DisciplineOverview:Offenses/DefinitionsTheStudentCodeofConducthasbeenwrittentoillustratethattherearelevelsofresponseswithinClassI,IIandIIIoffenses.Belowisanoverviewofeachclass.Thefollowingpagesfurtherdefinetheoffenses,interventionandresponses.ClassIoffensesincludeawiderangeofbehaviorswhichdisruptthelearningenvironment.TheclassroomteacheristhefirstlevelofinterventiontocorrectClassIbehaviors.Inmostcases,responsestrategiesusedbytheteacherwillbesufficienttobringthestudent’sbehaviortoanacceptablelevel.ForClassIbehaviors,ashort-termorlong-term(outofschoolsuspension)willnotbeassignedforanygradelevel.ClassIIoffensesarebehaviorsthattendtoseriouslydisruptthelearningenvironment.AClassIIoffensemaywarrantanofficereferral.Administrativeresponsesmayincludeamenuofinschoolinterventionsaswellasshorttermsuspensiondependingontheseverityoftheincident.Along-termsuspensionoranexpulsionwillnotbeassignedasaresponseinClassII.ClassIIIoffensesarebehaviorsthatmayseriouslyjeopardizeschoolorderandsecurity.Schoolofficialswilltreatthesebehaviorsveryseriously.Accordingly,theresponsesinClassIIImayinclude,butarenotlimitedto,short-termand/orlong-termsuspension.ClassIVoffensesarebehaviorsconsideredcriminalactsthatseriouslyjeopardizeschoolorderandsecurity.ClassIIIorIVoffenses,areentryplanmustbecreatedbeforethestudentreturnsfromlongtermsuspensionorexpulsionsothatstrategiescanbeimplementedimmediatelyuponthestudent’sreturntoschool.Thiscanincludemediationoradditionalstrategiestorestoretherelationships.

ClassIDefinitionsandExplanations:ClassIoffensesarebehaviorsthattendtodisruptthelearningenvironment.AClassIoffensemaywarrantanofficereferral;however,theteacherwillbeprimarilyresponsibleforrespondingandcorrectingtheseoffenses.ForClassIbehaviors,short-termorlong-term(outofschoolsuspension)willnotbeassignedforanygradelevel.FollowingisalistofClassIbehaviorsanddefinitions:
1. AcademicDishonesty/Cheating/Forgery:Academicdishonestythrough
cheating,copying,forgingsignatureofteacherand/orparent,plagiarizing,oralteringrecords,orassistinganotherinsuchactions.
2. Disrespect/UseofProfanity:Useofnegativelanguage/profanitythatdisruptsothersinthelearningcommunity.Thisbehaviorincludeswritten,oral,electronic,andanyremarkorexpression,includingobscenegestures,whichisoffensiveinviolationofschoolstandardsbutthatisnotdirectedatanindividual.
3. ExcessiveTardiness:Repeatedreportingtoassignedclass(es)aftertardybellringswithoutacceptableexcuse.Morethan7(seven)tardies,latearrivalstoschool,and/orleavingbeforetheendofschool.
4. ImproperDisplayofAffection:Impropertouching,hugging,kissingand/orengagingininappropriatesocialbehavior.
5. InappropriateComputer/InternetMisuse:Accessing,communicatingorcreatinginappropriateand/orprofaneinformationthatinterfereswiththestudent’sparticipationintheclassroom.
6. Non-ConformitytoDressCode:Dressorappearancethatislikelytocausedisruptionoftheeducationalprocessortocreateahealthorsafetyproblem.Neatness,decencyaregoodtasteguidelinesofthedistrictdresscode.Studentsmustdressinamannerthatisnotobscene;offensive;orsubstantiallyormateriallydisruptivetothelearningenvironment.Apparelthatissexuallysuggestive;promotesviolence,illegalactivities,drugs,alcoholand/ortobacco;orisdeterminedtobegangrelatedisprohibited.
7. PossessionofEducationalNuisance:Devicesthatimpedeorinterruptthe
educationalprocessincluding,butnotlimitedto,cellphonesonorusedduringclass,videogames,discplayers,playingortradingcards,electronicdevices,stuffedanimals,radios,MP3players,skateboardsandanysocialmediadevices.
8. SkippingClass:Theunauthorizedabsencefromascheduledclassorafterschooldetention,withoutobtainingconsentoftheproperschoolauthority.
9. TobaccoPossession:Havingtobaccoonone’sperson,inone’spockets,bags,car,andorlocker,onschoolpropertyoratschool-sponsoredevent(s).

Alternative School Program (ASP):
AstudentmayonlybeplacedintheASPProgramifalong-termsuspensionhasbeenproposedandaformaldisciplinaryhearinghastakenplace.PlacementinASPisthedecisionofthedesignatedhearingofficerasanalternativetoalong-termout-of-schoolsuspension.AstudentassignedtoASPwillbeforaperiodnottoexceed25schooldaysforaminimumof12hoursperweek.Astudentcannotbeproposedforalong-termsuspensionwithoutanotherformalhearing.TheparentandstudentmustagreetothetermsoftheASPcontract.Attheendofthe25schooldays,schooladministratorswillconveneatransitionmeetingwiththestudent,parent,ASPteacher,counselor,andotherstudentsupportstaff,inordertore-teachbehaviorexpectations,identifyresources,andestablishare-entryplanforasuccessfultransitiontoschool.

EmergencySafetyInterventionsTheboardofeducationiscommittedtolimitingtheuseofEmergencySafetyInterventions(ESI),suchasseclusionandrestraint,withallstudents.Seclusionandrestraintshallbeusedonlywhenastudent’sconductnecessitatestheuseofanemergencysafetyinterventionasdefinedbelow.Theboardofeducationencouragesallemployeestoutilizeotherbehavioralmanagementtools,includingpreventiontechniques,de-escalationtechniques,andpositivebehavioralinterventionstrategies.TheboardofeducationfollowsESIstatutes/regulationsestablishedbytheStateofKansasandKansasStateDepartmentofEducation.Boardpolicyandpracticesshallfollowandreflectanychangesmadeinstatutes/regulationsgoverningtheuseofESI.Thispolicyshallbemadeavailableonthedistrictwebsitewithlinkstothepolicyavailableonanyindividualschoolpages.Inaddition,thispolicyshallbeincludedinatleastoneofthefollowing:eachschool’scodeofconduct,schoolsafetyplan,orstudenthandbook.Definitions(SeeK.A.R.91-42-1)“EmergencySafetyIntervention”istheuseofseclusionorphysicalrestraint,butdoesnotincludephysicalescortortheuseoftime-out.“Seclusion”meansplacementofastudentinalocationwherearethefollowingcriteriaaremet:(1)thestudentisplacedinanenclosedareabyschoolpersonnel;(2)thestudentispurposefullyisolatedfromadultsandpeers;and(3)thestudentispreventedfromleaving,orthestudentreasonablybelievesthatthestudentwillbepreventedfromleaving,theenclosedarea.“ChemicalRestraint”meanstheuseofmedicationtocontrolastudent’sviolentphysicalbehaviororrestrictastudent’sfreedomofmovement.“MechanicalRestraint”meansanydeviceorobjecttolimitastudent’smovement.Parentmeans:(1)anaturalparent;(2)anadoptiveparent;(3)apersonactingasaparentasdefinedinK.S.A.72-1046(d)(2),andamendmentsthereto;(4)alegalguardian;(5)aneducationadvocateforastudentwithanexceptionality;(6)afosterparent,unlessthefosterparent’schildisastudentwithanexceptionality;or(7)astudentwhohasreachedtheageofmajorityorisanemancipatedminor.“PhysicalRestraint”meansbodilyforceusedtosubstantiallylimitastudent’smovement,exceptthatconsensual,solicitedorunintentionalcontactandcontacttoprovidecomfort,assistanceorinstructionshallnotbedeemedtobephysicalrestraint.“PhysicalEscort”meansthetemporarytouchingorholdingthehand,wrist,arm,shoulder,orbackofstudentwhoisactingoutforthepurposeofinducingthestudenttowalktoasafelocation.“Time-Out”meansabehavioralinterventioninwhichastudentistemporarilyremovedfromalearningactivitywithoutbeingsecluded.“Campuspoliceofficer”meansaschoolsecurityofficerdesignatedbytheboardofeducationofanyschooldistrictpursuanttoK.S.A.-8222,andamendmentsthereto.

“Lawenforcementofficer”and“policeofficer”meansafull-timeorpart-timesalariedofficeroremployeeofthestate,acountyoracity,whosedutiesincludethepreventionordetectionofcrimeandthelawenforcementofcriminalortrafficlawofthisstateoranyKansasmunicipality.Thistermincludesacampusofficer. “Legitimatelawenforcementpurpose”meansagoalwithinthelawauthorityofanofficerthatistobeachievedthroughmethodsorconductcondonedbytheofficer’sappointingauthority.“Schoolresourceofficer”meansalawenforcementofficerorpoliceofficeremployedbyalocallawenforcementagencywhoisassignedtoadistrictthroughanagreementbetweenthelocallawenforcementagencyandthedistrict.“Schoolsecurityofficer”meansapersonwhoisemployedbyaboardofeducationofanyschooldistrictforthepurposeofaidingandsupplementingstateandlocallawenforcementagenciesinwhichtheschooldistrictislocated,butisnotalawenforcementofficerorpoliceofficer.ProhibitedTypesofRestraintAllstaffmembersareprohibitedfromengaginginthefollowingactionswithallstudents:
• Usingface-down(prone)physicalrestraint;• Usingface-up(supine)physicalrestraint;• Anyrestraintthatobstructsthestudent’sairway;• Anyrestraintsthatimpactsastudent’sprimarymodeofcommunication;• Usingchemicalrestraints,exceptasprescribedtreatmentofastudent’smedicalor
psychiatricconditionbyapersonappropriatelylicensedtoissuesuchtreatments;and
• Useofmechanicalrestraint,except:o Protectiveorstabilizingdevicesrequiredbylaworusedinaccordancewithan
orderfromapersonappropriatelylicensedtoissuetheorderforthedevice;o Anydeviceusedbylawenforcementofficerstocarryoutlawenforcement

health care provider, a copy ofwhich has been provided to the school and placed in thestudent’sfile.Suchwrittenstatementshallincludeanexplanationofthestudent’sdiagnosis,alistofanyreasonswhyESIwouldput the student inmental orphysical danger, and any suggestedalternatives to ESI. Notwithstanding the provisions of this subsection, a studentmay besubjected to ESI, if not subjecting the student to ESI would result in significant physicalharmtothestudentorothers.UseofSeclusionWhenastudentisplacedinseclusion,aschoolemployeeshallbeabletoseeandhearthestudentatalltimes.Allseclusionroomsequippedwithalockingdoorshallbedesignedtoensure that the lock automatically disengages when the school employee viewing thestudentwalksawayfromtheseclusionroom,orincaseofemergency,suchasfireorsevereweather. Aseclusionroomshallbeasafeplacewithproportionalandsimilarcharacteristicsasotherroomswherestudents frequent.Suchroomshallbe freeofanycondition thatcouldbeadangertothestudentandshallbewellventilatedandsufficientlylighted.TrainingAllstaffmembersshallbetrainedregardingtheuseofpositivebehavioralinterventionstrategies,de-escalationtechniques,andpreventiontechniques.Suchtrainingshallbeconsistentwithnationallyrecognizedtrainingprogramsontheuseofemergencysafetyinterventions.Theintensityofthetrainingprovidedwilldependupontheemployee’sposition.Administrators,licensedstaffmembers,andotherstaffdeemedmostlikelytoneedtorestrainastudentwillbeprovidedmoreintensetrainingthanstaffwhodonotworkdirectlywithstudentsintheclassroom.Districtandbuildingadministrationshallmakethedeterminationoftheintensityoftrainingrequiredbyeachposition.
Eachschoolbuildingshallmaintainwrittenandelectronicdocumentationregardingthetrainingthatwasprovidedandalistofparticipants,whichshallbemadeavailableforinspectionbythestateboardofeducationuponrequest.NotificationandDocumentationThe principal or designee shall notify the parent, on the same day the emergency safetyintervention was used. If the school is unable to contact the parent, the principal ordesignee shall attempt to contact the parent using at least twomethods of contact. Thesamedaynotificationrequirementshallbedeemedsatisfiediftheschoolattemptsatleasttwomethodsofcontact. Aparentmaydesignateapreferredmethodofcontacttoreceivethe samedaynotification. Aparentmayagree, inwriting, to receiveonlyone same-daynotificationfromtheschoolformultipleincidentsoccurringonthesameday.DocumentationoftheESIusedshallbecompletedandprovidedtothestudent’sparentsnolaterthantheschooldayfollowingthedayonwhichtheESIwasused.Thisdocumentationshallinclude:
Ø Theeventsleadinguptotheincident;Ø Studentbehaviorsthatnecessitatedtheemergencysafetyintervention;Ø Stepstakentotransitionthestudentbackintotheeducationsetting;Ø Thedateandtimeoftheintervention,thetypeofintervention,thelengthoftimethe
interventionwasused,andtheschoolpersonnelwhoparticipatedinorsupervisedtheintervention,andanyotherinformationrequiredbystatuteorregulation.

Ø Space or an additional form for parents to provide feedback or comments to theschoolregardingtheincident;
Ø Astatementthatinvitesandstronglyencouragesparentstoscheduleameetingtodiscuss the incident and how to prevent future use of emergency safetyinterventions;and
Ø Emailandphone information for theparent to contact the school to schedule theemergencysafetyinterventionmeeting.
TheparentshallbeprovidedthefollowinginformationafterthefirstandeachsubsequentincidentinwhichanESIisusedduringeachschoolyear:(1)acopyofthestandardswhichindicateswhenESIcanbeused; (2)a flyeron theparent’srights; (3) informationon theparent’srighttofileacomplaintthroughthelocaldisputeresolutionprocess(whichissetforth in this policy) and, the complaint process of the state board of education; and (4)information that will assist the parent in navigating the complaint process, includingcontactinformationforFamiliesTogetherandtheDisabilityRightsCenterofKansas.Uponthe firstoccurrenceofan incident involving theuseof emergencysafety intervention theforegoing information shall be provided in printed form, or upon the parent’s writtenrequest,byemail.Uponoccurrenceofasecondorsubsequentincident,theparentshallbeshallbeprovidedwithafullanddirectwebsiteaddresscontainingsuchinformation. LawEnforcement,SchoolResourceandCampusSecurityOfficersCampuspoliceofficersandschoolresourceofficersshallbeexemptfromtherequirementsof thispolicywhenengaged inanactivitythathasa legitimate lawenforcementpurpose.Schoolsecurityofficersshallnotbeexemptfromtherequirementsofthispolicy.If a school is aware that a law enforcement officer or school resource officer has usedseclusion, physical restraint, or mechanical restraint on a student, the school staff shallnotify theparent the samedayusing theparent’spreferredmethodof contact. A schoolshall not be required to provide written documentation to a parent, as set forth above,regardinglawenforcementuseofanESI,orreporttothestatedepartmentofeducationanylaw enforcement use of an ESI. For purposes of this subsection, mechanical restraintincludes,byisnotlimitedto,theuseofhandcuffs.DocumentationofESIIncidentsExceptasspecifiedabovewithregardtolawenforcementorschoolresourceofficerusedofemergencysafetyintervention,eachbuildingshallmaintaindocumentationanytimeESIisusedwithastudent. Suchdocumentationmustincludeallofthefollowing:
• Dateandtimeoftheintervention• Typeofemergencysafetyintervention,• Lengthoftimetheinterventionwasuse,• SchoolpersonnelwhoparticipatedinorsupervisedtheESI.• WhetherthestudenthadanIEPatthetimeoftheincident,• WhetherthestudenthadaSection504planatthetimeoftheincident,and• Whether the student had a behavior intervention plan at the time of the
incident.
Allsuchdocumentationshallbeprovidedtothebuildingprincipal,whoshallberesponsibleforprovidingcopiesofsuchdocumentationtothesuperintendentorthesuperintendent’sdesigneeonatleastabiannualbasis.Atleastonceperschoolyear,eachbuildingprincipal

ordesigneeshallreviewthedocumentationofESIincidentswithappropriatestaffmemberstoconsidertheappropriatenessoftheuseofESIinthoseinstances.
ReportingDataDistrictadministrationshallreportESIdatatothestatedepartmentofeducationasrequired.
ParentRighttoMeetingonESIUseAftereachincident,aparentmayrequestameetingwiththeschooltodiscussanddebriefthe incident. A parent may request such meeting verbally, in writing, or by electronicmeans.Aschoolshallholdameetingrequestedunderthissubsectionwithinten(10)schooldaysof theparent’s request.The focusof any suchmeeting shall be todiscussproactivewaystopreventtheneedforemergencysafetyinterventionsandtoreduceincidentsinthefuture.ForastudentwhohasanIEPoraSection504plan,suchstudent’sIEPteamorsection504plan team shall discuss the incident and consider the need to conduct a functionalbehavioral analysis, develop a behavior intervention plan or amend either if already inexistence.Forastudentwithasection504plan,suchstudent’ssection504planteamshalldiscussandconsidertheneedforanevaluationunderthespecialeducationforexceptionalchildrenact,K.S.A.72-961etseq.,andamendmentsthereto.ForstudentswhohaveanIEPprogramandareplacedinaprivateschoolbyaparent,ameetingcalledshall includetheparentandtheprivateschool,whoshallconsiderwhethertheparentshouldrequestanIEPteammeeting. If the parent requests an IEP teammeeting, the private school shall helpfacilitatesuchmeeting.For thestudentwhodoesnothavean individualeducationprogram(IEP)orsection504plan,theparentandschoolshalldiscusstheincidentandconsidertheappropriatenessofareferral for an evaluation under the special education for exceptional children act, K.S.A.72961et.seq.,andamendmentsthereto,theneedforafunctionalbehavioralanalysisortheneed for a behavior intervention plan. Any meeting called shall include the student’sparents, a school administrator for the school where the student attends, one of thestudent’s teachers, a school employee involved in the incident and such other schoolemployeesdesignatedbytheschooladministratorasappropriateforsuchmeeting.Theparentshalldeterminewhetherthestudentshallbeinvitedtoanymeetingcalled.Thetimeforcallingsuchameetingmaybeextendedbeyondthe10schooldaylimitiftheparentofthestudentisunabletoattendwithinthattimeperiod. Nothinginthissectionshallbeconstrued to prohibit the development and implementation of a functional behaviorassessmentorabehavior interventionplan foranystudent if suchstudentwouldbenefitfromsuchresources.LocalDisputeResolutionProcessIfaparentbelievesthatanemergencysafetyinterventionhasbeenusedontheparent’schildinviolationofstatelaworboardpolicy,theparentmayfileacomplaintasspecifiedbelow.TheBoardofEducationencouragesparentstoattempttoresolveissuesrelatingtotheuseofESIinformallywiththebuildingprincipaland/orsuperintendentbeforefilingaformalcomplaintwiththeBoard.Onceaninformalcomplaintisreceived,theadministratorhandlingsuchcomplaintshallinvestigatesuchmatter,asdeemedappropriatebytheadministrator.Intheeventthatthecomplaintisresolvedinformally,theadministrator

mustprovideawrittenreportoftheinformalresolutiontothesuperintendentandtheparentsandretainacopyofthereportattheschool.Thesuperintendentwillsharetheinformalresolutionwiththeboardofeducationandprovideacopytothestatedepartmentofeducation.Iftheissuesarenotresolvedinformallywiththebuildingprincipaland/orsuperintendent,theparentsmaysubmitaformalwrittencomplainttotheboardofeducationbyprovidingacopyofthecomplaintwiththeclerkoftheboardandthesuperintendentwithin30daysofthedateonwhichtheparentwasinformedoftheuseoftheemergencysafetyintervention.Uponreceiptofaformalwrittencomplaint,theboardpresidentshallassignaninvestigatortoreviewthecomplaintandreportfindingstotheboardasawhole.Suchinvestigatormaybeaboardmember,aschooladministratorselectedbytheboard,oraboardattorney.SuchinvestigatorshallbeinformedoftheobligationtomaintainconfidentialityofstudentrecordsandshallreportthefindingsandrecommendationactiontotheboardinexecutivesessionAnysuchinvestigationmustbecompletedwithinthirty(30)daysofreceiptoftheformalwrittencomplaintbytheboardclerkandsuperintendent. Onorbeforethe30thdayafterreceipt of the written complaint, the board shall adopt written findings of fact and, ifnecessary, appropriate corrective action. A copy of the written findings of fact and anycorrectiveactionadoptedbytheboardshallonlybeprovidedtotheparents,theschoolandthe state department of education and shall be mailed to the parents and the statedepartmentwithinthirty(30)daysoftheboard’sreceiptoftheformalcomplaint.Ifdesired,aparentmayfileacomplaintunderthestateboardofeducationadministrativereviewprocesswithinthirty(30)daysfromthedateafinaldecisionisissuedpursuanttothelocaldisputeresolutionprocess.
