6.4 Approve Waiver of Tipping Fees - Wawa Green Days Community

Clean-Up (resolution)

WHEREAS the Wawa Energy Plan Implementation Committee is spearheading a community Clean-Up Day as part of the Wawa Green Days; AND WHEREAS J. Provost Contracting has donated the use of a portable dumpster so that individuals may drop off waste collected during the Community Clean-up Day; NOWTHEREFORE BE IT RESOLVED that the Council of The Corporation of the Municipality of Wawa does hereby authorize the waiver of the landfill site fees to dispose of the refuse collected during the Community Clean-up Day on September 16, 2016.

6.6 Approve Support - Ontario 150 Community Celebration Program

Moved by: Y. Besner R. RC16169 Seconded by: B. Chiasson

WHEREAS the Municipality of Wawa is making application to the Ontario 150 Community Celebration Program to support a local celebration event that commemorates Canada and Ontario’s 150th anniversary and the opening of the Trans-Canada Trail and Wawa Goose Rebuilding; AND WHEREAS the Ontario 150 Community Celebration Program’s objective is to facilitate the creation and delivery of impactful, participatory and inclusive initiatives that celebrate and commemorate Canada and Ontario’s 150th anniversary and the Municipality of Wawa is planning such an event; NOWTHEREFORE BE IT RESOLVED that the Council of The Corporation of the Municipality of Wawa does hereby approve a funding application to the Ontario 150 Community Celebration Program for up to $70,000 in funding, or 75%, of the costs to hold a series of local celebrations in Wawa in 2017. AND FURTHER that the Municipality of Wawa commit to fund up to $23,500, or 25%, towards the cost of the celebrations and cover all cost overruns of the initiative, if required.

10.2 Approve Actions - Norpro Report (resolution)

Moved by: Y. Besner R. RC16174 Seconded by: B. Chiasson

WHEREAS Gerry Liddle and Tamara Liddle filed a complaint to Mayor and Council against CAO Chris Wray with various allegations on November 12, 2015; AND WHEREAS a complaint of harassment was filed against Councillor Tamara Liddle on November 14, 2015; AND WHEREAS a complaint of harassment was filed against Gerry Liddle on November 14, 2015; AND WHEREAS Norpro Security and Investigations was retained by the Municipality to investigate and provide findings on all of the above noted complaints; AND WHEREAS Norpro Security and Investigations conducted an investigation by reviewing many documents, policies and pieces of correspondence and by interviewing or attempting to interview 17 witnesses (Gerry Liddle, Tamara Liddle and Paul Prosperi from the Ministry of Municipal Affairs and Housing all refused to interview);

AND WHEREAS Norpro Security found that there was ample evidence that Gerry Liddle and Councillor Tamara Liddle did in fact harass CAO Chris Wray in an effort to obtain a personal benefit to avoid paying municipal taxes or avoid enforcement of their municipal tax arrears; AND WHEREAS Norpro Security reported that Gerry Liddle and Councillor Tamara Liddle did not participate in the investigation and failed to provide any evidence or information to substantiate or provide specifics of their complaint against CAO Chris Wray; AND WHEREAS Norpro Security found that there was no evidence to support the Liddle’s complaints against Chris Wray and the complaints were therefore found to be unsubstantiated; AND WHEREAS the investigation revealed harassment by the Liddles against other members of municipal staff; AND WHEREAS the investigation revealed that Gerry Liddle manipulated his position as Chair of the Strategic Plan Implementation Committee in order to obtain information unethically and improperly to obtain information for his own personal use to create a job for himself to repair or rebuild the Wawa Goose; AND WHEREAS the investigator concluded that Councillor Liddle failed to declare a conflict of interest with respect to meetings on November 30, 2015 and December 10, 2015 in which enforcement of her tax arrears and the above noted complaints were discussed and that Councillor Liddle ought not have participated in these specific meetings that it may have put her in an obvious conflict of interest; AND WHEREAS Gerry and Councillor Tamara Liddle commenced an application in the Superior Court of Justice against the Municipality in an apparent attempt to continue their harassment of CAO Chris Wray and other members of the Municipality; AND WHEREAS the application was withdrawn without any evidence being put forward by Gerry and Councillor Tamara Liddle; AND WHEREAS the Municipality, as a result of the actions of Councillor Tamara Liddle and Gerry Liddle has had to incur significant expenses and dedicate considerable resources in dealing with and responding to their misconduct which expenses would not have been incurred had Councillor Tamara Liddle and Gerry Liddle complied with their obligations pursuant to the Municipal Act, 2001, the Municipal Conflict of Interest Act, the Occupational Health and Safety Act and the Municipal Code of Conduct; AND WHEREAS Council takes very seriously its legal obligations to provide a workplace free from harassment and will not tolerate workplace harassment of any kind; AND WHEREAS Council is determined and duty bound to protect its employees from this established pattern of harassment by Councillor Tamara Liddle and Gerry Liddle; AND WHEREAS Council has an obligation to protect and prevent unnecessary expenditures of public funds; AND WHEREAS Council has found that Councillor Tamara Liddle has acted in breach of her oath as a Councillor and against the best interests of Wawa;

NOWTHERFORE BE IT RESOLVED that the Council of the Corporation of the Municipality of Wawa does hereby enact the following:

1. Apart from during Council Meetings, Councillor Tamara Liddle is to communicate with municipal staff solely by email to an email address to be provided. No other form of communication shall be permitted nor responded to; and

2. Councillor Tamara Liddle is to immediately return her keys and key FOB to the municipal offices; and

3. Councillor Tamara Liddle is not to access the municipal offices except to attend at the Front Desk to pick up her Council packages or make bill payments and to attend Council Chambers via the public entrance; and

4. Councillor Tamara Liddle is not to enter the interior of the municipal offices for any purpose without prior authorization from Council; and

5. To carry out her role as a Councillor, Councillor Tamara Liddle is permitted to attend all Council meetings, Policy Meetings, Corporate Planning Meetings and any special meetings of Council but will not be permitted to travel on municipal business and be reimbursed by the Municipality for any expenses incurred; and

6. Councillor Tamara Liddle is hereby removed from all committees that she has previously been appointed to; and

7. Councillor Tamara Liddle will not act as Deputy Mayor; and

8. Councillor Tamara Liddle is to cease all harassing behaviour against CAO, Chris Wray, forthwith; and

9. Gerry Liddle is to cease all harassing behaviour against CAO, Chris Wray, forthwith; and

10. Gerry Liddle is hereby removed as Chair of the Strategic Plan Implementation Committee and will not be a member of that committee or any other committee with the Municipality of Wawa; and

11. All communication between Gerry Liddle and the Municipality must be solely by email to an email address to be provided. No other form of communication shall be permitted nor responded to; and

12. Gerry Liddle shall not have any direct or indirect communication with Mr. Wray; and

13. Gerry Liddle shall immediately cease holding himself out as in any way representing the Municipality.

11.2 Accept Recommendation - Wawa Boundary Signage Update

WHEREAS the Municipality of Wawa has the opportunity to upgrade its Boundary Signage; AND WHEREAS the Municipality of Wawa deems it important to Include Ojibway on this Signage, as well as both Official Languages of English and French; NOWTHEREFORE BE IT RESOLVED that the Council of The Corporation of the Municipality of Wawa does hereby wish to receive Enhanced Signage from the Ministry of Transportation; AND FURTHER that the Municipality will provide the MTO with the appropriate Logo; AND FURTHER that the Municipality of Wawa wishes to install on the sign the Slogan : “A Place to Live, Work, & Play`` / “Un Endroit à Vivre, Travailler, et Jouer”; AND FURTHERthat the Municipality would ask the MTO to consider adding First Nations Languages to future signage of this type.

11.3 Approve Support for Temporary Liquor Licence - Tri-Sport

WHEREAS the organizing committee of the Annual Tri-Sport Weekend have petitioned the Council to designate the weekend of August 26-27, 2016 as Community Festival for the purposes of applying for a Special Occasion Permit from the Liquor Control Board of Ontario; AND WHEREAS Council supports the efforts of the organizing committee and recognizes the event as a Community Festival;

NOWTHEREFORE BE IT RESOLVED that the Council of The Corporation of the Municipality of Wawa does hereby declare the Annual Tri-Sport Event as a Community Festival and supports the application for a Special Occasion Permit for the event scheduled to be held August 26-27, 2016.

RESOLVED THAT the following by-laws be introduced and read a first, second and third time and finally passed and that the Mayor and Clerk do sign and seal the same, any rule of this Council to the contrary notwithstanding:

By-Law No. 2969-16 - to confirm the proceedings of Council at its meetings held on the 9th day of August, 2016.

By-Law No. 2970-16 - to delegate authority to provide marriage solemnization services to Ms. Desiree Norwegian.

By-Law No. 2971-16 – establish and appoint a Community Development Committee for the Municipality of Wawa.

By-Law No. 2972-16 – to establish and appoint members to the Community Well-Being Fund Committee for the Municipality of Wawa.

By-Law No. 2973-16 – to establish and appoint a Strategic Plan Implementation Committee for the Municipality of Wawa.

By-Law No. 2974-16 – to establish and appoint a Heritage Committee for the Municipality of Wawa.

By-Law No. 2975-16 – to establish and appoint a Special Events Committee for the Municipality of Wawa.

By-Law No. 2976-16 – to authorize The Corporation of the Municipality of Wawa to enter into an agreement with Her Majesty the Queen in Right of Ontario, represented by the Minister of Transportation, regarding authorized requester execution of agreement number 12187.

By-Law No. 2977-16 – to authorize The Corporation of the Municipality of Wawa to enter into a Lease Agreement with Hatch Corporation respecting the lease of office space situated at 3 Maple Street, Wawa, Ontario.

By-Law No. 2978-16 – to enter into an agreement with Industry Canada / FedNor, under the Canada 150 Community Infrastructure Program to provide contribution towards the rehabilitation of the Wawa Goose Monument (Project No. 842-500075).

By-Law No. 2979-16 – to adopt Municipality of Wawa Policy No. HR-004: Orientation of New Employees.

By-Law No. 2980-16 – to authorize The Corporation of the Municipality of Wawa to enter into an Agreement with Level Plains Enterprises Inc. for the lease of land.

To Ontario mayors and councils,

The Ontario Coalition for Better Child Care (OCBCC),the Canadian Union of Public Employees (CUPE)andother labour and community partners around Ontario have announced Wednesday, October 26, 2016 asthe 16"‘annual Child Care Worker & Early Childhood Educator Appreciation Day, a day of recognition forthe many people who work providing early learning and child care services in your community. We arewriting to ask that you and your Council consider proclaiming Child Care Worker & Early ChildhoodEducator Appreciation Day in your municipality. A sample proclamation is attached.

This annual awareness day recognizes the education, skills, commitment and dedication of EarlyChildhood Educators (ECEs)and childcare staff, and each year is proclaimed by municipalities and schoolboards across Ontario. Many groups are recognized by way of municipal resolution. Such a day allowsus to acknowledge the important contributions of child care workers and ECEs.

Even if your council does not issue official proclamations, there are many ways for your municipality to

participate in celebrating this special day:0 Your council could sponsor a public announcement;0 Display our posters and distribute our buttons;0 Many municipalities organize events and contests for the clay or have councilors or the mayor

THE CORPORATION OF THEMUNICIPALITY OF WAWA

BY–LAW NO. 2982-16

BEING A BY–LAW to confirm the proceedings of Council at its meeting

held on the 30th day of August, 2016 and the 6th day of September, 2016.

WHEREAS Section 9 of the Municipal, S.O. 2001, Chapter 25, provides that a

municipality has the capacity, rights, powers and privileges of a natural person for the

purpose of exercising its authority under this or any other Act;

AND WHEREAS the Municipal Act, S.O. 2001, Chapter 25, Section 238, provides that

every municipality and local board shall pass a procedure by-law for governing the

calling, place and proceedings of meetings;

AND WHEREAS Article No. 1.22.2 of said By-Law No. 2027-07 provides that the

minutes of each and every Regular and Special meeting of the Council, shall be

confirmed through a confirmatory by-law;

NOWTHEREFORE the Council of The Corporation of the Municipality of Wawa enacts

the following as a By-Law:

1. THAT the actions of the Council at its meeting held on the 30th day of August

2016 and the 6th day of September, 2016, in respect of each recommendation

and in respect of each motion, resolution and other action taken by Council at its

said meeting is, except where the prior approval of the Ontario Municipal Board

or other authority is by law required, hereby adopted, ratified and confirmed as if

all such proceedings were expressly embodied in this By-Law.

2. THAT where no individual by-law has been or is passed with respect to the

taking of any action authorized in or by the above-mentioned minutes or with

respect to the exercise of any powers by the Council in the above-mentioned

minutes, then this by-law shall be deemed for all purposes to be the by-law

required for approving and authorizing and taking of any action authorized

therein or thereby, or required for the exercise of any powers therein by the

Council.

3. THAT the Mayor and the Clerk of The Corporation of the Municipality of Wawa

are hereby authorized and directed to do all things necessary to give effect to the

said action of the Council or to obtain approvals where required and, except

where otherwise provided, the Mayor and Clerk are hereby directed to execute

all documents necessary on behalf of The Corporation of the Municipality of

Wawa and to affix the Corporate Seal thereto.
