Terms & Conditions

1- Only registered contractor/firm/company with UPPAN having PAN,GST No., Character

certificate issued from office of District Magistrate, registered in labour department and

having experience in building construction projects can quote the rates.

2- Any bidder, who having criminal record, is not allowed to participate in e-tender

process.

3- T.D.S., Cess & other applicable taxes will be deducted as per Govt. Rules.

4- G.S.T. extra as applicable.

5- E-Tender Fee Rs. 1000.00+12%GST=1120.00 only (Non refundable) through DD Of

any Nationalized bank in favour of E.E. U.P. Police Avas Nigam Ltd. Payble at Jalaun.

6- Documents completed in all respect should be submitted in office of E.E./Unit incharge

along with EMD Of Rs. 200000.00 (Two Lacs) only through DD/FDR/RTGS of

Nationalized bank in favour of EE- U.P. Police Avas Nigam Ltd. For the purpose of

7- Executive Engineer/Unit In charge, UPPAN reserve the right to accept or reject any or

all tenders or in part thereof without assigning any reason whatsoever and without

assigning any reason whatsoever and without any legal obligation thereof. The

decision of the undersigned will be final and binding to all. UPPAN reserve the right to

increase or decrease the quantity to be ordered.

8- Validity of rates for six months.

9- The contractor shall be completely held responsible for any mishap at site due to in

sufficient safety measures.

10- In respect of all the labour directly or indirectly employed in the works for the

performance of the contractor part of this contract. The contractor shall comply with all

the rules framed by Government from time to time for the protection of the health and

sanitary arrangements for workers employed by the contractor.

11- For any type of substandard quality the suitable deduction will be made from the bill of

PRW as per direction of engineer in charge.

12- All the works shall be carried out as per details specifications of UPPWD and as per

direction of engineer In charge.

13- Minimum 80% of empty cement bags will be recovered from the bill of PRW @ Rs.

1.00 per bags.

14- 5% Extra to be paid above G.F. floor per floor level for item no. 14 to 17, 20 to 23,

26,32 ,34, 38 to 40, 43, 45 to 49, 70 to 80, 85 to 87 and 89 to 101 only.

15- Rate inclusive of cost of petty and consumable material such wire brush, narial Gurra etc.

16- Rates are inclusive of all T&P.

17- In case of any damage/loss of UPPAN material, the cost of the same shall be

deducted from the PRW bill.

18- The Engineer-in-charge shall have the right to take sample for testing as per CPWD

norms or as decided by the Engineer-in charge and get it tested. The contractor shall

bear all charges of sampling, carriage and testing etc.

19- Sample & make of materials/equipment’s and item of work shall have to be approved

by the E/I before execution. The contractor shall ensure to consume the materials

within its expiry date. The material if consumed after the expiry date the affected work

will have to be dismantled or the recovery shall be made by the authority at rate of

double the cost of work in which such materials consumed.

20- The contractor shall confine his equipment, storage of materials operation of his works

& people to the limits as directed by the E/I and shall not unnecessary spread over the

premises with his materials and hutment.

21- If contractor constructed any work in wrong way which is objectionable then contractor

will correct that work without any extra payment including the cost of material.

22- All drawings and designs will be supplies according to the necessity of the particular

works and the contractor will not have any claim for compensation in case of late

supply of necessary design drawings.

23- For carrying out the work the contactor shall be provided with one set of working

drawings. Additional copies if required will be supplied to him on payment of additional

charges as decided by the Engineer-in-charge.

24- In giving their rates the Tenders take into account all fluctuations of the market, as no

claim shall be entertained on this account during the acceptance of the tender.

25- Payment will be made only on Tax Invoice.

26- All subject to Lucknow Jurisdiction only.

27- The contractor must fill the rate in percentage above or percentage below in the

prescribed performa.

28- If the E-Tendering opening date happens to be on a holiday or non-working day due to

any other valid reason, the tender opening process will be done on the next working

day at the same time and place.

29- Curing charges are not included in labour rates.

30- Executive Engineer/Unit Incharge will place work order to the PRW who has quoted

lowest rates i,e L1.

31- Incase of tie rates either work will be decided through lottery or quantum of work will be

distributed among the PRW’s as per discrimination of Executive Engineer with written

acceptance of the parties.
