Gardner Leader

Jo Tedd at Gardner Leader solicitor’s talksabout the media “hype” surroundingpoints made in the family justice reportand the Queens speech, emphasising thatfamilies considering separation shouldtake expert advice to be sure of what istrue and not just media spin.

There has been a lot written in the media overthe past six months regarding proposedchanges to Family Law and how this impactson separating couples. However, how muchof this is actually new information?

The headlines made reference to “DIYDivorces – couples to be able to divorce online”. This is not a new development – onlinedivorces have been around for a long time,and couples have actually always been ableto do their own divorces. However, mostpeople choose to take expert legal advice toresolve not just the divorce but also issuesregarding their children and finances.

There was also reference to couples havingto attend mediation to settle disputes. Again,this is something that has been available for

many years and is not a new principle. The ideaof couples attending mediation to resolve theirdifferences as amicably (and cheaply) as possibleis one that all at Gardner Leader (and most otherfamily solicitors) advocates strongly. Weencourage clients to take this step before rushingoff to Court and engaging in expensive andacrimonious litigation. In fact, in a lot of familycases that are brought to Court, the Judgesencourage mediation at an early stage.

The Government is seeking to ensure that childrenretain a relationship with both parents (provided ofcourse, it is in the child’s best interests). Again,this is not a new principle or major change as mostsolicitors subscribe to this in their day to daypractice. In the past, it has been suggested thatthere should be an emphasis on “equal parenting”so that children spend an equal amount of timewith each parent, but in many cases this is notpractical or in the best interests of the child, andthe recent reports do not go as far as this. Allcases regarding children are, and always havebeen, decided on the individual facts of the caseand the “welfare of the child is paramount”.

There are changes relating to the Adoption Rules,and this appears to be a more common senseapproach to adoption – the priority will be to find ahome for a needy child with less emphasis onracial considerations.

There may be other changes that come about as aresult of the Family Justice Report or the Childrenand Families Bill that is proposed by theGovernment – no doubt, there will be emotive andsensational headlines in the media, and thereforeit is important that families considering separationtake expert advice to be sure of what is true andwhat is “hype”!

A lawn is an essential part ofmost gardens, but how can youmake sure yours looks good?

Feeding a lawn is essential to ensure itlooks lush and green. Feeding keeps thegrasses growing vigorously enough tohelp keep out moss and weed growth. Apoorly maintained and inadequately fedlawn is far more likely to be invaded bymoss or weeds and is prone to disease.Choose a lawn fertilizer formulated forthe specific needs of the grass at anytime of year; nitrogen is often in shortsupply, largely because it is so importantin the formation of the grass and, as thisis constantly being removed by mowing,it is necessary to replace it.

There are also many other nutrients, inparticular phosphorus, potassium andiron which help to promote and maintaintop quality growth. The precise amountof fertilizer that your lawn requires isdetermined by many factors includingsoil type, frequency of irrigation orrainfall, frequency of mowing andwhether clippings are left on the lawn.

If your lawn has a weed problem andyou’re happy using chemicals, it’seasiest to use a product containing bothweed killers (usually two different ones toprovide best overall control) and afertilizer. Applying these togetherensures rapid grass growth to fill in thegaps left by the dead weeds. If you havetime, there is a marginally better effect if

you feed the lawn with feed -then wait acouple of weeks before applying theweed killer. Small infestations of weedscan be removed effectively by hand,using a daisy grubber or even an oldkitchen knife.

A proprietary moss killer should takecare of the moss, but follow theinstructions carefully to ensure that themosses have been thoroughly killedbefore you attempt to rake them out. Ifliving moss is raked out the problembecomes worse. It’s worth rememberingthat once the moss is dead the lawn willlook worse than when the moss wasalive. Once you have raked the deadmoss out, the overall effect is evenworse - all the bare patches may makeyou despair, but if you keep the lawn wellfed, or if necessary over-seed the worstlooking areas as well, it will soon greenup.

Regular mowing is essential. A lawnwhich is left for too long before the grassis cut will soon lose its good, greenappearance and when it’s finally cut, youmay well wonder if it will ever look rightagain. If cut frequently, so that only smallamounts of grass are removed at anyone time, it should grow dense andgreen. As a rule, you should try toremove up to 30% of the grass growth at

a single mowing. As the weather startsto warm up, the frequency of cut will benoticeably greater and with the onsetof summer the rate increases rapidlyagain. However, if the weather is dryand lawn isn’t well watered, growth ratewill be correspondingly slow. If thegrass is tobe well walked on or used aplaying surface then the cut should bekept to ¾ - 1 inch. If you want a reallysmart lawn for show that isn’t subjectedto pounding feet, then keep the grass to¼ inch or slightly longer, but rememberthat to achieve this during summer youwill need to use the mower severaltimes a week - another good reason forkeeping a more low-key lawn!What about mowers? The range seemsto be ever increasing and the one youchoose will probably be determined bycost as well as the job you want yourmachine to do. If you have a level, fairly

high-quality lawn then a cylinder moweris best, as it tends to give a betterquality cut. If the surface of your lawn isthe slightest bit uneven then a rotarymower is a better choice as it will copemuch better in ‘adverse’ situations and,in most cases the cut it gives isperfectly adequate. If you remove a fairamount of grass at each cut then theclippings should definitely be raked upimmediately. However, if you cut thelawn regularly and produce only tinyclippings then, particularly during verydry weather, there may be someadvantage to leaving them on the lawnwhere they can act like a mulch andhelp to conserve soil moisture.

Being a mother herself, KarenHolland knows how important it isto teach children to swim properlywith both enjoyment and confi-dence. She has taught swimming,with the help of her fully qualifiedteachers, to literally hundreds ofchildren over the last fifteenyears.

The success of Waterworld SwimSchool, Karen believes, is a resultof a careful monitoring scheme.One stroke at a time is taught -this ensures every child works at

his or hers own speed - buildingconfidence and skills soundly andsystematically and above all withfun. Fun is vital and key to suc-cess.

For the past seven years Karenhas held classes at Brockhurstand Marlston. Such has been thedemand that Karen has now ex-tended her classes to run an addi-tional session on Fridays. This isa new class which has becomevery popular.
