It is to be used when assessing applications under the Restructure Overlay (Clause 45.05) in the Mount Alexander Planning Scheme. 2.0 Subject Land The Tarilta Restructure Overlay is located approximately 10 kilometres south of Castlemaine between the townships of Guildford and Vaughan. The area is shown on Planning Scheme Map 32RO (the restructure overlay is designated RO9 on this map). The overlay applies to some 124 lots in the Crown ‘Township of Tarilta’ and adjacent Parishes of Tarilta and Fryers. The overlay covers an area of approximately 80 hectares. Most of the land in the area is located along the Tarilta Creek valley and comprises cleared grazing land which is held by two landholders whose holdings also include land outside of the restructure overlay. The lots which make up their holdings vary is size between about 1,000 square metres to 7.2 hectares, and are for the most part indistinguishable as separate lots due to lack of fencing. There are several other landholdings located in bush land which is only accessible via tracks which run through the Heritage Park. The Tarilta Restructure Overlay area is accessed via two roads – Tarilta Road which follows the valley and connects with Guildford, and the Vaughan-Tarilta Road which connects with Vaughan to the east. In addition, there are numerous other road reservations which in some cases contain tracks and in other cases are reserves in name only. The Tarilta Creek flows north through its valley, ultimately to join with the Loddon River to the north. The land along the creek is in the PCRZ. The Castlemaine Diggings National Heritage Park occupies higher ground adjoining to the east of the restructure overlay area. There are numerous tracks through this area, including tracks which provide access to privately owned lots which are included in the restructure overlay area and which would otherwise be landlocked. There are only five dwellings in the entire overlay, with two of these being associated with farms, one on land which formerly comprised five lots which are now consolidated, and two located on bush lots adjacent to the Heritage Park. Although the Land Subject to Inundation Overlay is not applied to any of the affected land, substantial areas along the Tarilta Creek may be affected by flooding, and this has implications in terms of waste water management. In this regard, most of the lots in the area have been assessed as being “high risk” in the Rural Land Capability Study. The entire area is included in the Bushfire Management Overlay (WMO). Fire is an obvious risk given the limited access into the area, and the extent of bushland in the areas adjacent to the Heritage Park and the reliance on tracks running through this park as the only means of access to two of the existing dwellings. With the exception of several larger lots in the area (including a landholding which has already been consolidated), the lots comprised in this restructure overlay area are assessed by Council’s Land Capability Study (Golder Associates, 2011) as

TARILTA RESTRUCTURE PLAN, JULY 2013

1.0 Preamble

Pursuant to Clause 81, this document is incorporated in the Mount AlexanderPlanning Scheme as Tarilta Restructure Plan, July 2013. It is to be used whenassessing applications under the Restructure Overlay (Clause 45.05) in the MountAlexander Planning Scheme.

2.0 Subject Land

The Tarilta Restructure Overlay is located approximately 10 kilometres south ofCastlemaine between the townships of Guildford and Vaughan. The area is shownon Planning Scheme Map 32RO (the restructure overlay is designated RO9 on thismap).

The overlay applies to some 124 lots in the Crown ‘Township of Tarilta’ andadjacent Parishes of Tarilta and Fryers.

The overlay covers an area of approximately 80 hectares.

having a high risk rating in terms of their ability to treat and retain wastewater.This and the fact that the area is within the Cairn Curran Special Water SupplyCatchment are factors which support lot consolidation. Lot consolidation is alsosupported by the fact that most of the land is in farming use and also because thearea is relatively isolated and therefore remote from services.

It is accepted that the consolidation of lots comprising the two larger landholdingswhich are in farming use does not need to result in all lots being consolidated intoone title. In this regard, smaller parcels defined by road reserves (constructed andunconstructed) but which will not have the potential for dwellings are seen as agood means of achieving consolidation objectives whilst also maintaining flexibilityfor landholders to acquire and dispose of parcels when required.

3.0 Objectives

To manage the subdivision, use and development of old Crown allotments in thispart of the Township of Tarilta and Parishes of Tarilta and Fryers:

To give maximum practical effect to the provisions of the TariltaRestructure Plan.

To prevent further fragmentation of landholdings and reduce the number ofsmall and inappropriately located lots in this area by encouraging thesubdivisional restructuring and consolidation of multiple-lot landholdings.

To limit the number of dwellings in an area with minimal social andengineering infrastructure and which is remote from an urban area.

To discourage the inappropriate development of dwellings on small lots.

To prevent inappropriate development in the environs of Tarilta Creek.

To prevent development on land subject to flooding.

To limit the environmental effects of wastewater disposal in an area withpoor land capability.

To prevent the further development of dwellings in areas of high fire risk.

4.0 Policy

It is policy to:

Prohibit any additional dwellings in this Restructure Overlay area. Restructure each lot in accordance with the table forming part of this

Restructure Plan.

Consolidate lots prior to reconstruction of a replacement dwelling, where a

dwelling currently exists. The replacement dwelling is subject to land

capability requirements.

Consider one Dependent Persons Unit (DPU) on a restructure lot following

consolidation of lots, as required by this Restructure Plan, subject to land

capability requirements.

Consider a building other than a dwelling if the lots comprising the

restructure lot are consolidated as one title, and a dwelling exists.

Consider a permit for an outbuilding under 45 square metres prior toconsolidation, where a dwelling on the restructure lot exists.

Consider replacement or extension to existing dwellings only after the lotsin the immediate vicinity of the dwelling (as identified in the restructureplan) have been consolidated into one title.

Encourage consolidation of lots used for farming purposes to form a largerRestructure Lot which is defined by physical features (e.g. Tarilta Creek)and road reserves (whether constructed or unconstructed).

Prohibit the development of buildings and works and the removal of nativevegetation within 60 metres of Tarilta Creek.

Consider a permit for a farm shed on a lot without an existing dwelling

prior to consolidation, provided at least two full sides of the farm shed are

open-sided.
