BURNETT GATHERING 2013 Plans for the 2013 Gathering are progressing. Dates will be Wednesday 31 st July - Saturday 3 rd August. Unlike previous visits, the programme will end at the event on the evening of Saturday which is also the day of the Aboyne Highland Games. This will make for easier departure on the Sunday. The Friday tours may include some options which visitors have previously enjoyed but there will also be a new tour for those who have already attended our gatherings. We will have a Grand Ceilidh since this has proved so successful in the past. We will be hosting a welcome party (with differences), on Wednesday and there will be a diverse programme of new events in addition to the established essentials for Burnetts who come to Crathes. I would like repeat the same and am sure that the interpretation of our motto that Courage Strengthens with Adversity will encourage her back to good health. As the Banner goes to “print”, I hear that Phyllis is making good progress and continues to improve. She is able to sit at the computer for short periods of time. She admits that she is not at 100% but is working on it.

NOTE FROM HOB PRESIDENT My thoughts and thanks go out to the Board of Directors for their confidence in electing me President of the House of Burnett again for another term. Now that I am no longer working part time at the church, nor the purse factory, I am hoping I can devote more time to your concerns and ideas for our group. I also want to welcome to our Board two new members, Ms. BB McGinley and Mr. Bruce Barnard. Mr. Barnard is an attorney and has accepted the role of VP of Legal Affairs. His preliminary advice already extended to us regarding our Corporation has been very enlightening. We are bidding a fond farewell to JL Weaver who served our Board with great gusto during the past 2 years. She "took the bull by the horns" and got us started up again, and for that we are grateful. We have received some publicity from some unexpected sources this year. I want to acknowledge Mr. David Bell, the Coordinator for The Clan Bell in this area. Not just because he and his wife make Thistle House Bed & Breakfast their home away from home during the Grandfather games, but because his recent article in the Bell Newsletter (called NABELICH), mentioned their clans close ties with the Presidents of Clan Sinclair and the House of Burnett. (My husband is a Bell). Thanks David for the good word. I might also mention that NABELICH puts a free ad in their newsletter every year around Christmas time for our overnight specials at the Bed & Breakfast. In addition to Clan Bell, the LOL, (better known as the Ladies of Lallybroch), have the B&B featured on their chat room. Ron and I had the pleasure of meeting (once again) author Diana Gabaldon when we were in Scotland in August. We were very gratified that she actually remembered who I was! I was also able to discuss with her the possibility of writing a book about Monboddo (at Jamie's request). Because she had no less than 3 other projects going on at the same time, she declined, but was very interested in who Monboddo was and about the musical. The House of Burnett will again have a tent at Grandfather Mountain. Please, all members and those of you who are Burnett's who would like to become members, stop by and say "hello" and sign our book. We would love to have a good turn out there. Anyone wishing to "man" a tent at a games near you, please get in contact with Leland

GREETINGS We are now into month 3 of 2011 and the new season of Scottish Games/Festivals have begun. Jacky Daugherty and Evelyn Kafura had a Burnett Tent at the 47th Annual Arizona Scottish Games Feb 26 & 27. They will also be at the Las Vegas Games 15 – 17 Apr. I will be at the Rural Hill Scottish Festival and Loch Norman Highland Games that same weekend. If you are in the area of these events please stop and see us. We should have the events page of the Burnett web site updated soon reflecting most of the 2011 events Burnett’s will be participating in. If you are going to participate in an event and haven’t contacted me yet please do so. The calendar of Scottish Games & Festivals for 2011 is included in the banner but is also available on the internet. The address is www.asgf.org/calendar. This Calendar is not a complete listing, so you will need to keep an eye out for other festivals taking place near you. We hope to add more events Burnett’s are involved with as time goes by. I have been informed by several members of trouble they have had paying their dues through the Burnett web site. If you have a Pay Pal account this should not been a problem. BIOGRAPHY OF B.B BURNETT MCGINLEY

B.B hails from the great state of Virginia. Being a southerner has many rewards, including growing up near the homes of the American Founding Fathers. She attended nursing school in South Hill, VA and the University of Virginia. Upon graduation, B.B specialized in surgery and worked in several large hospitals. In 1964 she was accepted into the US Peace Corps. Her assignment was working as a public health and nutrition specialist in Niger, a very under-developed former French West African colony. Most of the children suffered malnutrition and childhood diseases, but she persevered and spent considerable effort helping to clean up the polluted water and sanitation systems.

At the end of her Peace Corp career, B.B left with thoughts of saving some, but losing too many of her children. To this day she feels that she learned more from the Africans than she could teach them. Her Peace Corps experience taught her the real importance of sincerity, gratitude and humility in every aspect of life. After coming home, B.B continued her life-long cause of helping other people. She worked in rural southwest VA for a large national anti-poverty program. Her role with the indigent people was helping them become more self sufficient and less dependent on government services. In 1972 B.B met her future husband Tom, a Montana boy, but not a cowboy. After a brief engagement they were married in 1973 and made their home in Missoula, MT. Son Jeffrey came along four years later. B.B was a very devoted mother and stayed at home until Jeff was 10. Tom’s career is broadcast engineering. In 1980, the family relocated to Salt Lake City, Utah.

B.B was actively involved in crisis intervention during the 70’s and 80’s, working as a volunteer at the local crises centers. As a Catholic, B.B has served her church in various areas, including the local parochial school boards. One of her hardest jobs was Den Mother, keeping twelve little Cub Scouts busy learning how to become good citizens. In 1984, the family moved again to the Maryland/DC area. B.B decided to embark on new career as a Realtor, concentrating on serving the international community there for 16 years. Tom’s company transfer with CBS Radio in 2000 brought us to our current home near Seattle, WA. Since then, B.B has been serving in various roles with the Republican party and most recently was elected as a precinct committee officer. B.B and Tom are also members of the Caledonian Society of Seattle. When researching her family heritage, B.B felt honored to learn that her family has ties to the original builder of Crathes Castle, Alexander Burnett. In 1840, a Lazarus Burnett married and had 4 children. One of his sons, Robert was born in 1846. He eventually married a Roberts and they had nine children. Two of their children were twins, James and John. John Burnett had 8 children, of which one was B.B’s father, William Burnett. The Burnett’s all resided in Virginia until their deaths. I am very proud to serve and represent the Burnett Family on the Board. It is my sincere hope that I can endeavor to increase the membership in the House of Burnett, and to be a worthy representative to spread the love and knowledge of Scotland. Jack Burnette Sr. son of James Norman Burnette passed away January 28 2011. Please keep us in your prayers and thoughts as we go through this difficult time. WHO CAN BE A BURNETT? I am frequently asked whether a particular surname, of not wholly dissimilar spelling to Burnett, is eligible to be a Burnett. I am occasionally asked if membership of the name of Burnett is possible for someone who lays no such claim In answer to the first, readers may have seen on our website that spellings of the name include but are not limited to the following: Burnett, Burnet, Burnette, Bernat, Burnat, Bernet, Burnap, Burnard, Barnard, Barnett, Barnette, Barnet, Bornet, Bornat, Mac Burnet etc. There is no rule as to such inclusion and it is my decision, as chief, as to which names I wishes to regard as septs of the clan. It does not mean that any person whose name is one of the above is necessarily included. Some of the names may have evolved from Burnett whilst others may have been derived from other surnames. I was recently asked by a Burnette as the link but had to tell him that there are no Burnettes whose links with my family are proven and therefore anyone with such a surname would be regarded as indeterminate albeit welcome into the collective family of Burnett. It may be of interest that in Scotland, [particularly in Glasgow], there is a growing practice to pronounce the surname as though there was an e on the end. What the written records show in this country is the following sequence of surname spelling: Burnard, Burnes, Burnet, Burnett. In geographical terms Burnet appears to be restricted to the Borders and East Lothian, with Burnett being associated with the north-east of Scotland. With regard to membership of somebody who has no claim to be a Burnett, I have recently received two such enquiries. To be a little explicit, as Chief of the Name I am the nominal head of all Burnetts. However, I would never claim or insist on allegiance from

every Burnett in the World. Whether anyone else can join a clan might be explained as follows. Historically a ‘broken’ man or outcast from a clan could seek shelter and protection by giving allegiance to another chief AND IF THAT CHIEF WAS AGREEABLE, the broken man would become a member of the clan. However, I should point out that Burnetts are a Lowland family which is prepared to recognise the Highland practice of accepting 'broken men', [perhaps a more appropriate description is 'strangers not of the kin']. With that concept in mind, (and I do not suggest that any enquirer might be categorised as a 'broken' man!), I can issue a House of Burnett Certificate (illustrated below) accepting someone into the House, even if the surname was not Burnett, on condition that the person accepted me as Head of the House of Burnett. I suppose that, if anybody wished to do this and lived in the USA, I might suggest that the "fee" for joining the clan might be membership of the House of Burnett. However, I don’t think that this should be obligatory and we would still be pleased to offer membership of the collective family of Burnett.

SAVE MY SEAT AT WESTMINSTER ABBEY One often wonders about ancestors and the series of events and decisions that needed to take place in order to be standing here forming a thought. My parents were born on opposite sides of the state of North Carolina and I assumed it was a quite random circumstance that gave rise to my existence. But as my curiosity about my family began to peak as I turned fifty, I learned that we are all much closer than we ever could have believed. The Jones’ arrived in Hull, Massachusetts in 1638 straight from Caversham, Oxfordshire, England. A family of tailors by trade they occupied the peninsula which defines Boston Harbor for several generations before starting an ancestral journey that took the Jones’ to Virginia, Georgia, Missouri, Texas and finally back to the east coast and Raleigh, North Carolina. My mother is a Burnett. Her father took a keen interest in ancestry throughout his life and learned of the Burnett of Leys and Crathes Castle from his father. His great grandfather’s name was John Burnett and arrived in America about 1807. Family lore told of his journey from his Scottish birthplace to Constantinople where he was raised before showing up on the coast in North Carolina as a young man. We believe he was attracted to the strong Scottish community that began arriving in the Cape Fear Region in 1739 with the arrival of the Argyll Colony. These Scottish ancestors were driven to the plush and fertile lands of the piedmont region of North Carolina as a result of the encroachment by English and lowland Scots on the highlands beginning with the elimination of tacksmen from the clan system, then the conversion of farmland to sheep pastures for economic reasons and finally the defeat of the Jacobite rebellion, lead by Charles Stewart in an attempt to overthrow the House of Hanover, at the Battle of Culloden in 1745. As interested in the Burnett of Leys as my grandfather was, the origin of our first American Burnett has never been documented. Nonetheless my grandfather adopted the origin of the family’s name with all vigor infecting his children with the malady. Although my mother, most of my aunts and uncles and many cousins have made it over the pond for the modern Burnett of Leys reunions, I have been unable to visit but once many years ago. When I was 19 during the summer of 1976, I travelled for the summer through Europe with

two buddies. My mother had talked relentlessly about the Burnett of Leys and Crathes although up to that point no one in the family had actually visited the castle. Believing my mother’s assurances that we were all family and would be welcomed with opened arms, I dragged my buddies to Crathes to have a look and possibly a spot of tea. Quite to my surprise the Burnetts no longer lived at Crathes Castle. The nice lady at the entrance informed me the castle was now owned by the Trust of Scotland but the Burnett family lived just a quarter mile down the lane. Far be it from me to come this far and abandon my social obligations so my friends and I marched right down the lane and knocked on the door. Unfortunately Jamie was not home but Fiona, to her detriment, was and answered the door. At the time I thought nothing of it but looking back I realize with horror the grace, kindness and....discipline Fiona demonstrated by welcoming us in and showing us Jamie’s elaborate family trees despite the fact we had not shaven in weeks and spent the last several nights sleeping in sheep pastures. Although I didn’t understand the significance of the sheep pastures and my ancestors past at the time, no doubt Fiona’s slightly detectable revulsion was not as much because I had some highlander blood coursing through my veins as much as the fact that we carried the full essence of the sheep pasture into her den with us. I’m glad to say many relatives have visited since and I’m sure Jamie and Fiona have never had the essence of sheep pasture forced upon their home as was done that day. My paternal grandmother’s family was one of those well established Scottish families in the piedmont of North Carolina that arrived with the Argyll Colony and contributed to the cultural attraction for John Burnett. The Americanized surname of Culbreth came from the original Galbraith which originated in Dunbartonshire, Scotland. Although the Scottish-Americans in the American south instinctively bear the independent character of their forefathers, the low and highlanders have always gotten along famously in the States as far as I can tell. Throughout history Scottish-American southerners have consistently contributed a larger proportion of soldiers to the US military than any other region of the country and very nearly kicked the behinds of our northern brethren and would have if not for our limited numbers. Nonetheless, the Burnetts and Culbreths seem to have shared more culturally than not and early threats from the natives kept any differences about Scottish regions at bay.

Now my mother’s mother was a Deaton which is an old and established English name that we believe originated following the arrival of William the Conqueror from his supporters hailing from Auton, France (de Auton). The Deatons arrived in Virginia in the late 17th century and migrated slowly over many generations the short distance to the foothills of North Carolina. So the stage was set for my creation. Jones’ covered the entire country that existed at the time, the Burnetts and Culbreths came directly to the Cape Fear region of North Carolina and the Deaton’s came through Virginia. So it is something of a miracle that my parents met at all in Raleigh, North Carolina in 1953. Following a whirlwind romance and a heady summer of love, they were married that October and less than a year later my sister was born. Fifty two years later I started researching this far flung and interesting set of characters and places of which I was to become intimately aware. Now you would think that my existence must be a product of fate but it could just as well be coincidental. You see, in researching my past, low and behold my parents have common ancestors. They are sixth or seventh cousins at least two different ways. Further research helped me come to the realization that not only are my parents distantly related but almost all Americans of European descent can claim direct descendency from royalty or great characters from the stage of history. The unique thing about me is that I have traced my personal ancestry generation-by-generation without a break to William the Conquerer (27th GGF), Charlemagne (33rd GGF) and royal families of the Welsh, Scots, English, Norse, French and Germans....who knew? So in the process of researching over three years I accumulated quite a respectable database of my relatives. One evening not too long ago I sat down with my parents to show them some old family pictures I had on my computer. My brother’s name is Adam and after showing them a picture of our great uncle Adam after whom he was named we discovered my parents did not realize we had a great-great uncle named Adam as well. Mom wondered out loud the source from which that name may have come in our family. So I pulled up my ancestry database and did a search on given names for Adam. The names were ordered by date and the first name on the list was Adam de Brus. Well, I didn’t know Adam de Brus from....well, Adam. So I went to his record and began following that line backward to discover

the origins of that family line. After a few minutes of flipping back and forth from one generation to the next it suddenly dawned on me. Adam de Brus was of the family of Robert the Bruce, King of Scotland from whom the Burnetts received their grants of land on the banks of the River Dee in 1324. So I did a little research and discovered exactly who was who. Robert de Brus was born in 1078, the 1st Lord of Annandale and the progenitor for the Bruce family in Scotland. Robert had two sons; the eldest was Robert II born in 1138 and the younger was Adam. Along the elders line, Robert de Brus, 7th Lord of Annandale was Robert the Bruce, 1st King of Scotland born in 1274. Along the younger son’s line, William Davis Jones, IV born in 1956 is....well, me. So to everyone’s great relief we have finally confirmed a direct connection between my mother’s Burnett family of eastern North Carolina and the Burnett House of Leys and through me nonetheless. You see Robert the Bruce is my fifth cousin 21 times removed who gave land to Alexander Burnett, theoretically my 20th GGF. So now that we have that cleared up, I’d simply like to ask Jamie to notify the Trust of Scotland that I’ll be arriving in a few weeks and would like for them to have the southeastern wing of Crathes prepared for my extended stay. After all, with the sounds of love in the air and my noble position in Anglo-American society well established, I would be amiss not to make myself available to accept an invitation to William and Kate’s spring gala. MEASURING THE EARTH I have written a series of items on Physical Science, entitled “Talking to Granddad”, for my 10 year old Grandson, Mattie, and have had them printed off in Booklet form. Each booklet is A5 sized, of 32 pages and artist illustrated. They have proven to be popular here and the titles of the first twelve are: “Speed, Stars, Newton, Mars, Einstein, Disease, Weather, Giants, Exposure, Archimedes, Aliens, and The Doppler Effect. I have spare copies of these and can send them to anyone who would like them, in exchange for postage and a small remuneration. All are the same format, length and degree of difficulty. They should prove suitable for any bright child aged from 10 to 14. The full set consists of 24 titles with the second twelve covering: Fission/Fusion, Star Flight, Galileo, Superstitions, Physical Limits, Exponential Growth, Computers, Intelligence, The Age of Things, Grains of Sand, Parallax, and The Future. I am, at present, sold out of these latter titles but could easily have some more printed off if necessary. I have attached a short extract from the booklet on Archimedes which will acquaint you with the degree of difficulty and the style I have used. My purpose is to help promote the Burnett name rather than to make money from their sale but I would like to recover postage and printing costs if any of your readers are interested. They sell here for $5.00 NZ per booklet, plus post. Tony Burnett Granddad? Yes, Mattie?

Who first knew that the Earth was round? I’m not sure about that Mattie. I don’t think anyone really knows who was first. There were probably some men from very early times—cave men days—who thought that the Earth was round but many thought it was flat, too, and the arguments dragged on and on for years. I know who was first to prove that the Earth was round though. He was really clever. He not only proved that it was round but he also measured how big it was.

Gee, who was that? He was a man called Eratosthenes. He lived in Egypt about 230 years before the birth of Christ. Back in about 230 BC in other words.

Was he a professor at a University? No. There were no Universities in those days Mattie. He was the Chief Librarian at the ‘Great Library’ at Alexandria in Egypt.

How did he do his proof?

Well, books in those days didn’t have pages like they do now. Things were written from top to bottom on a scroll, which was then rolled up and tied. The Great Library had thousands of scrolls and one day Eratosthenes was reading one from Syene. Syene was a small town built many kilometres upstream on the banks of the Nile river.

What did it say? It mentioned that at mid-day on the longest day of the year the sun was directly overhead. In other words the sun was right above them and not shining down at any angle.

Is that all? That doesn’t sound like much. Anyway, how did they know that the sun was right overhead? They could tell from the shadows. They noticed that at 12 o’clock on that day—the 22nd of June—a tall straight column had no shadow showing at all. If there was no shadow then it had to mean that the sun was shining directly down on it.

Hmm. There might have been no shadow because it was raining, Granddad. Ha ha. Quite right Mattie, but let’s assume that it was a nice fine day and the sun was shining, shall we?

Okay. So what did Eratosthenes do when he read about the sun in Syene? Well, he wondered if the same thing was true in Alexandria on that day.

And was it true? No, it wasn’t. He waited until mid-day on June 22nd and had a look. He saw that columns in Alexandria did cast a shadow......quite a large shadow in fact.

What did that mean? Well, it meant that the surface of the Earth must be curved. If the Earth really was flat then there would either be no shadows at Syene and Alexandria or both places would have shadows of the same length.

Oh, yes. I see. It seems obvious, really, but he must have been clever to be the first person to think about it. How did he work out the Earth’s size? Well, mainly he just wanted to see if there was any shadow at Alexandria at the same time that there was none at Syene, but well before the longest day he also had the sense to measure the height of his column. When the right time came, and he saw that there actually was a shadow showing, all he had to do was measure its length. By comparing the length of the shadow to the height of the column he would know the angle of the sun at Alexandria.

Oh, I see. And what was it Granddad? It was eight degrees. Of course he knew that at mid-day on June 22nd the sun was right overhead at Syene, so an angle of eight degrees at Alexandria meant there was eight degrees difference between the two places. Still follow me?

Yes. I think so. Good. Well, the rest, apart from one hard bit, was easy. Do you know how many degrees it takes to go right around in a circle?

Oh, yes. It’s 360 degrees, isn’t it? That’s right. Good. Now......how many times does 8 go into 360? Let’s see. Dum de doo, 360......divide by......8......equals......45 exactly!

Forty-five. Okay. Well that means the distance between Syene and Alexandria must be one forty-fifth of the distance right around the Earth. Oh, I see what he was getting at. Of course!

Well, how far was it between Syene and Alexandria? That’s the hard bit, Mattie. That was the one thing that poor old Eratosthenes didn’t know.

He didn’t know? Why not? Why didn’t he just look it up? We can do that today, Mattie, but there were no maps or atlases back in 230 BC. He couldn’t look it up. Oh, I see. Yes, I forgot about that. So what did he do then? Well, you may not believe it Mattie, but he did the only thing he could think of doing. He hired a man to pace out the entire distance.

Holy Moly! You mean the man had to walk all the way from Alexandria to Syene and measure the distance as he went? Yes, that’s right. Eratosthenes found someone willing to do it and paid for the whole thing out of his own pocket. Gee, good on him. And what was the answer? Well, it took a few months but the answer came back as 5000 stades.

What’s a stade? It’s a unit of distance that was common in Egypt back in those days. It’s where our word stadium comes from but we have kilometres and miles today so we don’t use stades at all now. One stade is about 172 metres, so do you think you can work out how far 5000 stades is in kilometres?

I think so, Let’s see. 5000......times......172......equals......divide by 1000......equals. It’s 860 kilometres. How’s that, Granddad? That’s good, Mattie. Now, how far is it right around the Earth?

Umm. Is it worth an ice-cream?

Yes, all right. That’s if you get it right of course. You’ll be as fat as me soon.

Right. Let’s see. The angle between Syene and Alexandria is 8 degrees which is one forty-fifth of the distance right around, so 860 times 45 is ......38,700 kilometres. How’s that? Well done Mattie. That’s quite right. That’s the answer that Eratosthenes finally came up with.

Good on him! Was he right? Yes. His answer was very good compared to what we know the distance is today.

How close was he? He was very close......within about 3% of the right answer. Today we know that the distance right around the Earth is about 40,000 kilometres.

It sure was. My teacher says that the ancient Greeks were very clever and made a lot of important discoveries. Your teacher is quite right Mattie. Eratosthenes was a brilliant man. Come on. Let’s go and get that ice-cream, shall we?

Following the article in the Banner of September 2009, Edt.7, I have received a lot of interesting genealogical information from Darryl Rogers and his younger brother Dwayne Rogers from St Charles, Illinois, USA with some additions and corrections included in the following Darryl Roy Rogers, is the middle son of Sheila Irene McEleny Burnett-Rogers and Donald Eugene Rogers. Sheila was the youngest child of Reginald John Burnett and Hilda McElney who immigrated to New Zealand in 1919. They had four children: Phyllis Jean Burnett (never married), who moved to America and lived in Florida in the mid-1970's until her death in the early 1990's; Reginald Thomas John Burnett and Mavis May Cox lived in New Zealand and had four children; Jacqueline, Diane, Kerry and John who are believed still to live there; Reginald John (Jack) and his wife Mavis are deceased; Myrtle had two daughters and lived in New Zealand also ( no knowledge of daughters names or if Myrtle is still be living ).

Saint Charles , Illinois died on Aug 11 2003. They lived in Sioux Falls , South Dakota , USA (upon Sheila and young son Donald John's arrival from NZ to the USA 1944 ) where sons Darryl Roy Rogers and Dwayne Eldon Rogers were born. The family moved to Grand Rapids , Michigan , USA for a brief time after Sheila's husband left the Sioux Falls , S.D. Police Department (PD). In 1963 they moved to St. Charles . They had three sons: Donald John Rogers, b. July 8 1944 in Hastings , N.Z.- d. 20 April 20 2005; Darryl Roy Rogers, b.Feb 5 1947; and Dwayne Eldon Rogers, b. Feb 25 1950. Donald John Rogers d.April 20 2005 in Belton, Missouri and is survived by his wife, Lynn Wolfe Rogers, of Belton, Missouri; and a son, (by his first marriage to Christiane Juster of France), Toby Eugene Rogers, b.Aug 8 1967 who resides and works in Washington, DC Donald John Rogers served with the United States Marine Corps 1959-84. Darryl is a retired Lieutenant with the St. Charles PD and also served in the US Army during the Vietnam War. They have two (2) sons: Brian Darryl Rogers, b. Feb 27 1969 and Kip Charles Rogers, b. May 31 1977. Both sons also live in St. Charles , Illinois . Brian Darryl Rogers m. Jill Ann Lewandowski on June 7 1997. They have two children: Kirsten Susan Rogers, b. Darryl and Dwayne both served on the St. Charles PD while their father, Donald Eugene Rogers, was the Chief of Police there. Donald John Rogers was a "lifer" with the US Marine Corps in which his father also served during World War II in the South Pacific. Donald Eugene Rogers met and married Sheila Irene McElney Burnett while on a short leave pass in New Zealand during the war. Over the years the family has lost touch with Darryl and Dwayne's cousins in New Zealand, mainly Jacqueline Burnett (daughter of Jack and Mavis Burnett), who visited them several times in the USA. They also had visits from Jacquline’s father Jack (Reginald John) before his death. Jacqueline has three siblings: Diane, Kerry and John. The family had the most contact with Aunt Phyllis Burnett, who lived in the USA but have never met their Aunt Myrtle Burnett or her daughters. ELIZA BURNETT Those who have been to our Burnett Gatherings may be amused to see this caricature of our daughter Eliza who is prominent in the world of poker as a player and editor of a European magazine dedicated to the game. It was painted by Laetitia Guilbaud, a French artist working in Glasgow. Early last year, I noticed in the press a somewhat raunchy picture of the Scottish Government deputy leader and, since Laetitia advised me that it was available for purchase, I thought that it would be a fitting decoration for the Banchory Business Centre where we have a small collection of local art. Politics and family prevented me from doing this but instead I commissioned her for this picture of Eliza. Letitia’s paintings have been in the news again recently since Catherine Middleton, Prince William’s fiancée has been a subject of her painting. Each time the artist makes the headlines, the article is accompanied by the painting of the deputy leader!

BURNETT GUN FIGHT The remake of “True Grit” reminded me of just how wild and violent Western Arkansas and Oklahoma was after the civil war. Notorious villains such as Belle Starr, Cherokee Bill, The Dalton Gang, and Jesse James often sought refuge in the “Indian Territory” where lawmen were scarce. After statehood, Oklahoma continued to struggle with its wild and rowdy past while growing and trying to throw off the last vestiges of the frontier. By 1900 the old outlaws were gone. Cherokee Bill had met his fate at Judge Parker’s gallows. The Dalton gang had been shot up in a Kansas street, and Jesse James had been murdered by Bob Ford. Bob Ford had also been murdered by a certain Ed Kelly who served time for the murder in Colorado before being paroled and deciding to venture to Oklahoma City where he met his fate in a bloody duel with Joe Burnett. Joe Burnett was one of a handful of city policeman in Oklahoma City at the turn of the century. It was a tough job. Oklahoma City was a still wild town with a history of violence which attracted persons with a certain “reputation” from time to time. This might explain why Ed Kelly decided to visit. His real purpose is not clear but one can assume “leave Colorado” was an informal condition, if not specifically noted, in his parole. Kelly had been arrested at least twice during his stay, once by Burnett, and had begun making remarks that no policeman had better try to arrest him again. The story goes that Joe Burnett was simply walking his beat when he encountered Kelly. “Hello Kelly,” Burnett is supposed to have said, whereupon Kelly whirled on Burnett, pistol in hand, and said, “You come with me. I’ll arrest you, you son of bitch.” Being an officer with quick reflexes, Burnett immediately grabbed Kelly’s right pistol hand with his left hand while reaching for his pistol with his right hand. In turn, Kelly grabbed the officer’s pistol hand and the duo was locked in a life and death struggle in the street. Back and forth the two struggled. Kelly, seeking an advantage, began chewing on Burnett’s ears and though he chewed them down, the officer would not relent. Finally, after almost 15 minutes a baggage clerk from the nearby train depot heard Burnett’s cries for help and ran to his assistance. The clerk grabbed Kelly’s hand, freeing Burnett’s gun and the officer ended the fight.

It had been a terrible struggle and a close call. In addition to the badly chewed ears, Joe Burnett's left ear was powder-burned. He later became deaf in the ear. There were two bullet holes in the back of his overcoat and the left hip-pocket was torn by a bullet. Burnett's gloves were burned and his clothing was on fire when his friends reached him. Joe Burnett served out his career in the Oklahoma City police department, rising to the rank of assistant Chief of Police and earning his place in a footnote of American history as the man who killed the man who killed the man who killed Jesse James. The best ward against this hazard is to promise a child a ready pardon for the greatest fault if they candidly confess it: and indeed to teach an habitual ingenuity may well deserve a connivance at great escapes. A humour also of telling ill of those whom they emulate doth also feed this custom of lying; which is the more to be guarded against, because it is coupled to another evil almost as bad, detraction and envy. This fault will also be best corrected by a constant pardoning the child accused, and a translating the punishment due to the fault upon the tattler
