This is in response to your April4, 2013, Freedom oflnf01mation Law (FOIL) request in which you sought any and alldocuments and tape or digital recordings, emails, documents residing on hard drives, and various computer memorydevices, regarding the license revocation, disciplinary hearing of Steve Paul Rombom aka RAMBAM.

The Department's search of our records has been completed. The records include approximately four hundred fifty-nine( 459) pages of hard-copy documents, as well as two (2) electronic files, reproduced on a standard compact disc (CD).

Pursuant to FOIL and Executive Law§ 96(3), photocopies of Department records are provided at a cost of fifty cents($.50) per page, payable in advance. To the extent that the records are maintained in electronic format, they can bedelivered on a CD for the cost of reproduction (ie -4 9 cents ($0.49) for the cos t of the media). Please remit a check ormoney order made payable to the NYS Department of State in the amount of $229.99 and return it along with a copy ofthis letter. If payment is not received wi thin thirty (30) calendar days of this correspondence, the Department will deemthe request to have been withdrawn.

Basedupon further review o f you r request., your appeal with regard to materials provided to . the Department by the ·Federal Bureau oflnvestigation (hereinafter FBI' ') i ; Jrereby denied .

Public Officers Law §87(2) states that Each agency shall, in a c c o r ~ n c ewith its published rules, makeavailable for . public inspection and copying all record s, except that such ageriey may deny acce ss to records orportions thereof that (e) are comp lied for law enforcement purp os es and which., if disclosed, would: (i) interferewith law enforcement investi gations or judicial proceedings. As the Department has an opim inve stigation in thecase of State v. R ombom, it would not be appropriate to release the three Q) page interview memorandum (FormF D -~ 0 2 )and the tw 0 DVDs provided by the FBI .

It should be further noted that the FBI su g ge.; ts that t h ~s e materials are exclusively the property of the FBI

and shall not be disseminated . In a l•etter da ted July J G, 2008, the FBI asserts: •.. he Privacy Act precludes theFBI from disclosing any inform ation concerning any pr?
