SUBJECT: FLOOD TASK FORCE MEMBERS

SUGGESTED MOTION

THAT _____ and _____ be appointed to the Flood Task Force Committee as Council representatives;

AND THAT staff prepare an advertisement, requesting applications for volunteers interested in participating in the Flood Task Force Committee, if the current members no longer wish to sit on the Committee.

BACKGROUND & DISCUSSION

Last year following the flooding on Lake St. John and the Black River, Council established a Flood Task Force Committee for the purpose of understanding and providing an overview of past flooding events- what happened, what worked and didn't work, what can be done better in the future to protect the lives, wellbeing and property of its citizens and to ensure the protection of Ramara's ground and surface water. Attached is a copy of the terms of reference adopted by Council.

Due to the recent changes to Council, new Council representatives are required to be appointed to the Flood Task Force Committee. This Committee meets on an as needed basis. With spring quickly approaching, it would be beneficial to have the Committee formed and ready to meet as soon as required.

Staff is in the process of contacting the current volunteer members of the committee to ensure they are still interested in sitting on the Committee. If these members are no longer interested, staff would like to move forward with posting an ad on the Township's website, public bulletin boards the Packet & Times and the Brock Citizen newspapers requesting applicants.

ALTERNATIVES

Council could disband the task force as the issue of controlling water levels is a matter of the provincial and federal government.

FINANCIAL INFORMATION

The costs incurred to date would consist of staff time. If new volunteer members need to be recruited to sit on the Committee, there will be costs associated with advertising in the Brock Citizen and the Packet and Times.

STRATEGIC ISSUES

Two strategic issues apply: Safety and Security and Water Quality in Our Lakes and Rivers.

Safety and Security- To protect the lives, well-being and property of our citizens with comprehensive and efficient protective, emergency and health related services for the betterment of the community.

Water Quality in Our Lakes and Rivers- To ensure the continued protection of the quality of our ground and surface water by promoting best practices which recognize the importance of this resource for existing and future development.

RECOMMENDED ACTION

THAT staff proceed with the suggested motion.

Ramara Township Flood Task Force

Terms of Reference

During the spring of 2013 and now again in 2014, Ramara Township experienced extensive flooding in several different areas of the municipality and has turned to the Province to declare it a disaster area.

Purpose

The Ramara Township Flood Task Force is being established to understand and provide an overview of past flooding events -what happened, what worked and didn't work, what can be done better in the future to protect the lives, wellbeing and property of its citizens and to ensure the protection of Ramara's ground and surface water.

Objectives

The task force will gain an understanding of the issues by examining the history of flooding in Ramara Township and key aspects in detail such as preparedness and response, forecasting, public communication, operation of flood control infrastructure and flood protection.

Aim

To deliver sound analysis and recommendations that will ultimately improve the way Ramara addresses seasonal flooding.

Task Force Structure

The Task Force will be comprised of the following:

• residents directly affected by the flooding • 2 Members of Council • representatives of Provincial and Federal levels of Government including

o Ministry of Natural Resources o Parks Canada o Trent Severn Waterways

Simcoe Road and Laguna Parkway Intersection (possible three-way stop)

SUGGESTED MOTIONS:

THAT we receive the Ramara Community Policing Committee report CPC-02-15, dated February 2"d, 2015

AND THAT we request the Manager of Municipal Works to investigate the installation of a three-way stop intersection at Simcoe Road and Laguna Parkway.

GENERAL BACKGROUND & DISCUSSION:

During the January ath, 2014, Ramara Community Policing Committee meeting the Committee discussed the intersection of Simcoe Road and Laguna Parkway.

We were advised it is a "blind" intersection due to the partition in the middle of Laguna Parkway entrance. The traffic during summer months is relatively busy causing a concern for residents leaving Lagoon City.

We have decided this may be a suitable location for a three-way stop intersection. This will not only provide the drivers on Laguna Parkway a clear view of the cars on Simcoe Road but will provide a break in traffic allowing Laguna Parkway drivers to pull out onto Simcoe Road (especially after a train) and decrease speeding along Simcoe Road which is known to have a high volume in speeders.

FELINE CONTROL

SUGGESTED MOTION:

THAT we receive report CD-05-15 and that Council regulate I or not regulate felines in Ramara.

BACKGROUND & DISCUSSION:

Council received correspondence from Barry Compton requesting that Council limit the number of cats in residential zones. Staff were asked to prepare a report on feline control and the matter was referred to Canine Control Officers Mark Cronk and Erica Loutskou.

In preparation of this report Canine Control contacted nearby municipalities to determine if they have a feline bylaw in place. Of the following municipalities; Brock, Kawartha Lakes, Rama First Nation, Orillia, Severn, Oro-Medonte, Barrie and Gavenhurst there are 4 that currently have a Cat Bylaw in place.

Brock is the only municipality that has a fully operational, municipally run shelter. It offers complete veterinary care for animals that are impounded. Animals are held for a set stray period and then assessed before eligible for adoption. This means that all cats & dogs have a complete health check, are dewormed and vaccinated, and are spayed or neutered before they are eligible to be rehomed or adopted back out into the community. Brock's current bylaw does limit the number of cats that are allowed in a residential zone and gives leeway to others in rural or rural/agricultural. Licensing of cats is not required. As such Brock's bylaw reads "no owner shall knowingly or not knowingly allow the dog or cat to run at large within the limits of the Township."

Rama First Nation contracts out shelter services in our facility. Rama has a similar bylaw to Brock with regards to cats including no requirement to licence. Cats are assessed upon arrival or capture and deemed sociable or feral. Sociable cats are held for a minimum 5 day stray period and then gifted away in exchange for a donation to the shelter, usually something cat related, i.e. food or litter to help off-set the cost of caring for the few cats that Rama does acquire. Rama is trying to move away from impounding cats, also licensing is not a requirement and feral cats are euthanized.

To the best of our knowledge the only municipality regulating cats and imposing fees for licensing of cats is the City of Barrie, with limited success with compliance as it is difficult to enforce such a provision.

Difficulty in enforcing tended to be the overwhelming consensus when in discussions with other municipalities and agencies on regulating cats.

Orillia is currently working toward implementing bylaws for control.

In most municipalities, the local SPCAs will take in cats that are brought directly to them by residents. Feral cats are euthanized. Residents of Ramara are free to take stray cats to the local SPCA (Orillia) however the SPCA will not pick up in our area. Some municipalities will remove feral cats by live trap and transport the animal to shelters, humane societies or vet clinics that they have agreements or contracts with and euthanized at the Township's expense.

In 2014 Canine received 23 calls and 2013 there were 10 calls with regards to nuisance or stray cats. Our records do show that the number of calls did increase but only in areas that are more densely populated, for example Lake Avenue in Lagoon City & Oakridge Drive in Washago.

OTHER CONSIDERATIONS

There are many aspects Council should consider before implementing a Bylaw to control the number of cats. Council must consider if it will create a Feline Bylaw that only limits the number of cats a resident may have based on zoning or across the entire municipality.

Council must also consider that implementing a Feline Bylaw will result in the need to impound stray, sick, injured or feral cats. When handling sick/ injured or feral cats the animal control officer is at a higher risk of being bitten or scratched because feral cats have had little or no human contact making them unpredictable and dangerous. A cat bite is one of the worst bites to receive due to the large amounts of bacteria that are naturally found in their mouths and the number of easily transmitted zoonotic diseases & viruses that are found in un­vaccinated feral colonies. Rabies; Toxacara (round worm); Toxoplasmosis (can cause abortions in humans); Leptospirosis and Bartonella (cat scratch disease) to name a few. Often a person that has been bitten by a cat can expect to be on a treatment of antibiotics or hospitalized with I.V. antibiotics in the case of blood poisoning depending on the severity of the bite.

Typically feral cats would be assessed to determine if they are adoptable or not. Feral cats are not typically housed for the stray period due to the inability to humanely care for them during that time and as a result, would be euthanized at the Township's expense.

FINANCIAL INFORMATION:

Basic costs could include the purchasing more cat banks, or possibly adding to or renovating the Canine Control facility to accommodate more animals. Other cost considerations are the acquisition of proper equipment to safely handle feral cats, including but are not limited to live traps, Kevlar lined gloves or sleeves to prevent bites as well as cat tongs to name a few.

Staffing and facility costs need to be considered. There is the necessity to have the animals cared for while they are being held in shelter providing food, water, cleaning and general basic care or even medical attention. Officer's hours will need to be addressed and budgeted for. Also the potential increase in veterinary costs incurred by the Township.

Also in order to provide all of our adoptable animals with the same level of care as other local shelters, estimates on expenses per animal could be.

Expense: • Estimated range: $242.54- $383.79 for a male cat • Estimated range: $412.04-$638.04 for a female cat.

Remittance: • Brock currently adopts out their cats for $73.45. • The Orillia SPCA adopts out their cats for $165 (or if the cat is older

than 6 years old $85) • And the Humane Society of Kawartha Lakes adopts out their cats

for $195 (or if older $133)

POTENTIAL BENEFITS AND CONSEQUENCES

Positive benefits resulting from the creation of a Feline Bylaw in Ramara include: • A new service to offer residents that may experience cat related issues

due to no fault of their own. • We have a wonderful facility, small in comparison to most but it is very

efficient and functional and this would give the Township an opportunity to

expand our facility and move toward being a fully operational animal care shelter.

• Provides increased more humane, protection for cats that do not have owners. As we do for the stray dogs of our area. Currently a sick or injured cat may be left to its own demise if the resident or caller is unwilling to transport to the OSPCA. OPP may dispose of them if they are on the roadway or highway.

• Increase in Canine Control staff hours.

Negative aspects that may occur with establishment of a Feline Bylaw can include:

• An increase number of feline related calls and complaints, which could take away from Canine Control matters.

• Having to impound stray/ sick/ injured or feral cat, would; o Increase capital expenses, i.e. facility costs, new equipment

expenses i.e. cat bowls, litter pans, cat carriers and cat graspers; and everyday expenses, i.e. litter, food, etc.

o Increase hours required for staff to maintain the shelter and care for animals.

o Increase potential dumping of unwanted cats at shelter or in the area.

o Increase spread of disease/ illness within a shelter population. o Increase vet costs to treat or euthanize sick/ injured/ or feral cat. o Increase liability with handling, caring for and adopting out cats. o Redemption rate for cats by owners is very low, almost non­

existent, which could quickly lead to overcrowding. o Most shelters cats greatly out number any other animal they house o Difficulty adopting out cats without them having the same level of

care as others, because the three shelters immediately surrounding the Township adopt out their cats fully vaccinated, spayed/neutered, dewormed, etc. for a fraction of the cost a new owner would incur by going directly to the veterinarian themselves.

MUNICIPAL SERVICES

By providing a Feline Control Bylaw the Township would be providing an increase in service to its residence, which could potentially alleviate cat related concerns.

INCREASING DOG LICENCE SALES

SUGGESTED MOTION:

THAT we receive report CD-06-15;

AND THAT licences be sold I or not sold in multiple locations;

AND THAT Council charge/or not charge for first impound stay for licensed dogs;

AND THAT the cost of licences remain at its current $16.00 fee;

AND THAT the cost of repeat canine impounds be increased;

AND THAT the revenue generated due to increased fees charged for impounds be directed to a fund to create a specific canine project to be determined by council;

AND THAT council authorize a microchip I licence clinic to be held.

BACKGROUND & DISCUSSION:

Deputy Mayor O'Donnell requested a report on ways to promote and increase the sales of dog licences in the Township. The matter was referred to Canine Control Officers Mark Cronk and Erica Loutskou. Between 2011-2014 the sales of dog licences show fluctuations from one year to the next. This could be contributed to of residents moving into an out of the area. Also, we have a large number of seasonal residents who hold licences for their dog at their permanent place of residence which the Township recognizes as valid.

might be prevented from reaching the Administration building due to hours of operation or disability or age.) Licences are available from November to accommodate "snowbirds" through to the 28th day of February at the established rate of $16.00/dog. After the February deadline a $34 late fee is applied to licences, bringing the cost up to $50.00/dog(s). Licences for new dogs to owners or new puppies turning 3 months of age are prorated at a rate of $1.33/month for the remainder of the year.

It has been a standard operating procedure that during a Canine complaint investigation that all parties involved are compliant with the Canine Control bylaw. This means both the accused and the complainant are ordered to purchase current licences for their dogs if they have not already done so. Canine Control checks for licences when out on regular patrols in the community when talking with or meeting residents on the street.

Promoting the low cost rate and Canine Control contact information licence information is also included in the tax insert directly mailed to residents annually. The administration office mails renewal forms in the fall to residents who currently hold licences.

Recommendation

At this time Canine Control would recommend that licences be sold at multiple locations throughout the Township to better accommodate residents with varied schedules. These locations may include:

-Ramara Centre because of its central location, and our local -Veterinary office in Washago, to accommodate the northern residents.

These added locations would increase the opportunity and the accessibility for residents to purchase licences.

Canine Control would also like to hold a licence clinic perhaps in conjunction with a rabies clinic or even a low cost microchip clinic if it could be arranged, to better serve residents. This would also give the residents the opportunity to purchase licences outside the administration offices regular hours.

Council may also want to consider that some incentive programs could be implemented to encourage residents to purchase licences prior to a bylaw infraction. An incentive could include "free ride home" for dogs that are picked up who are wearing their current Township licence.

Something else to keep in mind, residents are sometimes reluctant to purchase licences as the feel it is a "money grab" or they are unsure of where the money goes. If a portion of the fees collected where set aside to create a dog park or spay and neuter program at the shelter to help stray dogs found in our community or any other viable realistic program or incentive may be better received by residents and the Township may see more compliance.

Lastly if an increase in fees is desired by Council it could be done. However Canine Control would recommend that caution be taken as there has not been an increase in several years and an increase in the wrong area may be detrimental to the progression of compliance. If an increase is decided upon it should reflect the needs of the residents, and not penalize the ones that regularly purchase their licences faithfully. Perhaps an increase could be applied to the repeat offenders whose dog or dogs frequent the shelter, in the form of a gradual increase in pound fees.

RECOMMENDED ACTION:

THAT Council provides further direction.

Ramara Township has been providing aeriallarviciding for nuisance mosquitoes since approximately 1970. Spring aeriallarviciding, while not eliminating all mosquito species, does provide our lakeshore residents with a measure of mosquito control.

The treatment area will remain the same as in previous years and the program will be conducted according to MOE permit requirements.

Over the last several years the cost has remained relatively stable. This has enabled the cost per household to be held at $13.00 for 2010, 2012, 2013 and $14.00 for 2014.

The 2015 rate will be calculated once pricing has been secured from the contractors.

STRATEGIC ISSUES:

Under Municipal Services we provide our stakeholders with cost effective services and programs consistent with the community's financial resources, priorities and best interests. The spring aerial larviciding for nuisance mosquitoes is a program the Township has provided for many years and which our residents have come to expect.

Through Safety and Security, the Township continues this program to protect the lives, wellbeing and property of our citizens with comprehensive and efficient protective, emergency and health related services for the betterment of the community. This program may contribute to reducing the West Nile virus risk by reducing the overall mosquito population.

Also, in order to protect the Water Quality in our Lakes and Rivers by promoting best practices, the product used only affects mosquito larvae. It is an environmentally safe product with no negative impact on fish, frogs, animals, vegetation or humans.

RECOMMENDED ACTION:

THAT we provide our residents with nuisance mosquito larviciding as in previous years.

GLENREST DRIVE RECONSTRUCTION- PRE-BUDGET APPROVAL

SUGGESTED MOTION:

THAT Council pre-approve the relocation of utilities (Bell and Hydro) for the Glenrest Drive reconstruction project prior to the 2015 budget.

BACKGROUND & DISCUSSION:

The realignment and reconstruction of Glenrest Drive was budgeted in two parts. The engineering was completed in 2012 and the construction phase is scheduled for this fall.

Prior to the road construction, both Bell and Hydro must relocate their services. We have received cost estimates from both utilities, however for them to accommodate us on their schedules for this year we must confirm our approval now so that our construction can proceed in the fall.

ALTERNATIVES:

None suggested.

FINANCIAL INFORMATION:

Bell and Hydro provided costs for service relocation in 2012: Hydro $ 21,953.65 Bell $106,300.00

Re: Fern Resort Road Common Collection Site

Staff recently were contacted by County Staff regarding the Fern Resort Road temporary common collection site currently located in the Township parking lot on Fern Resort Road.

This enclosure was constructed on a temporary trial basis. There are now two options available going forward:

A. Either the Township build, or allow the Islanders to, construct a permanent shed to act as a common collection site; or,

B. The County will provide landfill passes to the Islanders which would allow individuals or their representative to deliver weekly waste to a County waste facility for disposal at no cost.

The County has a report going to County Committee in February regarding the future of the site and would like two questions answered prior to final draft of their report.

1. Will Ramara consider constructing the permanent waste enclosure on the property? and,

2. Will Ramara take responsibility for cleaning up any illegal dumping that occurs due to the common collection point?

As you are aware, County Council approved the following resolution last year:

THAT the waste management service level for island residents in the area of Fern Resort Road be Option 1, provision of landfill passes, as outlined within Item CCW 14-197;

AND THAT should the Township of Ramara and the Fern Resort area island residents establish a building in the future that a provisional common collection point be implemented on a trial basis.

As a result, the former Mayor of Ramara undertook construction of an enclosure last summer which he also monitored/maintained for litter and illegal dumping.

The location has been observed for compliance by County staff and the County's waste collection contractor since that time and has generally been found to be satisfactory. It was noted that on a weekly basis there was little waste in the enclosure, with the exception of immediately following long weekends. The County did not receive any complaints about the location during the period of the trial. County staff are therefore prepared to support the ongoing use of a common collection point at the location but are seeking some assurances from the Township:

a) The Township continues to be willing to permit the common collection point at the municipal property located at the corner of Fern Resort Rd. and Prospect Ave.

b) The Township is willing to construct a permanent lockable building/shed to contain the waste generated by the island residents. In this case, the temporary enclosure could be utilized for up to another summer season while the permanent structure is completed.

c) The Township will take responsibility for cleaning up any illegal dumping that occurs at the common collection point. It is noted that should the County receive verifiable complaints or note significant misuse of the common collection point, it will be discontinued per County Council's provisions, and the County would take no responsibility for any construction or other costs incurred.

We would note that if the Township is not willing to construct the permanent lockable building/shed, the island residents may choose to do so on their own and the same provisions would apply to them. Alternatively, landfill passes would be issued to affected island residents for the 2015 cottage season.

Please advise at your earliest possible convenience so that we can include the Township's position with respect to the continuation of the common collection point in our report to County Council. If you have any questions in the meantime please do not hesitate to contact me.

MUNICIPAL WORKS -INCIDENT REPORT- JAN. 5, 2015

On Thursday, January 15, a Works operator observed damage to the rear corner of the gradall, Unit #33 during his circle check. Prior to operating it, he reported the damage to his Supervisor who documented the damage with photos. The damage did not prevent or interfere with the machines operation.

This unit had not been used in some time and it is unknown when the damage occurred. No one has reported an incident prior to Thursday.

RAMARA TOWNSHIP AUDIT COMMITTEE TERMS OF REFERENCE

1. PURPOSE

The Audit Committee is an advising Committee to Council that assists Council in the provision of effective municipal government by reviewing the administrative systems regarding financial accounting, reporting, internal controls, safeguarding of corporate assets, compliance with legal, ethical and regulatory requirements and the efficient and effective use of resources.

2. MANDATE

The Audit Committee provides a focal point for communication between Council, the External Auditor and management, and facilitates an impartial, objective and independent review of management practices through the internal and external functions.

3. GOALS AND OBJECTIVES

The Audit Committee shall enhance the credibility of financial reporting, the independence of external auditors and increase the reliability of financial reporting. The primary purpose of the audit committee is to liaise and oversee the work of the external auditor and to make recommendations to Council that would enhance Council's fiscal oversight role.

4. MEMBERSHIP

The Committee shall be comprised of five (5) voting members as follows. • Treasurer • Two (2) members of Council to be selected by Council; • Two (2) Citizen members to be selected by resolution of Council.

Citizen Members will: • Be a qualified elector of the Township or own business or be employed in the

Township at the time of appointment and throughout incumbency; • Have relevant experience serving as a corporate officer, auditor, attorney or

professional consultant to business, government or organizations;

• Be able to allocate sufficient time during the day for participation in regularly scheduled meetings;

• Sign confidentiality and conflict of interest agreements; Three members constitute a quorum.

5. TERM

Members will be appointed by Council. Their term will be concurrent with the term of Council.

6. COMMITTEE CHAIR

The Committee shall appoint a Chair from among their elected members who shall be responsible for conducting the meetings of the Committee in accordance with Council's current procedural by-law as may be amended for time to time. The Chair shall endorse any Committee Report prior to its presentation to Council.

7. REMUNERATION

None, except the incurring of pre-approved expenses during the course of Committee activities.

8. DUTIES AND FUNCTIONS

The Audit Committee is responsible for making recommendations to Council regarding the following:

The External Audit Function • Make recommendations to Council in conjunction with Staff with respect to

the selecting and dismissing of the external auditor, • Reviewing the terms of engagement, fees and scope of the audit and any

non-audit services provided, • Reviewing any reports and correspondence from the External Auditor relating

to The Corporation of the Township of Ramara, and any other local boards or agencies which may be created, including communication from the External Auditor on relationships between the External Auditor and the Township and its local boards and agencies, and on any matters that may have a bearing on the independence of the External Auditor,

• Assisting staff in evaluating the external auditor's performance,

• Reviewing with management and the External Auditor the result of the audit performed including any difficulties encountered.

Financial and Other Reporting • Reviewing the draft annual financial statements of the Township and its local

boards prior to presentation to Council, • Reviewing and making recommendations to staff respecting existing and

proposed new financial and fiscal policies, practices and procedures (eg. Accrual policy, deferred revenue policy, policies for established reserves, reserves funds, etcetera),

• Reviewing and making recommendations regarding enhanced information used for decision making (including management reports, affirmations, etcetera), as to integrity, timeliness and comprehensiveness.

Internal Control • Reviewing the adequacy of the internal control systems for safeguarding

assets, including the review of policies and ethics, • Reviewing the effectiveness of corporate reporting systems regarding

administrative and program performance (for example, budget monitoring systems).

Compliance • Reviewing the level of compliance with legislation, regulations, corporate

objectives, policies and ethics, • Reviewing the adequacy of the systems establishment to ensure compliance, • Reviewing and making recommendations regarding by-laws and policies

specifically regulating the conduct of members of council, staff, and suppliers (for example, personnel, fraud and theft polices, conflict of interest policy, purchasing by-law, expense claims policy, etcetera).

General • Reviewing the terms of reference and fees of professional services retained

for purposes related to the Audit Committee's responsibilities, • Receiving an annual report from the Treasurer summarizing progress made in

resolving issues raised by either internal or external audits, • Providing opportunities for private discussion of sensitive matters raised by

the External Auditor, the Chief Administrative Officer, or the Treasurer relating to personnel, legal, or other matters which could be prejudicial to the corporate interest of discussed in open committee,

• Reviewing the Audit Committee Mandate periodically and recommending modifications to Council, at least once each term,

• Any other matter which could come within the purview of internal or external audit.

9. MEETING TIMES AND LOCATIONS

The Audit Committee shall meet at least two (2) times per year, with additional meetings at the call of the Chairperson in order to properly discharge its responsibilities as set out in the Terms of Reference. Minutes shall be prepared for each Audit Committee meeting and shall be presented to the next succeeding meeting of Council.

10. STAFF SUPPORT

The Corporate Services Department will provide administrative support services to the Committee including the preparation and distribution of agendas, the taking of minutes, preparation of follow-up correspondence, and general administrative co-ordination of meetings of the Committee.

The Chief Administrative Officer may be called upon as needed to provide information and support to the Committee.
