TEPP Patios | Winter Update

We recognize!that this has been an exceptionally challenging time for local businesses and we hope that the Temporary Expedited Patio Program has supported your business recovery e"orts throughout the summer.

As we near the end of the 2020 instalment of this program, and winter weather returns, there are some important dates and requirements your business should be aware of if you intend to retain and use your patio past October 31, 2020.

Permits for temporary patios on City property, issued through the Temporary Expedited Patio Program, will expire on October 31, 2020.

To extend your temporary patio past this date, businesses are required to reapply for a new temporary patio permit (free). If your temporary patio permit is on private property your permit will be automatically extended and you don’t need to apply for an extension.

Help prevent the transmission of COVID-19

As COVID-19 is primarily spread from person to person through respiratory droplets released into the air when talking, coughing, and sneezing, fresh air must be able to circulate throughout your patio. Learn more

Winterizing patios With rain and colder weather upon us, winterizing your patio may help to keep customers dry, warm and comfortable during their dining experience. Businesses must obtain and pay for any gas, electrical and awning permits required to winterize a temporary patio. Please use this guide to learn what is allowed for your type of patio. Depending on what features you want for your patio, you may require additional permits for your heating, lighting, or covering.

Winter season brings darker days with heavy rain, wind and sometimes even snow. We all want to make sure that we continue to operate patios safely for sta", patrons and the public.

A condition of permit extension will be compliance with the terms and conditions of the permit and of the TEPP program. Fines and enforcement may also be used in certain instances.

Winter options | Curbside Patios

Umbrellas are permitted within curbside patios Tents or other structures are not permitted in curbside patios to ensure full visibility for people walking, cycling and driving. To comply with health guidelines spaces must allow for ventilation and spaces cannot be enclosed. Umbrellas can only have a single post. Items in red below are NOT permitted.

Curbside Patios Heaters • Portable heating devices, including propane heaters are

allowed within curbside patios • Heaters under or near umbrellas or trees are NOT permitted • Heaters must be at least 160cm (65”) tall and installed and

used following manufacturer’s requirements • Heaters must be brought inside daily at close of business and

propane tanks must be caged and locked in a vented structure outside in compliance with the BC Gas Safety Regulation

Lighting • Solar or battery powered lights on tables or railings are allowed

within curbside patios • Running power (cables) from the building to the patio is NOT

permitted • Suspended lights are NOT permitted

Visibility • To maximize the visibility of the patio for oncoming tra#c an

object marker must be installed and retro-reflective tape or reflectors may be added to the patio

• Object marker signs warn road users that they are approaching objects within and immediately adjacent to the pavement that constitute a hazard to passing tra#c. Please make sure that an object marker has stripes which slope at a 45-degree angle down toward the travel lanes of the roadway as shown in the examples to the right

Maintenance • The patio will be visited by you on a daily basis to remove litter,

debris, leaves, and snow in and around the patio and surrounding catch basins

• Any food packaging, waste, debris, or leaves collected must be discarded in appropriate commercial bins

• Cleaning area: Patio footprint plus 1.5 metres onto the sidewalk and additional 5 metres along the curb in both directions to facilitate City street cleaning, as shown in red below

Umbrellas | Requirements Umbrellas must sit within the footprint of the patio and not extend over on to the sidewalk or tra!c lanes • Must be at least 1m away from an adjacent building (fire clearance requirements) • Must not obstruct exits or restrict movement between building and sidewalk • Must not be attached to railings • Must not obstruct fire department connections • Must be secured to the ground with su#cient weights/concrete blocks/sandbags to

prevent shifting or blowing away (do not connect directly to the sidewalk or street) • Ensure any snow is brushed o"; and excess water drained • Must be removed and stored at the end of each day

Propane heaters | Requirements Must be CSA/ULC listed and be designed for outdoor use only • Must be brought inside daily at close of business and caged and locked in a vented

structure outside in compliance with the BC Gas Safety Regulation • Must be free-standing and be placed on a non-combustible and solid surface that is

not the table top • Not permitted to be placed under any patio coverings, under fire escapes, within

means of egress or adjacent to an exit, not attached to trees, utilities, or other street elements, and must not be adjacent to, or obstruct firefighting equipment (for example,!hydrants, fire department connections, etc.)

Applicant must ensure • Compliance with all applicable orders from the Provincial Health O#cer (including

occupancy, seating configurations, gathering restrictions, etc.). Please review the most up-to-date information

• Valid BC liquor licences (for patio options that allow liquor), and that railings are installed and maintained for liquor service areas

• Patios are accessible to people of all abilities (ramps and seating options) • Compliance with all applicable City By-laws

Introduction | ContextThe COVID-19 pandemic has inflicted significant negative economic impacts to Vancouver businesses, restaurants, tourism, and personal care industries. Restaurants have been one of the most immediate and hardest hit sectors, and small business operators are struggling to survive with many limited to takeout o!erings and attempting to make it through the pandemic

Small businesses like restaurants are vital to the fabric and character of Vancouver neighbourhoods and support complete communities, and are key contributors to Vancouver’s economic health generating jobs and tax revenue

• Facilitate economic recovery with speed, flexibility, and nimbleness by streamlining tools and programs and making necessary regulatory changes

• Support businesses in maintaining health measures and physical gathering restrictions

• Develop and test innovative approaches to patios – such as pop-up patios, spatial expansions, public space reallocation, and “turnkey” guidelines

• Review and improve on existing patio regulations and programs

• Demonstrating to our business community, specifically hard hit restaurants, that supporting them is a priority for Council.

• Supporting sta! in prioritizing this work.

Phase 1 | Patio OptionsAt present, the Temporary Expedited Patio Program (TEPP) will consider patio applications that fit three options on City property: small patio, curbside patio (on-street parking spaces), and large patio. The following pages will guide you through the description and specific requirements for each of these patio options.

Applicants must meet all of the requirements of the options they’re applying for. These pre-approved requirements will ensure that patio applications can be e"ciently and quickly permitted and implemented. General rule of thumb: the simpler the patio proposal, the easier it is to approve and implement.

The program will be available from June 1st to October 31st, 2020. Permits issued are non-renewable. If applicants meet all requirements, the permits may be issued within two business days of application submission. If applicants want to keep their patios beyond October 31st, they will need to reapply through the regular Annual Patio Permit avenues.

Please carefully read through the patio details and requirements to ensure you are prepared for your application and to avoid any potential delays.

Patio Options | Small PatioDescription Small patios are located directly against the business property,

either in the front or on the side where there is suitable public space. Small patios are not enclosed by railings.

Liquor Businesses may not serve liquor in small patios.

Requirements Furniture may not be stored on the patio overnight. Businesses must take in furniture at closing hour each day.

For accessibility, table and seating options that accommodate people of all abilities must be available. Additionally, furniture must not obstruct entrances and exits.

Description Curbside patios are fully detached from buildings and occupy on-street parking spaces. They are set back from the sidewalk, segregated from surrounding parking spaces, and enclosed by railings. These patios may be in front of the business or on the side, and can only be placed in parking spaces without parking restrictions (rush hours) or special zones (bus lanes, passenger drop-o!, taxi only, construction, etc.).

Liquor Businesses may serve liquor in curbside patios if they hold a valid BC liquor licence.

Requirements To ensure safety, railings must be provided and maintained by the business at their cost, while signage, bollards, and wheel stops may be provided and installed by the City as part of the design and operations of a curbside patio.

For accessibility, table and seating options that accommodate people of all abilities must be available, and access ramps must be available wherever there may be changes in grade (e.g. a step down from the curb). Ramps must be provided and maintained by the business.

Furniture may be stored overnight on the patios.

D. Curbside patio must maintain at minimum 1.0m clearance every two parking spaces (approx. 12m). A business with a curbside patio must o!set the beginning and end of the patio 0.5m from the property line in order to provide 1.0m total clear space.

General RequirementsIn addition to the requirements specific to the individual patio options, please read through the general requirements below and ensure your patio application abides by them.

Applications must not have:

Construction (new or of any kind)

Utility connections of any kind (electrical, sprinkler, gas, heaters)

Accessory structures (decking, tents, overhead canopy, platforms, enclosures) or heaters

Increased occupancy of any kind

Applicants must ensure:

Compliance with all applicable orders from the Provincial Health O"cer (including occupancy, seating configurations, gathering restrictions, etc.). Please review the most up-to-date information.

Valid BC liquor licences (for patio options that allow liquor), and that railings are installed and maintained for liquor service areas.

Proposed patios are accessible to people of all abilities (ramps and seating options).

Railings comply with the following:

• Can penetrate the ground to a maximum depth of 10cm except in special pavement areas where anchoring is not permitted (e.g. bricks, cobbles, granite, glass bricks, structures, areaways, etc.). The City will confirm if the application impacts special pavement areas.

• Must have an open appearance with an approximate height of 1.0m.

• Weights may be used to hold temporary railings in place within the patio area. The weights must not protrude into the roadway (curbside patios) or the sidewalk (large patios).

• Bollard and chain fencing is not permitted.

• Planters can substitute railings for delineation.

Patio access cannot be through business kitchen or employee-only areas.

Proof of liability insurance coverage. If the restaurant has a valid liquor license, you must check o! “Host Liquor Liability” on the form.

If you want to use the space in front of an adjacent business, get written permission from your neighbouring property owner or tenant.

Work is underway to expand the temporary patio program to include complex patios on private and partially private/public property. More details will be announced in the coming weeks.
