Dear Tribal Leader:
The Federal Communications Commission extends its greetings to you. Thank you for using our Tower Construction Notification System (TCNS).
This letter is a notice of proposed positive train control (PTC) wayside pole construction notifications submitted by railroads within the last week,
which match the geographic area(s) for which you have chosen to receive such notifications.
In the Program Comment to Govern Review of Positive Train Control Facilities Under Section 106 of the National Historic Preservation Act (PTC
Program Comment), the Advisory Council on Historic Preservation adopted special procedures tailored to PTC wayside poles. The PTC Program
Comment takes into account the time-sensitive public safety objectives of PTC as well as the need to protect historic properties, including Tribal
traditional cultural properties. Therefore, we respectfully request that you respond within no more than 30 days with any recommendations or
comments regarding the effect on historic properties of each of the proposed constructions listed below, including any need for additional
information. Within this time period, the railroads that have submitted the notifications are encouraged to contact you to schedule meetings to
discuss the adequacy of their submissions and potential avoidance, minimization, and mitigation strategies (including the need for monitoring). You
may respond either through the TCNS as described at the end of this Notice, directly to the entity submitting the notification, or by contacting one of
the FCC employees listed below. If you are unable to reach an agreement with the railroad on any disputed matter within 10 business days after the
end of the 30-day period, you or the railroad may refer the matter to the FCC with a copy to the Advisory Council on Historic Preservation.
Please also be aware that, pursuant to the Best Practices guidance document between the FCC and United South and Eastern Tribes (USET) that
was released in October 2004, the USET member Tribes have agreed to a recommended best practice to respond to "initial contact" notifications
within 14 days. Created with the input of Tribal Nations and Tribal organizations from across Indian Country, and recognizing that cultural
preservation processes vary greatly among the many Tribal Nations, the TCNS was designed to facilitate the initial contact process.

Thank you for using the Federal Communications Commission's (FCC) Tower Construction Notification System (TCNS) for your proposed Positive
Train Control (PTC) wayside poles in GARFIELD, Nebraska.
The purpose of this electronic mail message is to inform you that the following authorized persons were sent the information you provided through
TCNS, which relates to your proposed wayside facilities. The information was forwarded by the FCC to authorized TCNS users by electronic mail
and/or regular mail (letter).
Persons who have received the information that you provided include leaders or their designees of federally-recognized American Indian Tribes,
including Alaska Native Villages (collectively "Tribal Nations"), and State Historic Preservation Officers (SHPOs). For your convenience in identifying
the referenced Tribal Nations and in making further contacts, the City and State of the Seat of Government for each Tribal Nation, as well as the
designated contact person, is included in the listing below. We note that Tribal Nations may have Section 106 cultural interests in ancestral
homelands or other locations that are far removed from their current Seat of Government. Pursuant to the Commission's rules as set forth in the
Nationwide Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings Approved by the Federal
Communications Commission (NPA) and the procedures adopted in the Program Comment to Govern Review of Positive Train Control Facilities
Under Section 106 of the National Historic Preservation Act (PTC Program Comment), all Tribal Nations listed below must be afforded a
reasonable opportunity to respond to this notification, consistent with the procedures set forth below, unless the proposed construction falls within an
exclusion designated by the Tribal Nation.
The information you provided was forwarded to the following Tribal Nations. Pursuant to the PTC Program Comment, these Tribal Nations are
afforded 30 days from the date of notification to review your submission and make recommendations and comments, including requests for
additional necessary information. During this period, you are encouraged to schedule meetings or phonecalls with the Tribal Nations referenced
below to discuss the adequacy of your submission and potential avoidance, minimization, and mitigation strategies (including the need for
monitoring). In the event a Tribal Nation does not respond to your notification and outreach efforts within the 30-day period, you may refer the
matter to the FCC through TCNS. You may then proceed without the Tribal Nation's further participation unless the FCC directs otherwise within 10
business days. If you are unable to reach an agreement with a Tribal Nation regarding any disputed matter within the 30-day period, you shall notify
