The life of a law enforcement officer is not for everyone. We come from different backgrounds with different experiences and ultimately we all make the decision to join one of the finest professions in the world for different reasons. I want to say what an honor it has been for me to be afforded the opportunities that I have had.
This will be my final letter as your president. I have the greatest confidence that Jeff Marano and the rest of the Executive Board will continue to lead the PBA successfully forward. I could not have accomplished my job without the support of the members who have served on the Board of Directors and the tremendous staff we have here at the Bro-ward PBA and the Florida PBA. I cannot begin to list all the people I should thank for my law enforcement and PBA careers, so thank you to each of you.
I was a military brat, born and raised on military bases. After college (Go Noles!), I en-tered law enforcement. I have spent my life surrounded by real life super heroes. Not the comic book, TV or movie super heroes, but real ones. I was surrounded by them where I lived, where I played, where I worked; I could see them everyday. Many people did not recognize them or realize how close they were to a real super hero, and it wasn’t because they were in their secret identity clothes. Maybe people think that the only way to recog-nize a super hero is by their tights, costumes or capes when all they really need to do is look for their badges or dog tags.
As retirement approaches, there are three questions I am constantly asked: Are you going to miss the job? What are you going to do? Where’s the party? Many have told me you have to do a job first before you can miss it. What I will miss really will be the people I have worked with. I am really not sure what I will be doing other than I know I will be taking some time off. As for the party, stay in touch.
To summarize my presidency, I give you one of my most favorite quotes, “If I were to try and read, much less answer, all the attacks made on me, this shop might as well be closed for any other business. I do the very best I know how, the very best I can, and mean to keep doing so until the end. If the end brings me out all right, what is said against me won’t amount to anything. If the end brings me out wrong, then ten angels swearing I was right would make no difference.” --Abraham Lincoln
Always keep those who are serving in our armed forces in your thoughts and prayers and also please pause for a moment to remember those brave souls who have not yet returned home – POW, MIA, KIA.
The Broward County PBA is proud to represent each and every one of you who is brave enough, proud enough and strong enough to wear the badge. You are among the best in Broward County, the State of Florida and the nation. I thank each of you and your fami-lies for your sacrifices, your hard work and the risks you take.
Stay healthy, stay in shape, watch your diet, so that someday you can look in the mirror on the first day of the every month, smile and say, “Screwed them out of another month’s pension.”

Hollywood Officer Critically Injured In Crash
New Executive Board Voted InTerms to begin in January
Current PBA President Pat Hanrahan will be stepping down at the end of December, and the terms of the other Executive Board members will be ending as well. During the November 12 Board of Directors meeting, the Board voted on who will lead the PBA for the next three years.

Thoughts and prayers of the entire PBA family go out to Hollywood Officer Armando Silva, who was injured in a accident while at-tempting to make a traffic stop on October 29. As of press time, Armando remains in critical condition at Memorial Regional Hospital.
Silva, who has been in motors for 10 years, lost control of his bike while making the stop. A surveillance video shows two sport cycles speeding away from the crash; Hollywood Police are looking for those bikers in order to piece together what happened. It’s unknown whether or not they are involved.

Term Life Insurance Discontinued
The no-cost term life insur-ance that has been provided to our members since 2009 is being discontinued effective December 1, 2012.
Any additional policies, like disability or cancer policies, that were purchased from that compa-ny and are being paid for through dues deduction are still in force.
Please note that this will not affect the $30,000 Florida PBA Heart Fund payments for line-of-duty deaths.

HOPE Fund Update
In 2012, the Broward County PBA HOPE Fund was able to raise over $10,000 to benefit members of our PBA family.
Raffles were held for Deputies Ronnie DeAngelo and John Meiers, who both lost sons to cancer this year. The funds helped both families offset some of the financial burden incurred in fighting this disease.
Thank you to everyone who partici-pated in the raffles, from those that purchased tickets to those that orga-nized the events and collected dona-tions. A special thanks to our raffle winners, who both graciously donated their prizes back to the families.

To: Mr. Pat Hanrahan, P.B.A. President, I want to express my appreciation to the P.B.A. and individuals, that went far beyond what was required of them.
My Arbitration decision is pending, therefore I can't go into more of the details of my case. I was a former BSO
DLE Deputy Sheriff that was involved in a domestic violence incident with my ex‐girlfriend. Unfortunately, because of what many believe are flawed domestic violence statutes, coupled with a false statement from my
girlfriend, and conflicting evidence, I was wrongly arrested. I was a 23 year BSO employee with an exemplary
record. The Magistrate Judge read the Arrest Form, and ordered the lowest possible bond on the two domestic
violence charges. I retained one of the finest criminal defense attorneys, Al Milian, to represent me. He did an
excellent job and made himself available to me at all hours. The State Attorney's Office no filed both domestic
violence charges. Unfortunately, BSO then commenced an "administrative investigation" against me for the two charges that were
no filed by the State Attorney's Office, charged me with "conduct unbecoming" for apparently being involved in
the domestic violence incident, where I sustained a serious injury in self‐defense. I also was the one to call 911 and
provided information to responding Deputies. Later, BSO added "untruthfulness" on the pretense that I gave a
false reason to a Deputy on scene for the verbal argument. I did not give a false reason, however, is that issue
even relevant and serious enough to charge against an employee? Untruthfulness alone is a termination offense.
The BSO investigative report contains false statements, inaccuracies and is biased against me. This report was the
only "evidence" presented to the Professional Standards Committee. At this time, it is comprised of mostly Command Staff and civilians. I just read in the October 2012 Broward Centurion, the proposed 2012‐2015 BSO
contract includes a provision to "alter the makeup" of the Board. I suggest that every Deputy Sheriff ratify the
contract, for that reason alone. I was not allowed to attend the PSC, to either testify or answer any questions. My
PBA Attorney Michael Braverman, who did an outstanding job, was also not allowed to attend. The victim wasn't
allowed to appear, who could have been questioned about her statement, which basically she later recanted. She
later sent an e‐mail without my knowledge or assistance. She had moved out of state and I didn't have any contact with her for five months. The Board, predictably, sustained all four charges and recommended termination. I was given a legally required
hearing, which was limited by a BSO Chief to about ten minutes or less. Mr. Braverman offered the e‐mail that
basically exonerated me from the domestic violence charges on November 13, 2011. The Chief admitted it and
directed the BSO investigator to contact my ex‐girlfriend to speak with her. The day she obtained pro bono legal
representation, I was summoned to the Public Safety Building and terminated. My arbitration hearing lasted two days and I am awaiting the Arbitrator's award. I feel confident, due to the expert
representation of Mr. Braverman, the support of the PBA staff and special thanks to PBA Vice President Debbie
Reggio, who attended both days. I never expected myself ever to be "caught in the net" of flawed domestic violence laws, wrongfully arrested by
my own agency, subjected to an unfair disciplinary process and terminated. I have faith in the arbitration process
and other civil litigation, if necessary. However, win or lose this arbitration, I wanted the PBA to be aware of my
sincere thanks for everything that they have done for me. In my opinion, every Deputy Sheriff should join the PBA, vote on every contract; but be very aware of how easily a
wrongful arrest can happen to you or a fellow Deputy. Most importantly, the nightmare you will be subjected to
by your own agency... fighting against unfair investigative, disciplinary and appeal processes. Sincerely, THEODORE D. MILLER

Supreme Court To Decide Two Cases Involving Drug Dogs
The Supreme Court of the United States has heard argu-ments on two cases from Florida that involve the legality of drug dog use. This is the first time since 2005 that the court will consider this question. In that case, Illinois v. Caballes, the Court concluded that po-lice do not need reasonable suspicion to justify a detector dog sniffing a car during an otherwise proper traffic stop. The Florida cases, Florida v. Jardines and Florida v. Harris, bring up question of whether a dog sniffing outside a residence is a search (Jardines) and how much evidence must be produced to show a detector dog’s reliability in giving probable cause (a positive response) to search a car (Harris).
In Harris, Clayton Harris was stopped for expired plates on his pickup truck. The Liberty County deputy who made the stop suspected that Harris was under the influence of drugs and requested permission to search the truck. Harris refused, so the deputy used his detector dog to sniff the exterior of the truck. The dog gave a positive response and a subsequent search turned up chemicals needed to cook meth, including 200 pseudoephedrine tablets. He was charged with unlawful possession of the pseudoephedrine. In court, Harris questioned the dog’s reliability. The Florida Supreme Court held that the prosecution had not given enough evidence to prove that the dog was reliable. Many state and federal courts across the country would disagree with the Florida Court, hold-
ing that proper training and certification are suf-ficient predicates for supporting probable cause.
Police got an anonymous tip that Mi-ami resident Joelis Jardines was grow-ing pot in his home. Detectives and a detector dog team went to the home. The dog gave a positive response outside the front door. A detective on the scene, upon being told of the response, inhaled deeply and was able to smell marijuana as well. A search warrant was obtained and plants were found inside the house. The court was asked to suppress the evidence obtained during the warrant execution on the grounds that the dog’s sniff constituted a search. The US Supreme Court has previously found that a “sniff is not a
search” when a detector dog sniffs the exterior of luggage or a vehicle. In Jardines, The Court must decide whether the dog’s presence on the porch violated a legitimate expectation of privacy and constituted a search.

Chris Schaub Added To PBA Memorial Wall
It was with great sadness that the name of Deputy Christo-pher Schaub was added to the memorial wall in the lobby of the PBA offices. He joins 55 other Broward County heroes who made the ultimate sacrifice. God willing, his name will be the last.

Coconut Creek Officers Lesley and Dan Eberly welcomed Katherine Shea on September 13 She was
4 lbs. 3 oz. and 17 inches long. Katherine was five weeks early and after two weeks at the hospital, she and her mother are finally at home resting comfortably.
Hollywood Officer Matt Fregin; his wife, Holly; and their son, Cayden welcomed new daughter/sister Karsynn Grace on October 25. Karsynn weighed in at 7 lbs., 4 oz.
Hollywood Detective Wadson Sa-invil; his wife, Jasmin; and son, Bryson, welcomed baby girl Kendall Elise on October 22. She weighed in at 8 lbs., 5 oz. and was 19 inches long.
