On July 9, 2015, Gov-ernor Greg Abbott announced the ap-pointment of six new board members and re-appointment of Kathy Leader-Horn, LVN for a second six-year term to the Texas Board of Nursing (BON). New appointees to BON included Diana Flores, MN, RN; Francis Stokes, BA; Allison Edwards, DrPH, MS, RN, CNE; and David E. Saucedo II, BA, whose terms ex-pire January 31, 2021. Governor Abbott also appointed Doris Jack-son, DHA, (ABD), MSN, RN; and Laura Disque, MN, RN to the Board for terms to expire January 31, 2017, and January 31, 2019, respectively.

Doris Jackson, DHA, (ABD), MSN, RN, of Pearland is a RN and is a professor for the associate degree nursing program at Lone Star College – Kingwood. She is a member of the Society of Pediatric Nurses, TNA, ANA, Texas Community College Teachers Association, and Student Nurse Association Faculty Advisor. Dr. Jackson received a bachelor of science and a master of science from Prairie View A&M University, and is pursuing a doctorate from Capella University.

Kathy Leader-Horn, LVN, of Granbury is a licensed vocational nurse and serves as school nurse for Parkway Elementary School in Crowley. She is a member of the National Federation of Li-censed Practical Nurses and participates in the Healthy Kids School Lunch and Operation School Supplies programs. David Saucedo II, BA, of El Paso is president of the Saucedo Lock Company, a 4th generation family business started in 1917. He serves as vice-president of the Boys and Girls Club of El Paso, board member of the El Paso Hispanic Chamber of Commerce, member of the Borderplex Alliance, and founding co-chair of the Circle of Giants for the El Paso Museum of History. Mr. Saucedo received a bachelor of business administration from the University of Notre Dame.

Francis Stokes, BA, of Port Aransas is a veteran of the U.S. Marine Corps and is a vice president at First Community Bank in Corpus Christi. He is chairman of the Port Aransas Recreational Development Corporation, member of the Port Aransas Veterans of Foreign Wars and the Na-tional Association of Government Guaranteed Lenders – Small Lender (West) Committee. Mr. Stokes received a bachelor of business administration from Texas A&M University, Kingsville.

These appointments are subject to Senate confirmation.

Nurse Licensure Compact Benefits ExplainedOn October 1, 2015, there will be 25 states participating in the Nurse Licensure Compact (NLC). The NLC provides professional mobility for nurses whose practice may cross the borders of one compact state to another compact state. Texas has been part of the NLC since January 1, 2000. In the next few issues of the Bulletin, the Board will answer questions commonly asked about the NLC.

Question: What does a travel nurse need to do to be eligible for multistate privileges on a license from any of the compact states?Answer: An essential component to secure multistate privileges is declaring a state of residence in a state participating in the NLC. Proof of Texas residency may include a Texas address on a Texas driver’s license; a voter registration card reflecting a Texas address; a federal income tax return declaring Texas as the state of residence; or a W-2 form indicating Texas as the state of residence. For military personnel, Military Form No. 2058 – state of legal residence certificate, reflecting Texas as the legal residence, will also serve as acceptable documentation of the residency requirements. In addition, the eligibility requirements for a Texas license are accessible in Licensure then Eligibility on the BON website. There is a Primary State of Residence Declaration Form in the Forms section of the BON website for nurses to fill out when declaring Texas as the state of residency.

Nursing Education Actions - July 2015 Board Meeting

At the regularly scheduled meeting of the Board of Nursing (BON or Board) held on July 23-24, 2015, the Board approved the repeal and simultaneous adoption of new: 22 Tex. Admin. Code §213.27, pertaining to Good Professional Character; §213.28, pertaining to Licensure of Persons with Criminal Offenses; §213.29, pertaining to Criteria and Procedure Regarding Intemperate Use and Lack of Fitness in Eligibility and Disciplinary Matters; §213.30, pertaining to Declaratory Order of Eligibility for Licensure; and §213.33, pertaining to Factors Considered for Imposition of Penalties/Sanctions.

The Board also approved amendments to: Eligibility and Disciplinary Sanctions for Nurses with Substance Abuse, Misuse, Substance Dependency, or other Substance Use Disorder; Disciplinary Sanctions for Fraud, Theft, and Deception; Disciplinary Sanctions for Lying and Falsification; Disciplinary Guidelines for Criminal Conduct; and

Guidelines for Physical and Psychological Evaluations. Amendments to the Guidelines and Sanctions were published as adopted in the August 28, 2015 issue of the Texas Register.

In an effort to maintain consistency among the Board’s eligibility and disciplinary policies, guidelines, and rules, the BON Eligibility and Disciplinary Advisory Committee (EDAC) reviewed Board Rules 213.27, 213.28, 213.29, 213.30, and 213.33 in conjunction with the Board’s eligibility and disciplinary sanction policies and criminal guidelines in meetings taking place from 2012 to 2015. The EDAC’s recommendations were adopted by the Board at its regularly scheduled July 2015 Board meeting. The proposed repeal and simultaneous adoption of new Rules 213.27, 213.28, 213.29, 213.30, and 213.33 were published in the August 28, 2015 issue of the Texas Register with the earliest effective date being September 27, 2015.

In the August 14, 2015 issue of the Texas Register, the Board published as adopted an amendment to §223.1, concerning Fees.

The amendment was adopted without changes to the proposed text as published in the June 26, 2015, issue of the Texas Register to meet funding requirements resulting from the 84th Texas Legislative Session. Senate Bill 195, enacted by the 84th Texas Legislature, became effective on September 1, 2015. The bill transfers the prescription monitoring program from the Department of Public Safety to the Texas State Board of Pharmacy. The bill authorizes the Texas State Board of Pharmacy to charge a fee to cover the cost of establishing and maintaining the program. Each agency that licenses individuals or entities to prescribe or dispense controlled substances is authorized to increase its occupational fees in order to generate sufficient revenue to support the operation of the program. The $15.00 fees that are generated are remitted to the Texas State Board of Pharmacy to support the funding of the program.

Disaster relief nursing can be both rewarding and challenging. Nurses working in disaster-stricken areas face unpredictable environments, scarce re-sources, and risks to physical and mental health.1 Disasters are commonly thought of in reference to catastrophic weather or seismic events. Bioterrorism shifted attention to the threat of widespread illness and disease due to the intentional release of bacteria, viruses, or other germs. With the Ebola outbreak of 2014, the threat included widespread illness and death due to infection with Ebola virus. Disasters resulting in injury and/or illness provide perfect opportunities for nurses to volunteer.

The Ebola outbreak of 2014 affected primarily three West African countries: Guinea, Liberia, and Sierra Leone. Over 12,000 people have died thus far, includ-ing more than 500 health care workers. The World Health Organization (WHO) reports the Outbreak of 2014 as the most significant health crisis in modern history.2 In response, the United States Agency for International Development (USAID) put out a call for Ebola response workers and hosted a database from which relief organizations could recruit volunteers.

I responded to the call and was selected by Partners in Health, a non-profit or-ganization based in Boston, Massachu-setts. As an Ebola response clinician, I provided care to patients in an Ebola Treatment Unit (ETU), a local govern-ment hospital, and an Ebola survivors’ clinic in Sierra Leone from February to April 2015.

After returning from Sierra Leone, I re-ceived several questions about how to volunteer as a disaster relief nurse in a foreign country. In the U.S., licensure to practice nursing is granted and regulated by state boards of nursing. All states have enacted a Nursing Practice Act (NPA), which guides and governs nursing practice.3 Since Texas is a member of the Nurse Licensure Compact, nurses who are licensed in Texas have the ability to practice in Texas plus 24 additional states.4 When working in a non-home compact (remote) state, nurses are held accountable to the NPA in the state in which the patient resides or where the practice occurs.4 But, what happens when a nurse practices as a disaster relief nurse outside of the U.S.?

The American Nurses Association (ANA) established guidelines for standards of practice in disaster relief nursing. The overarching principle is that no emer-gency changes the basic standards of practice, code of ethics, competence, or values of the nurse.5 The individual nurse is responsible for giving the best possible care to patients within the avail-able resources. The uniqueness of the disaster environment should guide the nurses’ adaptation of standards of care. A crosswalk of ANA standards with cor-responding Texas Administrative Code (TAC) standards [22 TAC §217.11(1)] re-sulted in the following emerging themes: competency, safety, appropriate care, and infection control (Table 1).6

Competency: Before traveling to a for-eign country as a disaster relief nurse, learn about the culture and the types of injuries, illnesses, or diseases you will likely encounter. To prepare for my work, I learned about the culture of the Sierra Leonean people and read the most cur-rent literature about Ebola and emerging treatments. In Sierra Leone, I attended a 5-day training program developed by WHO and provided in partnership with the International Office of Migration. The

training included classroom instruction about the pathophysiology of Ebola and current treatment protocols. The final two days of training included practice in a simulated ETU and competency check-offs on donning and doffing personal protective equipment (PPE).

Safety: Assessing the environment for safety concerns is a common practice for nurses in the U.S. At one of the gov-ernment hospitals in Sierra Leone, I per-formed a risk (safety) analysis. I assessed the nurses’ work areas, patient areas, storage areas (supplies, equipment, and medications), and the hospital grounds. Sharps containers were full, gloves were in short supply, handwashing stations were inadequate, and visitor access to patient areas was poorly controlled. The outside spaces were littered with trash and it was common to see stray dogs, goats, and ducks. The risk analysis provided opportunities to teach the local health care workers about patient and environmental safety.

Appropriate Care: The appropriateness of care during a disaster depends on many factors including the type of care needed to stabilize or improve health status, available resources, and cultural norms/practices. Providing appropri-ate care for patients with Ebola was challenging. The mantra in the ETU was “there is no emergency in Ebola.”

This translated to no fast movements and no resuscitation efforts; CPR could not be safely performed while wearing PPE and there was no equipment for advanced life support. Ebola treatment protocols were frequently modified due to direct observations of patient outcomes, the most basic foundation of evidence-based practice.7

Infection Control: The nurse should become familiar with the infectious pathogens and communicable condi-tions endemic to the area in which you plan to travel, and become familiar with all current infection prevention and con-trol measures. Ebola is spread through direct contact with an infected person, animal, or dead body. In Sierra Leone, close contact with others, such as hand-shaking and hugging, was discouraged. Infection control areas were commonly located at the entrance to stores in the city of Freetown, and at various screen-ing checkpoints along the roadways. These areas consisted of hand-washing stations and thermometers.

It is important to ensure personal im-munizations are up-to-date. The Centers for Disease Control provides a complete list of recommended immunizations for travelers by country.8 Proof of yellow fever vaccination was required in order to obtain a travel visa for Sierra Leone. And, due to the prevalence of malaria, all health care workers were encouraged to take medication for malaria prophylaxis and sleep under bed netting.

The legal ability to practice disaster relief nursing in a foreign country depends on the laws, rules, and/or regulations of the individual country. Interested nurses should consider volunteering with an established and reputable relief orga-nization; such organizations are likely to know the specific requirements per country and can assist with necessary travel documents. A current passport is essential. And, remember the basics of disaster relief nursing practice: com-petency, safety, appropriate care, and infection control. Taking care of these preliminary steps will allow the nurse to respond quickly to a call for disaster relief volunteer nurses.

HB 21 by Kyle Kacal. HB 21 is known as the “Right To Try Act.” Bill would allow use of an investi-gational drug which has successfully completed phase one of a clinical trial but has not yet been approved by the FDA for general use and remains in the clinical trial. A patient may receive an inves-tigational drug, biological product, or device, after signing an informed consent form and providing it to the manufacturer.

HB 495 by Donna Howard. Provides funds whereby the Texas Higher Education Coordinating Board (THECB) can award grant funds to nursing programs selected to carry out research that will benefit many nursing programs across Texas.

HB 1083 by Marisa Marquez. Prior to confine-ment of an inmate in administrative segregation, an appropriate medical or mental health care professional must perform a mental health as-sessment of the inmate.

HB 1595 by Andrew Murr. Allows for direct testing for infectious diseases of a person who is arrested, if their bodily fluids come in contact with a peace officer, magistrate, or correctional facility employee.

HB 1666 by Dennis Bonnen. Expands the Good Samaritan Law and extends immunity from liabil-ity to emergency and disaster volunteers during planning and training exercises.

HB 1670 by Susan King. Requires a hospital or birthing center to allow an obstetric patient (or spouse of patient if she is incapacitated or deceased) who is negative of infectious diseases to remove a placenta, without a court order and after signing an acknowledgement form unless a physician or hospital/birthing center policy requires a pathological examination.

HB 1878 by Jodie Laubenberg. Ensures Medicaid reimbursement to an authorized physician for telemedicine in a school-based setting and allows a health professional, such as a school nurse, to be present while the child receives telemedicine from a physician.

HB 2020 by Armando Martinez. Allows certified emergency medical technician-paramedics to provide advanced life support within a healthcare facility emergency department or urgent care clinical setting under the delegation and direct supervision of a licensed physician.

HB 2171 by J.D. Sheffield. Requires an individual’s parent, managing conservator or guardian to submit written or electronic consent to maintain that individual’s immunization information in ImmTrac before the individual is 18 years of age. Immunization information will now be stored until the individual is 26 years old unless the consent is withdrawn.

HB 2498 by John Zerwas. Allows for a licensing compact for emergency services personnel to cross state lines to provide care in non-declared states of emergency under an EMS personnel Licensure Interstate Compact.

HB 2574 by Eric Johnson. Requires that infor-mation on the danger of a heatstroke for a child left unattended in a motor vehicle be included among the information to be provided in the resource pamphlet that a hospital, birthing center, physician, nurse midwife, or midwife who provides prenatal care during gestation or at delivery to the infant’s mother, the father if possible, or another caregiver.

HB 2646 by Helen Giddings. Allows for release of medical or epidemiological information to governmental entities that provide first respond-ers who may respond to a situation involving a potential communicable disease of concern and need the information to properly respond or to a local health department for a designated monitoring period based on the potential risk.

HB 2696 by Donna Howard. Authorizes the Texas Center for Nursing Workforce Studies (TCNWS) to conduct a study on workplace violence against nurses in certain health care facilities.

HB 2697 by Rick Galindo III. Expands definition of continuing care in Health and Safety Code to include the furnishing of services to an individual in the individual’s residence which may increase demand for nursing care in home settings.

HB 2789 by Richard Raymond. Requires the Department of Aging and Disability Services to develop trauma-informed care training for new employees to complete before working directly with individuals with intellectual and developmental disabilities in state supported living centers and intermediate care facilities.

HB 3074 by Drew Springer. Requires modifica-tion of an advance directive form as it relates to administration of nutrition, hydration and life-sustaining treatment.

HB 3078 by Drew Darby. Creates an advisory committee of at least 16 members (including a representative from the Board of Nursing) to develop and recommend a uniform pre-nursing curriculum for undergraduate professional nurs-ing programs offered by institutions of higher education in Texas.

HB 3374 by Geanie Morrison. Requires health-care providers to provide information on Down's Syndrome to expectant parents when adminis-tering a test or diagnosing Down's Syndrome.

SB 66 by Juan Hinojosa. Requires the commis-sioner of the Texas Department of State Health Services, in consultation with the Commissioner of Education and an advisory committee com-posed of physicians with expertise in treating anaphylaxis and at least one registered nurse employed by a school district or open-enrollment charter school as a school nurse to adopt rules for school districts to keep unassigned epinephrine auto-injectors available on campus and at school events to treat anaphylaxis and have staff who are trained in how to recognize and respond to it.

SB 195 by Charles Schwertner. Transfers rulemak-

ing authority over the state’s prescription drug monitoring program and related duties from the Department of Public Safety (DPS) to the Texas State Board of Pharmacy (See page 3 for further information).

SB 239 by Charles Schwertner. Creates a student loan repayment program subject to legislative funding to be administered by the THECB to assist certain mental health professionals including APRNs with a nationally recognized certification in psychiatric/mental health nursing. THECB will post further information on the loan repayment program on their website at a later date.

SB 373 by Royce West. Requires hospitals to develop and implement a plan to address defi-ciencies that may have contributed to preventable adverse events.

SB 791 by Lois Kolkhorst. Requires hospitals, birthing centers, physicians, nurse midwives, or midwives who provide prenatal care to a pregnant woman during gestation or at delivery of an infant shall provide a resource pamphlet that includes information of the incidence of cytomegalovirus, birth defects caused by congenital cytomegalo-virus, and available resources for the family of an infant born with congenital cytomegalovirus.

SB 807 by Donna Campbell. State agencies that issue occupational licenses are required to waive the license application and examination fees paid to the state for applicants who are military service members or military veterans whose military service, training, or education substantially meets all of the requirements for the license or who are military service members, military veterans, or military spouses who hold a current license issued by another jurisdiction that has licensing requirements that are substantially equivalent to the requirements for the license in Texas.

SB 1128 by Judith Zaffirini. Amended Health and Safety Code 81.090, requiring physicians or other persons permitted by law to attend to a pregnant woman by taking a blood sample (no earlier than 28th week of pregnancy) to perform diagnostic testing including testing for syphilis. A physician or other person is required to obtain a blood sample of a child if a woman delivers a newborn child with no diagnostic test in prenatal records for syphilis and HIV.

SB 1235 by John Whitmire. Amends Section 168.001 of the Texas Occupations Code to define “operator” to include owner, medical director, or physician affiliated with pain management clinics in any capacity. SB 1235 also specifies that operating and owning a pain management clinic is engaged in the practice of medicine and includes, but is not limited to, all supervision and delegation activities related to the pain management clinic.

SB 1243 by Konni Burton. Amends the Texas Health and Safety Code to require the Department of State Health Services (DSHS) to establish a pilot program for the donation and redistribution of prescription medications in one or more mu-

SB 1462 by Royce West. Allows a person or organization acting under a standing order to store and distribute an opioid antagonist, provided they did not request or receive compensation. Emergency services person-nel are authorized to administer an opioid antagonist to a person who appears to be suffering an opioid related drug overdose, as clinically indicated.

SB 1753 by Donna Campbell. Requires hospitals to adopt a policy for health care providers who are providing direct patient care in the hospital to wear a visible photo identification badge that clearly states the type of license held by the provider. Hos-pitals are required to implement these new photo identification badge requirements by September 1, 2019.

Ms. Gallarzo is not licensed to practice professional nursing in the State of Texas; however, she used the name and RN license number belong-ing to a licensee with a similar name, but a different social security number who resides in the Hidalgo County area. In addition, the Board has received infor-mation that this individual has worked as a RN in DeWitt County, Victoria County, Goliad County, and Matagorda County. This case has been referred to the Victoria County District Attorney’s Office and the Goliad County District Attorney’s Office.

In 2013, the 83rd Texas Legislative Session passed a law that specifies new continuing education requirements for all nurses to complete at least 2 hours of continuing ed-ucation related to nursing jurisprudence and ethics before the end of every third, two-year licensing period. The Board’s workshop “Protecting Your Patients and Your Practice” and the online continuing nursing education (CNE) course “Nursing Regulations for Safe Practice” awards contact hours that will satisfy the new requirements for Nursing Jurisprudence and Ethics.
