2. Technical and Pre- qualification bid details specification (envelope No.1) will be opened first and subject to evaluation, based on the qualification criteria contained in the individual bid document. Price bids (Envelope No.2) of bidders who are assessed and declared as substantially technically responsive on evaluation of the technical bid will be opened for further commercial evaluation.

3. Tenderer shall also certify that quoted tender is ‘UNCONDITIONAL’ on tender covers itself.

4. Both the bids should be submitted in another separate sealed cover on or before due date of submission with the name of work superscripted thereon and with note ‘TENDER-DO NOT OPEN’ written prominently.

5. Subletting of tender is not permitted. 6. The tender received after time and date specified in the tender notice will not be

SPECIAL NOTE FOR PRE-QUALIFICATION OF BIDDERS FOR TENDERS The tender documents are for two separate bids, i.e. Technical and Price bid. The bidder should submit technical bid with the following credentials for pre-qualification. If these documents are not submitted with the technical bid, the tender will automatically stand rejected.

1. Experience of having successfully completed similar nature of works in Government/Semi Government/GEB (GSECL)/State/Central/Railway during last 7 years ending last day of month previous to the one in which applications are invited should be either of the following.

Three similar completed works costing not less than the amount equal to 40% of the estimated cost.

OR Two similar completed works costing not less than the amount equal to 50% of the estimated

cost. OR

One similar completed work costing not less than the amount equal to 80% of the estimated cost.

2 The bidder should possess registration of E-2 class or above class with GSECL, State Government semi Government, Central Government, Railways, PWD etc. for estimated amount above Rs. One Lac.

3 Tender without Earnest Money Deposit will not be entitled for opening of Technical bid. 4 Attested true copies of partnership deed, articles of association or Memorandum of association

in case of companies where in the order value is above Rs. 5 lacs. 5 List of tools & tackles in case of annual rate contract works as prescribed in tender. 6 Copy of Group Insurance Policy. 7 Cost and rate analysis should be submitted in case the bidder quoted less than 40% of

estimated value.( This should be attached with price bid.) 8 The bidder should also certify that the quoted tender is “UNCONDITIONAL” 9 On receipt of LOI/Work Order the bidder should process for obtaining Labour Licenses from

Assistant Commissioner of labour, Bharuch, before starting execution of work at site, if the numbers of contract labour being engaged exceeds nine or more.

11 The copy of PAN No., Service Tax Number and TIN No. is required. 12 If rate is quoted in % and not shown “Above or below”, we may consider below only. 13 The payment shall be made within 30 day of recording bill by EIC. The commercial bid shown

in tender documents comprising schedule- B may please submitted in separate self address sealed envelope with tender documents.

14 A Copy of allotment of PF code No. Received from regional provident fund commissioner. 15 Latest Bank Solvency Certificate from any scheduled and nationalized bank (not issued before

one year) of at least 20% of estimated cost. The bank solvency of nationalized banks, private banks which are (a) IDBI bank (b) AXIS bank (c) HDFC bank (d) ICICI bank(e) Kalupur Commercial Co. Op. Bank, A’bad shall be accepted. The bank guarantee of any other co-operative bank and other scheduled banks etc. will not be accepted. After scrutinize of the technical bid if party fails the above requirements for pre-qualification, the commercial bid of such parties will not be opened. The commercial bid of qualified parties shall be opened afterwards in the presence of parties. The technical bid shall invariably be accompanied with an E.M.D. of Rs. 3756/- in DD issued in favors of GSECL payable on State Bank Of India at Kevadia colony. The EMD in any other form shall not be accepted and no interest shall be payable on EMD. The bid should be clearly subscribed with our reference number, due date and title of work. The offer should be valid for acceptance for minimum period of 120 days from the date of opening of Technical bid.

CIRCULAR – 1

The following are the major obligations to be fulfilled by the Contractors as per the Contract Labor (R&A) Act 1970 and rule mentioned there under: 1. License to be obtained before starting the Work where number of contract laborers in

ten or more. 2. Payment of contract labours have to be made through Bank, in account of concerned

labours and Bank receipt of said month with duly stamped by Bank & to be submitted along with salary statement, P.F. Challan, W.C. Policy and attendance register to establishment department. Wages rates for contract laborers are applicable as per the terms and conditions of the license. The contractor shall have to pay wages to workers as notified by Government of Gujarat., from time to time

3. Every contractor shall have to maintain the muster roll and wages register in respect of his contract labor.

4. Every contractor is required to issue employment card, wages slip and attendance card to their laborers.

5. The contractor has to maintain the register No. 13 containing details of contract labors employed by him.

6. Earned leave register/ card as per the Factories Act. And Rules. 7. Other registers required under Contract Labor Rules and the Factories Act. And Rules. 8. Every contractor shall have to obtain insurance policy in respect of the contract labors

engaged by him to cover them under workmen’s Compensation Act. 9. To send half yearly return to licensing officer as per Rule 82 (1) as per schedule time. 10. Before starting the work as per the contract awarded to him, he should make

arrangement to enter into the agreement in the prescribed format on the stamp paper as applicable. Before fulfilling the above requirement the contractor is instructed not to start the work. The responsibility will be on his head in case he fails.

11. Contractor should posses separate P.F. code on their firm, name otherwise their offer may not be considered.

All the contractors are informed to adhere to the rules and regulations applicable to them, particularly in respect of the laborers engaged by them, the contractor not fulfilling the obligations will not be allowed or continue with work/ not be held qualified to carry out the work at GSECL, SSHEP, K’ Colony.

GENERAL INSTRUCTION TO THE TENDERERS 1.0. Sealed percentage rate limited tenders are hereby invited for work of: “Providing and

fixing NETLON mosquito jali, RCC cover in colony quarters at Kevadia Colony.” The Project is located in the State of Gujarat in Tal. – Nandod, District - Narmada.

2.0. The scope of work is explained in “Technical Specification” of this document. The work shall be carried out according to the enclosed General Conditions, Technical Specifications, Applicable Indian Standards and relevant drawings.

3.0 The tender’s documents are of two bid systems. A) The technical bid which is to be submitted in separate sealed envelope

mentioning ‘TECHNICAL BID’ on envelope with the details given special note for prequalification. E.M.D. receipt / E.M.D. D.D. & Tender fee receipt must be with technical bid.

B) The commercial (price) bid which is to be submitted with the rest page of tenders including Schedule – B in separate sealed envelope, mentioning COMMERCIAL BID. Both the bids should be submitted in separate sealed over on the due date of submission of tender mentioned in tender notice.

4.0 Tenderer should attach necessary certificate copies of contract justifying their capacity as Contractor to execute the job of this nature and extent. He should also attach the copies of documents in supports of his past experience as a contractor in the work.

5.0 E.M.D. for the work covered by this tender notice is Rs. 3756/- . Tenderer should deposit E.M.D. by demand draft in favour of GSECL payable at S.B.I. Kevadia Colony in DD only. Unless the E.M.D. is paid the tender will not be considered. The E.M.D. for unsuccessful tenderer will be refunded with out any interest as soon as the tender is finalized.

6.0. The bidders shall submit their offer without any deviations in general terms and conditions of the contract or in technical specifications. The tender and contract for works booklet is available in the office of the I/c Chief Engineer (O & M), GSECL, Kevadia Colony for reference. The contractor is deemed to have fully informed himself all general terms and conditions of contract.

7.0 Tenders received after the time and date specified in the tender notice will not be accepted.

8.0 The work shall be completed within the period stipulated in the contract. The contractor has to organize and co-ordinate the works to complete the work in time limit. In the event of any delays due to any other reasons not attributable to the contractor, reasonable extension in completing the work may be given at the discretion and as decided by the Company but no compensation or idle charges will be paid to the contractor on this account under any circumstances.

9.0. The Company reserves the right to accept any tender irrespective of whether it is lowest or not or to reject all the tenders without assigning any reasons thereof. Tenders departing from the technical specifications or the method of bidding in a radical manner may also be rejected.

10.0 The tenderers shall be presumed to have carefully examined the drawings, conditions & specifications of work, “Tender & contracts for works” booklet available in the office of I/c Chief Engineer (O & M), GSECL, Kevadia Colony & to have fully acquainted themselves with all details of the site conditions, locations, materials, geological & weather characteristics, labour conditions & in general all the necessary information and data etc. pertaining to and need for the work.

11.0 On acceptance of the tender the name(s) of the accredited representative(s) of

the tenderer who would be responsible for taking instructions from the Engineer-In-Charge shall be communicated to the Engineer-In-Charge.

12.0 “All royalties, sales tax, toll tax, local tax, development charges, VAT tax, welfare cess and any other taxes including works contract tax etc., in respect of this contract and also any statutory variation in future towards above mentioned taxes & any other taxes if levied in future by statutory authority applicable to the this contract shall be payable by the contractor and GSECL will not entertain any claim whatsoever in this respect. The rates will be "Excluding the service tax'. Service Tax will be paid at prevailing rate it claim by party in Invoice/Bills. 13.0 This specification is intended as a general description of quality envisaged for materials

and workmanship and of the finished work. It is not intended to cover minute details. The

work shall be executed in accordance with the best modern practice and to the complete satisfaction of the Purchaser Special techniques approved by the Purchaser shall be used if and where found necessary. This specification shall have precedence if anything contrary to this is stated elsewhere in the contract documents. The Purchasers decision shall be final and binding on the contractor on any issue arising out of such discrepancies.

14.0 The successful contractor will have to sign an agreement as per the Gujarat Electricity Company's rules on stamped paper of appropriate value and the necessary stamp duty charges shall be borne by the Contractor.

15.0 Tenderers must submit the Schedule - B, and other schedules duly signed & bearing the SEAL OF COMPANY. Any tender not bearing signature of the bidder & SEAL OF COMPANY on all the documents accompanying the tender is liable to be rejected.

16.0 Tenders which do not fulfill all or any of the above conditions or incomplete in any respect are liable to rejection.

17.0 The Company will not pay any extra charges or rate for any reasons in case the contractor claims, after acceptance of contract to have misjudged the site condition.

18.0 The contractor must arrange for transport of all man and materials and include all such costs in the rates quoted by him for finished work.

19.0. The rates and price shall be written both in words, and figures and the units in words. The tender documents shall be written legibly and free from erasure, overwriting or conversions of figures. Correction unavoidable shall be made by crossing out, initialing, dating and rewriting. In case of discrepancies between the amounts for unit rates or prices written in words and in figures, amounts written in words shall be considered as final.

20.0 The contract or any part thereof shall not be subject to change without the written permission of the I/c Chief Engineer (O & M), GSECL, Kevadia Colony or his authorized representatives.

21.0 Tender shall remain open for acceptance for a period of 120 days from the date of price bid opening and during this period no bidder shall be allowed to withdraw his tender. Any such withdrawal, during the said period will entail forfeiture of the earnest money deposited with the tender.

22.0 Further information required, if any, can be had from the office of the I/c Chief Engineer (O & M), GSECL, Kevadia Colony. But it must be clearly understood that the tenders must be received complete in every respect by the due date and time.

23.0 The 'Tender Document’ including the General Instructions to the Tenderers shall form part of the contract.

24.0 The tender shall be accompanied by the following information. Schedule - B. Bar chart indicating how the tenderer proposes to carry out the work in stipulated time

period. 25.0 The Electric power will be made available at one mutually agreed point for the work

under this tender as covered in schedule - B. Further distributions will have to be carried our as per the requirements at your cost. The electric consumption charges will be recovered, as per the tariff rate of GSECL from time to time as per the GSECL Rules.

26.0 Looking to the present conditions at Power Station site, the Company cannot provide any quarter to the contractors.

27.0 The water supply line for the work under this tender as covered in Schedule-B, will be given at one mutual agreed point, further distribution will have to be carried out by the contractor as per their requirements at their own cost.

28.0 Work carried under this contract shall be completed in all respect within specified time limit mentioned in Tender Notice. The Time limit period commences from date of issuance of commencement letter from Engineer-In-Charge.

29.0 Bidders must quote firm price only without any escalation, till completion of work under contract and this is to be confirmed by bidder while submitting his offer. In case, if the bidder does not offer firm price his offer is likely to be rejected & the price bid envelope may not be opened.

30.0 Each tenderer shall also submit a 'Declaration' to the effect that the tenderer is an engineering construction firm or an association of firm or firm which has successfully carried out large works of this nature and has adequate organization and experienced personnel to handle this type and magnitude of work. Information should also be given

regarding the constitution of the firm, its authorized, subscribed & paid up capital, the date & place of registration, the place of business, the names of the directors and other relevant information. In the case of non-Indian firms the 'Declaration' should also include an undertaking to get the firm registered in India. If not already registered, within three months of the date of notice of the acceptance of the tender. Failure to so in registering after due notice, the tender acceptance is liable to result in the annulment of the tender with forfeiture of the Earnest Money and other penalties that may be leviable under the conditions specified in tender & contract documents.

31.0 Each tender shall contain the name, residence & place of business of person or persons making the tender & shall be signed by the tenderer with his usual signature with seal of the company. Tender by partnerships shall furnish the full names of all partners. It shall be signed with the partnership name by one of the members of the partnership or by an authorized representative followed by the name & designation of the person signing. Tenders by corporation shall be signed with the legal name of the Corporation followed by the name of the state of incorporation and by the signature and designation of the President, Secretary or other person authorized to bind it in the matter with rubber seal of the company.

An attested copy of the constitution of the firm with the name of partners shall be furnished. Whenever, whether in submission of the tender or later in other matters, the signatures are made by one person on behalf of a partnership or a firm or a corporation, an attested copy of the resolution of the partners or of the Company of Directors or an authority acceptable in law shall be supplied by the tenderer authorizing acceptance, binding and signature by the said person. Witnesses and sureties shall be persons of status and probity, and their names, occupation and address shall be stated below their signature. All signatures shall be dated.

32.0 Company reserves the right to delete any item of Schedule ‘B’ in full or part. Contractor shall not have any right to claim on account of this.

33.0 PAN No. and TIN No. shall have to be submitted with Technical Bid. 34.0 Service Tax Registration No. shall have to be submitted along with Tech. bid. 35.0 Party shall have to be submitted P.F. Code No along with technical bid. 36.0 The successful contractor has to pay 5% Security Deposit of the work order

amount; S.D. must be paid before placing of the work order. The amount of security deposit will be released by the GSECL after specific guarantee period is over on completion of work.

37.0 Accommodation will be on chargeable basis if available by GSECL.

GENERAL CONDITION OF CONTRACT

1. WAGES TO BE PAID & TIME OF PAYMENT ETC, BY THE CONTRACTORS: A) The Contractors shall pay minimum rates fixed under the minimum wages act. The

wages of every contract labour employed by him under this contract shall be paid by him before the expiry of 7th day of the last day of the month in respect of which the wages are payable (i.e. wages of a month have to the paid by him in the first week of the next month) The payment shall be disbursed in the presence of management representative during the working hours in factory premises and the contractor shall get the entries certified in the register of wages by the representatives of the company, Any default will result in cancellation of contract forthwith or also the contract shall be punishable to the extent of Rs. 100/- fine per each day.

B) The contractor shall give his telephone number and address to the GSECL so that in case of labour trouble etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present through out the working hours.

2.0 LABOUR LAW APPLICABLE:- 2.1 The contractor will not employ any person below the age of 18 years for any work.

No. female worker shall be employed in the night shift between 07-00 PM. To 06-00 AM.

2.2 The contractor shall issue Photo Identity Cards as prescribed under Industrial Employment Standing Orders Act / factories Act to each of their employees at their cost.

2.3 The contractor shall at their own expense comply with all Labour Laws and keep GSECL indemnified in respect thereof. Some of the major liabilities under various Labour & Industrial Laws which the contractor shall comply with, are as under, but not limited to:-

2.3.1 Payment of deposit in respect of each contract labour at the rate prescribed with the office of Commissioner of Labour, as per the Contract Labour (Regulation & Abolition) Act 1970.

2.3.2 License fee as prescribed under the Contract Labour (Regulation & Abolition) Act 1970 and the rules framed there under, depending upon the number of workmen employed by the contractor. Labour Licence is compulsory if ten or more labours engaged per day.

2.3.3 Payment of retrenchment compensation, notice pay and other liabilities as per the Industrial Dispute Act. Any payment of employee / arising out of claim or dispute under the Industrial Dispute Act, 1947 or any other Labour Laws. The above are some of the contractor’s major liabilities in addition to other liabilities prescribed under the various Labour Laws in force form time to time and as made applicable by the Statutory Authorities which the contractor shall have to comply with.

2.3.4 The Contractor shall employ adequate number of experienced staff at site for daily supervision and maintain various registers and records required under the Law and the Contract. No payment for supervision shall be admissible.

2.3.5 Contractor shall maintain a valid labour license under the contractor labour (Regulation and Abolition) Act for the employing necessary manpower to be required by him in the absence of such license the contractor shall be liable to terminated without assign any reasons thereof.

2.3.6 Payment of contributing of way of Employer’ s contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administrative charges etc, at the rates made applicable from time to time by Government of Gujarat / Government of India or other Statutory Authorities. The Labour Licence should be specifically for the activity for which contract is being awarded.

2.3.7 Payment of compensation in case of accidental injury. 2.3.8 PROVIDENT FUND AND PENSION SCHEME :-

The contractor shall submit along with their monthly bills, a Statement regarding deduction against Employees provident Fund (PF) in respect of each concerned employee. PF @ 12% or at the rates made applicable by the Government from time to

time of the basic wage rate / amount specified by GSECL, shall be deducted by the contractor from the payment made to the workers who are eligible for PF deduction.

Contractor’s contribution and workers contribution towards PF and Pension Fund (PS) shall be paid by the contractor every month before 10th instant to Regional Provident Fund Commissioner Office and the contractor will be required to show proof of the same to the Personnel Department of GSECL for verification. Contractor contribution towards PS shall be deposited by the contractor with RPFC. GSECL in no way will be responsible for any non-compliance by the contractor.

2.3.9 DEPOSIT LINKED INSURANCE SCHEME :- The contractor shall have to deposit 0.5%(Half Percent) of the aggregate of wages in

respect of employees who are members of the Provident Fund as the contribution to the Deposit Linked Insurance Fund with RPFC or such contribution per worker as decided by the company.

2.3.10 ADMINISTRATIVE CHARGES: - Administrative charges for maintaining PF, PS, EDLI Account shall be deposited by the contractor at RPFC, at the rates applicable or such contribution as may be decided by the company.

2.3.11 PAID LEAVE FACILITY:- Paid Leave Facility at the rate one day for every twenty days worked by the contractor’s labour shall be provided by the contractor to their workers. The contractor shall maintain leave record / leave cards for individual labour which shall be duly verified and approved by the GSECL’s Authorized Officer.

2.3.12 Gratuity / Bonus liabilities:- The contractor shall pay Gratuity and Bonus to its eligible employees under the

Gratuity Act and Bonus Act if it is applicable. 2.3.13 WORKMEN’S COMPENSATION AND EMPLOYEE’S LIABILITY INSURANCE:-

The contractor shall be liable to pay compensation under the provision of the

Workmen Compensation Act, 1973. Insurance shall be effected for all contractor’s employees engaged in the performance of this contract. If any of the work is sub-leted with or without GSECL knowledge, the contractor shall require the sub-contractor to provide Workmen’s Compensation and Employer’s Liability Insurance for the latter’s employees, unless such employees are covered under the contractor’s insurance.

2.3.14 The contractor shall raise no claims against GSECL on account of payments to be made by them as indicated in Clause Nos. 2.2, 2.3 2.3.1, 2.3.2, 2.3.3, 2.3.4, 2.3.5, 2.3.6, 2.3.7, 2.3.8, 2.3.9, 2.3.10, 2.3.11, 2.3.12 above. GSECL shall not be called upon to bear any liability whether financial or otherwise on these matters and the contractor shall satisfy the Government / GSECL authorities that all obligations in this respect have been duly fulfilled by them. Statements made in the inquiry documents or any other documents, if any, which are not in conformity with the above stipulation, should be deemed to have been withdrawn.

2.3.15 CONTRACTOR TO INDEMINITY THE GSECL:- The contractor shall indemnify GSECL and its every member, Officer, Employee and

Engineer against any claims, demands, costs and expenses whatsoever arising out of or in connection with the matters referred to in these Articles and elsewhere and against all actions, proceedings, claim, demand, costs and expenses which may be made against GSECL or by Govt. for or in respect of or arising out of any failure by the contractor in the performance of their obligations under the documents. GSECL shall not be liable for or in respect of any demands or compensations payable under any law or in consequence of any accident or injury to any of their consequence of any accident or injury to any of their workmen or other person in their employment or their sub- contractor and the contractor shall indemnify and keep indemnified GSECL against all such damages and compensation and against claims, demands, proceedings, costs, charges and expenses whatsoever in respect there of or in relation there to.

2.3.16 GSECL shall be entitled to deduct directly from the bills to be paid to the contractor, any sum or sums payable by the contractor and which sum / sums GSECL is required to pay as principal employer on account of their default in respect of all liabilities referred to in above clauses.

2.3.17 The contractor shall be responsible for all matters arising out of the performance of the contract and shall comply and adhere to, at their expense with all laws / act / enactment

/ orders / regulations / statutory obligations, Government / Local Self Government, any statutory or non-statutory authority. The contractor shall indemnify and keep indemnified and the GSECL harmless against all liabilities in this respect. The contractor shall be fully responsible for the work, conduct, supervision and control of all their own personnel and GSECL shall in no way be held liable and responsible for supervision, control, etc. of these personnel. Since the contractor shall have full and exclusive supervision and control over contract awarded to them and the persons engaged for the purpose under this contract, the contractor shall be responsible and liable under the provisions of civil and criminal laws etc for their work, behavior and Industrial Relation problems and GSECL shall have no responsibility whatsoever on this account.

2.3.18 The contractor shall ensure that all the employees engaged by them are medically fit and are free from all communicable contagious infections and other diseases and that their employees shall submit themselves to GSECL’s Physician from time to time for such medical examination as may be required and decided by GSECL and GSECL shall have the right under Clause No. 2.3.21 to ask the contractor to remove any of his employee / s.

2.3.19 The contractor shall be liable and responsible for their employees observing all the security and safety regulations provided under the laws and instructions that may be issued by GSECL from time to time. In case GSECL suffer any loss etc. of whatever nature on account of contractor ‘s employees not following the security and safety regulations / instructions, the contractor shall be liable to make good all such losses as may be determined by GSECL at his sole discretion. GSECL shall have the right to recover all such losses etc. from the dues payable to the contractor and from contractor’s Security Deposit with GSECL to the extent available and by other remedies available under the law.

2.3.20 If in GSECL’s opinion any of contractor’s employee/s is / are found to be suffering from any disease or if any employee is found to commit any misconduct or misbehavior on in GSECL’s opinion undesirable, GSECL in its sole discretion, may require the contractor to remove such employee/s.

2.3.21 The contractor shall do the job with utmost care, speed, precision and follow all the instructions / directions / formalities for execution of this work. If GSECL suffer any loss towards demurrage, wharf age, detention and other charges, loss of materials, loss of energy, loss of any property, etc. due to delay and / or negligence of the part of contractor and / or their employees, the same will be recovered from contractor’s Bills / Security Deposit or Bank Guarantee. GSECL’s decision in this regard will be final and binding to the contractor. The contractor and their employees will carry out all the instructions / directions given by GSECL Authorized Officers for the prior execution of the work.

2.3 All contractor’s workmen / employees / agent and their Tiffin’s / bags, etc. will be liable to security check at any time and at the time of entry / exit.

2.4 The monthly payment of wages to the contract labourers will be compulsorily made through bank. The contractors shall have to ensure that each & every contract labourer engaged by them opens the S/B Account in the nearest Bank. The contractor shall supply copy of Bank statement duly stamped by the concerned Bank as a token of proof towards payment of wages to HR Deptt.

2.5 Regarding PF challan, copy will be submitted to Establishment Dept. and payment will be released after receiving the copy of PF challan.

3 The Company reserves the right to terminate this rate contract at any time during contract period without giving notice of termination of any reasons thereof.

4 The Company will be entitled to deduct directly from the bills, to be paid to the contract or for any sum of sums payable by the contractor and which sum / sums the GSECL is required to pay as a principal employer on account of Contractor default in respect of all liabilities referred to in above clauses.

5 Nothing in the contract document stated shall anywise constitute any workman / employees of the contractor or any sub contractor as or to be workman employees of the owner or place obligationary liability in respect of any such workman / employee upon the GSECL.

6 Office Correspondence will be carried out in English and if any time to facilitate the contractor, Gujarati Translation may be furnished if deemed fit, the English version will be the contract one, the same only will held good for legal matters.

7 Contractor will be responsible and liable to pay difference in wages if any or observe the revised service conditions that may be awarded by the honorable Industrial Tribunal effective from the dated directed in the award.

8 Rate quoted are firm and hence no price escalation or labour escalation will be applicable towards execution of work.

9 In case of delay in execution of work the beyond contractual cut off date/stipulated period in order shall be subjected to penalty (not liquidated damages) at the rate of 1/2% of the contract price / order price per week OR part thereof subject to a maximum of 10% of total contact value / order value (i.e. End cost of work order). However in case of delay due to circumstances beyond the control of contractor either in date of commencement or due to waiting during construction extension time may be considered for completion of work.

10 Party shall have to provide at their own the required personal protective equipments of standard make (ISI approved) to their staff during work execution and it will be your responsibility to see that the same are by your staff while at works.

ADDITIONAL GENERAL TERMS & CONDITIONS:

1. The contractors, shall at their own expense make all necessary provision for housing, water supply and sanitary arrangements for their employee as well as for works and shall pay direct to the authorities concerned all rates, and taxes.

2. The contractors shall make their own arrangements for the necessary approach road, for transport of their materials and be responsible for the compensations on account of damage to crop on GSECL property.

3. All the royalty charges, octroi, construction workers’ welfare cess and other duties will be paid by the contractor and no extra could be claimed on this account.

4. Godowns or sheds hired or constructed for storage controlled materials and more particularly of cement shall be such as would prevent material from getting damaged in any way.

5. It will be absolutely incumbent on the contractors to have on the site of work only such of the materials as have been duly passed by the Engineer-in-charge. Materials that have rejected must on no account be allowed to remain on the site and in spite of written order to do so any such rejected materials is on the site beyond a period of 48 hours notice, the Engineer-in-charge shall have the right to remove it at the risk and cost of the contractor and even destroy it.

6. It must be distinctly understood that the conditions of contract and claims in respect of extra work will not be allowed unless the works to which they relate is clearly without the spirit and meaning of the specifications or unless such work are ordered in writing by the Engineer-in-charge and claimed for in specified manner.

7. On completion of the work, the site shall be cleared by the contractors within the stipulated period and ground brought to original state and they shall not be entitled for any extra claim on this account.

8. General specifications of the latest edition of the P.W.D. Hand book volume I & II shall also apply.

9. When cement is obtained either through or with the recommendation or issued by the GSECL, it should be understood that the contractors will have to be very careful regarding the handling of the cement bags so to preserve their serviceability and quality.

10. Damage causes to works: - The works whether fully constructed or not, and all materials, machinery plant tools, temporary building and other things connected there shall be at the risk and in the sole charge of the contractor until the works have been completed & delivered, to the Engineer in charge and certificate from him to that effect obtained Until such delivery the contractor shall at their own cost, take all the precautions reasonably necessary to keep all the aforesaid work materials machinery, plant, tools, Temporary building and other things connected with the work, free from any loss or damage and in the event to the some or any part there of being lost or damage shall from with within possible speed, reinstate and make good such loss or damages at contractor’s own cost.

11. Supply of controlled articles will be invariably recommended after the actual requirement have been carefully scrutinized, In the event of any such materials remaining in surplus in charge of the contractor, on account of some modifications either in the design or changes in construction or any other reason will be returned to the department.

12. There will be generally no objection on the component parts of the works being given over to responsible sub contractors but it must be borne in mind that this department would under no circumstances recognize these sub-contractors and the responsibility of executing the work in accordance with the condition of contract will entirely on the main contractors. The main contractors will therefore always have the very responsible member preferably a technical hand, present on the works with power to sign, all work orders issued on the site of work and to take requisite actions in the interest of very efficient execution of works.

13. The Engineer in charge will fix the hours of work and no work shall be executed beyond that period during night time or in absence of the Engineer in charge or his authorized agent. The box measures shall be filled only in the presence of the Engineer in charge or his authorized agent.

14. Contractor will be asked to present the sample of materials and the approved samples will be preserved at the site of work no charge in the approved sample will be allowed without the written permission of the Engineer in charge.

15. If any work is not executed according to the specifications and the directions of the Engineer in charge the same will be rejected or reduce rate will be allowed as deemed fit by the Engineer in charge.

16. Contractor will have to communicate the name of his agent who shall be present on the work site and shall be authorized to sign the material requisitions receive instructions given verbally, or on the order book on behalf of the contractor.

17. The contractor will have to sign the conditions of contract and execute the agreement, send the list of previous works executed solvency certificates and pay up the security deposits, failing to that the tender will be rejected and earnest money deposit will be forfeited. The value of the stamp paper and stamp duty charges shall be borne by the contractor.

18. Tenderer must return the form of tender with the specifications and the schedule of quantities and rate and other schedule duly signed, any tender not bearing signature of the tenderer on all the document accompanying the tender is liable to be rejected.

19. Before submitting his percentage rate tender which shall be for the finished work complete including charges involved in testing and maintenance for a period of 6 months. The tenderer shall closely examine the specifications and carefully study the drawings and all document which from a part of the contract to be entered in to by the accepted tender.

20. The tenderer must visit the site of works and see for himself the site conditions regarding availability and building materials rates, approach road during all season and other matters affecting the works before submitting the tender.

21. The submission of tender by a contractor implies that he has read these instructions, the conditions of contract etc, and has make himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores will be issued to him and local conditions and other factors bearings on the execution of the works, the GSECL will not therefore after acceptance of contractor’s rate pay any extra charge for lead of for any other reason, in case the contractor is found letter on the have misjudged the site conditions.

22. The contractor must arrange for all transport of materials weighting of material issued at department stores and all such cost include in the rates of schedule ‘B’ with the loss or above percentage quoted by the contractor for finished work.

23.The competent authorities can delete to any items in the schedule ‘B’ of the tender order if they fill that the items is not essential to be executed.

24.Schedule of quantities is included in the tender documents for which it shall be definitely understood that the GSECL does not accept any responsibility for the correctness or completion of this schedule and this schedule is liable to alternations by commissions, deductions or additions at the description of the Chief Engineer or as set for the in the conditions of contract specific percentage less or above shall be quoted by the contractor below the total amount of schedule ‘B’. The tender document shall be written legibly and free from erasure, over writing on conversion of figures correction where unavoidable shall be made by crossing out initialing dating and rewriting both in figures and in words in case of any discrepancy in figures the price quoted in words shall prevail.

25. The GSECL authorized offers who accept tenders, shall have right of rejecting all or any of the tenders and will not be found to accept the lowest nor to assign any reason whatever for the rejection of any tender or all tenders.

26. Tenders shall remain open for acceptance subject to the provisions of clause 25 above, for a period of three months from the date on which they are due for submission and during this period no tenderer shall be allowed to with draw his tender. Any such withdrawal during the said period will entail forfeiture of the earnest money deposited with the tender.

27. This notice to tender shall form a part the contract. 28. The entire work is to be completed within the stipulated time limit from the date of work

order or from the date of issuance of commencement letter from GSECL. The contractor will not be eligible for any extra for the idle period of work or waiting period that may be required to suit other considerations and no claim for compensation on account of such will be considered However in case of delay due to circumstances

beyond the control of contractor either in date of commencement or due to waiting during construction extension time may be considered for completion of work.

29. The contractor shall keep one full time qualified Civil Engineer at site who shall be fully authorized to receive and comply with such instructions as given by the Executive Engineer. The names of such Engineer with his qualification and experience shall be intimated by the contractor. The E.E. shall have the right to demand the removal of any technical person, Skilled or unskilled workmen who in his opinion are considered to cause bad workman ship in the execution of work or to cause in discipline.

30. The department reserves the right to make any change in the design and the plans of the work and the contractor shall % less or above quoted by the contractor. No, claim of compensation will be allowed on this account.

31. Bill shall be submitted by the contractor monthly on or before the date fixed by the E.E. for all works executed in the previous months.

32. Supply of water and Electricity: - The water supply line from G.S.E.C.L. will be given at one mutual agreed point, further distribution will have to be carried out by the contractor as per their requirements at their own cost. The water for maintenance purpose shall be supplied free of cost.

The Electric power will be made available at one mutually agreed point. Further distributions will have to be carried our as per the requirements at your cost. Electric consumption charges will be recovered, as per the tariff rate of GSECL from time to time as per the GSECL Rules.

33. Should this tender be accepted I/ We have agreed to abide by and full fill all the terms and provision of ‘Tender and Contract of works’ applicable and in default there to for fait and pay to the GSECL the sum of money due.

34. The full value or ‘Earnest Money Deposit’ paid here with should be absolutely forfeited to the GSECL should I / we not deposit the full amount of specified security deposit.

35. The work will have to be carried out in co-ordination with other, agencies on the same site on account of this in case the contractor has to stop or delay his works for some time he will not claim any thing extra only GSECL may consider to give suitable extension in time limit if necessary on such account.

36. Any dispute arising out of the contract, if not settled mutually, than only the Rajpipala court shall have jurisdiction to settle & decide the dispute.

37. The GSECL reserves the right to terminate this contract at any time without assigning any reason whatsoever by giving a notice period of one month. From the date of notice of termination of the contract contractor will not be entitled for any compensations / damages / losses, whatsoever on account of such termination of the contract.

Special conditions for use of cement / Steel in works.

1. The rates in schedule-B is inclusive of cement cost contractor has to purchase fresh 43/53 grade cement confirming IS-8112 or P.P.C. fly ash based as per IS 1489 Part-I and of approved brand by GSECL.

2. Contractor has to construct pucca godown at site of work so that cement bags can be properly preserved to avoid damage due to any kind of water.

3. Contractor has to bring sufficient quantities of cement bags / if in the work the cement is required more than 200 bags than at no time less than 200 (Two hundred) to maintain progress of works. The work should not suffer for want of cement

4. Cement should give the required strength of cement concrete. 5. To bring sufficient & timely cement at site is full responsibility of contractor. Nothing

extra will be paid on account of any reason to maintain progress of work and to complete the work in schedule time.

6. Contractor has to submit material A/C for consumption of cement used with every bill in case of not submitting the same, bill will not be passed. Party has to submit the copy of cement purchase bill along with each R.A. bills / Final Bill.

7. No negative variation will be allowed for consumption in cement than prescribed as per booklet of technical specification of board mix design & nothing will be paid extra for over consumption.

8. Contractor is fully responsible for safety of cement at site. Nothing will be paid extra on account of safety.

9. If GSECL´S authorized representative wants to check cement stock at site, contractor has to allow for the same at any time.

10.Contractor has to maintain day to day cement consumption balance account at site. 11. As far as possible contractor has to maintain supply of cement of only one brand and grade throughout the work and no account of closer/shortage of approved brand. Cement of other brand in accordance of condition no (1) will be allowed by EIC. 12. Contractor will be allowed to carryout work only after physical verification of cement brought at site. 13. Contractor has to submit material A/C for the consumption of steel used with every bill in case of not submitting the same, bill will not be passed. Party has to submit the copy of steel purchase bill along with each R.A. bills / Final Bill.

ADDITIONAL TERMS AND CONDITIONS OF CONTRACT REGARDING

INDUSTRIAL LAW AND OTHER RELATED MATTERS 1.1 Contractor will not assign or give sub contract of the work awarded to them, without

GSECL’s prior written permission. 1.2 Contractor shall have to arrange and procure at their own costs required number of

tools, tackles, and other equipment’s for execution of the job work. 1.3 Contractor shall arrange and obtain License under the provisions of Contract Labour

(Regulation & Abolition) Act, 1970 and Rules 1972 there under, before deploying and necessary manpower for commencing contract work and all submit a copy of the same to GSECL. In absence of such License, contract shall be liable to be terminated forthwith without assigning any reasons thereof and liabilities whether legal, statutory or of financial as a result consequence thereof shall be on thee contractor. Contractor shall comply with all the requirements of all Labour & Industrial Laws including Contract Labour (Regulation & Abolition) Act, 1970 and such other Acts and Statutory as may be applicable to the contractor in respect of all their employees employed by the contractor in connection with the job work awarded to them.

1.4 Contractor shall be liable and responsible for and shall make good forthwith all losses, damages and expenses incurred or suffered by GSECL and shall keep GSECL harmless and indemnify against all or any claim, injuries, losses suffered or caused to be suffered or incurred by GSECL or by any of contractor’s employees, workmen, representatives agents or to all or any of GSECL properties, plant, machinery, equipments, materials or goods or personnel or to a third party, by reasons or consequence of any act, omission or negligence committed or omitted to be done during the course of their performance of this contract and within the terms of the contract.

1.5 GSECL shall not be liable for all or any claim, injury, loss, damages, cost of expenses which may be made against or caused to be suffered or incurred by contractor, their representatives, employees, workmen, or agents or properties, machinery, equipments, materials or goods during the course of their work under this contract.

1.6 In case of accident, injury, losses caused, suffered or incurred by all or any of contractor’s employees, workmen, representatives or agents, contractor will be wholly and solely responsible to meet with the expenses of accident, treatment and payment of compensation as per the Workmen’s Compensation Act.

1.7 GSECL shall be entitled to terminate the contract during the period of the contract and without any notice / reference to contractor and without prejudice to their right, should the contractor fail to fulfill or carryout all or any of their obligations covered under this contract or commit default or breach of any or all the terms and conditions of this contract.

1.8 Contractor shall forthwith remove or replace any of their employees who in the opinion of GSECL’s Officers, is unfit on any account to be associated with the execution of jobs awarded to the contractor.

1.9 PERIOD OF CONTRACT: - The contract for the jobs will be for a period of 03 (Three) Months.

1.10 No worker, employee or agent or sub-agent or any of contractor’s dependents shall smoke or light anything within the factory premises. Carrying of match box/lighter or any other explosive and / or inflammable materials inside the plant, is strictly prohibited.

1.11 In case canteen facilities are authorize by the contractor’s worker, employee or agent or sub-agent or any of their dependents, suitable amount will be paid to the canteen contractor directly by the contractor.

1.12 Contractor shall maintain suitable register to enter relevant particulars concerning each document handed over by GSECL to the contractor within the scope of work awarded to the contractor. Contractor will have to maintain all statutory registers, record and returns to be submitted under different laws.

1.13 Contractor shall submit to the concerned Officer of GSECL daily statements, showing pending work and progress of work in such a format and manner as may be required.

1.14 GSECL reserves its right to do any or all the jobs mentioned under the scope of work departmentally or through any other agency for which contractor shall have no claim whatsoever.

1.15 Contractor shall faithfully, honestly and with due diligence and care, execute, perform and carryout all the work as per contract. If due to the negligence or delay attributable to contractor or due to any failure on their part or their agent or their employee in exercise of due diligence, care, caution or economy or due to non-compliance of any of the provisions or directions given by GSECL, GSECL suffer or are caused to suffer any loss or damage or incur any cost or expenses, contractor shall be liable to reimburse and make good such losses and / or damages, costs and expenses immediately. Any damage to buildings or to roads or to any other properties at site or work which may be caused by contractor or their agent or their sub-contractor or their employees, shall have to be repaired, replaced or made good by the contractor immediately at their own costs as required by GSECL. In case, the contractor fails to carry out such repair / replacement job then GSECL will get such job done and cost of such job will be recovered form dues payable to the contractor.

1.17 The contractor shall ensure and make available sufficient labour force and shall put such man-power into such a position so as to carry out and discharge obligations and liabilities under the contract and to carry out the jobs awarded to the contractor and to carryout the instructions given by the Officers In charge on behalf of GSECL, in such a way that the work is carried our properly, smoothly, steadily, expeditiously, regularly and continuously.

a) In case if the contractor fails to provide required number of man-power as required by GSECL, GSECL shall arrange to procure at contractor’s cost and risks. In such case the decision of GSECL will be final and binding to the contractor.

b) Contractor will provide an effective supervision on all the jobs awarded on them. The contractor shall engage a suitable qualified and experienced full time supervisor for the purpose.

c) Female and child labour shall not be engaged for any of the jobs. d) The decisions of the requirement of number of persons, type of persons, tools and

tackles and safety equipments, for any jobs, will be taken by the Officer Incharge of the Department of GSECL where such job is to be carried out and the same shall be binding to the contractor.

e) Contractor shall procure and issue Safety Item to the labour deployed by him. It shall be the responsibilities of the contractor to issue the safety items for the use of the labour deployed by him at GSECL Site and are properly used. In case of default, pertaining t use, misuse, non-use of safety items, the penalty equivalent to double the price of safety item multiplied by the number of persons not using the items shall be levied on the contractor.

f) The contractor shall be required to submit a statistical statement in the prescribed perform to the concerned authority before 15th of each month in respect of work done in the previous calendar month.

2.0 RATES AND REMUNERATION: - 2.1 The rates quoted and agreed to shall be as stipulated in the contract. Rates applicable are based on minimum wages for Skilled, Semi-skilled and

unskilled workmen as notified by Gujarat Government effective from 01.04.2015 and then after varies as per GOG shall be payable by you to the labours engaged for this work which is binding to the contractor.

2.2 GSECL will have the right to recover the damages / losses at its discretion, terminate the contract in part or full and get it executed through some other agency, at contractor’s risks and costs, in the event of non-performance, non-fulfillment of contractual terms or breach of contract, namely but not limited to:

2.2.1 Non-fulfillment of the terms and conditions of the contract. 2.2.2 If the contractor does not deploy adequate manpower for the services stipulated under

the contract, GSECL will have the right to employ people from any alternate source and recover the extra cost incurred from any of contractor’s bill/s or Security Deposit. GSECL reserves the right to terminate the contract without assigning any reasons or without payment of compensations. The decision of GSECL in this regard, shall be final and binding to the contractor.

2.3 The contractor is not appointed as an exclusive party for this job and GSECL reserves the right to appoint one or more agencies.

3.0 PAYMENT: -

3.1 The wages of all employees employed by the contractor under this contract, shall be paid by the contractor before expiry of 7th day after last date of the month in respect of which wages are payable (i.e. wages of a month have to be paid by the contractor in the first week of the following month). The minimum basic wage rates as notified by the Government or any such other Authorities will have to be paid by the contractor to all their workers. The payment of wages, advances, bonus, settlement of employee’s legal dues, etc. shall be disbursed in the presence of GSECL’s representatives and the same shall be effected during the working hours in the factory premises.

3.2 The Clause will apply even to differential payments and such differential payments made subsequently as arrear payment shall also be disbursed by the contractor in the presence of GSECL’s representatives.

3.3 In case the contractor fails to discharge his obligations as stipulated in the contract, the security deposit shall be forfeited. The decision of the competent authority of GSECL shall be final and binding and shall not be disputed by the contractor.

4.0 INCOME-TAX: - As this being a job / labour contract, Income-Tax at the rate as at present applicable or

at a rate certified by the appropriate authority on production of documentary evidence or at a rate prescribed by the Income-Tax Authority from time to time, will be deducted from the contractor’s each bill as per The Income-Tax Act and a certificate in this regard shall be issued by GSECL.

5.0 AREA OF WORK: - 5.1 The contractor shall be responsible for deploying all categories of labour for execution

of job awarded to them in all the Plant / Units / Departments / Area as allotted to them from time to time.

5.1.1 The contractor will be required to maintain the required registers, records, etc. and would show it to representative of Personnel Department of GSECL on demand.

5.1.2 The contractor shall not deploy more number of labourers than mentioned in the

Contract Labour License as per Section 12.1 of Contract Labour (Regulation & Abolition) Act.

5.1.3 The said License shall have to be renewed from time to time by the contractor without any default.

5.1.4 The contractor shall have to maintain record of details of workers employed in Form No. 13, giving the details of their date of entry, full address and their specimen signatures or left hand thumb impression.

5.1.5 The contractor shall issue attendance card in Form No. 14 to all the labour deployed by them.

5.1.6 The contractor shall maintain attendance register in Form No. 16 and salary register in Form No. 17. The contractor shall also issue salary slips to all the labour deployed by them in Form No. 19 before the disbursement of salary is made.

5.1.7 The contractor shall maintain the register of advance in Form No. 23 and any advance disbursed to any labour should be in presence of the representative of Personnel Department of GSECL.

5.1.8 The contractor shall maintain overtime register in Form No. 23. 5.1.9 The contractor shall display on their Notice Board giving the details of wage period,

Place of disbursement of wages and time. The copy of this notice should be sent to the Personnel Department of GSECL at least 24 hours before the disbursement of wages is to be made.

5.1.10 The contractor shall maintain wage deduction register in Form No.20 and fine register in Form No. 21.

5.1.11 The contractor shall prepare half yearly return in Form No. 24 on 30th June and 31st December respectively and shall submit thee same on the next working day to the Personnel Department of GSECL without fail. The contractor shall forward the Half Yearly Return to the Labour Commissioner, Government of Gujarat, Ahmedabad and Assistant labour commissioners, Bharuch under intimation to this office.

5.1.12 The contractor shall give leave card to all their employees and maintain the leave register required under the Factories Act.

5.1.13 The contractor shall issue Identity Cards with Photograph to all the labour deployed by them within 3 (Three) days of their date of entry.

5.1.14 The contractor shall immediately inform the Personnel Department of GSECL any accident occurred in the premises of GSECL and shall fill-up the accident form in Form No. 21 and submit immediately to the Personnel Department of GSECL.

5.1.15 The summary of the Contract Labour Regulation Act in Gujarati would be displayed by the contractor on their Notice Board. The contractor would also exhibit the notice on their Notice Board at the place of work regarding hours of work, wage period, place of wage disbursement and its time and send the copies of these Notices to the Local Officer of the Factory Inspector and to GSECL.

5.1.16 The contractor shall keep and maintain all record, registers, returns, etc. in GSECL premises and should be update from time to time and should be shown to the representatives of Personnel Department of GSECL on demand.

5.1.17 The contractor shall send a copy of all the notices, shift schedules, etc. to the concerned Government Labour Officer or Factory Inspector as the case may be, with a copy to Personnel Department of GSECL.

5.1.18 The contractor shall maintain Provident Fund eligibility register and Provident Fund Deduction register, etc. and shall submit to the Personnel Department of GSECL every month for inspection.

5.1.19 The contractor shall maintain register A, B & C under payment of Bonus Act, 1965 and shall submit to the Personnel Department of GSECL on demand.

5.1.20 The contractor shall within 10 (Ten) days after last date of the month, submit to GSECL a certificate / declaration duly signed, stating that they have complied with all requirements of the Labour Laws and PF Act and has not committed any default or breach of any law applicable.

6.0 ARBITRATION: - “All question, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out or in relation there to and whether as to construction or otherwise shall be referred to the decision of the sole Arbitrator , appointed by the Chairman & MD, GSECL for that purpose, who shall be retired High Court Judge or a retired District and sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties. Reference to the Arbitrator shall be governed by the provisions of the Arbitration and Conciliation Act, 1996 as amended from time to time and rules made there under. The Arbitration proceedings shall be conducted at HO GSECL, Vadodara or at such places as the Sole Arbitrator may be determined. The award of Sole Arbitrator shall be final and binding upon the parties” B] Arbitration clause for indivisible [i.e. combined supply and works order/tenders-

“All questions, disputes or differences, whatsoever, which may at any time arise between the parties to this contract in connection with the contract or any matter arising out of or in relation thereto, shall be referred to the Gujarat Public Works Contract Dispute Arbitration Tribunal as per the Provisions of the Gujarat Public Works Contracts Disputes Arbitration Tribunal Act,1992”

In case, where divisible orders for supply and works are placed instead of indivisible supply and works order, the arbitration clause for such divisible supply order shall be incorporated as per Sr. A] above and for divisible work order, the Arbitration clause shall be as per Sr. No. B] above.

7.0 JURISDICTION: - In case of any dispute arising out of these presents, the Courts at Rajpipala only will

have jurisdiction.

TECHNICAL SPECIFICATIONS Name of work: - Providing and fixing NETLON mosquito jali, RCC cover in colony quarters at

Kevadia Colony.

ITEM NO.1: Providing and fixing NETLON make mosquito jali to the windows of colony quarters including fitting the one welcrow to the window by killas/stapplers, stitching the second welcrow to the jali including labour charges for fixing the same etc. complete as directed by EIC. (sample should be got approved before starting of the work) Specification shall be adhered to Item description. Sample should be got approved before starting of the work. The rate shall be for a unit of one sq. Metre. ITEM NO.2: Labour charges for removing the unwanted plants with roots, shrubs, trees, vegetation growth grown on outside walls, chhajahs, parapet, pipe bend of quartets, buildings, on chhajahs, on terrace, water tanks from G.L. to top of parapet & terrace and digging in concrete/ masonry by cutting the same from roots by using chisel, Kulhadi etc. & pouring acid/chemical on the roots of plants for destroying the plants from roots incl. required tools & tackles & suitable materials at any height and any location without damaging adjoining surface, G.I. pipe line ,C.I. pipe line, PVC Pipe line, window frame etc complete including filling the gap with brick masonry (1:6) & plastering the same in cement mortar (1:3) with nerru finishing the portion carefully and making the plaster same to match with adjoining surface & applying colour wash on plaster with all tools and tackles, ladder making jullas, scaffolding etc disposing of the same in outside colony premises. All the materials & tools & tackles, labours are to be brought by the contractor. The work carried out as per site situation & as per instruction of EIC. (Qty. should be operated wherever required). Qty. should be operated wherever required. Payment shall be made for whole above job provided on one number basis. ITEM NO.3: Repairing of collapsible grill of porch area of various blocks by oiling, greasing, providing and fixing necessary missing rivets, welding if required etc. Complete in all respect with all tools and tackles with safety precautions as directed by EIC. aggregate 20mm nominal size) and curing complete including cost of form work for reinforced cement concrete work in Foundations, footings, base of columns and mass concrete for preparing precast concrete cover. (Reinforcement will be given in separately). 1. Materials Cement The cement shall be of approved brand. Aggregates All aggregates shall conform to IS: 383. The natural aggregates shall be chemically inert, strong, hard, durable of limited porosity, free from adherent coatings, clay lumps, coal and coal residues and shall contain no organic or other admixtures that may cause corrosion of reinforcement or impair the strength or durability of the concrete. * Percent by weight of aggregate ** Sum of Percentages of coal and lignite and clay lumps Approved natural sand and crushed stone for structural concrete and well washed, thoroughly cleaned and graded natural gravel, shall be used as aggregates for lean and backfill cement concrete. Representative samples of selected aggregates shall be tested at the Contractor’s cost of sieve analysis from time to time as required by the Engineer for approval. The aggregates shall conform to the following requirements: Fine Aggregates Fine aggregates (sand) shall be clean, sharp, coarse sand with a fineness modulus between 2.2 and 3.2 (Fineness modulus is the sum of cumulative percentages retained on the IS sieves given below for graduation divided by 100). The contractor shall check and ensure that local sand will satisfy this requirement and if necessary shall include for and supply materials from other sources which comply with the specifications. It shall be graded as follows: The objectionable foreign matter in sand shall be removed by screening or washing or both as required. Coarse Aggregates The pieces shall be angular in shape and shall have granular or crystalline surfaces. Friable, flaky and laminated pieces, mica and shale, if present , shall be only in such quantities that will not, in the opinion of Engineer, affect adversely the strength and / or durability of concrete. The maximum size of the aggregate shall be as specified in the drawings / specifications. The maximum size of coarse aggregate shall be the maximum size specified, but in no case greater than ¼ of the minimum thickness of the member, provided that the concrete can be placed without difficulty so as to surround all reinforcement thoroughly and fill the corners of the form. For heavily reinforced concrete members, the nominal maximum size of the aggregate shall be 5 mm less than the minimum clear distance between the reinforcing main bars or 5 mm less than the minimum cover to the reinforcement whichever is smaller. Crushing Value The aggregate crushing value, when determined in accordance with IS:2386 (Part IV) shall not exceed forty five (45) percent for aggregate used for concrete other than for wearing surfaces and thirty (30) percent for concrete for wearing surfaces, such as roads, pavements and floor finishes. The aggregate impact value may be determined in accordance with the method specified in IS:2386 (Part IV). The impact value shall not exceed forty five (45) percent by weight for aggregates used for concrete other than for wearing surfaces and thirty (30) percent by weight for concrete for wearing surfaces, such as roads, pavements and floor finishes. Abrasion Value Unless otherwise agreed to between the Purchaser and the supplier, the abrasion value of aggregates, then tested in accordance with the method specified in IS:2386 (Part IV), using Los Angeles Machine, shall not exceed the following values : A. For aggregates to be used in concrete for wearing surfaces: Thirty (30) percent B. For aggregates to be used in other concrete (structural): Forty five (45) percent The amount of fine particles occurring in the Free State or as loose adherents shall not exceed 1% when determined by laboratory sedimentation tests as per IS: 2386. After 24 hours immersion in water, a previously dried sample shall not have gained more than 10% of its even dry weight in air, as determined by IS: 2386. Should at any time the Engineer have reason to consider any aggregate defective or of poor quality, then irrespective of any

previous approval or tests, representative samples of such materials shall be immediately tested and until the results of such tests prove the material to be satisfactory, it shall not be used for any work. The contractor shall not be entitled to any claim of any nature on this account. The cost of these (including collection of samples and transportation) shall be borne by the Contractor. Storage of Aggregates All coarse and fine aggregates shall be stacked separately in stock piles to avoid mixing of different aggregates. While heaping the materials, contamination with foreign materials and earth shall be avoided. The aggregates must be of specified quality not only at the time of receiving at site but particularly at the time of loading into mixer. The coarse aggregates shall be piled in layers not exceeding 1.20 meters in height to avoid segregation: each layer shall cover the entire stock piled area before placing the next layer. Aggregates that have become segregated shall be rejected; however, rejected material may be accepted after remixing if subsequent tests demonstrate conformance with required gradation. Water Water for all work shall be fresh, clean and free from injurious or deleterious materials and conforming to IS:3025. The Contractor shall provide at his own cost for distribution, storage, filtration and / or treatment, as necessary of the required quantity of water. Quality of water to be used in concrete shall be such as to obtain the consistency specified; this quality of water shall be subject to approval by the Engineer on the basis of test finding and shall in no case be changed without permission. The suitability of water for making concrete shall be ascertained by the compressive strength and initial setting time test specified in IS:456. The sample of water taken for testing shall be typical of the water proposed to be used for concreting, due account being paid to seasonal variation. The sample shall not receive any treatment before testing other than that envisaged in the regular supply of water proposed for use in concrete. The sample shall be stored in clean container previously rinsed out with similar water. Average 28 day compressive strength of at least three 15 cm concrete cubes prepared with water proposed to be used shall not be less than 90% of the average strength of three similar concrete cubes prepared with distilled water. The initial setting time of test block made with the appropriate test cement and the water proposed to be used shall not be less than 30 minutes and shall not differ by more than 3 minutes from the initial setting time of control test block prepared with the appropriate test cement and distilled water. The test blocks shall be prepared and tested in accordance with the requirements of IS: 4031. The water used shall also conform to the following:- a. To neutralize 200 ml sample of water, using phenolphthalein as indicator, it should not require more than 2 ml of 0.1 normal NaoH. The details of test shall be as given in IS:3025. b. To neutralize 200 ml sample of water, using methyl orange as an indicator, it Mixing of Concrete Cement, sand and crushed stone shall be measured by weight as directed by the engineer; the components of the concrete shall be batched in such a way that each batch contains a whole number of cement bags. Concrete shall be mixed in concrete mixers of a size and type previously certified & acceptable to the Engineer. Concrete shall be mixed in the machine for at least one (1) minute dry and for at least one and half (1-1/2) minutes after adding water. Mixed concrete shall be of even colour and uniform consistency. Concrete shall be mixed only in such quantities as are required for immediate use. No more concrete shall be mixed in any one lot than that can be laid in position before the “Initial Setting” occurs. Partly set or re-tampered concrete shall not be used. After the finish of each day’s work the mixing plants shall be thoroughly washed and cleaned. On commencing work, the first batch shall have 10% additional cement. The mixer and weigh batchers shall be maintained in a clean serviceable condition. The accuracy of weight batchers shall be periodically checked. They shall be set up level on a firm base and the hopper shall be loaded evenly. The needle shall be adjusted to zero when the hopper is empty. Fine and coarse aggregates shall be weighed separately. Volume batching will not be permitted. However, Engineer may permit to volume batching by subsequent conversion of the weights of the aggregate into their equivalent volumes knowing their bulk densities, only in the case of small and less important pours. All concrete shall be mixed in mechanically operated batch mixers complying with IS: 1791 and of approved make with suitable provision for directly controlling the water delivered to the drum.

The water – cement ratio to be adopted shall be determined in each case by the Contractor as frequently as desired by the Engineer and shall be approved by him. The water cement (W/C) ratio is defined as the weight of water in the mix/including the surface moisture of the aggregates) divided by the weight of cement in the mix. This cement concrete is for preparing precast concrete cover. Consistency & Workability of the Concrete Consistency and workability of concrete shall be checked by measuring the slump of a truncated cone of concrete straight from the mixer under normal working conditions. The conical mould shall be metal, 300 mm high and 100 mm and 200 mm in diameter at top and base respectively. Moulds shall be prepared by Contractor. The slump range of concrete shall be as mentioned in the “Issued for Construction” drawings. Slump tests shall be performed as per IS:1199 at intervals established by the Engineer at the Contractor’s cost in such a way as to check that degree of consistency established by the Engineer for work in progress is maintained. Curing Concrete cover shall be kept damp for as long a period as practicable. Concrete surfaces that are approximately horizontal shall be cured by ponding, water being maintained at a depth of at least 25 mm for a minimum period of 14days. Wall shall be draped with hessian cloth as soon as practicable after pouring has been completed. The hessian cloth shell be kept saturated by means of continuous pumped flow of water from perforated pipes or other methods, if approved, for the period Arrangements shall be made by the Contractor for a standby supply of water in case of failure of the normal supply. The contractor shall see that the sump / water retaining structure are watertight. Any parts which show signs of leakage are to be marked during the test and are to be traced to the inside face of the pond after emptying and sealed with bitumen or other suitable material and retested to the satisfaction of the EIC. This shall be deemed to be included in the rate of concrete work. Sub – standard Concrete Should the work strength of controlled concrete fall below the specified strength, Engineer shall decide: To reject the work, in which case the Contractor shall replace the defective work with concrete of required strength and bear all costs for dismantling and replacing including the cost of associated framework, reinforcement, embedded parts and associated works. To accept the work at a reduced rate, in which case the unit rate payable for sub – standard work will be reduced by the Owner directly in proportion to the work strength as compared to the specified strength. The owner may, in addition, require other tests performed on the respective structural member so accepted prior to its acceptance with or without necessary corrective measures and in each such case the Contractor shall bear all costs for all such test or corrective measures, besides the reduction in the unit rates as specified herein. Concrete of strength below fifteen (15) percent of the specified strength will not be accepted. The load test shall be at 125 percent of the maximum superimposed load for which the structure was designed. plus full dead load. Such test load shall be applied after 28 days after placing of concrete. During the test, struts strong enough to take the whole load shall be placed in position leaving a gap under the members. The test load shall be maintained for 24 hours before removal. If within 24 hours of the removal of the load the structure does not show a recovery of at least 75 percent of the maximum deflection under super imposed load shown during the 24 hours under load, the test loading shall be repeated after a lapse of at least 72 hours. The structure shall be considered to have failed to pass the test if the recovery after the second test is not at least 80 percent of the maximum deflection shown during the second test. If the structure is certified as failed by the Engineer, it shall be demolished by the contractor at his own cost & reconstructed. Jointing with Adjacent works The contractor shall bond new work to adjacent completed work, as shown in the drawing or as directed, by chipping, cutting or drilling of old concrete, by embedding new dowels in old concrete or by exposing and cleaning the reinforcement of the old structure and lapping / welding new reinforcement to obtain continuity. All precautions as specified for preparing construction joints, shall also be taken for this work. Rates & measurements

Rates The quoted rates shall include the cost of labour, materials, mixing, placing in position, vibrating, compacting, finishing including , rendering and smoothening, curing, sampling, testing and all inclusive and no claims for extra payment on account of such items as formwork, leaving holes, pockets, embedding inserts , etc shall be entertained unless separately provided for in the schedule of Quantities. No extra claim shall also be entertained due to change in the number, position and/or dimension of holes, slots or openings, sleeves, inserts or on account of any increased lift or scaffoldings, etc. All these factors should be taken into consideration while quoting the unit rates. Unless provided for in the schedule of quantities, the rates shall also include fixing inserts in all concrete work, whenever required. The quoted rate of concrete work shall include the laying in position and fixing of all inserts, bolts, embedment, fixtures and fitting, etc. The supply and fabrication of these inserts, bolts, embedment, etc. shall be paid for separately. Payment of concrete will be made on the basis of unit rates quoted of the respective items in the schedule of Quantities. The quoted rate also includes the shuttering/ formwork, staging etc. required for concreting. No extra payment shall be made for shuttering/ formwork, staging etc. for which the specifications shall be as per foregoing paras. Measurement It will be measured as per actual volume of work for various grades of concrete as executed or as per drawings issued whichever is less and shall be measured in cubic meter correct up to second place of decimal. No deductions shall be made for the following. i) Reinforcements, sleeves, anchor bolts, inserts, etc ii) Opening up to 0.05 Smt in area where concrete is measured in sq m & 1/150 Cmt where concrete is measured in Cmt. iii) Volume occupied by pipes. Conduits, sheeting, etc not exceeding 100 sq cm in cross sectional area.

The rate shall be for a unit of one cubic meter

Item no.5: Providing mild steel reinforcement (ISI Mark) for R.C.C. work including, bending, binding and placing in position complete up to floor two level.

All reinforcement bars, pain, tor steel etc. specified in item shall confirm to relevant IS standard i.e IS432 in mild steel and medium tensile steel, IS 1139 for deformed bars, IS 1786 for cold twisted bars etc., wherever tested bars to be used, certificate for the same from manufacturer shall be submitted. If Executive Engineer instructs it, contractor shall have to arrange for testing of bars at the laboratory or institution, suggested by GSECL at his cost.

Bars shall be bent as per bar bending schedule supplied with drawing. If bar bending schedule is not supplied contractor shall prepare it and get it approved at site before cutting for fabrication.

Bars shall be clean, free from rust, dust mud etc, if coils are there, they shall be first straightened. Bars shall be cut according to the cutting length specified/approved by department. Bars shall be bent gradually. Bars having crack or splits shall be rejected. Bars shall be bent cold, unless otherwise specified in case of higher diameter bars. If bar is bending wrongly, it should be straightened and re bent such that it does not injure the materials. Laps and splices shall be got approved. They shall be staggered and shall be at location shown/approved. Lapping shall be avoided when full length bars are available. All laps, hooks, bends etc. shall be provided as per IS standards. Reinforcement bars shall be place in position as per instruction of EIC. It shall be tied with annealed black wire/G.I. wire of 18 gauges. Blocks, spacers, chairs etc, shall be provided as per IS. 2502 at places instructed. Bars shall be provided with clear cover as instructed on site. Cover shall be provided with cement mortar cover block prepared of specified thickness with binding wire embedded to fix cover in position and tie with the reinforcement so that it may be not get disturbed. Minimum clear cover shall be less than 13mm or diameter of bars for slabs. For beam and columns depending on size it shall be 20mm to 25mm. Cover shall be provided depending on structure, weather condition, location of structure etc, as per ISI. The bars should be used for making the handles for lifting the precast cover as per the instruction of EIC.

After the reinforcement is tied and checked by contractor himself it shall be got checked by GSECL authorized representative and okayed for pouring of concrete. Quality of reinforcement bars in M.T. embedded in concrete shall be paid. Weight shall be computed on cutting length approved or given multiplied by standard weight of particular diameter of bars as per IS standards. Work shall be carried out at all levels, “Rate quote shall inclusive of providing & placing mild steel bar reinforcement, including wastages if any, cost of binding wire etc, No separate payment will be made for binding wire, However laps, dowels etc, shall be paid as actual provided & approved on site.
