    Regulations on the use and control of the Collective

    Naktuinbouw Quality Brand ‘Elite’ (Article 2.37 of the Benelux Convention on Intellectual Property)

    2.1 Article 1

    Definitions:

    a. Holder of the registered collective trademark is Stichting Nederlandse Algemene

    Kwaliteitsdienst Tuinbouw [Netherlands Inspection Service for Horticulture]

    in Roelofarendsveen, hereinafter to be referred to as the “Holder”;

    b. User of the Collective Mark is each Registered Party which has been explicitly

    authorised by the Holder rand to which the assurance of the Collective Mark

    applies;

    c. Registered Party is the natural person who, or legal person which, is registered with

    Naktuinbouw as referred to in article 42 of the Dutch Seeds and Planting

    Materials Act 2005 [Zaaizaad- en Plantgoedwet 2005] and who/which, by

    virtue of their profession, performs at least one of the following activities

    with regard to propagating material: propagating, producing, processing –

    other than for use in the Registered Party’s own business – and/or

    marketing;

    d. Collective Mark is the word/pictorial mark and/or logo shown below, all the rights, including

    copyrights, in which are vested in the Holder pursuant to the provisions of

    article 2.34 ff. of the Benelux Convention on Intellectual Property. The

    Collective Mark pertains to agricultural, horticultural, and forestry products,

    insofar as they are not included in other categories; seeds for sowing, live

    plants and flowers, plant parts, fresh fruits and vegetables, vegetable seeds;

    propagating material and nursery stock tissue culture material, as well as

    laboratory services, in particular for the above-mentioned goods / products;

    inspection, checking and certification services in the field of the quality

    improvement and control of the above-mentioned goods; services in the field

    of testing standards, certification criteria and assessment guidelines; testing

    quality improvement, control and assurance systems on the basis of the

    applicable requirements; testing services, products and processes on the

    basis of standards, certification criteria and assessment guidelines;

    supervising the quality of services, products and processes of the third

    parties; providing certificates to such third parties; drawing up and issuing

    objective quality statements.

    e. Material is the propagating material produced by the Registered Party, such as

    graftwood, budwood, dormant buds, rootstocks, cuttings, and certified

    planting material from which certified plants have been obtained, the current

    condition of which complies with the requirements based on the Dutch Seeds

    and Plating Materials Act, the Dutch Plant Diseases Act [Plantenziektenwet],

    and any rules and regulations based thereon, and based on the Naktuinbouw

    Certification Regulations [Certificeringsreglementen Naktuinbouw] for the

    crop concerned as indicated below in article 2, to, on, in, or for which

    material, and, if so desired, its packaging, advertising, price lists, brochures,

    invoices and/or on stationery, the Registered Party can apply the Collective

    Mark as a quality assurance, however any pursuant to the explicit conditions

    of article 8 of these Regulations;

    f. Removal of the Collective Mark is the rendering completely illegible and/or removing

    of the Collective Mark from packaging materials for the Material and/or from

    the Material itself, as well as from advertising, price lists, brochures, invoices

    and/or from stationery, insofar as the material, to, on or for which the

    Collective Mark has been applied does not, or no longer, comply with the

    applicable quality requirements.

    2.2 Article 2

    The Holder allows the non-exclusive use of its Collective Mark to all Registered Parties registered

    with Naktuinbouw, which trade in Materials that at least meets the requirements defined in:

    a. The Dutch Seeds and Planting Materials Act 2005 and the Dutch Plant Diseases Act and any rules

    and regulations based thereon;

    b. The Naktuinbouw Inspection Regulations;

    c. The Naktuinbouw Certification Regulations of the crops concerned;

    d. The regulations of the Naktuinbouw Management Team that are based on points a., b. and c.

    above;

    e. The Conditions on the use of the Naktuinbouw Elite logo,

    and;

    f. Any other new and/or modified legislation, rules and/or regulations that have come into effect

    after the date on which these Regulations were drawn up.

    2.3 Article 3

    In order to qualify for the non-exclusive use of the Collective Mark, each Registrated Party shall in

    advance, by a written agreement concluded with Naktuinbouw, undertake to comply unconditionally

    with anything which has been, or will be, stipulated in, or pursuant to, the Articles of Association and

    Regulations of Naktuinbouw, i.e. the Holder.

    2.4 Article 4

    For the non-exclusive use of the Collective Mark being granted, each User shall pay an annual

    contribution in advance each year, which will be determined by the Naktuinbouw Board. This

    amount shall also be determined by how the costs required for maintaining the Naktuinbouw

    organisation, which is responsible for the management and control of the use of the Collective Mark,

    are spread among Users.

    2.5 Article 5

    1. The Holder supervises compliance with these Regulations itself or can, through a license,

    delegate the management of such supervision to persons and/or institutions appointed by the

    Holder. Such supervision shall comprise:

    a. administrative check;

    b. Sampling and research;

    c. Visual checks of Material and Material packaging;

    d. Other inspections and checking methods as deemed necessary by the Holder to maintain the

    quality standards.

    2. Users are not authorised to transfer the right to use the Collective Mark to any third party or to

    grant a licence to any third party for its use.

    2.6 Article 6

    1. User shall allow supervisors, inspectors and auditors appointed by Naktuinbouw, who shall

    identify themselves for such purpose beforehand, to enter – during regular office hours –

    industrial spaces and/or other storage facilities, and/or cultivation areas where the User

    performs, or has third parties perform, activities that are related to the trading of

    propagating materials, the quality standards of which are assured by the Collective Mark.

    2. All Users of the Collective Mark shall immediately notify the Naktuinbouw Board of any

    infringement on the Collective mark that comes to their knowledge.

    2.7 Article 7

    A report shall be drawn up of any check or inspection referred to in article 6 within five days of such

    check or inspection, and a copy of such report will subsequently be sent to the User if the quality

    standards have not been met or not been fully met.

    2.8 Article 8

    Users are entitled to apply the Collective Mark to their materials and/or product packaging materials

    and place it in advertising, price lists, brochures, invoices and/or on stationery and suchlike as quality

    assurance, provided that such right has not been withdrawn from them for another reason. The

    above use of the Collective Mark by Users shall only be allowed in relation to the certified product in

    question. There shall be a clear relationship between the Collective Mark and the relevant product

    that has been produced under the certification at all times, as to avoid third parties being misled.

    This means that using the Collective Mark in general statements that have no direct bearing to the

    certified product in question, for example on cars, stationery, in e-mail signatures, etc., is not

    allowed.

    If the requirements for the use of the Collective Mark pursuant to these Regulations are not met, or

    are no longer met, the User or former User shall remove the Collective Mark in accordance with

    article 1.f.

    2.9 Article 9

    1. Any infringement by a User of their/its obligations arising from these Regulations, including

    the provisions of article 2, and/or of the agreement concluded with the Holder, shall

    constitute a violation. The Holder can impose the following sanctions on the User who or

    which uses the Collective Mark inappropriately for purposes other than those provided for by

    these Regulations and the agreement:

    a. a warning, accompanied by an instruction as to which internal measures will have to be

    taken by the User in order to be able to comply with the requirements of these

    Regulations in the future;

    b. a one-off, immediately payable penalty of a maximum amount of € 225.000,

    c. a temporary prohibition against using the Collective Mark for a period of a maximum of

    two years and/or a prohibition against using the Collective Mark for one or more type(s)

    of materials or products;

    d. complete disqualification from using the Collective Mark;

    e. a prohibition pursuant to c. above, and/or disqualification pursuant to c. above may be

    accompanied by coercive measures being imposed by the Holder, such as a penalty in the

    amount of a fine as referred to in b. above, which the User in question shall forfeit for

    any and each violation of the prohibition imposed;

    f. publication of a sanction or sanctions imposed on the User, stating the reasons of such

    prohibition, in one or more newspapers and/or trade journals.

    2. When imposing a sanction as described in the previous paragraph under b. to f., the Holder

    shall always state the legal remedies that are available.

    3. The User of the Collective Mark shall no longer be bound by these Regulations, if and as soon

    as the Collective Mark is cancelled, declared void or stricken from the register. In derogation

    of the above, the User shall continue to be bound to the measures and sanctions as referred

    to in paragraph 1 of the article with regard to violations that took place during the time when

    the Collective Mark was still registered.

    2.10 Article 10

    If the User uses the Collective Mark without all due care, thereby causing loss of the Holder or other

    Users, the Holder shall be entitled to take legal action, either individually or together with other

    Users, to claim such loss from the User first mentioned. The costs of such claims shall be fully at the

    expense of such User.

    2.11 Article 11

    The Holder has the exclusive right to take legal action to protect the Collective Mark. When

    exercising such right, the Holder may also take into account the general interest of any other Users of

    the Collective Mark, including any loss incurred by them in its claim for damages. However, if desired,

    any User of the Collective Mark can institute a claim together with the Holder, and/or participate in

    such proceedings in any other way.

    2.12 Article 12

    1. Without prejudice of the provisions of the Benelux Convention on Intellectual Property and

    the provisions of article 9.3 of these Regulations, the right to use the Collective Mark shall

    end:

    a. by withdrawal of the right of use pursuant to the stipulations of the opening sentences

    and point d. of article 9;

    b. by termination of the Registered Party’s registration with Naktuinbouw and

    c. if a User, also after a reminder, remains in default to pay Naktuinbouw the contribution

    referred to in article 4 within 30 days.

    2. If a User’s right ends pursuant to the stipulations of paragraph 1, such User shall not be

    entitled to compensation of any loss incurred due to such User no longer being allowed to

    use the materials referred to in article 1.e. to which the Collective Mark is applied.

    2.13 Article 13

    1. Any additions to, and/or modifications of, these Regulations shall come into effect

    immediately following their announcement by registration with the Benelux Office for

    Intellectual Property. The Holder shall ensure that such additions and/or modifications are

    registered with this Office.

    2. Resolutions to modify these Regulations can be adopted at a meeting of the Naktuinbouw

    Board, with due observance of the requirements on adopting legally valid resolutions as

    provided by the foundation’s Articles of Association.

    2.14 Article 14

    The Holder shall provide each User of its Collective Mark as well as any interested third parties a free

    copy of these Regulations.

    Participation agreement for Naktuinbouw Elite collective

    trademark

    The undersigned:

    A. (name company) in (place), registered with Naktuinbouw under number ………….., hereafter

    to be called the ‘Participant’;

    and

    B. Stichting Nederlandse Algemene Kwaliteitsdienst Tuinbouw (Naktuinbouw), PO Box 40,

    Sotaweg 22, 2370 AA Roelofarendsveen, The Netherlands, legally represented for these

    purposes by Mr R.A.Th. Bleijswijk, Head of Inspections Department;

    Hereby agreed as follows:

    1. Naktuinbouw shall, financially compensated by the participant, observe provisions and

    conditions mentioned in the Regulations on the use of the collective trademark Naktuinbouw

    Elite and the Certification Regulations, added as an Appendix to this Agreement. The

    Participant accepts these provisions and conditions unabridged.

    2. The under 1. mentioned financial compensation is charged on the basis of tariffs fixed by the

    Board of Naktuinbouw.

    3. This agreement shall endure for a period of 3 years, starting on (date) and expiring on (date

    3 years later). At the moment of expiry, this agreement is automatically prolonged for a

    period of one year, unless, at least 3 months before the expiry date, one party has informed

    the other party that the agreement is not going to be prolonged and therefore will be ended.

    4. In case of changing the Regulations on the use of the collective trademark (Naktuinbouw

    Elite or Certification Regulations), the participant has the right to reject these changes, by

    letter, within two months after notice, fully and unconditionally. Naktuinbouw and/or the

    participant then have the right to end this agreement.

    5. The General Terms and Conditions of Naktuinbouw are applicable to this agreement, as well

    as the Regulations on the use of collective trademark Naktuinbouw Elite. In the event of a

    dispute regarding the interpretation of this Agreement, the English text will be decisive.

    6. If the participant fails to comply with the conditions of this Agreement, Naktuinbouw may, at

    its discretion, after a warning in the form of a registered letter or bailiff’s writ, declare this

    Agreement dissolved, without any judicial intervention being required, in which case

    Naktuinbouw reserves the right to claim the loss actually incurred.

    Certification regulations Naktuinbouw Elite Ornamental Crops Determined by the Naktuinbouw Board dated 18 December 2020

    4.1 Article 1 – Definitions

    These Regulations follow the definitions from the "Keuringsreglement Naktuinbouw" (Naktuinbouw

    Inspection Regulations), unless expressly stated otherwise. The meaning of the definitions is

    described in chapter 32 Definitions / references.

    4.2 Article 2 - Applicability

    1. These Regulations apply to propagation material, commercially produced and presented to

    Naktuinbouw for certification, of species and varieties of ornamental crops as mentioned in

    Appendix I to this Regulations.

    2. Any propagation material and plant material presented by a supplier for certification which does

    not satisfy the requirements as layed down in the EU directive 98/56, will not be eligible for

    certification.

    3. This Regulation does not apply to propagation material that is not inspected by Naktuinbouw,

    except when it is produced in a propagation- and certification scheme that is declared

    equivalent by Naktuinbouw.

    When the requirements mentioned above are fulfilled, on request of the participant

    propagation material can be brought into the propagation and certification schemes inspected

    by Naktuinbouw and certification inspections can be carried out. The participant has to hand

    over to Naktuinbouw all the relevant documents, including the document or certificate, that at

    as a minimum contains the following information: country of origin, class of certification and

    name of the official organization that has formally carried out the certification.

    4.3 Article 3 - Notification

    1. Crops must be presented to Naktuinbouw for certification, at the commencement of

    cultivation, by means of a form provided by Naktuinbouw, or in any other manner accepted

    by Naktuinbouw.

    4.4 Article 4 - Requirements imposed on the company management and obligations of

    the supplier

    1. The participant must have implemented a quality management system compliant to

    Appendix VI ‘Naktuinbouw Module Quality Management System Requirements / Sampling

    Requirements’ and the participant must:

    a. provide a map of the company to Naktuinbouw. The map must show in which parts

    of the company the Naktuinbouw Elite propagation material is produced;

    b. implement procedures and work instructions for activities that can have impact on

    the quality and health of the propagating material;

    - there must be an overall plan concerning the production and processing of

    the propagation material;

    - the production must be carried out under controlled conditions;

    - ensure complete traceability of propagation material. All the lots of mother

    plants, seed plants and/or propagating material should be clearly

    identified;

    - ensure that the propagation material has been stored, handled,

    transported and delivered under proper conditions (including final

    inspection and delivery documents).

    2. A participant can become eligible for certification inspection when an audit of the quality

    management system, carried out by Naktuinbouw, has shown that requirements mentioned

    under paragraph 1. are fulfilled.

    3. Sampling as described in Appendix IIA must be carried out compliant to Appendix VI

    ‘Naktuinbouw Module Quality Management System Requirements / Sampling Requirements’

    and testing of these samples can be carried out by the participants’ own laboratory or external

    laboratory.

    If testing is carried out by the laboratory of Naktuinbouw or by an ASLN authorized

    laboratory, Naktuinbouw control sampling as stated in Appendix IIB, will be reduced

    according to Appendix IIC.

    4. a. The participant must in conformity with regulations in the country of production, report to the official authorities all relevant quarantine organisms found in the crops or in propagation material.

    b. The participant reports immediately to Naktuinbouw when a quarantine organism

    relevant in Regulation (EU) 2016/2031 and or mentioned under 4a, is found.

    5. The participant has the obligation to report immediately to Naktuinbouw the presence of

    pathogens that prevent the classification of material into any certification class.

    6. The participant has to declare to Naktuinbouw that he/she, by producing or supplying

    propagation material, operates in full compliance with regulations concerning breeders

    rights and (intellectual) ownership/properties. This written and signed declaration shall be

    included in the company’s file kept in Naktuinbouw’s archives.

    4.5 Article 5 - Cultivation Requirements

    1. All necessary care must be demonstrably taken of the crop, in particular in regard to crop

    protection and weed prevention. Sufficient monitoring for possible diseases and crop

    protection has to be carried out. Naktuinbouw can prescribe further specific requirements.

    2. The company must observe rules of good hygiene practice. Particular attention must be paid

    to:

    a. the presence and use of disinfectants and disinfectant footh baths (footh mats and/or other sufficient disinfection methods);

    b. the presence and use of sticky traps; c. regular disinfecting of tools; d. the wearing of clean clothing by all employees involved; e. a smoking ban in all compartments or rooms where mother plants, seed plants or

    propagation material is produced, rooted, or handled; f. a disease-free growing medium; g. disinfection of materials before use; h. regular disinfecting of all compartments or rooms where motherplants, seed plants

    or propagation material is produced, rooted, or handled.

    3. Water must be demonstrably free from relevant pathogens, see chapter 26 Instruction

    sampling plant material and water and chapter 28 Instruction disinfecting water. Surface

    water or recycled water can only be used after effective disinfection has taken place (this at

    the discretion of Naktuinbouw).

    4. Mother plants, seed plants, cuttings, seedlings and grown plants must be cared for and

    grown in such a way and under such hygienic conditions, that infection by pathogens is

    actively prevented.

    4.6 Article 6 - The Certification Inspection

    1. The certification inspection is effected by means of:

    a. auditing of production and handling of certified propagation material;

    b. checking the origin of the material used for propagation;

    c. sampling and testing of mother plants, seed plants and/or propagation material;

    d. random control of mother plants, seed plants and propagation material;

    e. control of propagation material after delivery.

    2. Naktuinbouw will plan and carry out inspections, controls and tests as deemed necessary.

    Naktuinbouw determines the frequency, the effective data and the way inspections, controls

    and tests are executed.

    3. If it is found that batches of mother plants, seed plants and/or propagation material during

    cultivation show symptoms of the diseases mentioned in Appendix III to these Regulations,

    the participant has to take appropriate measures as referred to in the said Appendix.

    4. By conducting certification inspections gaps will be left out of consideration, provided that it

    is satisfactorily proven that such gaps were caused by removal or dying off rather than as a

    result of disease.

    5. If, at any point, it is found that propagation material fails to satisfy the requirements of these

    Regulations or specifications based thereon, no certification can take place. If the participant

    finds that propagation material is not satisfying these Regulations he will report these finding

    to Naktuinbouw immediately. If measures have subsequently been taken to the satisfaction

    of Naktuinbouw, application may be made for a re-assessment, so that the propagation

    material may again be certified if at the time of such a re-assessment it satisfies all the

    requirements.

    4.7 Article 7 - Classification

    1. A crop and/or propagation material originating therefrom will be certified if official

    inspection(s) has (have) shown it to be true-to-type, true to variety and sufficiently healthy,

    as set out for the class and/or varieties concerned in Appendixes I, II and III to these

    Regulations, and if in addition it meets all other quality requirements for certified material as

    mentioned in the Appendixes.

    2. On certification, the propagation material is classified Class SEE, Class EE, or Class E.

    3. The classification as referred to in article 7.2 will on delivery be combined with the designation:

    « Naktuinbouw Elite ».

    4.8 Article 8 - Candidate Plants

    1. Candidate plants are plants selected by the participant for introduction into the propagation

    system used for production of certified material that have to undergo all the prescribed

    tests.

    2. Candidate plants must be grown in an aphid-proof greenhouse or compartment provided

    with a double-door entrance, in which no plants and/or propagation material of any

    certification class are kept, not in contact with the floor, in separate pots or containers,

    under strict hygiene conditions. The candidate plants must be tested in a way approved by

    Naktuinbouw for all pathogens, as set out in Appendix IIA to these Regulations, and must

    further be inspected in particular for varietal purity.

    3. Candidate plants must be free from the diseases mentioned in Appendix III to these

    Regulations.

    4. Candidate plants or their offspring that have been found free from pathogens as mentioned

    in Appendix II will be considered by Naktuinbouw as pathogen free material and may be

    introduced in the SEE1-class of the propagation of the participant. To this end, the participant

    shall submit the findings of tests conducted on candidate plants.

    4.9 Article 9 - Classification under Class SEE

    1. (Pre-basic) mother plants and/or in-vitro propagated plants will be classified by Naktuinbouw

    under Class SEE if:

    a. they have been propagated directly from material as referred to in paragraph 4 of

    Article 8, or from Class SEE propagation material, or from Class EE certified material,

    or obtained from other material which is regarded by Naktuinbouw as being

    equivalent;

    b. they are grown free of contact with the ground in an aphid-proof greenhouse or

    compartment provided with a double-door entrance in which no other plants are

    grown than SEE plants or in a tissue culture laboratory. Pre-basic mother plants must

    be grown in separate pots or containers;

    c. during the growing season, prior to the production of cuttings, all mother plants have

    been tested for pathogens as set out in Appendix IlA and IIB, and have been found to

    be free of infections;

    d. an identity control as described in Appendix I is carried out; and it is proven the

    plants are true to type;

    e. the results of certification inspections carried out by Naktuinbouw show all

    requirements have been fulfilled. Naktuinbouw executes during these inspections

    the tests prescribed in Appendix IIB. If testing of the samples ‘control participants’ is

    carried out by Naktuinbouw laboratory or by an ASLN authorized laboratory,

    Naktuinbouw control sampling as stated in Appendix IIB, will be reduced according

    to Appendix IIC.

    2. Propagation material will be classified under Class SEE:

    a. if it originates directly from Class SEE mother plants, or from tissue culture material

    that has the SEE status;

    b. if rooting or cultivation takes place in tissue culture and /or in an aphid-proof

    compartment free of contact with the floor, under conditions as laid down for the

    growing of SEE mother plants. Cuttings derived directly from SEE mother plants may

    be rooted in the compartment where SEE mother plants are present.

    3. To test trueness to variety and health of SEE-stock that is maintained in tissue culture, on a

    periodic basis a representative sample has to be grown to flowering. The prescribed identity

    control and their frequencies (Appendix I) and health controls (Appendix II) are carried out on

    this material.

    4. Classification under class SEE may only take place if the tolerance in respect of diseases and

    pests, described for this class in Appendix III to this regulation have not been exceeded. On

    the establishing of the presence of a disease or pest the infected plant must be removed

    immediately, including any plants which are in contact with the infected plant.

    5. a. At the entrance of a SEE greenhouse or compartment a trough drenched mat with

    sufficient disinfectants and/or other sufficient disinfection methods have to be in

    place.

    b. Only employees who have to carry out designated tasks, employees on duty from

    official organisations who have to execute inspections or employees of Naktuinbouw

    who carry out audits or controls are permitted into the greenhouse or compartment

    or tissue culture laboratory for execution of their tasks.

    All persons who enter the greenhouse or compartment or tissue culture laboratory

    have to carry out all measures to prevent infection, such as disinfecting of hands and

    shoes, and wearing of prescribed clothing, conscientiously. Hygiene and access

    regulations must be clearly visible at the entry of these facilities.

    4.10 Article 10 - Classification under Class EE

    1. Basic mother plants and/or seed plants or in-vitro propagated plants will be classified by

    Naktuinbouw under Class EE if:

    a. the crop consists of plants grown directly or indirectly (in no more than one

    propagation step) from propagation material classified under Class SEE or from Class

    E certified material. If more than one propagation step is allowed it is mentioned in

    Appendix II;

    b. they are grown free of contact with the floor in an aphid-proof compartment

    provided with a double-door entrance in which no other than Class EE plants are

    grown or in a tissue culture laboratory;

    c. during the growing season, prior to production of cuttings the mother plants have

    been tested for pathogens as indicated in Appendix IIA and IIB; the findings shall be

    submitted to Naktuinbouw;

    d. an identity control as described in Appendix I is carried out and trueness to variety is

    proven;

    e. the results of certification inspections carried out by Naktuinbouw show all

    requirements have been fulfilled. Naktuinbouw executes during these inspections

    the tests prescribed in Appendix IIB. If testing of the samples ‘control participants’ is

    carried out by Naktuinbouw laboratory or by an ASLN authorized laboratory,

    Naktuinbouw control sampling as stated in Appendix IIB, will be reduced according

    to Appendix IIC.

    2. Propagation material (seeds, seedlings, cuttings, plants) will be classified under Class EE:

    a. if it originates directly from class EE mother plants, seed plants or from tissue culture

    material, that has the EE status;

    b. if rooting or cultivation takes place free of contact with the ground, in an aphid-proof

    compartment under conditions as laid down for the growing of EE mother plants.

    Cuttings derived directly from EE mother plants may be rooted in the compartment

    where EE mother plants are present.

    3. Classification under class EE may only take place if the tolerance in respect of diseases and

    pests as specified for this class in Appendix III to these Regulations have not been exceeded.

    On the establishing of the presence of a disease or pest the affected plant must be removed

    immediately, including any plants which are in contact with the affected plant.

    4. a. At the entrance of an EE greenhouse or compartment a trough drenched mat with

    sufficient disinfectants and/or other sufficient disinfection methods have to be in

    place.

    b. Only employees who have to carry out designated tasks, employees on duty from

    official organizations who have to execute inspections or employees of Naktuinbouw

    who carry out audits or controls are permitted into the greenhouse or compartment

    or tissue culture laboratory for execution of their tasks.

    4.11 Article 11 - Classification under Class E

    1. Certified mother plants and/or seeds plants will be classified by the Naktuinbouw under

    Class E if:

    a. the crop consists of plants grown directly from propagation material classified under

    Class EE (or SEE). If more propagation steps are allowed its mentioned in Appendix II;

    b. they are preferably grown free of contact with the ground in a compartment in which

    no plants other than certified mother plants or material that is from a disease free

    heritage are grown or in a tissue culture laboratory. Cuttings directly originating from

    these basic mother plants may be rooted in this compartment;

    c. during the growing season prior to production of cuttings the mother plants have

    been tested for pathogens as indicated in Appendix IIA and IIB; the findings shall be

    submitted to Naktuinbouw;

    d. an identity control as described in Appendix I is carried out and trueness to variety is

    proven;

    e. the results of certification inspections carried out by Naktuinbouw show all

    requirements have been fulfilled. Naktuinbouw executes during these inspections

    the tests prescribed in Appendix IIB. If testing of the samples ‘control participants’ is

    carried out by Naktuinbouw laboratory or by an ASLN authorized laboratory,

    Naktuinbouw control sampling as stated in Appendix IIB, will be reduced according

    to Appendix IIC.

    2. Propagation material (seeds, seedlings, cuttings, plants) will be classified under Class E:

    a. if it originates directly from at least Class EE mother plants; seed plants or from tissue

    culture in vitro material that has the E status;

    b. if rooting or cultivation takes place preferably free of contact with the ground,

    preferably in an aphid-proof compartment under conditions as laid down for the

    growing of E mother plants. Cuttings derived directly from E mother plants may be

    rooted in the compartment where E mother plants are present.

    3. Classification under Class E may only take place if the tolerance in respect of diseases and

    pests as specified for this Class in Appendix III to this regulation has not been exceeded. On

    the establishing of the presence of a disease or pest the affected plant must be removed

    immediately, including any plants which are in contact with the affected plant.

    4. a. At the entrance of an E compartment a through drenched mat with sufficient

    disinfectants and/or other sufficient disinfection methods have to be in place.

    b. All persons who enter the greenhouse, compartment or tissue culture laboratory

    have to carry out all measures to prevent infection. Hygiene and access regulations

    must be clearly visible at the entry of these facilities.

    4.12 Article 12 - Quality

    Marketed propagating material/plants must be sufficiently developed, well rooted and substantially

    free from damage. It has to fulfill common trade requirements.

    4.13 Article 13 - Identification and Documents

    1. Propagation material classified under Class SEE or Class EE, must during release for

    circulation and sale, be accompanied by a certificate conforming to the specimen shown in

    Appendix V to these Regulations, while in addition the specified contents must be clearly

    shown on the packaging.

    2. A certificate will be issued per batch. Two or more batches may be described on one

    certificate, if the same period of validity applies to the batches concerned, and if these

    batches are of the same class of certification.

    3. The certificate will only be valid if initialed by the authorized officer of the company. If

    delivery does not take place within ten days of the date of issue of the certificate, the

    certificate will cease to be valid.

    4. On each packaging unit of SEE and EE material it must be clearly indicated, by means of a

    label, what material is contained in the packaging and of which class it is.

    5. Conditions may additionally be attached to a certificate. These conditions will be stated on

    the certificate.

    6 a. Propagation material classified under Class E must, during release for circulation and

    sale, be accompanied by a delivery sheet (supplier’s document) written out by the

    participant. On this delivery sheet each batch of propagation material that is Class E

    certified must be indicated.

    If the participant wishes to use a Naktuinbouw Elite indication on his/her delivery

    sheets and/or labels he/she needs, prior to any use, a written consent from

    Naktuinbouw.

    b. On his/her request Naktuinbouw can supply the participant with a certificate for his E

    Class propagation material. In that case paragraph 2, 3, and 5 of this article become

    valid.

    4.14 Article 14 - Withdrawal of Certificates

    1. Naktuinbouw decides upon applications for the issue of a certificate.

    Naktuinbouw has the right to withdraw an issued certificate which has been issued earlier, if

    it is established that the material in question or the supplier in question no longer satisfies

    the requirements in force, and furthermore, the issuing of certificates shall be suspended in

    those cases where the director of Naktuinbouw has established that there has been an

    infringement.

    2. The supplier may lodge an objection with Naktuinbouw within five days against the decision

    of Naktuinbouw not to issue a certificate, including the failure on the part of Naktuinbouw to

    make such decision in good time.

    3. In the event of the supplier failing to comply with and being in default of fulfilling his financial

    obligations towards Naktuinbouw, including those arising otherwise than under certification,

    Naktuinbouw may suspend its certification activities until the date of payment in full by the

    supplier.

    4.15 Article 15 - Final Provisions

    1. These Regulations may be referred to as the « Certification Regulations Naktuinbouw Elite

    Ornamental Crops »

    2. In respect of any cases not provided for in these Regulations, the Board of Naktuinbouw shall

    decide.

    Appendix I Specific requirements for identity, trueness to variety

    and trueness to type for propagation material of ornamental

    crops to be accepted for certification

    Propagation material of species and varieties of ornamental crops is eligible for certification if the

    variety:

    - is listed in the Dutch Register of Varieties ("Nederlandse Rassenregister") or the

    European Register of Varieties ("Europees Rassenregister") and/or

    - is included in the registration and documentation system of the Floricode (Roelofarendsveen,

    The Netherlands) and/or

    - is included in the registration and documentation system of the KAVB (Hillegom, The

    Netherlands) and/or

    - is included in the registration and documentation system of Naktuinbouw and /or

    - is described and identified in such a manner that in the opinion of Naktuinbouw they satisfy

    the variety description requirements.

    A variety description has to be presented as part of the first application for certification. The

    participant should periodically submit a list of certifiable varieties to Naktuinbouw.

    5.1 Identity

    5.1.1 General

    For varieties that are sensitive to sporting (mutation), also called unstable varieties, the following

    regulation is prescribed.

    To determine whether propagation material is true to variety and true to type the participant has to

    check before certification each plant or clone (100%) for proper flower bearing properties or other

    identity features, based on the variety description.

    Deviant plants must be removed.

    Naktuinbouw can prescribe that varieties are placed on a list of varieties that are sensitive to

    sporting (mutation). For all varieties placed on this list this specific requirement is obligatory.

    Further requirements for the inspection for identity of propagation material of the listed species and

    varieties in Class SEE, Class EE and Class E.

    5.1.2 Class SEE

    To determine whether propagation material is true to variety and true to type the participant has to

    check before certification each plant or clone (100%) for proper flower bearing properties or other

    identity features, based on the variety description. In case propagation material is only used for

    internal use, certification of SEE material is permitted under strict conditions. Identity control needs

    to be finished before certification of next Class.

    When maintaining SEE-stock in tissue culture, a yearly identity control is prescribed.

    Deviant plants must be removed.

    5.1.4 Class E

    No control prescribed.

    Appendix II Requirements for the testing for pathogens of

    propagation material of ornamental crops

    Appendix II.A Control by participant For the purposes of certification the participant must be able to produce a written record of the

    results of the tests for the pathogens mentioned in this Appendix II. Crops (in the case of candidate

    plants) originating from outside the EU, must be documented as proven free of relevant quarantine

    organisms.

    Crops originating from in vitro propagation (tissue culture) or grown in vivo must be grown in a

    growing medium in vivo-conditions for at least 4 weeks* before sampling and testing takes place. *[Rosa L.; this will take at least one growing season]

    When more than one test is prescribed, the waiting period between tests is at least 4 weeks*. *[ Rosa L.; this will take at least 8 weeks.]

    Tests have to be carried out in a way prescribed by Naktuinbouw or accepted by Naktuinbouw.

    Companies must maintain a clear and understandable procedure and records for their test program.

    If testing of the samples ‘control participant’ is carried out by Naktuinbouw laboratory or by an ASLN

    laboratory, Naktuinbouw control sampling as stated in Appendix IIB, will be reduced according to

    Appendix IIC.

    Naktuinbouw can, in addition to these Regulations, prescribe that testing for specific (other)

    pathogens is carried out.

    7.1 Candidate Plants

    All plants have to be tested at least twice* for viruses (C1 and C2) of all standard pathogens significant

    for the family or genus (standard pathogens). *[Rosa L.; testing will have to be conducted at least once in Spring]

    7.1.1 C1 (indicator plants)

    For at least one of the two virus tests, indicator plants must be used (except when the candidate

    plant originates from pathogen free breeding conditions, accepted by Naktuinbouw.* *[Compartment with plants grown used for breeding purposes. Plants have to be tested for relevant pathogens. This to be determined by

    Naktuinbouw]

    7.1.2 C2 (pathogens)

    Furthermore, all plants must be tested once for all other pathogens that are significant for the family

    or genus (standard pathogens/additional pathogens).

    All candidate plants are to be found free of pathogens and may not induce symptoms on indicator

    plants, before it is possible to move on to the SEE phase. The participant must submit a testing report

    along with the first request for certification for class SEE. Candidate plants also must be free of

    symptoms caused by pathogens which are not mentioned. Participants must be able to produce

    written records of the results of the tests to Naktuinbouw.

    When candidate plants originate from countries outside the EU, tests for other pathogens can be

    prescribed.

    7.2 Pre-basic mother plants SEE (nuclear stock)

    7.2.1 SEE1 (plants and clones produced directly from Candidate plants)

    7.2.1.1 In vivo propagation

    Before production of propagating material takes place, all individual plants have to be tested once

    for pathogens that are significant for the family or genus (standard pathogens).

    Furthermore, all plants must be tested once for all other pathogens that are relevant for the family

    or genus (additional pathogens) during the growing season.

    Any plant showing symptoms that might indicate viral diseases or bacterial diseases must be tested

    immediately. Each plant that is found to be infected must be removed by the participant.

    7.2.1.2 In vitro propagation (tissue culture)

    Before production of propagating material takes place, all clones have to be tested once for

    pathogens that are significant for the family or genus (standard pathogens).

    Furthermore, all clones must be tested once for all other pathogens that are relevant for the family

    or genus (additional pathogens) during the growing season.

    When maintaining and producing a variety in a participant’s tissue culture laboratory, no testing is

    prescribed thereafter (regardless of the duration) except in specific situations (these situations to be

    determined by Naktuinbouw).

    7.2.2 SEE2 (plants or clones produced directly from SEE1 or SEE2)

    7.2.2.1 In vivo propagation

    Before production of propagating material takes place, the percentage of plants mentioned in the

    table have to be tested once for pathogens that are significant for the family or genus (standard

    pathogens).

    Furthermore, the percentage of plants mentioned in the table must be tested once for all other

    pathogens that are relevant for the family or genus (additional pathogens) during the growing

    season.

    Any plant showing symptoms that might indicate viral diseases or bacterial diseases must be tested

    immediately. Each plant that is found to be infected must be removed by the participant.

    7.2.2.2 In vitro propagation (tissue culture) derived from vivo propagation

    Before production of propagating material takes place, all clones have to be tested once for

    pathogens that are significant for the family or genus (standard pathogens).

    Furthermore, the percentage of clones mentioned in the table must be tested once for all other

    pathogens that are relevant for the family or genus (additional pathogens) during the growing

    season.

    7.2.3 SEE (plants or clones derived from certified vivo material)

    7.2.3.1 In vivo propagation

    If certified vivo material is upgraded to class SEE¹ or EE, the percentage of plants mentioned in the

    table for its class have to be tested once for pathogens that are significant for the family or genus

    (standard pathogens). Furthermore, the percentage of plants mentioned in the table must be

    tested once for all other pathogens that are relevant for the upgraded class and family or genus

    Upgrading of vivo material may only be done in case of problems with crops and after approval of

    Naktuinbouw.

    7.2.3.2 In vitro propagation (tissue culture)

    If certified vivo material is upgraded to in vitro, the percentage of plants mentioned in the table for

    class SEE¹ have to be tested once for pathogens that are significant for the family or genus

    (standard pathogens). Furthermore, the percentage of plants mentioned in the table class SEE¹

    must be tested once for all other pathogens that are relevant for the upgraded class and family or

    genus (additional pathogens) during the growing season. The tests must be carried out before the

    production of propagating material takes place.

    Upgrading of vivo material may only be done in case of problems with crops and after approval of

    Naktuinbouw.

    Once a variety, certified as Class SEE, has been included in another participant’s tissue culture

    laboratory for purposes limited to production, no testing is prescribed except in specific situations

    (to be determined by Naktuinbouw).

    No testing is prescribed thereafter (regardless of the duration) except in specific situations (to be

    determined by Naktuinbouw).

    Crops may not be infected by Tobamo-viruses (ToMV-D-O3, TMV-WU1), Ralstonia solanacearum,

    Xanthomonas hortorum pv. pelargonii, Xanthomonas axonopodis pv. dieffenbachiae,

    Agrobacterium tumefaciens or Fusarium foetens. When infection takes place, retesting of all

    possible infected plants is prescribed.

    7.3 Basic mother plants EE (Propagation Stock)

    Before production of propagating material takes place, the percentage of plants or clones (number of

    samples), referred to in this Appendix, per compartment or company location have to be tested at

    least once for the pathogens that are significant for the family or genus (standard pathogens).

    Furthermore, the percentage of plants mentioned in the table must be tested once for all other

    pathogens that are relevant for the family or genus (additional pathogens) during the growing

    season.

    Any plant showing symptoms that might indicate viral diseases or bacterial diseases must be tested

    immediately. Each plant that is found to be infected must be removed by the participant.

    Crops may not be infected by Tobamo-viruses (ToMV-D-O3, TMV-WU1), Ralstonia solanacearum,
