and Appellate Court Judges shall be 10 years; or Circuit

12.3, six years; of Circuit Judges retained office

the office of Circuit Judga or will occur within six aonths
by a day certain. tbe Administrative Director of the
Illinoîs Courts shalk promptly notify the Chairman of the
appropriate Judicîal Nominating Commission wNo shall
immediately convene the Commission; (e) kithîn 12 days
after the receipt of such notice of a vacancy. the
Commission shall submit to the Governor a list of three

qualified to fill the vacancv. The Commission shall... the
Commission mav not include on a kist a nominee who is on
another list when pending before the Governor or the
Supreme Court pursuant to Subsection F of this Section to
fill the vacancy in the same judicial office. The function
of the lîst shall terminate upon naking the required
appoàntment therefroml (f) Immediatelv upon receipt of the
list, the Governor shall make it public. Not fewer than
284 nor more than 56 days after the receipt of the list,
the Governor shall either appoint therefrom a person to
fill tba vacancy or, ir the Governor disapproves of the
nominees submitted by the Commission, he shall promptlv
notlfy the Commission of his disapproval. Within 11 davs
after receipt of tbe notlfication from the Governor, the
Commission shall submit to the Governor another list or
three nominees in alphabetical order whom tbe Commission
deems qualified to fill the vacancy. If any appointment is
not made by the Governor within 1* davs after submission to
him of the second list, the Commission shall immediately
submit the list to the Supreme Court which shall promptly
make the appointment from the list. 41l appointments of
Circuit Judges under this Subsection shall be subject to
tbe advice and consent of the Senate, a malority of the
Members elected concurring by record vote. If the Senate
does not advise and consent to an appointee, the Governor
or Supreme Court shall select another name from the list

Option Referendumz The electors of any judîcial circuit
may, by referendumv hera designate as a local option
referendum adopt a proposition terminating Sections :2.:
and 12.3 as governing the selection of the judicial Judges
of tbe circuit. The electors of the circuit sball vote on
the proposition at the next general alection held not less
than three months following the filing of the petltions
with the Secretar? of State siqned b? not fewer tban five
percent of the total number of electors who voted at the
next preceding general election in that circuit asking that
the proposition be submitted to referendum. If a majorit?
of the votes cast on the proposition to terminate are in
the affirmative, the selection of Circuit Judges of that
circuit shall tbereafter ba governed bv Section t2.

shall be a Judicial Nominating Commission in each circuit
unless a referendum has been adopted in the circuit to
terminate the operation or Section :2.1 and :2.3 pursuant
to Section 12.2 for the nomination of Circuit Judges for
the circuit; (b) Each Judicial Nominating Commission shall

Members of each Judicial Nominating Commission shalL be
subject to ethics and economic disclosure requirements as
provided b? law. The lawyer Dambers shall be relected to
campaign... shall be sublect to campaign finance disclosure
requirements as provided b? law. Section :2.14 Retention
Elections: Not less than six months after the general
election next preceding the expiration of the term of
officev (1)4 the Supreme, Appellate or Circuit Judge wbo

was appointed to that office pursuant to Section 12.14 he
or she mav file in the Office of the Secretary of State a

election, whether or not a successor shall yet bave been
qualified. If an incumbent Judge, eligible to do so, does
not timely file a dectaration of candidacy ror retention,
the selection of a successor, if any, shall proceed
immediately in the manner provided in Section or 12.t,
whichever appLiesv so that the successor may take office as
soon as the vacancy occurs; (c1 The authorized reduction in
the number of Jppallate or Circuit Judges shall be wkthout
preludice to the right of such Judges in office at tbe time
to seek retention in accordance with the provisions of this
Section. Tbe reduction shall become effectlve when a
vacancy occklrs in the affected unit. Section 12.5,
Judicial Review Commissions for Circuit Judges: ta) A
provision for such Section 12.5 shall qovern the retention
of Circuit Judges in each circuit unless that circuitf bv
law option refendum terminates the operation of Section
12.1 and 12.31 (b) In each Judicial Circuit in which the
retention of Circuit Judges is governed b? this Section
pursuant to Subsection A, the Judicial Review Commission
shall be created and empowered to determine qualificatioqs
for retention or Circuit Judges; tcl <he Members of the
Judicial Review Commission shall be appointed or elected as
provided by Subsection (cl and (dl of Section 12.3 with
respect to Nembers of the Judicial Nominating Commission;

12.3 with respect to vacancies on a Judicial Nominating
Commission; (f) Judicial Review Commissions shall be
governed by the provisions of Subsection (b), (gl, (hI and
(J) of Section 12.3 with respect to Judicial Nominating
Commissions as well as by this Section; (g) A person having
served on the Judicial Review Eommission mav not serve on a
Judicial Review Eommission during the next eight years. A
person who bas served on a Judicial Nominating Commission
may not serve on a Judicial Review Commission for a period
of eight years thereafter. Iqo person may serve on a
Judicial Nominating Commission while serving on a Judicial
Review Commission; (h) In circuits governed by this Section
12.5. for eacb Circuit Judge *ho has timel? filed a
declaration of candidacy for retention in office pursuant
to Section t2.#, tbe SecretarM of State shall, within 1:
da?s of the receipt of such declaration of candidacy,
submit the Judges names to the Administrative Director of
the lllinois Courts not more than six nor less . than five
montbs before the general election next preceding the
expiration of the term of office of such Judge. The
Administrative Director of the Illinois Courts shaTl notif:
the Chairman of the appropriate Judiciat Review Commission
of the Judge's candldacy. The Chairman shall then promptly
convene the Commission; (i1 lf by concurrence of not less
than tbree-fifths of its Members, the Commission finds the
candidacy to be qualified to serve another termv the
candidate shall be retained in office for such full term
commencinq at the rirst Nondav in December following the

Not less than 77 days before the election the Commîssion
shall submit to the Gecretary of State a list stating bv
name (t1 which candidates it has found qualified to serve
another term. (2) which candidates it has failed to find so
qualified. and (3l which candidates have withdrawn their
candidac? b? written notification to the Commission; (J)
Failure of a candidate to be found qualified for retention
by the Judicial Review Commission shall be uithout
preludice to the candidates right to stand for retention by
the electorate at the general election pursuant to Section
t2.&. Section :2.64 Appointment of àppelkate and Supreme
Court Judgesz (a1 Five years after the adoption of this
Amendment. tbe Generat Assembly sball review the
implementation of procedures established for the selection
of Circuit Judges by this Amendment. If the General

applicable to the selection of Appellate Circuit Court
