Get ready to get into the busy season in Daytona. There will be a lot of race traffic in town that arenot to used with our roads so keep a close eye on the tourists. That also means Bike Week is justaround the corner.. I hope everyone stays safe out there and can avoid the flu that is going around,it is no joke this year again... Legislative Report January 17, 2020 John BantaEvery report says to get on State VP Darrin’s email list. Session Starts Jan 14, ends March 14.

There have been requests to contact certain legislators. The Abate State meeting in February, will be on a Sunday, ride to the capitolMonday Feb. 10 for our Tallahassee Freedom Rights Rally. It will be cold. It will be the 20th anniversary of the mandatory helmetlaw repeal and our lobbyist and State President Doc Reichenbach, has asked for a strong showing. Most people will be staying at theDays Inn or Super8 Lamont/Monticello. The parade starts Monday at Monticello at 9AM. Last year, we jumped in when it passedand I was the last bike in the courtyard. Alfy and I were thru security by 10AM. We left the courtyard at 11:30 and I arrived at theIron Horse Saloon at 3:30, 4 hours. My total miles from Ormond by the Sea, Tallahassee, to IHS was 529 miles. Protocol calls forestablishing appointments. I will be lucky to get through on the phone. Discussions will be safety money bill, vulnerable road usersbills, and building awareness on the US Senate and House Profiling resolutions. Legislators will not be there in the morning, but theiraides should be present.

SAFETY MONEYHB 2007 Abate of Florida, Inc. Motorcycle Safety Awareness Program Appropriations Project Rep. McClain. It asks for $300000for fiscal year 2020-2021. Florida collected $2.50 from 622347 (July 2019) registered motorcycles (that is over 1.5 million); 35452registered motorcycles in Volusia County. Registrations have increased from 617205 July 2018.Representatives Elizabeth Fetterhoff and Tom Leek gave their support. in the Transportation & Tourism Appropriations Subcommit-tee as they did last session. Next is the Appropriations Committee, 30 members. At the State Meeting we discussed strategies onhow to prevent this from being cut from the final budget by Senate President Bill Galvano and Speaker of the House Jose Oli-va. That happened last year. The strategy is to contact the legislators, at appropriate time and let them know how important this is, itis our money not free money. The December legislative report gave a history of the $2.50 which originally funded the Florida Motor-cycle Riders Training Program. Motorcyclist realized that we had to come up with a plan to reduce motorcyclist fatalities if we weregoing to have a chance of getting rid of the mandatory helmet law.

HB 2007 Abate of Florida, Inc. Motorcycle Safety Awareness Program by Rep. McClain, will soon be on the agenda for the Appro-priations Committee. Every year motorcyclist pay an extra $2.50 fee, on registrations, that goes toward motorcycle safety awarenesseducation.Motorcyclists were the ones to ask for legislation for additional fees for motorcyclist training rebates and safety education. Thisprogram has evolved over the years. Currently what does not get spent goes into the DHSMV general fund. HB 2007 would allowABATE of Florida, Inc. to have a small percentage of "our" money back so that we can educate the public to be aware of motorcy-clist. In the past when ABATE of Florida, Inc. did receive some of the safety money, motorcyclist deaths did drop in those years. Nobody can better educate the public on motorcycle awareness than a motorcyclist. When HB 2007 does get to the AppropriationsCommittee agenda, I would like to ask for your support and help pass HB 2007. This is not free money for the State of Florida. Onlymotorcyclist pay and it should be used for motorcycle safety. Please use your influence to prevent it being culled by the final budget

committee. I recently voted against the Volusia County ½ cent sales tax. Until motorcyclist money getsspent for motorcyclist safety, I will continue to have trust issues.

VULNERABLE ROAD USERS

SB308 Traffic Offenses Sen. Baxley. This bill has been assigned to: Infrastructure and Securitywhich has members Senators Keith Perry and Travis Hutson; Appropriations Subcommittee onTransportation, Tourism, and Economic Development Appropriations committees. We are sup-porting SB 308 Traffic Offenses by Sen. Baxley. This bill will help protect Vulnerable Road Usersby allowing for more appropriate penalties when the vulnerable road user (VRU) is injured orkilled in an accident that is the direct cause of an illegal act. As example, each year many VRU's arekilled or injured by a motorist who makes an illegal left hand turn in front of them. Many timesthe offending motorist is just issued a failure to yield citation, even if the result is the death of theVRU. This bill will allow for the judge to issue more appropriate penalties to the motorist convict-

ed of accident resulting in serious injury or death. Darrin Brooks sent out an email on members of the first committee. You CANcontact them even if they are not in your district. Add this to your emails: SB 308 is scheduled to go through your Infrastructureand Security committee this session. We would like to ask for your support and help pass SB 308. I did contact Sen. Hutson andgot an automatic response back.

Traffic Offenses HB455 Rep. McClain Provides criminal penalties for person who commits moving violation that causes seriousbodily injury to or death of vulnerable road user; requires person to pay specified fine, serve minimum period of house arrest, &attend driver improvement course; requires court to revoke person's driver license for minimum specified period; defines"vulnerable road user." The first of three committees is the Transportation & Infrastructure Subcommittee. The Chairman is Rep.Brad Drake, who has held up this bill in the past. We will be needed to slam him with phone calls and emails to get this billthrough. Doc did tell a story about the effectiveness of massive phone calls to Tallahassee.

McClain, on the agenda for the Transportation and Infrastructure Sub-committee. He alone can kill HB 455 by simply never placing it on the agenda. HE HAS DONE SO FOR MANY SES-SIONS. So we need to email and call his office and politely request that he place HB 455 on the agenda so it can get a fairhearing. It was suggested to also contact the Speaker of the House Jose Oliva ask that HB 455 get a chance to be heard in theTransportation and Infrastructure Subcommittee.Rep. PURPLE HEART MOTORCYCLE LICENSE PLATESB412 License Plates Sen. Bean. HB1135 License Plates Rep. Grant. Included in these bills is the redirection of funds from themotorcycle specialty plate to go from Prevent Blindness to Preserve Vision Florida and establishes a Purple Heart motorcycleplate.

SB860 Specialty License Plates Sen. Perry also establishes a Purple Heart motorcycle plate. Doc did have some input on this, but declined to give usany neat stories at the state meeting.

PROFILING

Our lobbyist, Doc Reichenbach, can not find a sponsor although I do not have a clue as to what sort of bill we are seeking to get filed. This is wherelocal grassroots involvement is crucial. .

Louisiana became the 3rd State to enact a profiling law. Here is the portion of 2019 HB141 ACT #294: The training shall con-sist of at least one-half hour of classroom or internet instruction, or a combination of classroom and internet instruction. This train-ing shall address issues related to motorcyclist profiling and shall be provided to peace officers

In 2016 Maryland enacted the second state motorcycling profiling law:Chapter 542 (18) to require:(I) a statement condemning motorcycle profiling to be included in existing written policies regarding other profiling; and(II) for entrance–level police training and for in–service level training conducted by the state and each county and municipal policetraining school, that the curriculum and minimum courses of study include, consistent with established law enforcement standardsand federal and state.constitutional provisions, training related to motorcycle profiling in conjunction with existing training regarding other profil-ingSo looking back at existing Florida Statues, it would take a minor tweak to make them compatible to Maryland and Louisiana motorcycling profilinglaws which have LITTLE TEETH. It really seems to establish training so law enforcement has guidelines to follow to perform traffic stops that arenot blatantly profiling. Profiling still exists but perhaps we will have better footing to bring about lawsuits.

HB771 Motor Vehicle Insurance Rep. Grail Repeals provisions of Florida No-Fault Law

SB378 Motor Vehicle Insurance Sen. Lee Repeals provisions of Florida No-Fault Law. We will monitor theses bills to see if they go anywhere. Pre-vious sessions, we have to guess about motorcycles.

CS/CS/SB140 Fireworks Sen. Hutson; CS/CS/HB65 Fireworks Rep. Sabatini Provides exemption for purchase, sale, or use of fireworks used or tobe used solely & exclusively during designated holiday; provides age requirement to purchase; provides affirmative defense for certain retailers. Thepeople, who sweep up my street, on July 5th, will not like this.

SB1148 Electric Bicycles Sen. Brandes HB971 Electric Bicycles Rep. Grant

Revising definitions relating to the Florida Uniform Traffic Control Law; requiring the driver of a vehicle overtaking an electric bicycle to pass theelectric bicycle at a certain distance; expanding exceptions to a prohibition on persons driving certain vehicles on sidewalks and bicycle paths; provid-ing electric bicycle regulations; requiring electric bicycles to comply with specified provisions of law; authorizing operators to ride electric bicycleswhere bicycles are allowed, etc. Motorcyclists on all continents are watching to see if misuse will lead to regulations on motorcycles.

SB1230 Electric Vehicles Sen. Brandes HB1219 Electric Vehicles Rep. Toledo and Rep. Slosberg. Authorizing the Department of Transportation toadopt rules; requiring that certain funds be used for specified purposes relating to the Electric Vehicle Infrastructure Grant Program, beginning inspecified years; requiring the department to establish the Electric Vehicle Infrastructure Grant Program; providing for the distribution of grants tocertain entities to install electric vehicle charging infrastructure; providing grant requirements, etc. These bills are concerned about those PersonalDelivery Devices; electrically powered device that is operated on sidewalks and crosswalks and intended primarily for transporting property. Thesebills also require Autocycles to have antilock brakes that meet the requirements of Federal Motor 46 Vehicle Safety Standard No. 122.

HB249 Use of Wireless Communications Devices While Driving Rep Slosberg Revises short title & legislative intent; prohibits op-eration of motor vehicle while holding or touching wireless communications device; provides exceptions; revises circumstances un-der which certain information may be admissible as evidence in proceeding to determine whether violation has been committed; re-vises procedures for collection & reporting by DHSMV of information recorded on citation; conforms provisions relating to use ofwireless communications devices in school & work zones. Bans all cell phone use unless you have Bluetooth.

HB809 Licenses to Carry Concealed Weapons or Firearms Rep. Fernandez DemocratSB1566 Concealed Weapons or Firearms Licensing Sen. Brayon DemocratReduces term and fee of license to carry concealed weapon or firearm; requires retention of fingerprints in specified state system;requires proof of completion of firearms training or safety course or class meeting specified requirements to renew license. Willrequire safety course EVERYTIME you renew your license. Another “reasonable” law to close a “loophole” that has not been anissue.

SB 1524 Prohibited Places for Weapons and Firearms Sen. George GainerHB183 Prohibited Places for Weapons and Firearms Rep. Mel PonderThese bills would change a law that prohibits people from bringing guns to government meetings. The bill would create an ex-ception to allow members of county commissions, municipal boards, school boards or special district boards to pack heat attheir meetings if they have concealed weapons licenses. A similar exemption exists for judges in their courtrooms. The statebans carrying concealed weapons at places such as police and sheriff's stations, jails, courthouses, polling places, colleges, pro-fessional sporting events and bars. Local elected officials in Florida could bring guns to government meetings, but people ap-pearing before them would remain unable to carry weapons. Congress gets criticized for passing laws that exempt them fromthe regulations common folk have to adhere to. Let’s see who supports this.

From Darrin’s emails:A circuit judge ruled in favor of the insurance company, but a panel of the 5th District Court of Appeal overturned that deci-sion last year. The appeals court said uninsured-motorist coverage follows the policyholder and not the insured vehicle, unlessan agreement is signed to limit the coverage

Voters will decide on at least two ballot initiatives this year, after getting Florida Supreme Court approval. The Florida CitizenVoters proposal would change part of the State Constitution wording to: “Only a citizen of the United States who is at leasteighteen years of age and who is a permanent resident of the state, if registered as provided by law, shall be an elector of thecounty where registered.” The Supreme Court last month approved the proposed minimum-wage amendment, which has beenspearheaded by prominent Orlando attorney John Morgan. The proposal would increase the state’s minimum wage to $10 anhour on Sept. 30, 2021 and increase it by $1 each year until it hits $15 an hour on Sept. 30, 2026. The state’s minimum wagethis year is $8.56 an hour.

National: From the MRF Bikers Bulletins:The 2018 U.S. Senate Resolution 154, Promoting awareness of motorcycle profiling. "Whereas motorcycle profilingmeans the illegal use of the fact that a person rides a motorcycle or wears motorcycle related apparel as a factor in decid-ing to stop and question, take enforcement action, arrest, or search a person or vehicle with or without legal basis underthe Constitution of the United States"

House Resolution 255 has 125 cosponsors. It still has to get thru committees in the US House of Representatives. Florida co-sponsors are Representatives Waltz US House District 6, Webster, Yoho, and Shalala. Waltz is up for re-election. An independent isplanning to run.
