ALERT: TOWN Of CHAPEL HILL NORTHSIDE AND PINE KNOLLS NEIGHBORHOOD STAff PLAN PROPOSES PROP & OTHER OVER-REACHING REGULATIONS! The Council considered a report detailing staff activities underway in the Northside and Pine Knolls neighborhoods associated with student rental development and the development of a response to the Northside and Pine Knolls temporary moratorium. A Public Hearing is scheduled for November 21, 2011, to consider the Northside and Pine Knolls Community Plan, a result of these efforts. The Community Plan includes Land Use Management Ordinance Text Amendment proposals designed to eliminate the development of accessory structures and the subdivision of property, establishes a 4-vehicle maximum per single family property for the Northside Neighborhood Conservation District and may add an annual affordable housing fee to the tax bill for houses at a certain value level.

TOWN Of CARY’S TRANSPORTATION DEVELOPMENT fEE AND ADEqUATE PUBLIC fACILITIES ROAD ORDINANCES White and Smith Planning and Law Group held a Focus Group meeting on September 29, 2011 with members of the Development Community in response to a Town of Cary request for com-ments regarding the Town of Cary’s Transportation Development Fee and Adequate Public Facilities Road Ordinances. Following is a summary of that meeting: Mr. Mark Smith opened the meeting with the following overview:• Effort somewhat unique because most studies performed for municipalities looking to adopt a new ordinance.• Town’s existing ordinance complicated with 20 years of precedence.• Town’s existing ordinance aggressive with timelines.• Staff’s direction to evaluate how to streamline and make more predictable.During the Q&A session, there were significant discussions on the challenges associated with working with the current ordinances. Several common themes or recommendations for improvement included:• Change the TIA procurement process to allow the developer to retain a qualified traffic consultant to perform the TIA with

review by one of the Town’s on-call traffic consultants.Thought process was to remove the “lack of trust” barrier and streamline the process similar to the City of Durham.• Re-build trust with more transparency and consistency throughout the developer’s agreement process.• Overhaul the reimbursement policy so that developers can re-capture costs associated with the Town’s vision for future roadway sections.• Push for Town facilitated developer agreements for off-site improvements to avoid the “1st come” or “last in” approach where a developer with 20% traffic pays 80% of costs.The consultant’s next step is to prepare recommendations by the end of October for the Council’s review at a work session on November 15th.

CITY Of RALEIGH RENTAL REGISTRATION AND PROBATIONARY RENTAL OCCUPANCY PERMIT (PROP) PROGRAM UPDATE As Raleigh owners/operators plan 2012 budgets, due to the significant legislative victory known as Senate Bill 683, owners/operators in the City of Raleigh no longer have to budget $30 first rental unit and $10 for each additional on the same parcel. The new law limits rental registration fees to a maximum of $50 for properties that have 20 or more rental units; $25.00 for properties that have 4 to 19 units; and $15 for properties with three or less units. Under Senate Bill 683, the City’s PROP ordinance has not changed. Please continue to operate a zero-tolerance policy when handling nuisance and criminal activity on your property. There are a number of ways a rental property can become eligible for PROP. Some examples are:1. Going past the deadline on a minimum housing case, or zoning case;2. Having four (4) violations (public nuisance’s or housing) within a two (2) year period;3. Three (3) noise/party citations/convictions;4. Violation of zoning density. PROP and Rental Registration are two different programs. PROP applies to “problem” rental properties, while rental registration applies to all rental properties in Raleigh. Project your rental property by using the PROP Lease Addendum, exclusively available to TAA members. The addendum is another tool to alert and educate your residents about the PROP program. TOWN MANAGER PITCHES NEW BUDGET PROCESS fOR CHAPEL HILLChapelboro.com | Elizabeth Friend Reporting As if a sluggish economy, rising unemployment and falling property values aren’t enough to worry Chapel Hill residents, Town Manager Roger Stancil says there are three looming issues that could squeeze taxpayer wallets in the coming years. “The annual operating cost for the expanded library: about a penny on the tax rate. The funding for street construction and improvements: about $600,000.... The estimate at this point as to chang-ing where we take our garbage: roughly another penny in the tax rate. So just from where I’m sitting today, you’re looking at three cents on the tax rate just to keep your head above water.” Stancil outlined the financial challenges facing Chapel Hill during a presentation to the town council Monday night. He estimates the council will either need to consider raising taxes or cutting $2 million dollars worth of town services to balance the 2012-2013 budget. Last year the council voted to use money from the town’s reserve fund to cover a $1.1 million dollar deficit, but Stancil said as the economic downturn drags on, that strategy be-comes less and less sustainable. Instead, he’s proposing a radical change to the way town leaders manage money, called “priority budgeting.” “Priority budgeting is an alternative to incremental budgeting, which is what we normally do when we think about continuing the same services and we talk about how much more we need to accomplish those services,” explained Stancil. “It’s intended to be based on how services are valued by the community and facilitates decision making when resources are scarce, as they continue to be.” The new process will create a two-year budget cycle that’s driven by community input and a realistic assessment of town revenues. “We’ll first start trying to project revenues and begin with those resources rather than beginning with the cost of what it takes to run a department,” said Stancil. “Hopefully this will encourage us to invest in the most important things for the com-munity, and if we have to cut back it will be those priorities that are not as high.” Council members applauded the new approach. “I totally support this process,” said Gene Pease. “This is transformative, a major change in how we’re thinking about moving forward for the town. In my opinion there’s no other way to go about it.”

Stancil will deliver another update on the town’s economic condition in November. Elected officials will begin work on the new budget process at a council planning retreat in February.

TAA IN ACTIONTAA Meets with Congresswoman Renee Ellmers (NC-02) On September 27, TAA Government Affairs Committee Members met with Congresswoman Renee Ellmers (NC-02) at her Dunn District Office during a Congressional recess. Congresswoman Ellmers graciously gave us more than forty-five minutes of her time. The time allotted gave us

an opportunity to familiarize Congresswoman Ellmers with the apartment industry as well as discuss priority national issues the industry faces such as a tax increase on carried interest, urging lawmakers to enact a more balanced housing policy, one that respects the rights of individuals to choose housing that best meets their financial and lifestyle needs and GSE reform that includes a federal guarantee for multifamily mortgages. TAA looks forward to meeting with Congresswoman Ellmers and other Congressional Members at the NAA Capitol Conference if not sooner.

CREDIT SCORE DISCLOSURE OBLIGATION As of July 21, 2011 a firm using a “credit score” in the rental screening process that takes an adverse action against a rental applicant may have a new disclosure obligation. The Dodd-Frank Wall Street Reform law (P.L. 111-209) expanded the Fair Credit Reporting Act’s adverse action notice requirements to include the disclosure of the credit score.

The term “credit score” is defined in statute and is generally limited to those scores used in the loan application process. If you or your resident

screening service provider use a credit score and take an adverse action, you must comply with this new notice requirement. Importantly, if you or your resident screening company does not use a credit score as defined, but use a scoring model specific to the rental decision, i.e., one not used in the loan process, then it is likely that you will have no additional notice obligations.

UPDATE ON POOL DRAINS: DEfINITION Of “UNBLOCKABLE DRAIN” IS REVOKED The Consumer Product Safety Commission (CPSC) has revoked its interpretation of an “unblockable drain” in complying with the requirements of the Virginia Graeme Baker Pool and Spa Safety Act (VGBA). This new interpretation may impact some apartment pool operators. The VGBA requires pool operators to install new anti-entrapment drain covers on all public pools. When a pool has a single main drain, other than an “unblockable drain,” the law requires additional layers of protection such as an automatic pump shut-off or a gravity drainage system. Prior to this change, the CPSC sometimes permitted the use of large drain covers installed on small single main drains to satisfy the requirements, eliminating the need for secondary anti-entrapment devices. The CPSC has now reversed its position. Now CPSC guidance will be amended to state: “placing a removable unblockable drain cover over a blockable drain shall not constitute an unblock-able drain.” CPSC does not plan to enforce this change before May 28, 2012. It will seek comments from pool operators regarding their ability to comply by this date.

APARTMENT INDUSTRY WANTS NEW JOBS ACT TO PROTECT INDUSTRY Digested From “Apartment Industry Wants Obama’s Jobs Act to Better Protect Rental Industry” | World Property Channel by David Barley The National Apartment Association (NAA) and the National Multi Housing Council (NMHC) are calling on Capitol Hill lawmakers to protect rental housing as they tackle the jobs bill recently proposed by the White House. The proposal would increase the tax on carried interest as a way to pay for the bill’s initiatives, and an increase in the tax on carried interest would be detrimental to real estate partnerships, say the groups.

The proposed tax increase would not only increase housing costs for new developments, but also would decrease the supply that makes deals financially viable. Causing a decline in rental housing supply at a time when demand is on the rise and supply is short is foolhardy, they say. The groups also indicate that the changes in the jobs bill would eliminate jobs and depress income for cities and counties. “The apartment industry supports sound economic policy that helps restore job growth, but a tax increase on carried interest is bad for our economy and bad for our housing supply,” notes Cindy Vosper Chetti, NMHC/NAA Senior Vice President for Government Affairs.

HUD ISSUES PROPOSED 2012 fAIR MARKET RENTS The U.S. Department of Housing and Urban Development (HUD) has issued its proposed FY 2012 Fair Market Rents (FMR), and there are significant changes in FMRs in almost all areas. Specifically, HUD is using the new five-year 2005-2009 data from the American Community Survey (ACS). This is the first time five-year estimates have been available. However, because it is based on data ending in 2009, a weak recessionary year, it has resulted in artificially low rents in many areas. According to one estimate, the FY 2012 FMRs are lower than FY 2011 rents in approxi-mately 70 percent of U.S. counties. A number of metro areas also record double-digit increases. The changes are particularly extreme in areas with relatively small populations. While the methodology used by HUD for the new FMRs appears to be sound, and the move to more accurate five-year estimates is encouraged, the wide variations in rents from one year to another will have an adverse effect on many local housing agencies and private property owners who participate in the Section 8 program. NAA/NMHC and a coalition of organizations submitted comments to HUD recommending the Department setting a floor of 5 percent on FMR decreases to mitigate the impact of moving to the new data source. SAfETY ALERT: fIRE SPRINKLER ANTIfREEzE The National Fire Protection Association (NFPA) in 2010 issued a safety alert regarding fire sprinkler systems containing antifreeze. Antifreeze is used in sprinkler systems that are subject to freezing. NFPA has removed its requirement that all antifreeze be removed from

sprinkler systems. It does have specific require-ments for NFPA 13D systems. 13R systems, typically installed in apartment buildings up to four stories in height, are required to comply with the antifreeze requirements contained in NFPA 13. NFPA recommends considering alternatives to antifreeze, using the minimum necessary concentration of antifreeze and having the system tested by a qualified individual.

EPA ENERGY STAR RATING ESTABLISHED fOR HIGH-RISES EPA has announced an Energy Star rating for multifamily high-rise buildings; prior ratings were for low-rise properties only. The designa-tion may be applied to new and substantially renovated properties that meet specific criteria, notably that they are designed to be at least 15 percent more energy efficient than ASHRAE Standard 90.1-2007.

The program differs significantly from the Energy Star rating system that is available to commercial properties. There are two paths to earning the Energy Star designation: developers may choose a prescriptive package devel-oped by EPA or a customized approach using ASHRAE-approved energy modeling software. Dr. Miller’s Current Project, The Efficacy of Bed Bug Management Products and Strategies. Virginia Tech is currently one of two universities in the nation that is rearing bed bugs for research. The liability issues associated with bed bug presence have already resulted in hundreds of thousands of dollars being awarded to people who have been bitten by bed bugs. Dr. Miller’s research has focused on evaluating the efficacy products labeled for bed bug control and those that have potential as a bed bug management tools. Bed Bugs have become a major problem with the multifamily industry. What began as a few scattered reports in the 1990s became a full-blown epidemic in 2005. Because bed bugs have not been a problem for over 40 years, rela-tively few pesticides are labeled for their control, and none have been evaluated for efficacy. State law requires political committees to report the name, mailing address, occupation and name of employer for each individual whose contribution aggregate is in excess of $50 in a calendar year. A qUESTION Of EVIDENCE Naturally, property managers cannot be everywhere at once to witness poor conduct by residents. Thus, a property manager’s knowledge of events is often learned second-hand, courtesy of the complaining residents – who sometimes make verbal complaints by telephone, more passionate and detailed ones in writing. Whether the information is received orally or in writing (note: whether the writing is notarized or not is really ir-relevant), such second-hand knowledge is usually referred to as hearsay. In the legal world, hearsay is usually inadmissible in a court of law, as it is considered inherently unreliable. Similarly, police reports alone do not a crime make. In fact, law enforcement officers are often the most common purveyors of hearsay: they usually show up when the conduct in question is long over, and as such, virtually their entire report is made up of second-hand evidence gleaned from wit-nesses who actually saw or heard something. Given these realities, an eviction lawsuit based on resident’s mere written statements or oral complaints – or one based purely on a

police report – can be one doomed to failure. Put another way, you cannot do this alone. Even if you hire an attorney to represent you in the eviction lawsuit, that lawsuit is also subject to failure without sufficient evidence from eyewitnesses: your residents.

“…BUT I DON’T WANT TO GET INVOLVED.” This is perhaps the most common refrain sung by residents, and it is the most unfortu-nate. The truth of the matter is simple: they are already involved – inextricably, unavoid-ably, absolutely. By virtue of being a witness to specific events in the community, they instantly become the only true source of information for a court to consider, other than a blatant admission by the resident you are seeking to evict (and how often will that happen?). When they share this information with you, you then have a duty to act to protect their rights and to enforce the lease agreement against the resident who is violating that lease. They, in turn, would have a duty to ap-pear in court and tell the judge the very same

items of information shared with you. Having a “victim resident” in court to testify is absolutely essential for not only evidentiary reasons but also for psychologi-cal ones as well. Assume for a moment that hearsay is not a concern and that the judge somehow allows you to testify about things for which you have no firsthand knowledge (this will probably not happen, of course, but let’s pretend you could actually get away with it). This places you in the position of presenting a case where the landlord is attempting to evict a resident for being too “noisy” or “bothering others.” To you and me this information may seem earthshaking and vital. To another person such a magis-trate, it may come across as anal-retentive and overly picky, not valid reasons to evict someone from their home. Now let’s imagine the same situation with the “victim resident” testifying on your behalf. They could inform the court of how the actions of the neighbor has interfered with their ability to live in your community; how noise or other nuisances have ruined their sleep patterns; created increased stress to the point that they cannot stand to live in

I It is a constant fact of a property manager’s life: residents will have complaints about their neighbors. Some complaints are about loud music or televisions; others involve reports of boisterous children or reporting disturbing domestic disputes; still others may allege criminal activity. I suppose one can argue that, in some places close neighbors may result in close friendships—while in others, closeness sometimes breeds contempt. It is also a constant that these contemptuous neighbors always seem to look towards you, the property manager, for assistance. How convenient!

At times like these, you may feel like a surrogate parent looking after hundreds of children who appear, quite suspiciously, to be grown adults. They make complaints. They point fingers. They demand you take them at their word and take action to protect them. Quite possibly, you may have to resist the compulsion to pat them on the head and tell them that everything will be alright. If only you could wield such power. The hard truth is: you cannot. They can.

their apartment any longer and have consid-ered moving out just to escape this horrible neighbor; and in criminal activity cases, how they witnessed the neighbor engaged in a criminal act of some kind. That kind of testimony can have a powerful psychological effect on a presiding magistrate judge. In the space of a few short minutes, the case has transformed itself from a landlord nitpicking a resident to death to one of the wonderfully proactive, heroic landlord coming to the aid of a resident in need, a resident victimized by the acts of an inconsider-ate, nuisance-causing neighbor – a neighbor who has breached the lease; a neighbor who, in short, should be evicted. The result of such testimony is a far higher chance of winning the eviction case and solving the root problem of evicting the problem resident. Thus, any debate of whether or not a complaining resident should get “involved” is a quick one: they absolutely should be willing to testify, even if you have to arrange to subpoena them to court as witnesses.

THE POWER TO fIX THE PROBLEM IS THEIRS, NOT YOURS Based on the above, you now understand that full cooperation from the complaining resident is essential. Without court testimony, it is a difficult and sometimes improbable task to win any eviction lawsuit for any reason other than nonpayment of rent. Thus, you may well decide that unless you obtain the cooperation of the victim, it is not worth pursing an eviction at all. . . . and perhaps you should tell the resident just that: no cooperation equals no eviction. Unfortunately, some over-demanding, perhaps irrational residents will then demand to be al-lowed out of their lease, alleging that they can no longer tolerate the living conditions in which they find themselves. In truth, this is nothing but a blatant attempt to transfer the heavy burden of doing the right thing back onto your

shoulders. Resist the urge to give in. Instead, when faced with this situation, you could return the volley back to the resident’s court and say something like this: “No sir. No ma’am. I will not agree to let you out of your lease due to the constant disturbances, the criminal activity, and/or the nuisances you bring to my attention. You had the opportunity to help me help you, and you refused to cooperate and come to court to testify against your neighbor. It is disingenu-ous and hypocritical to say that I am somehow a bad landlord or that I am not making this a better place to live, when you and you alone had the power to allow me to correct the situa-tion, but you avoided it out of fear of retaliation or embarrassment. If you would only change your mind and agree to testify in court, I would move as quickly as possible to file an eviction against your neighbor. Until that happens, I will not do so.”THE BOTTOM LINE Granted, these are strong words, and they may very likely provoke an equally strong reac-tion. They may even result in a sharply worded letter from an attorney on behalf of the victim resident claiming that you have somehow failed in your duties to make the community a fit and habitable place to live (sheer nonsense, in my opinion). However, so long as you have made

it clear that you stand ready and willing to file an eviction to enforce the lease, you transfer the burden – the power, if you will – to the victim resident to do the right thing. Perhaps one of the harder lessons for a property manager to realize is that you cannot solve all of your community’s issues by yourself. The residents are part of the fabric of your neighborhood, and in many ways, they are its lifeblood and its soul. As such, they have a vested interest in making it a better place to live. In Poor Richard’s Almanac, Benjamin Franklin stated that “God helps those who help themselves.” Until that happens, don’t attempt to carry the water all by yourself.

The Triangle Apartment Association participated in North Carolina Central University’s Fall Career Fair held on October 6, 2011 in Durham. The NAA Government Affairs department has drafted a model residential rental property inspections ordinance in response to an increasing number of rental housing inspections ordinances adopted in localities and municipalities that unduly punish owners, operators and residents of safe, professionally managed and code-compliant residential rental properties.

This model ordinance is provided as an example of language that may be used to promote the interests of rental housing providers in deliberations with lawmakers and other interested parties on issues concerning rental housing inspections programs. NAA members and affiliate associations who wish to use this model are encouraged to amend it to meet their unique needs.

Dr. Miller’s Current Project–The Efficacy of Bed Bug Management Products and Strategies

Virginia Tech is currently one of two universities in the nation that is rearing bed bugs for research. The liability issues associated with bed bug presence have already resulted in hundreds of thousands of dollars being awarded to people who have been bitten by bed bugs. Dr. Miller’s research has focused on evaluating the efficacy products labeled for bed bug control and those that have potential as a bed bug management tools.

Bed Bugs have become a major problem with the multifamily industry. What began as a few scattered reports in the 1990s, became a full-blown epidemic in 2005. Because bed bugs have not been a problem for over 40 years, relatively few pesticides are labeled for their control, and none have been evaluated for efficacy.

Dr. Dini Miller, Ph. D. is the Urban Pest Management specialist for the state of Virginia. The urban pest management position is predominantly extension with additional research and teach-ing responsibilities. The urban pest management extension program focuses on promoting the adoption of integrated pest management (IPM) techniques to control arthropod pests in structures. Dr. Miller also is a co-instructor for the Urban and

Public Health Entomology (UPHE) course at Virginia Tech. Her current research projects include; bed bug biology; the efficacy of bed bug management and strategies, IPM techniques for control of cockroaches, ants and subterranean termites, and the cost/benefit analysis of IPM in Virginia public housing. TAA hosted the 4th Annual Maintenance Mania event on Wednesday, October 12, 2011 at Heaven & Earth Landscaping in Raleigh. Maintenance Mania is a national competition where maintenance technicians compete against each other in various skill-based games. The games are focused on frequent maintenance issues, plus a pinewood derby style car race where the cars are made out of maintenance supplies! Winners received awards, prizes, bragging rights and a chance to compete in the National Championship at the 2012 NAA Education Conference in Boston, MA.

Jim Carrington is the President/Owner of Carrington Contracting, Inc. They perform exterior renovations within the Apartment Industry. Renovations that include exterior paint-ing, wood replacement, roofing, pressure cleaning, drainage, concrete, vinyl and hardi installations. Jim says, “since our com-pany’s inception, we have always placed an emphasis on quality workmanship, customer satisfaction, and job performance.” They have been servicing the Triangle Area and have been a member of TAA for over 15 years. The company’s goal is to build successful working relationships and have customers for life. Jim feels that their relationship with TAA has been priceless. They have been able to establish many successful, lasting relation-ships through TAA. As a bonus they feel that they also have also developed many personal friendships. Jim has been affiliated with the apartment industry for 20+ years. Jim currently serves on the TAA Products & Services Com-mittee and Craig Jackson, General Manager, is active on the Government Affairs Committee.

Jackie Kilby is an Account Manager for Ecoscape Solutions Group which

is a full service landscaping company.

Ecoscape offers a wide range of landscaping & maintenance services for

both commercial & residential customers. They have a portfolio of landscape

services addressing virtually every possible requirement a client may have. In

the case of an established landscape, they will review all aspects of a client’s

current plan and determine if it still works to maximize their landscape’s

potential. The staff has deep knowledge and expertise of landscape services

gained from decades of experience. The following are the core services they offer:

landscape maintenance, hardscaping, irrigation design and installa-

tion, landscape design and installation, low voltage lighting, site work

services, eco-friendly consulting & services and seasonal lawn care.

Jackie feels that their relationship with TAA is very valuable. They currently do

business with members of the Greater Charlotte Apartment Association and hope

to develop strong relationships here in the Triangle Apartment Association.

Jackie has been with the Ecoscape for two months and has been affiliated

with the Apartment Industry for 8 years. She currently serves on the Product &

Services Committee.
