Indian Oil Corporation Ltd, Bongaigaon Refinery (IOCL-BGR) invites electronic bids through its websitehttps://iocletenders.gov.in under two bid system, (Part-I : Techno-Commercial Part & Part-II : Price Part) for the work asdetailed below, from experienced Contractors fulfilling the qualifying requirements as stated hereunder:

6. Bid Qualification Criteria 6.1 Financial Criteria:

The annual financial turnover of the Bidder during any of the precedingthree financial years shall be at least Rs. 51,67,217.00

6.2  Experience Criteria

6.2.1 Bidder should have experience in successful completion of similar job asunder during any of the last five years ending on the last day of the monthimmediately previous to the month in which last date of bid submissionfalls of value as mentioned below: 

a) Three similar completed works each costing not less than the amountequal to Rs. 25,83,609.00 OR

b) Two similar completed works each costing not less than the amountequal to Rs. 34,44,811.00 OR 

c) One similar completed work costing not less than the amount equalto Rs. 43,06,014.00.

Similar job : Manufacturing/Repairing/Overhauling of Furnace inhydrocarbon processing industries.

NOTE: (a) Documentary evidence in the form of copy of Work order/Agreement and

completion certificate containing executed value from the client should besubmitted along with the name of the company, address, contact personwith Telephone, Fax, e-mail address in support of experience criteriaunder Sl. No. 6.2.1. In case executed value is not mentioned in thecompletion certificate, copy of certified bill shall also be acceptable fordetermining the executed value provided completion certificate is alsosubmitted. Bids without proper evidence are liable to be rejected.

(b) The completion certificate, submitted by the bidder shall separately indicatethe service tax amount included in the value of completed job OR aseparate certificate from the respective client, mentioning the service tax

amount if any, included in the value of completed job under considerationshould be submitted by the bidder.

(c) In case Service Tax amount/component is not specified in the submittedcompletion certificate, then the amount equivalent to rate of applicableservice tax for the subject tender shall be deducted from the value ofcompleted job mentioned in the completion certificate to arrive at thevalue of the completed job without service tax. Amounts mentioned underclause 6.2.1 above are excluding Service Tax. 

(d) Financial turnover shall be as per Balance Sheet including Profit & Loss Account of the bidder audited by a Chartered Accountant.

(e) For Annual Rate Contracts (ARC) of repetitive nature, similar ARC job thathas been successfully completed by bidder for the originally awardedperiod of such ARC shall be considered as completed works even thoughsuch ARC is under execution on account of extension. However, the

original contract must have been completed within the cut-off date ofcompletion as mentioned under clause 6.2.1 above and documentaryevidence thereon shall be provided by the bidder.

to quote for the execution of the same job for which they are working as consultant.

f) Conditional offers are liable for rejection. Offer shall be evaluated with respect to bid qualification criteria todetermine the techno-commercially qualified bidders. Offers of unqualified bidders is liable for rejection..

g) IOCL-BGR reserves the right to accept/reject any or all bids or to split the work amongst various contractors

or to award only part of the work or annul the total bid process without assigning any reason whatsoever. Nocompensation is paid for the efforts made by the contractor in case tendering process is abandoned by IOCL-BGR.

h) Prevailing Government guidelines regarding Purchase Preference shall be applicable.

i) The bidder shall bear all costs associated with their bid including costs and expenses relating to the visits tothe site etc. and IOCL-BGR will in no case be liable for these costs regardless of the outcome of the biddingprocess.

 j) IOCL (BGR) at its discretion may extend the deadline for submission of the bids.

k) Any dispute relating to this NIT is subject to jurisdiction at Bongaigaon, Assam.

1.0 GENERAL

1.1 This Special Instructions to Bidders (SITB) shall be read in addition to the Instructions toTenderers (ITB) appearing in page No. 79 to 87 of General Conditions of Contract.

1.3 Pre bid meeting shall be held on the date and time as mentioned in the Notice InvitingTender or its corrigendum to resolve bidders’ queries, if any. Bidder shall forward theconsolidated pre-bid query (if any) to IOCL by E-mail as per the format attached in thebidding document at least 5 days prior to the scheduled date of pre-bid meeting.  

1.4 In case foreign contractors intents to participate, tenders can be submitted either by the

contractor directly or by their Indian Agent on behalf of them, but not both. The Indian Agent should represent only one contractor and he shall not quote on behalf of anothercontractor for subsequent or parallel tender for the same job. 

1.5 Consultant appointed for the project / job is not allowed to participate in the tender eitherdirectly or indirectly. An indirect participation shall include participation through an affiliateor as a sub-contractor, consultant or supplier. The expression ‘affiliate’ for the purpose ofthis clause will include any person, or company or association (howsoever designated)who/which is a member of the consultant (if the consultant is a joint venture or consortiumor who or which directly or indirectly holds 10% (ten percent) or more of the capital orvoting capital of consultant (if the consultant or any of its members is a company or a bodycorporate) or who or which is a consultant or sub-contractor of the consultant with regard

to the project. 1.6 The Bid, all correspondence and documents relating to the bid, between Bidder and IOCL

(BGR), shall be written in English language only. Any printed Literature furnished by Biddermay be written in other language provided that this Literature is accompanied by anauthenticated English translation in which case, for purpose of interpretation of the Bid, theEnglish translation shall govern. Bid submitted in any language other then English as notaccompanied by an appropriate English translation will be rejected, without assigning anyreason thereof. 

1.7 After downloading of the Bidding Document from tender portal and at least 2 days prior tothe deadline for submission of bid, Bidder shall acknowledge receipt and confirm hisintention to bid for the subject Work in the prescribed format by mail and also state his

intention to participate in the pre-bid discussion, if scheduled as per NIT. 

1.8 Once quoted, the bidder shall not make any subsequent change in price or other changes,whether resulting or arising out of any technical/ commercial clarifications and detailssought on any deviations, exceptions or stipulations mentioned in the bid unless anyamendment to Bidding Document is issued by Owner. Similarly, no revision in quoted pricemay be allowed should the deviations stipulated by him are not accepted by Owner andare required to be withdrawn by him in favour of stipulation of the Bidding Document. Anyunsolicited proposed price change is likely to render the bid liable for rejection. 

1.9 Bidders shall quote the prices in Indian Rupees only unless otherwise specified in thetender. 

1.10 Cutting and corrections in the bid document should be avoided and if it is unavoidable, itshould be kept at the bare minimum and it should be neatly cut and re-written without over-writing and use of white fluid. All corrections should be duly signed by the tenderer. In case

the tenderers resorting to many corrections including usage of white fluid in the tenderdocument, the tender shall be liable for rejection. 

1.11 Bidders should submit their quotation on their letterhead only or by way of return of originaltender formats duly filled. If the tender document is attached with any communication orterms and condition, the same should be on party’s letterhead. Any tender submitted bythe tenderer in violation of above is liable to be rejected. 

1.12 The following conditions are applicable for conventional tenders invited throughwww.indianoiltenders.com 

i) Tenderers are advised to download the documents from Indian Oil website i.e.www.indianoiltenders.com, after due registration. This is to ensure that the bidderdownloads proper/complete tender documents. This also enables the bidder to visitthe website for any corrigendum / correction which is essential for submitting propertender. However, tenders from bidders who have not downloaded the documents fromIOCL website may also be accepted, provided the tenderer submits the requisitetender fees and EMD along with the Techno Commercial Bid. Such Tenderers arealso advised to visit the official website from time to time for any corrigendum orcorrection. Failure of bidder to submit tenders without taking cognizance ofcorrigendum/amendment issued by IOC are liable for rejection.

ii) Tenderers submitting the documents downloaded from other than official websiteshould give an undertaking to the effect that they shall abide by all the terms andconditions as per documents hosted in official website, should there be anydiscrepancy observed in the submitted tender, at a future date. Also they shouldundertake to agree for all decisions confirmed in pre-bid meeting. A standardundertaking in this regard may be included as a part any declaration that is normally

obtained from the bidders.

2.0 DefinitionsWith respect to this document, the following definitions shall apply:i) “Tender” or “Bid” shall mean Bidder’s offer to perform the Work, in accordance with

Bidding Document.

ii) “Tender Document” or “Bidding Document” shall mean the documents issued byOwner through tender website including any subsequent addenda to enable bidder tosubmit his Bid.

iii) “Bidder” or “Tenderer” shall mean the person or company who receives the TenderDocument and submits Tender or Bid to IOCL (BGR).

iv) The words “owner’, ‘purchaser’, IOCL, ‘IOCL (BGR)’, ‘Corporation’ have been usedinterchangeably and would mean the same in expression and intent in propercontext. Also, the words ‘bidder’, ‘tenderer’, ‘contractor’, ‘vendor’ have been usedinterchangeably and would mean the same in expression and intent in propercontext.

v) The words “Schedule of Rates” or “Bill of Quantities” have been usedinterchangeably and would mean the same in expression and intent in propercontext.

3.0 Submission of the Bid

3.1 The Bid shall be submitted in two parts viz. PART-I (Techno-commercial/ Un-priced Bid) &PART-II (Priced Bid).

3.1.1 PART-I of bid will contain the following documents:

3.1.1.1 Earnest Money Deposit (EMD)

x) Master Index enclosed with the tender document duly signed and stamped by theBidder in token of having received and read all parts of the Bidding Documents andhaving accepted and considered the same in preparing and submitting the Bid.

xi) Copy of MSE certificate if bidder is registered MSE for tendered item (In case ofSC/ST MSE, caste certificate issued by District Authorities also to be uploaded).

xii) Activity Bar chart (As specified in point 4.2.1. of SCC-II in the tender).

xiii) Valid Electrical contractor’s license (for job involving electrical works).

xiv) Valid Electrical supervisory certificate of competency (for job involving electricalworks).

3.1.2 PART-II (Priced Bid) of the bid shall consist of the duly filled in Excel file provided by IOCL-BGR as a part of tender document for E-tenders. In case of other than E-tenders, the pricebid shall be submitted within a sealed envelope in physical hard copy. No stipulation,deviation, terms & conditions, presumption, basis etc. shall be stipulated in Priced bid.Owner shall not take cognisance of any such statement and may at their discretion, rejectsuch Bid.

4.0 Bid Validity 

4.1 Bid shall remain valid for 4 (four) Months from the due date of opening of Bid. The Biddershall not be entitled during the said period to revoke or cancel his bid or to vary the bidexcept and to the extent required by Owner in writing. In case the tenderer alter / modify /withdraw his bid after deadline for submission of bid and within the validity period, thetender submitted by the tenderer shall be liable to be rejected and EMD forfeited. In caseof failure of the party for more than one occasion, the tenderer may be put on holiday listfor a period of one year.

4.2 Owner may request the bidder for extension of the period of validity of bid. If the bidder is

asked to extend the validity the same should be without any deviation in the terms andconditions including change in prices.  If the bidder agrees to the extension request, thevalidity of Bank Guarantee towards EMD/Bid Security shall also be suitably extended.Bidder may refuse the request of extension of bid validity without forfeiting his EMD/BidSecurity. However, bidders agreeing to the request for extension of validity of bid shall notbe permitted to modify the bid because of extension, unless specifically invited to do so.

5.0 Bid opening and evaluation 

5.1 Opening of Techno-Commercial Part of Bid

5.1.1 This part will be opened on the scheduled date and time as specified in Notice InvitingTender or any extension thereof. In case of e-tenders, bidder’s physical presence is not

required during bid opening.5.1.2 In the event the specified date of physical bid submission/opening (other than for e-

tenders) happens to be a holiday or a non-working day for IOCL (BGR), the date ofphysical bid submission/opening shall stand extended automatically upto the specified timeof next working day. However for e-tenders, there will not be any extension of online bidsubmission date if there is local bandh/strike on the date of submission; but in such case,the physical EMD instrument can be submitted upto the specified time of next working day.

5.2 Techno-Commercial Evaluation of Bids

5.2.1 Bidders who are found to qualify based on the Qualification Criteria specified in the NITshall be considered for detailed Techno-Commercial evaluation. Decision of Owner in thisregard shall be final and binding.

5.2.2 IOCL (BGR) reserves the right to use in-house information for assessment of Bidder’scapabilities keeping in view their performance in past job(s) with any client. Past

performance shall include safety related performance also.5.2.3 Though Qualification Criteria mentioned above are the basic criteria for consideration of a

bid, fulfilment of the same shall not automatically mean qualification of the bidder foropening of the price bid or for award of the job.

5.2.4 To assist in the examination, evaluation and comparison of bids, IOCL(BGR) may ask theBidders individually for clarification of their bids. The manner of such communication shallbe as decided by IOCL-BGR.

5.2.5 Notwithstanding any provision contained anywhere else in the bidding document regardingsubmission of any document by the bidder, IOCL-BGR shall have the absolute discretionto request any bidder for any additional/shortfall/outstanding documents for the purpose ofbid evaluation. Bidder shall submit all additional documents if asked for, in the manneradvised.

5.3 Opening of Price Part of Bid

5.3.1 Priced bids of only those Bidders who are found to qualify based on the QualificationCriteria specified in the NIT and whose bids are considered techno-commerciallyacceptable shall be opened after giving intimation to qualified bidders. Price part of bidsshall be opened in presence of bidder for physical bid opening and without presence ofbidder for opening of E-bids.

5.3.2 Pre-price bid conference – In certain specific tenders and if decided by IOCL-BGR, therewill be a pre-price bid conference with technically acceptable bidders. Other aspects of

such pre-price bid conference are5.3.2.1 All the commercial aspects will be fully clarified to the technically acceptable bidders.

5.3.2.2 Based on discussions in the pre-price bid conference, deviations, if any, from tenderedterms and conditions shall be communicated in writing to all the bidders and they shall beasked to submit their revised price bids when substantial changes are made/or priceimplication on their earlier quoted rates in other cases after taking into account themodified terms and conditions including deviations, within stipulated period. It shall beclearly understood by the bidder that if they take any further deviations, their offer shall berejected outright. Revised price bids received after the stipulated date shall not beconsidered. Bidders unable to comply with OWNER’s terms and conditions includingproposed deviations will be allowed to withdraw.

5.3.2.3 If a bidder takes any further deviations other than those agreed, while submitting therevised price bids/price implication, his price bid shall be rejected outright without anyreference. In case it is found after opening that any deviation is incorporated in the revisedprice bid, vendor/ bidder is also liable to be placed on holiday for a period of one year forfuture tenders in IOC.

5.3.2.4 Decisions will be taken strictly on the basis of revised price bids. Price negotiation ifconsidered necessary by OWNER, may be carried out with L-1 bidder.

5.4 Evaluation of Priced Bid

5.4.1 The price bids will be evaluated by OWNER to ascertain the relative position of the best-evaluated Tender in the interest of OWNER.

5.4.2 The quoted price of bidder shall be subjected to loading on account of the followings:

a) Price Reduction clause - The difference between the quantum as per GCC and thatoffered by the tenderer shall be added to the tendered amount.

b) Payment terms - In case bidders take deviations to the specified payment terms,loading for interest implication at 1% higher than IOC's cash credit rate shall be done.

c) Specific Discount - This will be considered while preparing comparative statement.

d) Item wise quotation - In such cases where the party has not quoted for each andevery item and few items have been left over which are not more than 5% based onestimated rate, the offer shall be evaluated by considering the highest rate quoted bythe other tenderers. If after taking the highest rate, party comes out to be the lowest,then the lowest party can be called for price negotiations and asked to match theunquoted items rates with the lowest offer.

e) Cenvat benefit - For the purpose of evaluation of offers, Cenvat benefit offered by

bidders on account of excise duty / CVD shall be considered for determining thelowest offer. In case the bidder is not able to submit relevant documents to IOCL-BGRfor claiming the Cenvat corresponding to guaranteed amount, the order value shallstand reduced corresponding to shortfall documents.

f) In case of any benefit to IOC R&D for the usage of IOC R&D formulations by thetenderer in the form of royalty, such royalty inflow net of prevailing taxes / surcharges,shall be deducted from the quoted price as specified in the tender documents.

5.4.3 If any unconditional rebate has been offered, the same shall be considered in arriving atthe net quoted price. No cognisance shall be taken for any conditional rebate, for thepurpose of evaluation of offer.

5.4.4 Any uncalled lumpsum / percentage reduction by the Bidder after the due date shall not beconsidered for evaluation. However, if reduction is from the Bidder who is otherwiseevaluated lowest, such reduction shall be taken into account for arriving at the contractvalue (if awarded) and not for evaluation purpose.

6.0 Negotiation and award of contract

6.1 Negotiations will not be conducted with the bidders as a matter of routine. However,Corporation reserves the right to conduct negotiations. Bidders to quote competitive pricesconsidering the fact that price negotiations, if required, will be held with the lowest tendereronly, unless specified otherwise in the tender.

6.2 Within the period of bid validity granted by the Bidder, IOCL(BGR) will notify the successful

Bidder in writing by letter sent by registered post/courier/mail or hand delivered intimatingIOCL’s acceptance of the bid.

6.3 Owner shall not be obliged to furnish any information/ clarification/explanation to theunsuccessful bidders as regards non-acceptance of their bids. Owner shall correspondonly with the successful bidder.

6.4 For contracts of value Rs. 10.00 lakhs and above, the successful Bidder(s) shall have toexecute a formal Contract with IOCL(BGR) in accordance with the form of contract in theformat prescribed in G.C.C. forming part of the bid documents within 30 (thirty) days fromthe date of receipt of the Letter of Acceptance of Bid from IOCL(BGR) on a non-judicialstamp paper and of appropriate value. The cost of non-judicial stamp paper shall be borneby the Bidder.

6.5 Until the formal contract is signed, the bid documents and Addendum (a) at any time andany modification thereto and/or therefrom agreed upon by IOCL(BGR) read with the

Bidder’s final bid shall be considered as contract.6.6 The Contract document shall consist of the following:

i) Agreement (Form of Contract), on non-judicial stamp paper by Owner andContractor.

ii) Letter of Acceptance.

iii) The Bidding Document alongwith the drawings, if any.

iv) General Conditions of Contract of Indian Oil Corporation Ltd

v) Amendments to Bidding Document or post award Amendment, if any.
