1 Testimony of Ellen Lee Director of Community and Economic Development for the City of New Orleans presented to the United States House of Representatives Committee on Oversight and Reform Subcommittee on Civil Rights and Civil Liberties February 5, 2020 Chairman Raskin, Ranking Member Roy, and members of the Committee, thank you for the opportunity to testify before you today on the Affirmatively Furthering Fair Housing regulation. My name is Ellen Lee, and I am the Director of Economic and Community Development for the City of New Orleans. On behalf of the City of New Orleans, I commend your Committee’s leadership in undertaking this important issue. The issue of Fair Housing is a longstanding and essential part of creating neighborhoods of opportunity and economic mobility for our nation’s residents and the generations to come. We appreciate your willingness to hear about the New Orleans experience in the context of the current regulatory environment. The U.S. Department of Housing and Urban Development (HUD) 2015 regulation provided new and updated guidance as well as data tools for jurisdictions to use in the production of an Assessment of Fair Housing, or AFH. The AFH is a document that complements the Consolidated Plan, a federally required five year plan that all HUD entitlement jurisdictions submit, and which we have always been required to submit. The 2015 regulation operationalizes Title VIII of the 1968 Civil Rights Act, otherwise known as the Fair Housing Act. Through the 1968 provision that focused on Affirmatively Furthering Fair Housing, Congress directed HUD to make sure that neither the agency itself, nor the cities, counties, states and public housing agencies it funds, discriminate in their programs. Further, Congress intended that HUD programs be used to expand housing choices and help make all neighborhoods places of opportunity, providing their residents with access to the community assets and resources they need to flourish. In other words, while the Fair Housing Act directs jurisdictions like ours not only to refrain from outright discrimination, it also directs us to spend our funds in order to decrease segregation and improve housing access and opportunities for everyone. In July 2015, HUD issued a new regulation to implement the affirmatively furthering fair housing requirements of the Fair Housing Act. With this new rule, HUD provided its program participants (states, counties, municipalities and public housing

agencies)withmoreeffectivemeans—thedataandwrittenguidance--tofurtherthepurposesandpoliciesoftheFairHousingAct.JurisdictionsthatreceivefederalHUDfundshavealwaysbeenrequiredtosubmitthisessentialplanningdocument,whichwascalledanAnalysisofImpedimentstoFairHousingChoiceunderthepreviousregulations.However,the2015regulationbroughtanissuanceofnewtools,newdata,andnewspecificguidanceofhowHUDwantedentitlementjurisdictionstoupholdthelaw.NewOrleanswasoneofthefirstjurisdictionsinthecountrytoimplementthe2015regulation.Allofthejurisdictionsonourfive-yearcyclewererequiredtosubmitatthesametime,withsomeexceptionsforsmallerjurisdictionsandthoserequiringadditionaltime.TheNewOrleansexperienceimplementingthisnewregulationwasoverwhelminglypositive.Whatwewereabletoachieveisformidableintermsofgreaterefficiencies,betterplanningandmappingcapabilities,andenhancedlocaldecision-makingforourlocalgovernment.NewOrleanswasabletoachievegreaterefficienciesbyworkingcloselywithlocalhousingrelatedagencies.Whilethesepartnershipsmayhavebeenperfunctoryundertheprevioussystemfromaplanningperspective,underthenewregulation,theCitydevelopedatruepartnershipintermsofinformationanddatasharingwithitshousingrelatedagencies,includingthehousingauthority,thefinanceauthorityandtheredevelopmentauthority.UsingtheAssessmentofFairHousing(AFH)toolandlocallyproduceddatacreatedgreaterefficiencies.Forexample,bypartneringwiththeHousingAuthority,wewereabletoincorporatereal-timedataforthetensofthousandoftenantsservedbythatagency.Additionally,thehousingauthorityisalsofederallyrequiredunderseparateregulationstosubmitanAnnualPlan,sowereducedredundanciestherebycollaboratingonasingledocumentthatcouldbeusedformultiplepurposes.Thedataprovidedthroughthenewtoolalsoimprovedlocalcontrolanddecision-makingcapabilities.Throughtheassessmentprocess,weactuallydiscoveredthatweweremore,notlesssegregated,thanyearsprevious.Throughthedataandmappingcapabilitiesprovided,andourabilitytoexaminenotjustourentitlementfundingbuttakealargerlookatallfederalhousingfunding—includingLowIncomeHousingTaxCredits,FHAfinancing,housingauthorityinvestments,ourownHUDfundingandevenprivatecapital—wecouldseethewaysinwhichwecouldbebetterleveragingHUDfundingtobeinvestingsmarterforgreateroutcomes.Theregulatorytoolsimprovedandsignificantlyinformedourlocaldecisionmakingcapacity.Asmentioned,theHousingAuthorityofNewOrleansjoinedtheCityintheAssessment.Oneoftheparticularlytroublingfindingswasthepost-KatrinaimpactonourHousingChoiceVoucherProgramparticipants,whichisapopulationofalmost20,000households,includingmanyofthoseservedwithtemporarydisasterhousingassistanceafterHurricaneKatrina.Voucherswereaprimarymeansto

assisthouseholdsdisplacedbythestorm,especiallyfollowingthedemolitionof5,000publichousingunitscitywide.Globally,thevoucherprogramisdesignedtoprovidethepotentialforgreaterhousingchoiceandsocioeconomicmobilityforlow-incomefamilies.Yet,whatwefoundisthatvoucherassistedfamilieswereconcentratedinraciallysegregatedcensustractswithhighpercentagesofpopulationsofpeoplebelowthepovertyline,whereonly8%ofhouseholdslivedwithinreasonableaccessoftransit.1

IhaveincludedasnapshotfromtheassessmentaswellastheMarketValueAnalysis2commissionedbytheCity.ItshowsjobdensityasanexampleoftherangeofindicatorsweareabletoconsiderwhenreviewingcurrentandprospectiveHUDandotherhousinginvestments.Fromthesetwomapstakentogether,wecanarriveatthetroublingconclusionthatafterHurricaneKatrinawehadrelocatedrentalassistedhouseholdsfurtherfromjobsandeconomicactivity.Thisleadsmetotwoveryimportantpoints.Thefirstisthataffordablehousingcannotbeconflatedwithfairhousing.Themapofhouseholdsinpovertystrickenandoverwhelminglyraciallysegregatedcensustractsisstillamapofaffordablehousing.Simplyaddingmoreaffordablehousing---astherecentlyreleaseddraftregulationproposestodo—doesnothingtoconnectHUDclientstotheladdersof

opportunityoutofpoverty.Nordoesitmakeourcitiesmoredatadriven,equitable,integratedorjust.Thesecondpointisthattheassessmentrevealedwehadroomtoimprovefromanurbanplanningperspective:clearly,wehadnotbeenmeetingourgoalstoconnecthousingtotransit,economicactivity,andotheropportunity3.Iwanttobeclearthatwhilethecurrent2015regulationdidhelpustousethisdatatobetterunderstandtheconnectionbetweenneighborhoodassetssuchastransitorschoolchoiceandourportfolioofhousinginvestments,itisinnowayprescriptiveorrequirehousingagenciessuchasourstomaketransportationorotherrelatedagencydecisions.TheAFHprovideduswithdataandinformation,sothatwecanbebetterinformedaboutourowndecision-makingprocesses.Sincereceivingthesefindings,wehaveimplementedaspecialpilotprogramforvoucher-assistedfamiliestomovetoneighborhoodsofopportunity.Wehavestreamlinedourhousingauthority’sbusinesspractices,incollaborationwithandwithfeedbackfromourlandlordcommunity.WehaveexaminedCitypoliciesandprocedurestomakeprogramsmoreaccessibletoall—especiallyintermsoflanguageaccessandtheneedsofdifferentlyabledpeople,whichhelpedpavethewayfornewhousingforwoundedwarriors.Werevisedcriminalbackgroundcheckpoliciestoalignwithcitywidegoalstoreducerecidivismandpromotereintegration.WehavealsoprioritizedhighopportunityneighborhoodswithourHUDentitlementfunds,bringingnewrentalhousingopportunitiestosomeneighborhoodswhileincentivizinghomeownershipinothers.Theadjustmentswehavemadeareconsistentwithwhattheresearchtellsusabouthowplacematters.Asmanyofyouknow,economistssuchasHarvardUniversity’sRajChettyhavedonesignificantprimarysourcestatisticalanalysisoftheeffectofplaceoninterruptingintergenerationalpoverty4.Thatis,thattheinfrastructureandfabricofaneighborhoodcanhaveaprofoundandlastingimpactonmultiplegenerations.BytrackingthesocialsecuritynumbersofHUDtenantsthatwereable5toliveinresourcerichneighborhoods,Chetty’steamwereabletotrackthesefamiliesovertimetolookattaxreturns,maritalstatus,fertilityandotherdemographicmeasures.Itisthefirststudythathasbeenabletolookbackoverthecourseoftwentyyears,totakealongerlookathowplacematters.Whatthedataclearlydemonstratesisthatchildrenfromlowincomefamilieswhoareabletoliveinresourcerichneighborhoodstendtoearnmoreasadults,aremorelikelytobecollegeeducated,arelesslikelytobesingleparentsandmorelikelytoliveinahigherincomeneighborhoodsasadultsthemselves6.Inotherwords,accesstoa

resourcerichneighborhoodimpactsnotjustparentsandtheirchildren,butalsotheirchildren’schildren.Astoundingly,theresearchalsofoundthateverysingleextrayearofexposuretoalow-povertyenvironmentduringchildhoodisbeneficialintoadulthood7.Consistentwiththisresearch,thesecondfindingthatIwanttohighlightrelatestotheinfrastructureofourneighborhoodsthemselves.Inzipcode70124,where93%oftheresidentsarewhite,theaveragelifeexpectancyis80years8.Inazipcodedirectlynearby,where87%oftheresidentsareblack,thelifeexpectancydropsbyalmost30yearsto54.5yearsaveragelifeexpectancy.Whatwefoundisthatplacestillmatters,buttheAssessmentofFairHousingalsogaveusthedataandresourcestobegintodelveintowhatcomponentsofneighborhoodinfrastructureexistedinsomezipcodesbutnotinothers.WhileallofourNewOrleansneighborhoodsaregreat,theplaceswherepeoplereallythrivearealsothoseplacesthatareconnectedtoinfrastructure,highperformingschools,transportation,economicactivityandothermeansofaccesstosuccess.

visiblework:inNewOrleans,agreatportionofourinfrastructureinvestmentisn’tthevertical,it’ssubsurfacefocusondrainageandotherpiecesthatarevitalbutmaynotbevisibletoresidents.However,wearealsofocusingonbeingmoreintentionalaboutclusteringandleveragingtopreventdisplacementintransitioningneighborhoods,improveaccesstoneighborhoodsofopportunity,andtobringinvestmentstoneighborhoodsthatstillhaven’tfullyrecoveredfromHurricaneKatrina.The2015regulationhasn’tthereforepresentedadramaticshiftinwhathasbeenrequiredofusasajurisdiction,butithasprovideduswiththedataandtoolstomakebetteruseofourpublicresourcesviaenhancedplanningcapacityandimprovedlocaldecision-making.ThelastthingIwanttohighlightasitrelatestothecurrentregulationandourAssessmentofFairHousingispeoplewithdisabilitiesandhowwe’vebeenabletomodifyCitypoliciestoensurewemeetpeoplewheretheyare.Forexample,somelocalbusinessownersrecentlydevelopedhousingforwoundedveterans,whichlaterproposedawellnesscenterwithaneurologicalrehabilitationclinicandan“adaptablegym,"oragymthatcanbeusedbydisabledpeople.PertheCity’sComprehensiveZoningOrdinance,theprojectrequiresazoningmodification.BecauseofthecitywideFairHousinganalysiswe’vedone,wehaverobustpoliciesinplacetoensurethereisazoningprocessforprojectslikethis,whichcanserveourwoundedveterans.Similarly,wefindthathomesthattreatopioidaddictionandothersubstanceabuseissuesfacechallengesfromazoningperspective,andourAssessmentforFairHousingisabletoprovideuswitharobustanalysisoftheCitypoliciesandproceduresthatmadeitmoredifficultforthebusinesscommunitytoservepeoplewithdisabilitiesandhelpusresolvesomeofthoseissues.Again,theregulationitselfisnotprescriptiveinwhatweoughttodo,butitgivesusthetoolstobeabletoapproachourlocalruleswithrigor,anddeveloplocalsolutionstolocalproblems.IalsowantedtosayalittleaboutanotherprimaryfocusofMayorCantrell’sAdministration,andthatisournextgenerationandthewaysinwhichthedecisionswemaketodayimpacttoday’schildrenandwhotheywillbecomeastomorrow’sadults.Roughlyone-quarterofNewOrleansrenterhouseholdsincludechildren,accountingformorethan40,000childrenlivinginrentalhousingcitywide9.Studiesclearlydemonstratethatthequalityofthathousingcansignificantlyimpactchildren’s’healthandschoolperformance.Substandardhousingconditionslikeleaks,mold,andinsectorrodentinfestationsareoftencorrelatedwithrespiratoryconditionsinchildren.AmericanHousingSurvey(AHS)dataindicatestherearenearly2,000NewOrleansrentalunitswithmoldandmorethan7,000unitswithsignsof

rodents.Allofthesekidsareathigherriskofasthma10,whichisthethirdleadingcauseofhospitalizationforchildreninourhomestateofLouisiana11.TheAHSreportsdatadirectlyrelatedtoasthma.One-quarterofallNewOrleansrenterfamilieswithchildrenhaveanasthmaticchildinthehome:atotalof5,500families.Childrenwithasthmainthesefamiliesaccountedfor1,107emergencyroomvisitsinthepastyearand5,533asthmamedicineprescriptionsinthepastthreemonths12.Especiallyinlower-incomeneighborhoods,housingqualityremainsaconcern.Thousandsoffamiliesmaybelivinginunsafeandunhealthyhomes,withyoungchildrenmostatrisk.AccordingtotheAHS,alittleover7%ofallrentalhouseholdsintheNewOrleans-Metairie-Kennermetroareareportedmajorproblemswiththeplumbing,heating,electricity,orupkeepoftheirapartment,whilepotentiallythousandsofothersreportingmorespecificissues13.It’sverylikelythatNewOrleanshasadisproportionateshareoftheregion’shousingproblems,butaconservativeestimatebasedonpercentageofthecity’sroughly84,000renter-occupiedunitssuggeststhatatleast6,020oftheseunitsreportedmajorproblems.Studieshaveshownthatlowerhousingqualityisassociatedwithpoorerpsychologicalhealthandlowerkindergartenreadinessscores.However,housingproblemsalsoplayaroleinthehighlevelofresidentialinstability:thesehousingqualitycrisesleadtofrequentemergencymoves,ratherthanfamiliesmakingstrategicchoicestorelocatetobetterneighborhoodsoremploymentopportunities14.Besidesthephysiologicaleffectofhazardsonhealththatleaddirectlytolowerliteracyrates,increasedrespiratoryandotherhealthproblems,learningoutcomesforchildrenarealsonegativelyimpactedbydisruptionsassociatedwithfrequentmoves.Theseeffectsarealsocumulative.15ThisisagainwheretheAffirmativelyFurtheringFairHousingregulationcanhelpustoimproveoutcomesforchildren,bothintermsoftheirphysicalhealthandreducingthenumberofhospitalstaysordoctorvisits,aswellasimprovingliteracy

andkindergartenorschoolreadiness.BecausetheregulationhelpsustomaptheCityandseetheplaceswhereweneedtoimprove.ItprovidesuswiththedatatobeabletocorrelateHUDoccupiedhousingwithratesofillness,orblightandneighborhooddisinvestmentwithearlychildhoodoutcomes.Bylookingholisticallyatarangeofneighborhoodlevelindicators,weareabletoseethewaysinwhichtheinfrastructureoftheneighborhooditselfisabletohelpchildrenthriveandsucceed.Thisiswhatthedatatellsus,andwhattheregulationcurrentlyinplacehasbeenablehelpusreckonwith:thatweshouldbeinvestingsmartertoensurelowerincomefamilieshaveequalaccesstohighopportunityneighborhoods,whilealsoimprovingchronicallypoorneighborhoodstobringopportunitytothem.Itallowsustoapproachcityinvestmentswithascalpelratherthanamachete,understandingthatnotallsolutionsworkfortheentirecity,becauseeachofourneighborhoodsaredifferentwithdifferentneeds.IwanttoshareonemoreLouisianadatapointthatisqualitativeratherthanquantitative.Andthatisofanowyoung-ishwomanwhooweshersuccesstoaccesstoaneighborhoodofopportunity.GrowingupinasmallerLouisianatown,hermomhadreceivedahousingvoucherforrentalassistancetokeeptheirfamilygoing.Themomhadlookedreallyhard,andmanagedtofindarentaltheycouldaffordinahighquality,residentialneighborhood.Thathousewasclosetothehomesoftheteachersandschooladministrators,whothentooknoticeofthisyoungneighborhoodchildandofferedherafterschoolhelp.Withthisassistance,shewasabletoacademicallythriveandgotocollegeandbeyond.SheisnowCEOofaleadingcitywidecommunityorganization,andifyouaskhersheattributesitalltoherearlychancetomovetoaneighborhoodofopportunity.IthinkI’vesharedafairamountabouthowthe2015regulationhascreatedamoreeffectiveprocess.Fromourperspective,theseregulationsareessentialtoholdingjurisdictionsaccountableintheiruseoftaxpayerdollars,aswellasensuringfundsservetheintendedpopulation.Thereisakeenunderstandingthatthedecisionswemaketodayarethetomorrowwebuildforourchildren.Welookforwardtoworkingwithourstateandfederalpartnerstobuildtowardsasharedvisionofourfuture.
