review of the implementation of thePlan Schemes, collection anddissemination of data on housing,building materials and techniques,general measures for reduction ofbuilding costs and nodalresponsibility for National HousingPolicy.

35. Human Settlements including the UnitedNations Commission for HumanSettlements and InternationalCorporation and Technical Assistancein the field of Housing and HumanSettlements.

36. Urban Development including SlumClearance Schemes and the Jhuggi andJhonpri Removal Schemes.International Cooperation andtechnical assistance in this field.

37. National Cooperative HousingFederation.

38. Implementation of the specificprogrammes of Urban Employment andUrban Poverty Alleviation, such asNehru Rozgar Yojana (NRY), Urban BasicServices for the Poor (UBSP), andPrime Minister's Integrated UrbanPoverty Eradication Programme (PMIUPEP) and other programmes evolvedfrom time to time."
