Summary of Purpose and Why:
The City and CRA wishes to partner with Rebuilding Together Broward County and Kappa Foundation ofPompano Beach to host National Rebuilding Day in Pompano Beach to be held on April 28, 2018, with thegoal of leveraging respective resources to provide meaningful home improvements and streetscapeimprovements that are significant, immediate and long lasting at no cost to the homeowners targeting thearea on and around NW 27 Ave.
Staff recommends the CRA Board approve a budget adjustment for the National Rebuilding Day homeimprovement project and the Interlocal Agreement between the City and the CRA relating to such budgettransfer.

The City and CRA wishes to partner with Rebuilding Together Broward County ( RTBC)and Kappa Foundation of Pompano Beach to host National Rebuilding Day in PompanoBeach to be held on April 28, 2018, with the goal of leveraging respective resources toprovide meaningful home improvements that are significant, immediate and long lastingat no cost to the homeowners.
In 2018, RTBC and the Kappa plan to assist 20+ homes in the Collier City area, withsignificant home improvements as a part of our National Rebuilding Day project/areaRevitalization day. They have worked on 40+ homes in Pompano Beach over the past
year and currently have a waiting list of homes/ homeowners seeking assistance.
The group will collaborate with the CRA Job Placement Center/ Look Local First for anyskilled labor required to provide home renovations, minor repairs and site preparation.
Also, workforce development, mentoring and support for youth in concert with therevitalization.
This is a joint City ($30,000.00) and CRA ($20, 000.00) initiative. The companion item
will be presented at the City Commission meeting on April 10th. The CRA funds to belimited to CRA eligible activities. i. e. landscaping, irrigation, sidewalks and driveways,facia board and painting the exterior of the homes abut a public street.
Budget:
The following is a breakdown of the $ 50, 000 requested to support the revitalization in
Collier City and continued support within Pompano Beach.
20, 000 will be spent on Materials and Appliances

15, 000 will be spent on Skilled Labor to provide home renovations, minor repairs,site preparation.
5, 000 will be spent on Project and Volunteer management
5, 000 will cover all additional operating support, including any permits needed.5, 000 will be used for by the Kappa Foundation for mentoring and support for youth
in concert with the Rebuilding Day project.
This is matched at 100% from RTBC other sources for a total impact of $100, 000 for the
20+ homes/ homeowners impacted.

A RESOLUTION OF THE POMPANO BEACH COMMUNITY
REDEVELOPMENT AGENCY (THE CRA), APPROVING AND AUTHORIZING
THE PROPER OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT
BETWEEN THE CRA AND THE CITY OF POMPANO BEACH RELATING TO
TRANSFER OF CRA FUNDS TO ASSIST THE CITY WITH PARTICIPATION
IN NATIONAL REBUILDING DAY IN THE COLLIER CITY AREA OF THE
NORTHWEST CRA; PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE POMPANO BEACH COMMUNITY
REDEVELOPMENT AGENCY THAT:
SECTION 1. The Interlocal Agreement between the Pompano Beach Community
Redevelopment Agency ( the CRA) and the City of Pompano Beach ( the City) relating to a transfer
of$ 20,000 of CRA funds to the City for the City' s participation in National Rebuilding Day in the
Collier City area of the Northwest CRA ( the Interlocal Agreement), a copy of which agreement is
attached hereto and incorporated by reference as if set forth in full, is hereby approved.
SECTION 2. The proper officials are hereby authorized to execute the Interlocal
Agreement.
SECTION 3. This Resolution shall become effective upon passage.

INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT (" Agreement"), is made and entered into this
day of 2018, by and between the
CITY OF POMPANO BEACH, a municipal corporation
organized under the laws of the State of Florida, whose address is
100 West Atlantic Boulevard, Pompano Beach, Florida 33060

and
POMPANO BEACH COMMUNITY REDEVELOPMENT
AGENCY, a body politic and corporate of the State of Florida anda community redevelopment agency created pursuant to Chapter163, Part III Florida Statutes, whose address is 100 West Atlantic
Boulevard, Pompano Beach, Florida 33060 (" CRA").
WHEREAS, the City Commission of the CITY has, pursuant to Part III, Chapter 163,Florida Statutes (" Redevelopment AcY') created a Community Redevelopment Agency for thepublic purpose of carrying out redevelopment in community redevelopment areas located in theCITY found by the City Commission as the governing body of the CITY to have conditions ofslum or blight; and
WHEREAS, the City Commission also serves as the governing body of the CRA which iscomprised of two (2) community redevelopment areas known as the Northwest and EastCommunity Redevelopment Areas ( collectively the" CRA Areas"); and
WHEREAS, both the CITY and the CRA desire to maintain and revitalize the CRA Areas
to be visibly attractive, economically viable, and socially desirable areas which respond to andsupport the needs and desire of all other parts of the CITY; and
WHEREAS, the CRA has undertaken certain actions to implement the communityredevelopment plans for the CRA Areas ( collectively the " Plans"); and
WHEREAS, the City intends to partner with Rebuilding Together Broward CountyRTBC) and Kappa Foundation of Pompano Beach to host National Rebuilding Day in Pompano
Beach to be held on Apri128, 2018 in the Collier City area of the Northwest CRA Area; and
WHEREAS, to the extent authorized by Chapter 163, Florida Statutes, the CRA wishes toassist the City in its participation in National Rebuilding Day.
NOW, THEREFORE, in consideration of the mutual promises and conditions contained
in this Agreement and other good and valuable consideration, the receipt of which is herebyacknowledged, the CITY and CRA agree as follows.
ARTICLE 1
RECITALS INCORPORATED
The recitals set forth in the " Whereas" clauses above are hereby accepted by the partiesand incorporated into this Agreement.
ARTICLE 2
CRA BUDGET TRANSFER
The CRA agrees to transfer $20,000 from its Substantial Housing Rehab account to the
City' s RTBC and Kappa Foundation of Pompano Beach account ( the CRA Funds) to improve thecondition and appearance of the public streets in the Northwest CRA Area.
ARTICLE 3
CRA ELIGIBLE SERVICES
The City agrees to use the CRA Funds solely on CRA eligible services ( the EligibleServices). The Eligible Services include the following, provided the location of such servicesabuts a public street: landscaping; irrigation; sidewalks and driveways; fascia boards; paintinghousing exteriors.
ARTICLE 4
PLEDGE OF COOPERATION
The parties recognize it will be necessary for both CITY and CRA staff to work closelyand coordinate with each other in order to effectuate the intent of this Agreement. Therefore, each
party pledges such cooperation.
ARTICLE 5
TERM
This Agreement shall take effect as provided in Article 16 of this Agreement and continue
in effect for the duration of National Rebuilding Day and its related activities.
ARTICLE 6
GOVERNMENTAL IMMUNITY
Nothing herein is intended to serve as a waiver of sovereign immunity by any party norshall anything included herein be construed as consent to be sued by third parties in any matterarising out of this Agreement or any other contract. Both parties are state agencies or political

subdivisions as defined in Chapter 768. 28, Florida Statutes, and agree to be fully responsible forthe acts and omissions of its respective agents or employees to the extent permitted by law.
ARTICLE 7
INDEPENDENT CONTRACTOR
The CITY and the CRA are separate legal entities and for purposes of this Agreement, each
is an independent contractor under this Agreement. Services provided by each party pursuant tothis Agreement shall be subject to the supervision of that party. In providing such services, each
party, its respective officers, employees, or agents are not authorized to and shall not act as officers,employees or agents of the other party. Neither party extends to the other party or its respectiveagents any authority of any kind to bind it in any respect whatsoever.
ARTICLE 8
ASSIGNMENT
This Agreement, or any interest therein is not assignable and both the CITY and CRA agreenot to assign, transfer, merge or otherwise convey any of their respective interest, right, orobligation under this Agreement, in whole or in part, to any other person, corporation or entitywithout the prior written consent of the other party
ARTICLE 9
AMENDMENTS
Both parties agree that no modification, amendment or alteration in the terms or conditionscontained herein shall be effective unless contained in a written document agreed to and executed
by both parties.
ARTICLE 10
NOTICE
Whenever either party desires to give notice unto the other, such notice must be in writing,sent by registered United States mail, return receipt requested, addressed to the party for whom itis intended at the place last specified; and the place for giving of notice shall remain such until ithas been changed by written notice in compliance with the provisions of this paragraph. For thepresent, the parties designate the following as the respective addresses for giving of notice.

ARTICLE 11
BINDING AUTHORITY
Each person signing this Agreement warrants that he or she has full legal authority toexecute this Agreement on behalf of either party and to bind and obligate such party with respectto all provisions contained in this Agreement.
ARTICLE 12
SEVERABILITY
Should any provision of this Agreement ar the application of such provisions be renderedor declared invalid by a court action or by reason or any existing or subsequently enactedlegislation, the remaining parts of provisions of this Agreement shall remain in full force andeffect.
ARTICLE 13
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Florida with venue lying inBroward County, Florida. By entering into this Agreement, CITY and CRA hereby expresslywaive any rights either party may have to a trial by jury of any civil litigation related to thisAgreement.
ARTICLE 14
ENTIRE AGREEMENT
This Agreement embodies the entire agreement between the parties and supersedes all prior
negotiations, correspondence, conversations, agreements or understandings applicable to the
matters contained herein. The parties agree there are no commitments, agreements or
understandings concerning the subject matter of this Agreement that are not contained herein.Accordingly, the parties agree that no deviation from the terms hereof shall be predicated uponany prior representations or agreements whether oral or written.
ARTICLE 15
INTERPRETATION
This Agreement shall be interpreted as drafted by both parties hereto equally.

ARTICLE 16
FILING AND EFFECTIVE DATE
This Agreement is an interlocal cooperation agreement entered into pursuant to Section
163. 01, Florida Statutes. It shall become effective upon being filed with the Clerk of the CircuitCourt of Broward County, Florida, pursuant to Section 163. 01( 11), Florida Statutes. The Cityshall be responsible for filing this Agreement with the Clerk of the Circuit Court of BrowardCounty and shall pay for all such recording fees associated with same.
ARTICLE 17
AUDIT RIGHT AND RETENTION OF RECORDS
Each party shall have the right to audit the books, records, and accounts of the other partythat are related to this Agreement. CITY and CRA shall keep such books, records and accountsas may be necessary in order to record complete and correct entries related to this Agreement. Cityand CRA shall preserve and, upon request, make available, at reasonable times for examination
and audit by the other party, all financial records, supporting documents and any other recordspertinent to this Agreement for the required retention period of the Florida Public Records Act,
Chapter 119, Florida Statutes, as may be amended from time to time.
